A RESOLUTION OF THE PLANNING COMMISSION
OF THE CITY OF DUBLIN
APPROVING PA 87-039 JAPAN KARATE ORGANIZATION CONDITIONAL USE PERMIT REQUEST
TO OPERATE A KARATE AND MARTIAL ARTS INSTRUCTION SCHOOL
AT 6866 VILLAGE PARKWAY
WHEREAS, Carl Hultin requested approval of a Conditional Use
Permit to allow the operation of a Karate and Martial Arts Instruction School
at 6866 Village Parkway;
WHEREAS, the City Zoning Ordinance requires Planning Commission
approval of a Conditional Use Permit to operate a commercial recreation
facility in the C-2 District; and
WHEREAS, the Planning Commission held a public hearing on said
application on April 6, 1987; and
WHEREAS, proper notice of said public hearing was given in all
respects as required by law; and
WHEREAS, this application has been reviewed in accordance with the
provisions of the California Environmental Quality Act and has been found to be
categorically exempt; and
WHEREAS, the Planning Commission finds that the Conditional Use
Permit will not have a significant environmental impact; and
WHEREAS, the Staff Report was submitted recommending that the
Conditional Use Permit application be approved; and
WHEREAS, the Planning Commission did hear and consider all said
reports, recommendations and testimony herein above set forth; and
WHEREAS, the proposed land use, if conditionally approved, is
appropriate for the subject property in terms of being compatible to existing
land uses in the area and will not overburden public service;
NOW, THEREFORE, BE IT RESOLVED THAT THE Planning Commission finds:
A) The use is required by the public need in that it meets the
recreational needs of a segment of the community.
B) The use will be properly related to other land uses, and
transportation service facilities in the vicinity, in that the use will be
commensurate with present use of property in the neighborhood.
C) The use will not materially adversely affect the health or
safety of persons residing or working in the vicinity, or be materially
detrimental to the public welfare or injurious to property or improvements in
the neighborhood, as all applicable regulations will be met.
D) The use will not be contrary to the specific intent clauses
or performance standards established for the District in which it is to be
located, as the proposed use will be compatible with adjacent retail uses.
BE IT FURTHER RESOLVED that the Planning Commission does hereby
conditionally approve PA 87-039 as shown by material labeled Exhibit A and
stamped approved on file with the Dublin Planning Department subject to the
following conditions:
1) Retail sales shall be limited to uniforms, books, magazines, safety pads,
safety equipment and training supplies. All said training supplies must
meet all applicable State regulations.

2) The Applicant shall not allow any nuisance to be maintained or conducted
on the premises.
3) The Applicant shall comply with all applicable Building Code regulations.
4) The Applicant shall comply with applicable DSRSD Fire Department
requirements including but not limited to:
a. All drapes, hangings, curtains, drops and all other decorative
materials shall be made from non-flammable material or shall be
treated and maintained in a flame-retardant condition.
b. All exit doors shall be equipped with panic hardware.
c. All loose seats, folding chairs or similar seating facilities that
are not bonded together in groups of three shall be bonded in
groups not less than three.
d. Fire extinguishers shall be located at every 75 feet of travel and
shall be of a 2A-10BC type.
e. All exit signs shall be illuminated any time the building is
occupied.
f. An occupancy load sign shall be posted in all rooms used for
assembly purposes.
g. A permit for occupancy shall be obtained from the DSRSD Fire
Department.
h. All exit doors shall open in the direction of travel to the
outside.
5) This permit shall expire April 16, 1992, and shall be revocable for cause
in accordance with Section 8-90.3 of the Dublin Zoning Ordinance.
