A RESOLUTION OF THE PLANNING COMMISSION
OF THE CITY OF DUBLIN
APPROVING PA 87-088 ST. RAYMOND'S SCHOOL CONDITIONAL USE PERMIT
APPLICATION TO CONTINUE USE OF THE EXISTING PORTABLE BUILDINGS AND PARISH HALL
FOR AN ELEMENTARY SCHOOL (GRADES K THROUGH EIGHTH) AT 11555 SHANNON AVENUE
WHEREAS, the Applicant, Richard P. Matgen, Administrator,
representing the Roman Catholic Bishop of Oakland, filed an application for a
Conditional Use Permit to continue operation of an elementary school (grades
kindergarten through eighth) for a maximum of 250 students in existing portable
buildings and the parish hall at 11555 Shannon Avenue; and
WHEREAS, this application has been reviewed in accordance with the
provisions of the California Environmental Quality Act, and has been found to
be categorically exempt; and
WHEREAS, notice of Public Hearing was published in The Herald,
posted in public buildings, and mailed to property owners within 300 feet of
the project in accordance with California State Law; and
WHEREAS, a Staff analysis was submitted recommending conditional
approval of the application; and
WHEREAS, the Planning Commission held a public hearing on July 6,
1987, to consider all reports, recommendations, and testimony;
NOW, THEREFORE, BE IT RESOLVED THAT THE Dublin Planning Commission
does hereby find that:
a) The use is required by the public need in that there are no
other Catholic schools in Dublin, and it meets the public need for an
alternative to public education;
b) The use will be properly related to other land uses and
transportation and service facilities in the vicinity in that the site is
located on a major residential street, across from a public park and community
center, and the daytime activities of the project will be commensurate with the
present use of surrounding properties within the neighborhood;
c) The use, under all the circumstances and conditions of this
particular case, will not materially affect adversely the health or safety of
persons residing or working in the vicinity or be materially detrimental to the
public welfare or injurious to property or improvements in the neighborhood as
all applicable regulations will be met;
d) The use will not be contrary to the specific intent clauses or
performance standards established for the district in which it is to be
located, in that the elementary school is consistent with the character of the
residential district.
BE IT FURTHER RESOLVED that the Planning Commission does hereby
conditionally approve PA 87-088 as shown by materials labeled "Exhibit A" on
file with the Dublin Planning Department and subject to the following
conditions:
1) This approval is for use of the existing parish hall and existing on-site
portable buildings for St. Raymond Catholic School. Said use shall be
limited to a maximum total of 250 students and shall be limited to grades
Kindergarten through eighth grade.
2) Hours of operation for the school shall be limited to 8:00 a.m. to 3:00
p.m. Monday through Friday, with the exception of an occasional evening
meeting or other school related activity.

3) The Applicant shall supplement existing landscaping, adjacent to the north
frontage of portable buildings, with small trees or large shrubs (minimum
15-gallon size). The Applicant shall submit a written description of
proposed landscaping identifying plant type, size and spacing subject to
review and approval of the Dublin Planning Department. Said landscaping
shall be installed within 60 days of the effective date of this permit.
4) Outside play activities shall not occur prior to 8:00 a.m.
5) School noise shall be controlled so as not to create a nuisance to the
adjoining residential neighborhood.
6) The drop-off and pick-up of students shall occur on-site within the
existing parking lot area.
7) The school operator shall make arrangements to have the Dublin Police
Services Child Abuse Program, or an equivalent program, presented to the
school staff and all children attending the school facility, at minimum on
an annual basis. Prior to July 1st of each year, the Applicant shall
submit written confirmation to the Planning Department, indicating this
Condition has been complied with.
8) The Applicant shall comply with all applicable DSRSD Fire Department
requirements, including but not limited to:
A. Each classroom shall have posted a plan showing paths of travel to
evacuate the room in case of emergency.
B. An emergency pre-fire plan shall be prepared for review and approval by
the DSRSD Fire Department.
C. Fire drills shall be conducted not less than once a month and a report
submitted to DSRSD Fire Department.
D. All drapes, curtains, hangings, and other such decorative materials
shall be non-flammable material, or shall be treated to maintain a
flame-retardant condition.
E. Fire extinguishers of a 2A-10BC classification shall be located within
75' of travel. When a fire extinguisher is located behind locked
doors, such as in locked classrooms, the extinguisher shall be located
within each area to insure accessibility to the extinguisher.
F. Every school building, regardless of occupancy classification, shall be
provided with a dependable method of sounding an alarm.
9) This permit shall expire on July 1, 1990, and shall be revocable for cause
in accordance with Section 8-90.3 of the Dublin Zoning Ordinance.
10) The approval period for the Conditional Use Permit may be extended two
additional years (Applicant must submit a written request for the extension
prior to the expiration date of the Conditional Use Permit) by the Planning
Director upon his determination that the Conditions of Approval remain
adequate to assure that the above stated Findings will continue to be met.
