HomeMy WebLinkAboutPC Reso 90-061 PA 90-082 Del Piso Tile and Brick Co RESOLUTION NO. 90 - 061 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF DUBLIN APPROVING PA 90-082 DEL PISO TILE & BRICK COMPANY CONDITIONAL USE PERMIT AT 6500 SIERRA COURT WHEREAS, Robert S. Kumnick, on behalf of Del Piso Tile & Brick Company, requests approval of a Conditional Use Permit and Site Development Review for the establishment of an outdoor storage yard, limiting the uses permitted on site and allowing exterior modifications to the existing improved site located at 6500 Sierra Court; and WHEREAS, Section 8-51.3 of the adopted City of Dublin Zoning Ordinance requires approval by the Planning Commission of a Conditional Use Permit for the establishment of an outdoor storage yard, finding that it is an appropriate use within the M-1, Light Industrial District; and WHEREAS, the Planning Commission did hold a public hearing on said application on November 5, 1990; and WHEREAS, proper notice of said public hearing was given in all respects as required by law; and WHEREAS, the application has been reviewed in accordance with the provisions of the California Environmental Quality Act (CEQA) and a Negative Declaration has been adopted (Planning Commission Resolution No. 90-060) for this project as it will have no significant effect on the environment; and WHEREAS, the Staff Report was submitted recommending that the application be conditionally approved; and WHEREAS, the Planning Commission did hear and consider all said reports, recommendations and testimony hereinabove set forth; and WHEREAS, the proposed land use, if conditionally approved, is appropriate for the subject property in terms of being compatible with existing land uses in the area and will not overburden public services. NOW, THEREFORE, BE IT RESOLVED THAT THE Dublin Planning Commission does hereby find: A. The establishment of an outdoor storage yard serving a wholesale tile, brick and masonry business provides for the public need by offering a range of services for the community. B. The use will be properly related to other land uses and transportation and service facilities in the vicinity, as the proposed use is compatible when compared to the type and - 1 - nature of operations typically found in light industrial district areas and the uses currently in operation in the immediate vicinity. C. The use will not materially adversely affect the health or safety of persons residing or working in the vicinity, or be materially detrimental to the public welfare or injurious to property or improvements in the neighborhood, as all applicable regulations will be met. D. The use will not be contrary to the specific intent clauses or performance standards established for the district in which it is to be located in that conditions have been applied to ensure conformance with the applicable zoning regulations, and the use is consistent with the character of the surrounding area as well as the light industrial district. E. The approval of the Conditional Use Permit will be consistent with the Dublin General Plan. BE IT FURTHER RESOLVED THAT THE Dublin Planning Commission does hereby conditionally approve PA 90-082 Conditional Use Permit application as shown by materials labeled Exhibit A (site plans prepared by Robert S. Kumnick, dated received October 25, 1990 and September 19, 1990, consisting of 3 sheets) on file with the Dublin Planning Department, subject to approval of the related Site Development Review and to the following conditions: CONDITIONS OF APPROVAL Unless stated otherwise, all Conditions of Approval shall be complied with prior to the issuance of building permits or establishment of use, and shall be subject to Planning Department review and approval. 1. This approval is for an outdoor storage yard, not to exceed 35,750 square feet, located at the western end of the site (6500 Sierra Court). The storage yard shall generally conform to the plans labeled Exhibit A, and shall occupy a maximum of sixty- four (64) spaces. 2. Approval of the outdoor storage yard is based upon limitations placed on tenant space #1, which is currently vacant. An industrial tenant occupying tenant space #1, 6444 Sierra Court, consisting of 40,000 square feet, may not utilize more than 10% of the tenant space as an office serving the industrial use. 3. All outdoor related activities shall take place between the hours of 7:00 a.m. and 5:30 p.m., except as may be approved in advance in writing by the Planning Director. Particular attention shall be given to minimizing the noise effects on adjacent residential areas. 4. The Applicant shall be responsible for clean-up and disposal of project related trash to maintain a clean and litter-free site. 90082re2 - 2 - .5. No loudspeakers or amplified music shall be permitted outside the enclosed building. 6. In compliance with Sections 8-60.56(b) and 8-51.3(b), an eight foot fence shall be installed around the perimeter of the outdoor storage yard. There shall be no storage of any materials above the fence line or outside of the designated storage yard. 7. All signs shall be subject to the requirements of the Sign Regulations within the Zoning Ordinance. 8. The Applicant shall work with the Dublin Police Services Department on an ongoing basis to establish an effective theft prevention and security program. 9. All requirements of the Dougherty Regional Fire Authority shall be complied with. A striping plan reflecting on site parking and a twenty-foot-wide fire lane through the outdoor storage yard shall be submitted subject to Planning Director and Dougherty Regional Fire Authority review and approval. 10. All subsequent uses proposed on site (6444-6510 Sierra Court), permitted or conditional, shall be reviewed and approved by the Planning Director, based on the related parking requirements and other applicable zoning requirements. 11. On an annual basis, these uses shall be subject to Zoning Investigator review and determination as to the compliance with the Conditions of Approval. 12. This approval shall become null and void, in the event the approved use ceases to operate for a continuous period of one year. 13. This permit shall be revocable for cause in accordance with Section 8-90.3 of the Dublin Zoning Ordinance. Any violation of the terms of conditions of this permit shall be subject to citation.
