(APPLICANTS)/DUBLIN ICELAND AND DUBLIN TOWN & COUNTRY SHOPPING CENTER (OWNERS) CONDITIONAL USE PERMIT APPLICATION TO ESTABLISH A RENTAL CAR FACILITY WHEREAS, Robert Fitch,on behalf of Enterprise Rent-A-Car Co., filed an application for a Conditional Use Permit to establish a rental car facility utilizing a tenant rental space in the Dublin Town & Country Shopping Center and a portion of the parking area in the adjoining Dublin Iceland Ice Rink parking lot; and WHEREAS, this application has been reviewed in accordance with the provisions of the California Environmental Quality Act and a Negative Declaration has been adopted (Planning Commission Resolution No. 87 - 045) for this project as it will not have a significant effect on the environment; and WHEREAS, notice of Public Hearing of the project was provided as required by local Ordinance and in accordance with California State Law; and WHEREAS, a Staff Report was submitted recommending conditional approval of the application; and WHEREAS, the Planning Commission held a public hearing on June 15, 1987, to consider all reports, recommendations, and testimony; NOW, THEREFORE, BE IT RESOLVED THAT THE Dublin Planning Commission does hereby find that: a) The use serves a public need in that the use provides a car rental facility. b) The use will be properly related to other land uses and transportation and service facilities in the vicinity in that daytime activities will be commensurate with present use of properties in the neighborhood. c) The use, under all circumstances and conditions of this particular case, will not materially affect adversely the health or safety of persons residing or working in the vicinity, or be materially detrimental to the public welfare or injurious to property or improvements in the neighborhood, in that all applicable regulations will be met. d) The use will not be contrary to the specific intent clauses or performance standards established for the District in which it is to be located in that the rental car business is consistent with the character of the commercial district. BE IT FURTHER RESOLVED that the Planning Commission does hereby conditionally approve PA 87-070 as shown by materials from the June 15, 1987, Planning Commission Staff Report labeled Exhibit C and Attachments #2 and #3, on file with the Dublin Planning Department, subject to the following conditions: CONDITIONS OF APPROVAL: Unless stated otherwise, all Conditions of Approval shall be complied with prior to the initiation of the requested land use activity, and shall be subject to Planning Department review and approval. 1. Development and operation of the rental car facility shall generally conform to the plans submitted with the application prepared by Richard Haro Drafting & Planning Service, consisting of one sheet and dated received by the City of Dublin Planning Department May 8, 1987, and as further described in the Applicant's Written Statement, also dated received May 8, 1987. -1- 2. The rental car lot shall be limited to a maximum of fifteen (15) rental cars on site at any one time. 3. Hours of operation for the car rental lot shall be limited to the hours between 6:30 a.m. and 6:30 p.m., or as otherwise approved by the Planning Director. 4. On site maintenance of rental vehicles shall be prohibited, including cleaning or repair of vehicles. 5. The Applicant shall provide the Planning Director with a copy of the lease establishing the car rental facility's right to store up to 15 cars on the Dublin Iceland parking lot and indicating the length of the agreement. 6. Any new project signing or area lighting shall be subject to review and approval by the Planning Director prior to installation. 7. With the exception of parking of rental cars in the Dublin Iceland Ice Rink parking lot, all demonstrations, displays, services, and other activities associated with the rental car facility shall be conducted entirely within an enclosed structure. No loudspeakers or amplified music shall be permitted outside the structure(s). 8. The Applicant shall be responsible for correction of deficiencies on the existing frontage improvements to the satisfaction of the City Engineer. 9. Overhead security lighting shall be maintained during all hours of darkness to light the area utilized for overnight parking of rental cars. 10. Handicap parking spaces within the Dublin Iceland Ice Rink parking lot (three spaces minimum) shall be provided and shall conform to requirements for Handicapped Accessibility outlined in the State Building Code. 11. This permit shall expire June 25, 1989, and shall be revocable for cause in accordance with Section 8-90.3 of the Dublin Zoning Ordinance. The approval period for the Conditional Use Permit may be extended three additional years (Applicant must submit a written request for the extension prior to the expiration date of the Conditional Use Permit) by the Planning Director upon his determination that the Conditions of Approval remain adequate to assure the above stated Findings of Approval will continue to be met. This permit shall be invalidated if a redevelopment proposal for the ice rink facility is authorized and pursued to the construction stage. 12. The Applicant shall work with the Dublin Iceland Ice Rink Property Owner to provide for the installation of appropriate on-site signage to designate the subject property as a "Private Property - Customer Parking Only" site. Signs shall be subject to review and approval by the Police Services Department prior to installation. 13. The Applicant shall install wheel stops and landscape border boards (2" x 8" planking) at the end of the 15 parking spaces on the Dublin Iceland site proposed for use by the car rental facility. 14. The Applicant shall supplement the existing landcaping within the north- easternmost on-site landscape "finger" with a minimum of 10 five-gallon sized fast-growing shrubs. 15. A ramped pedestrian/customer connection (meeting Building Code criteria) shall be supplied between the two sites. The design and location of this ramp shall be subject to review and approval by the Planning Department prior to installation. The ramp width and remaining walkway connection between the parking area on the Dublin Iceland site and the tenant lease space at Dublin Town & Country shall be a minimum width of 4'. Pedestrian lighting acceptable to the Planning Department shall be supplied for this pedestrian/customer interconnection. The existing wooden stairway shall either be removed or upgraded with handrails and pedestrian lighting. 16. Development shall comply with the requirements of the DSRSD - Fire Department. -2- 17. Except as specifically altered by the above Conditions of Approval, development and use of the Dublin Iceland Ice Rink shall comply with the Conditions of Approval established for C-2267 and V-5325, and development and use of the Dublin Town & Country Shopping Center shall comply with the Conditions of Approval established for PA 83-042. PASSED, APPROVED AND ADOPTED this 15th day of June, 1987.
