HomeMy WebLinkAboutPC Reso 87-023 PA 87-010 Lew Doty Cadillac request for vehicle storage and service in M-1 RESOLUTION NO. 87 - 023 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF DUBLIN APPROVING PA 87-010 LEW DOTY CADILLAC CONDITIONAL USE PERMIT REQUEST FOR WHOLESALE OF VEHICLES, VEHICLE STORAGE AND SERVICE IN THE M-1 ZONING DISTRICT AT 5787 SCARLETT COURT WHEREAS, Steve Doty, representing Lew Doty Cadillac, filed an application for a Conditional Use Permit to allow auto/truck repair and servicing, auto sales and outdoor auto storage at 5787 Scarlett Court; and WHEREAS, the Planning Commission held a public hearing on said application on April 6, 1987; and WHEREAS, proper notice of said public hearing was given in all respects as required by law; and WHEREAS, the request is categorically exempt in accordance with the provisions of the California Environmental Quality Act; and WHEREAS, a Staff Report was submitted recommending the application be conditionally approved; and WHEREAS, the Planning Commission heard and considered all said reports, recommendations and testimony hereinabove set forth. NOW, THEREFORE, BE IT RESOLVED that the Dublin Planning Commission does hereby find: a. The use is required by the public need in that it provides auto sales and repair to the general public. b. The use would be properly related to other land uses and transportation and service facilities in the vicinity, as activities will be commensurate with existing use of properties in the M-1 Zoning District. c. The use, if permitted under all circumstances and conditions of this particular case, will not materially affect adversely the health or safety of persons residing or working in the vicinity or be materially detrimental to the public welfare or injurious to property or improvements in the area, as all applicable regulations will be met. d. The use will not be contrary to the specific intent clause or perform- ance standards established for the district in which it is to be located, as auto/truck repair, servicing, storage of used and new cars, and automobile sales are consistent with the character of the M-1 District. BE IT FURTHER RESOLVED that the Dublin Planning Commission does hereby conditionally approve PA 87-010 as generally depicted by materials labeled Exhibit A on file with the Dublin Planning Department, subject to the following conditions and Conditions of Approval for PA 86-073 Doty Site Development Review: CONDITIONS OF APPROVAL: Unless stated otherwise, all Conditions of Approval shall be complied with prior to the issuance of building permits or establishment of use, and shall be subject to Planning Department review and approval. 1. PA 87-010 Lew Doty Cadillac Conditional Use Permit shall be limited to the following uses: a. Outdoor storage of used and new automobiles. b. Wholesale automobile sales. This Conditional Use Permit specifically does not permit retail sale or display of automobiles. -1- c. Vehicle repair and servicing, including trucks and automobiles. Prior to commencement of auto repair and servicing uses, the specific use shall obtain Planning Department and Building Department approval. d. Automobile rentals may be permitted subject to review and approval of the Planning Director. 2. The Applicant shall maintain, designate, and keep available (for the designated user group) at all times on a continuous basis, six customer parking spaces, two handicapped parking spaces, nine employee parking spaces, and four service parking spaces. 3. The Applicant shall increase the size of the customer parking spaces in conformance with the City's minimum dimensions for standard size parking spaces. 4. The Applicant shall locate the two handicapped parking spaces adjacent to the building as specified in Condition #14, PA 86-073 Doty Auto Repair/ Service Site Development Review. 5. This Conditional Use Permit is subject to compliance with Conditions of Approval for the related Site Development Review permit PA 86-073. 6. All signs are subject to Planning Director review and approval. 7. With the exception of storage of vehicles and minor vehicle preparation work, no exterior demonstrations, displays, services, or other activities shall occur outdoors. The washing of vehicles with any type of detergent or cleaning agent other than water must occur within an enclosed area with adequate drainage subject to approval by the City Building Department and DSRSD. 8. The Applicant shall submit a signing and striping plan for vehicle access, parking and pedestrian walkways on site for review and approval by the City Engineer and Planning Director. 9. The Applicant shall comply with all applicable DSRSD Fire Department requirements, including but not limited to: a. A permit shall be obtained from the DSRSD Fire department for any structure to be used for the purpose of repairing any motor vehicle. b. Fire extinguishers shall be placed every 75 feet of travel distance. Each extinguisher shall be of a 2A-10BC rating. c. In rooms where flammable or combustible liquids are stored or handled, there shall be an automatic fire protection sprinkler system. d. Adequate exit doors are required in the proposed area labeled "Lew Doty Cadillac Used Car Sales and Display Area". e. In any area where combustible or flammable liquids are used, handled, or stored, and in any area where combustible materials are stored or handled, there shall be posted "NO SMOKING" signs. f. Approved numbers and addresses shall be placed on the building in such a position as to be plainly visible and legible from the road fronting the property. g. No parking shall be allowed in front of the site fire hydrant; this area shall be posted and the curb painted red. h. No parking signs shall be posted along the entrance road to the building. This is to maintain adequate access to the building. 10. The Applicant shall comply with all applicable Alameda County Health Care Services Agency regulations related to Hazardous Materials, particularly those recommendations identified in a letter on file with the Dublin Planning Department, dated received March 23, 1987, from the Alameda County Health Care Services Agency. -2- 11. If any work involving the undercoating and sealing of vehicles is proposed, this work shall be done in an area that would contain spilled or released material. 12. The proposed retail automobile sales and display is denied without prejudice through this Conditional Use Permit application. The Applicant may submit a separate Conditional Use Permit application and associated Site Development Review for retail auto sales and display use. Said application shall comply with the City's General Submittal Requirements, and shall specifically include, but not be limited to, a revised site plan addressing customer and service vehicular and pedestrian circulation and compatibility of uses, and revised building elevation plans reflecting a building design and frontage characteristic of an automobile display or showroom. 13. This permit shall expire on April 16, 1990, and shall be revocable for cause in accordance with Section 8-90.3 of the Dublin Zoning Ordinance.
