A RESOLUTION OF THE PLANNING COMMISSION
OF THE CITY OF DUBLIN
APPROVING PA 87-104 CROWN-ISUZU CONDITIONAL USE PERMIT TO CONTINUE OPERATION
OF AN AUTO SALES/DISPLAY LOT AND CAR RENTAL FACILITY AT 5933 DOUGHERTY ROAD
WHEREAS, the Applicant, Patrick Costello representing Crown-Isuzu,
filed an application for a Conditional Use Permit to continue operation of an
auto sales/display lot and auto rental facility at 5933 Dougherty Road; and
WHEREAS, the City of Dublin Zoning Ordinance provides in part for
the establishment of an automobile, camper, boat and trailer sales, storage and
rental lot as a Conditional Use; and
WHEREAS, the Planning Commission held a public hearing on said
application on October 5, 1987; and
WHEREAS, proper notice of said public hearing was given in all
respects as required by law; and
WHEREAS, this application has been reviewed in accordance with the
provisions of the California Environmental Quality Act and has been found to be
categorically exempt; and
WHEREAS, the City is currently studying various alternatives for
the alignment of the Dublin Boulevard extension. Although the specific
alternative has not been selected, the future Dublin Boulevard extension is
likely to affect a portion of the property at 5933 Dougherty Road
(APN 941-550-9-15); and
WHEREAS, a Staff Report was submitted recommending that the
Conditional Use Permit application be conditionally approved; and
WHEREAS, the Planning Commission did hear and consider all said
reports, recommendations and testimony hereinabove set forth;
NOW, THEREFORE, BE IT RESOLVED THAT THE Dublin Planning Commission
does hereby find that:
a) The use is required by the public need in that the use offers
the Dublin consumer specific auto sales and auto rental otherwise not available
within the City;
b) The use will be properly related to other land uses and
transportation and service facilities in the vicinity in that the project is
located at the intersection of two major streets and will be commensurate with
the present use of surrounding properties within the neighborhood;
c) The use, under all circumstances and conditions of this
particular case, will not materially affect adversely the health or safety of
persons residing or working in the vicinity or be materially detrimental to the
public welfare or injurious to property or improvements in the neighborhood as
all applicable regulations will be met;
d) The use will not be contrary to the specific intent clauses or
performance standards established for the district in which it is to be
located, in that the auto dealership and auto rental facility is consistent
with the character of the surrounding Commercial and Industrial District.

BE IT FURTHER RESOLVED THAT THE Planning Commission does hereby
conditionally approve PA 87-104 as generally depicted by materials labeled
"Exhibit A" on file with the Dublin Planning Department subject to the
following conditions:
CONDITIONS OF APPROVAL:
Unless stated otherwise, all Conditions of Approval shall be complied with
within 30 days from approval and shall be subject to Planning Department Review
and approval.
1) PA 87-104 Crown-Isuzu Conditional Use Permit shall supercede all previous
Conditional Use Permit approvals for the site at 5933 Dougherty Road.
2) The following uses shall be permitted:
a) Automobile sales and display facility and lot;
b) Automobile rental lot facility.
3) The servicing of vehicles on site is not permitted.
4) The Applicant shall maintain, designate and keep available (for the
designated user group) at all times on a continuous basis a miniumum of 10
customer parking spaces and 15 rental car storage parking spaces.
5) Designated parking spaces shall be double-striped in compliance with City
of Dublin standards.
6) The Applicant shall maintain at all times a minimum 25 ft. wide clear and
unobstructed drive aisle on-site connecting the Dougherty Road entrance/exit
with the Scarlett Court entrance/exit.
7) The Applicant shall comply with all DSRSD Fire Department requirements,
including:
a) Provide and maintain at all times within the facility in operable
condition a 2A-10BC fire extinguisher.
b) Displays shall not hinder access into or around the building or lot.
8) The Applicant shall trim to the back of the sidewalk the ice plant
growing over the sidewalk along Dougherty Road and Scarlett Court in front of
the site.
9) The Applicant shall trim landscaping away from the catch basin located on
the property line along Dougherty Road.
10) This permit shall expire on October 16, 1992, and shall be revocable for
cause in accordance with Section 8-90.3 of the Dublin Zoning Ordinance.
PASSED, APPROVED AND ADOPTED this 5th day of October, 1987.
