A RESOLUTION OF THE PLANNING COMMISSION
OF THE CITY OF DUBLIN
APPROVING PA 90-065 CONDITIONAL USE PERMIT REQUEST FOR A
FREESTANDING SIGN AT VALLEY NISSAN/DODGE DEALERSHIP
AT 6015 SCARLETT COURT
WHEREAS, Barber Sign Co., Inc., representing Valley
Nissan/Dodge filed an application for a Conditional Use Permit to
increase the height of an existing 26 foot freestanding sign up
to 35 feet and Site Development Review to allow a new wall sign
to exceed the maximum permitted letter height on the site at 6015
Scarlett Court; and
WHEREAS, the Planning Commission did hold a public hearing
on said application on September 17, 1990; and
WHEREAS, proper notice of said public hearing was given in
all respects as required by law; and
WHEREAS, the application has been reviewed in accordance
with the provisions of the California Environmental Quality Act
(CEQA) and has been found to be categorically exempt under
Section 15311, Class 11(a) ; and
WHEREAS, the Staff Report was submitted recommending the
application be conditionally approved; and
WHEREAS, the Planning Commission did hear and consider all
said reports, recommendations and testimony hereinabove set
forth.
NOW, THEREFORE, BE IT RESOLVED THAT THE Dublin Planning
Commission does hereby find that:
1. The use is required by the public need in that it provides
business indentification to the general public for an
existing auto dealership facility in the City of Dublin.
2. The use will be properly related to other land uses and
transportation and service facilities in the vicinity, as it
will be commensurate with the present use of properties in
the industrial zoning district.
3. The use, if permitted under all of the circumstances and
conditions of this particular case, will not materially
affect adversely the health or safety of persons residing or
working in the vicinity or be materially detrimental to the
public welfare or injurious to property or improvements in
the area as all applicable regulations will be met.
4. The use will not be contrary to the specific intent clauses
or performance standards established for the district in
which it is to be located. The use is consistent with the
intent of the zoning district and with the General Plan.
BE IT FURTHER RESOLVED THAT THE Dublin Planning Commission
does hereby conditionally approve PA 90-065 Valley Nissan/Dodge
freestanding sign as shown on the plans labeled Exhibit A,
stamped approved and on file in the Dublin Planning Department,
consisting of one sheet prepared by Barber Sign Co., Inc.,
submitted to the Planning Department on August 2, 1990, and
subject to the following conditions of approval.
CONDITIONS OF APPROVAL:
Unless stated otherwise, all Conditions of Approval shall be
complied with prior to the issuance of building permits or
establishment of use, and shall be subject to Planning Department
review and approval.
1. PA 90-065 Conditional Use Permit is approved for one double
faced freestanding sign which shall generally conform to the
following dimensions:
a. Maximum Sign Area: 240 square feet (120 square feet
per face)
b. Maximum Sign Height: 35 feet
c. Front Setback: 60 feet
Note: Approval of this Conditional Use Permit shall
supersede previous approval for Dodge freestanding sign PA
89-143, Planning Commission Resolution No. 90-010.
2. A Landscape and Irrigation Plan for the landscape planter
area around the base of said freestanding sign shall be
submitted for review and approval by the Planning Director.
Said planter area shall be maintained in a viable and well
kept manner at all times.
3. All building permits for the proposed freestanding sign
shall be secured and construction commenced within six (6)
months of the date of approval of this use permit. The
Applicant and/or property owner shall comply with all
applicable building code requirements.
4. Any modifications to said freestanding sign shall be subject
to review and approval of the Dublin Planning Department.

5. This approval shall become null and void, in the event the
approved use ceases to operate for a continuous one-year
period.
6. This use shall be subject to Zoning Investigator review and
determination as to compliance with the conditions of
approval.
7. This permit shall be revocable for cause in accordance with
Section 8-90.3 of the Dublin Zoning Ordinance. Any
violation of the terms or conditions of this permit shall be
subject to citation.
PASSED, APPROVED AND ADOPTED this 17th day of September, 1990.
