HomeMy WebLinkAboutPC Reso 90-003 PA 90-003 DSRSD office trailer RESOLUTION NO. 90 - 003 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF DUBLIN APPROVING PA 90-003 DUBLIN SAN RAMON SERVICES DISTRICT OFFICE TRAILER CONDITIONAL USE PERMIT AND SITE DEVELOPMENT REVIEW TO LOCATE A TEMPORARY OFFICE TRAILER AT 7051 DUBLIN BOULEVARD WHEREAS, Emil Kattan, representing the Applicant/Property Owner Dublin San Ramon Services District filed a Conditional Use Permit and Site Development Review application requesting approval to locate a 924 square foot office trailer in the rear portion of the site at 7051 Dublin Boulevard for a two year period; and WHEREAS, the application was reviewed in accordance with the provisions of the California Environmental Quality Act (CEQA) and found to be Categorically Exempt under Section 15301 Class 1(e); and WHEREAS, a Staff analysis was submitted recommending conditional approval of the application; and WHEREAS, proper notice of said public hearing was given in all respects as required by law; and WHEREAS, the Planning Commission did hold a public hearing on said application on February 5, 1990; and WHEREAS, the Planning Commission did hear and consider all said reports, recommendations and testimony hereinabove set forth. NOW, THEREFORE, BE IT RESOLVED THAT THE Dublin Planning Commission does hereby find: 1. The use is required by the public need in that it provides additional office space for Dublin San Ramon Service District to service the public. 2. The use will be properly related to other land uses and transportation and service facilities in the vicinity in that the site is located within the C-2-B-40 District fronting on a major roadway (Dublin Boulevard) with office and commercial uses within the immediate vicinity, and the activities of the project will be commensurate with the present use of surrounding properties within the neighborhood. 3. The use, under all the circumstances and conditions of this particular case, will not materially affect adversely the health or safety of persons residing or working in the vicinity or be materially detrimental to the public welfare or injurious to property or improvements in the neighborhood as all applicable regulations will be met. -1- 4. The use will not be contrary to the specific intent clauses or performance standards established for the district in which it is to be located, in that the use is consistent with the character of the General Commercial District and with the Dublin General Plan. 5. All provisions of Section 8-95.0 through 8-95.8, Site Development Review, of the Zoning Ordinance are complied with. 6. Consistent with Section 8-95.0, this application, as modified by the Conditions of Approval, will promote orderly, attractive and harmonious development, recognize environmental limitations on development; and promote the general welfare by preventing establishment of uses or erection of structures having qualities which would not meet the specific intent clauses or performance standards set forth in the Zoning Ordinance and which are not consistent with their environmental setting. 7. The approval of the application as conditioned is in the best interests of the public health, safety and general welfare. 8. General site considerations, including site layout, vehicular access, circulation and parking, setbacks, height, walls, public safety and similar elements have been designed to provide a desirable environment for the development. 9. General architectural considerations, including the character, scale and quality of the design, the architectural relationship with the site and other buildings, building materials and colors, screening of exterior appurtenances, exterior lighting, and similar elements have been incorporated into the project in order to insure compatibility of this development with its design concept and the character of adjacent buildings and uses. 10. General landscape considerations, including the locations, type, size, color, texture and coverage of plant materials, provisions for irrigation, maintenance and protection of landscaped areas and similar elements have been considered to insure visual relief to complement buildings and structures and to provide an attractive environment for the public. BE IT FURTHER RESOLVED THAT THE Dublin Planning Commission does hereby conditionally approve PA 90-003 Dublin San Ramon Services District Conditional Use Permit and Site Development Review as shown by materials labeled "Exhibit A" on file with the Dublin Planning Department subject to the following conditions: CONDITIONS OF APPROVAL Unless stated otherwise, all Conditions of Approval shall be complied with prior to the issuance of building and grading permits or establishment of use, and shall be subject to Planning Department review and approval. -2- Conditional Use Permit 1. This approval is for a temporary office trailer at 7051 Dublin Boulevard. 2. The location of the trailer on the site shall generally conform with plans submitted to the Dublin Planning Department dated received January 17, 1990, labeled Exhibit A on file in the Dublin Planning Department. 3. All demonstrations, displays, services, and other activities shall be conducted entirely within the structures on the site. No loudspeakers or amplified music shall be permitted outside the enclosed structure. 4. This approval shall become null and void, in the event the approved use ceases to operate for a continuous one-year period. 5. This permit shall be revocable for cause in accordance with Section 8- 90.3 of the Dublin Zoning Ordinance. Any violation of the terms of conditions of this permit shall be subject to citation. Site Development Review 6. If during construction archaeological remains are encountered, construction in the vicinity shall be halted, an archaeologist consulted, and the City Planning Department notified. If in the opinion of the archaeologist the remains are significant, measures as may be required by the Planning Director shall be taken to protect them. 7. The Applicant shall submit color and material samples for exterior colors and materials for the building subject to final review and approval by the Planning Director. All ducts, meters, air conditioning equipment and other mechanical equipment on the structure shall be effectively screened from view with materials architecturally compatible with the materials of the proposed structure. 8. The trailer supports shall be effectively screened with materials architecturally compatible with the materials of the trailer and surrounding building. 9. All roof-mounted mechanical equipment shall be screened from view subject to Planning Department review and approval. 10. Measures shall be taken to contain all trash, construction debris, and materials on-site until disposal off-site can be arranged. The Developer shall keep adjoining public streets free and clean of project dirt, mud, and materials during the construction period. 11. Roof drains shall empty into approved dissipating devices. 12. The Applicant shall comply with all applicable Police Services Standard Commercial Building Security recommendations (Attachment 1). 13. The Applicant shall comply with all applicable Site Development Review Standard Conditions (Attachment 2). -3- 14. The Applicant shall comply with all applicable Building Code Regulations. 15. The Applicant shall comply with all Dougherty Regional Fire Authority requirements. 16. The Applicant shall secure building permits within six months of the effective date of this permit or said Conditional Use Permit and Site Development Review shall be void.
