HomeMy WebLinkAboutPC Reso 90-058 PA 90-075 Torrey Pines Directional Tract Sign RESOLUTION NO. 90 - 058 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF DUBLIN APPROVING PA 90-075 TORREY PINES CONDITIONAL USE PERMIT FOR USE OF A DIRECTIONAL TRACT SIGN LOCATED ON THE EAST SIDE OF SAN RAMON ROAD, NORTH OF DUBLIN BOULEVARD (APN 941-305-34) WHEREAS, RGM Advertising, filed an application for a Conditional Use Permit to allow a Directional Tract Sign on an undeveloped parcel on the east side of San Ramon Road, north of Dublin Boulevard adjacent to the Chevron Service Station; and WHEREAS, the Planning Commission did hold a public hearing on said application on October 1, 1990; and WHEREAS, proper notice of said public hearing was given in all respects as required by law; and WHEREAS, the application has been reviewed in accordance with the provisions of the California Environmental Quality Act (CEQA) and was found to be Categorically Exempt under Section 15301, Class 1(g) of CEQA; and WHEREAS, the Staff Report was submitted recommending that the application be conditionally approved; and WHEREAS, the Planning Commission did hear and consider all said reports, recommendations and testimony hereinabove set forth. NOW, THEREFORE, BE IT RESOLVED THAT THE Dublin Planning Commission does hereby find: A. The use is required by the public need in that it provides directional information to the general public for a housing development under construction (Torrey Pines) by the Standard Pacific Company. B. The use would be properly related to other land uses and transportation and service facilities in the vicinity, in that it will be compatible with surrounding uses. C. The use, if permitted under all circumstances and conditions of this particular case, will not materially affect adversely the health or safety of persons residing or working in the vicinity or be materially detrimental to the public welfare or injurious to property or improvements in the area, as all applicable regulations will be met. D. The use will not be contrary to the specific intent clause or performance standards established for the district in which it is to be located, in that conditions have been applied to insure conformance with the Zoning Ordinance. - 1 - BE IT FURTHER RESOLVED THAT THE Dublin Planning Commission does hereby conditionally approve Conditional Use Permit PA 90-075 as shown by materials labeled "Exhibit A" stamped approved and on file with the Dublin Planning Department, subject to the following conditions. CONDITIONS OF APPROVAL Unless otherwise specified, the following conditions shall be complied with prior to establishment of use. Each item is subject to review and approval of the Planning Director unless otherwise specified. 1) PA 90-075 is approved for the placement of a 4 foot x 8 foot directional tract sign on the vacant lot on the east side of San Ramon Road, north of Dublin Boulevard and the Chevron Service Station (APN 941-305-34). The use shall generally conform to the plan submitted with PA 90-075, dated received September 13, 1990, Exhibit A, and on file with the Dublin Planning Department and subject to conditions of approval. 2) The sign shall have a maximum single-faced area of 32 square feet and a maximum height of 8 feet. 3) The tract sign shall not obstruct the visibility of motorists, pedestrians or cyclists. Any relocation of the sign shall be subject to review and approval by the Planning Director prior to being moved. 4) The Applicant and Property Owner shall keep the site clear of overgrown weeds, vegetation and trash around the sign and maintain the site in a well kept manner at all times. 5) The Applicant and Property Owner shall post "No Parking" signs to prevent vehicles from parking on the property. Said sign dimensions and copy shall conform to Section 6.04.200 of the Dublin Municipal Code. 6) This approval shall remain in effect until October 1, 1992, or until the last lot/unit is sold, whichever occurs first. 7) This Conditional Use Permit approval shall be null and void in the event the approved sign copy is removed for a consecutive one month period. 8) The Applicant shall remove said sign and the entire sign support structure upon expiration of this Conditional Use Permit approval. 9) The Applicant shall post a security deposit with the City of Dublin in the amount of $500.00 to secure the faithful performance of Condition #8 (removal of sign). The security deposit shall be submitted in a form acceptable to the City Attorney (see Security Deposit Agreement attached) and guarantee that these funds will be available and that the instrument of credit will remain effective until December 1, 1992. An alternate instrument of credit may be used subject to review and approval by the City Attorney. 10) This Conditional Use Permit shall be subject to Zoning Investigator review and determination as to compliance with the Conditions of Approval. -2- 11) This permit shall be revocable for cause in accordance with Section 8-90.3 of the Dublin Zoning Ordinance. Any violation of the terms of conditions of this permit shall be subject to citation. PASSED, APPROVED AND ADOPTED this 1st day of October, 1990.
