HomeMy WebLinkAboutPC Reso 90-020 PA 89-063 Approving Revision to condition #43 chervron station/ convenience mart RESOLUTION NO. 90 - 020 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF DUBLIN APPROVING REVISION TO CONDITION #43 OF RESOLUTION NO. 89-046 FOR PA 89-063 CHEVRON SERVICE STATION/CONVENIENCE MART CONDITIONAL USE PERMIT/ SITE DEVELOPMENT REVIEW LOCATED AT 7007 SAN RAMON ROAD WHEREAS, Chevron USA (Applicant) requests approval of a revision to Condition #43 of Resolution 89-046 for PA 89-063 to allow contribution of in- lieu fees rather than completed street frontage improvements along Dublin Boulevard; and WHEREAS, the Planning Commission did hold a public hearing on said application on May 7, 1990; and WHEREAS, proper notice of said public hearing was given in all respects as required by law; and WHEREAS, a Negative Declaration was approved for the project on August 7, 1989, and this application is Categorically Exempt (Class 5) from the requirements of the California Environmental Quality Act (CEQA); and WHEREAS, the Staff Report was submitted recommending that the application be approved; and WHEREAS, the Planning Commission did hear and consider all said reports, recommendations and testimony hereinabove set forth; and WHEREAS, the requested revision to Condition #43 of Resolution No. 89-046, if approved, is appropriate for the subject property. NOW, THEREFORE, BE IT RESOLVED THAT THE Dublin Planning Commission does hereby find: a) The approval of the requested revision to Condition #43 is consistent with the Dublin General Plan and Downtown Specific Plan. b) All provisions of Section 8-95.0 through 8-96.8, Site Development Review of the Zoning Ordinance, are complied with. c) The approval of the requested revision to Condition #43 is in the best interest of the public health, safety and general welfare. /1 /1 BE IT FURTHER RESOLVED THAT THE Dublin Planning Commission does hereby revise Condition #43 of Resolution No. 89-046 to read as follows: Dedication of land shall be made to the City of Dublin such that it conveys land sufficient for the approved street right-of-way. The applicant shall contribute $36,600 to the planned project to improve Dublin Boulevard between Donlon Way and Village Parkway. The project frontage improvements shall be limited to the relocation of driveways as necessary to meet the new site plan and curb underdrains to convey on- site storm water to the street gutter. PASSED, APPROVED AND ADOPTED this 7th day of May, 1990.
