HomeMy WebLinkAboutPC Reso 90-059 PA 90-084 Waseca Kubota Tractors RESOLUTION NO. 90 - 059 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF DUBLIN APPROVING PA 90-084 WASECA KUBOTA TRACTORS CONDITIONAL USE PERMIT AT 6305 DOUGHERTY ROAD WHEREAS, Roy M. Usry Jr. of Waseca Kubota filed a Conditional Use Permit (PA 90-084) to continue the retail sale and service of tractors and equipment, and to allow the outside storage of equipment and display of tractors at 6305 Dougherty Road; and WHEREAS, the Planning Commission did hold a public hearing on said application on November 5, 1990; and WHEREAS, proper notice of said public hearing was given in all respects as required by law; and WHEREAS, the application has been reviewed in accordance with the provisions of the California Environmental Quality Act (CEQA) and was found to be categorically exempt under Section 15301, Class 1 ; and WHEREAS, the Staff Report was submitted recommending that the application be approved subject to conditions; and WHEREAS, the Planning Commission did hear and consider all said reports, recommendations and testimony hereinabove set forth; and NOW, THEREFORE, BE IT RESOLVED THAT THE Dublin Planning Commission does hereby find: A. The use is required to serve a public need in that is provides tractor sales and service. B. The use will be properly related to other land uses and transportation and service facilities in the vicinity, as daytime activities will be commensurate with present use of properties in the M-1, Light Industrial Zoning District. C. The use, under all circumstances and conditions of this particular case, will not materially adversely affect the health or safety of persons residing or working in the vicinity, or be materially detrimental to the public welfare or injurious to property or improvements in the neighborhood, as all applicable regulations will be met. D. The use will not be contrary to the specific intent clauses or performance standards established for the district in which it is to be located in that tractor sales, service, storage and display is consistent with the character of the M-1, Light Industrial District. BE IT FURTHER RESOLVED THAT THE Dublin Planning Commission does hereby conditionally approve PA 90-084 as shown on Exhibit A, plans dated and received September 26, 1990, on file with the Dublin Planning Department and subject to the following conditions: CONDITIONS OF APPROVAL: Unless stated otherwise, all Conditions of Approval shall be complied with prior to the issuance of building permits or establishment of use, and shall be subject to Planning Department review and approval. 1. This approval is for Waseca Kubota to operate a retail sale and service of tractors, trailers and similar equipment and machinery within the 5,500± square foot building at 6305 Dougherty Road. 2. The outdoor storage of equipment and machinery shall be limited to the 3,500± square foot area located southeast of Waseca Kubota tenant space, and within the existing enclosed cyclone fenced area as shown on Exhibit A. 3. Outdoor display shall be limited to three (3) tractors on the west side of Waseca Kubota tenant space as shown on Exhibit A. The display of tractors shall occur only during regular business hours. 4. The existing landscape areas adjacent to the tractor display shall be properly maintained in a viable and well kept manner at all times. 5. With the exception of authorized tractor display, all demonstrations, displays, services, and other activities associated with the sale and services at Waseca Kubota shall be conducted within the building. 6. The site shall be maintained in a litter-free condition at all times. All debris associated with Waseca Kubota (including but not limited to pallets, dumpsters, discarded engine parts, oil drums, etc.) shall be kept within the enclosed fenced area. 7. No loudspeakers or outside amplification of music or sound shall be allowed. 8. This approval shall be null and void, in the event the approved use ceases to operate for a continuous one-year period. 9. On at least an annual basis, the Conditional Use Permit shall be subject to Zoning Investigator review and determination as to compliance with the Conditions of Approval. - 2 - 10. This permit shall be revocable for cause in accordance with Section 8-90.3 of the Dublin Zoning Ordinance. Any violation of the terms of conditions of this permit shall be subject to citation. Waseca Tractor 6305 Dougherty Road To whom it may concern: Pursuant to submittal requirement no. 6 of the general submittal requirements for conditional use permits, let this letter serve as our written statement describing the "project." Waseca Kubota Tractors is in the business of selling and servicing new and used tractors and equipment from 7 to 75 horsepower. We have been at the above referenced location doing this for more than 5 years. We park three tractors in the front of our building each day for a display as indicated on our Site Slide (submittal requirement no. 8 of the general submittal requirements for conditional use permits). We have not made, nor do we plan to make and structural changes to the existing building. Sight plans and diagrams of the "project" are attached with this letter.
