HomeMy WebLinkAboutPC Reso 92-032 PA 92-025 Dublin Security Storage continued operation of existing self storge and truck rental facility RESOLUTION NO. 92 - 032 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF DUBLIN APPROVING PA 92-025 DUBLIN SECURITY STORAGE CONDITIONAL USE PERMIT TO ALLOW THE CONTINUED OPERATION OF AN EXISTING SELF-STORAGE AND TRUCK RENTAL FACILITY AND ANCILLARY P.G.&E. FACILITY WITH OUTDOOR STORAGE OF RECREATIONAL VEHICLES, RYDER TRUCK RENTALS AND P.G.&E. TRUCKS AND EQUIPMENT LOCATED AT 6005 SCARLETT COURT WHEREAS, Glenn Kierstead, Applicant, filed a Conditional Use Permit request to allow the continued operation of an existing self- storage and truck rental facility and ancillary P.G.&E. facility with outdoor storage of recreational vehicles, Ryder truck rentals and P.G.&E. facility trucks and equipment; and WHEREAS, the Planning Commission held a public hearing on said application on June 1, 1992; and WHEREAS, proper notice of said public hearing was given in all respects as required by law; and WHEREAS, the application has been reviewed in accordance with the provisions of the California Environmental Quality Act (CEQA) and was found to be Categorically Exempt under Section 15301, Class 1 of the State CEQA Guidelines; and WHEREAS, the Staff Report was submitted recommending that the application be conditionally approved; and WHEREAS, the Planning Commission did hear and consider all said reports, recommendations and testimony hereinabove set forth. NOW, THEREFORE, BE IT RESOLVED THAT THE Dublin Planning Commission does hereby find that: A. The proposed project will serve a public need by providing a self-storage facility with recreational vehicle storage and truck rental services in the City of Dublin. B. The use will be properly related to other land uses and transportation and service facilities in the vicinity, as the proposed use will be compatible to the type and nature of operations typically found in the neighborhood. C. The use, under all circumstances and conditions of this particular case, will not materially adversely affect the health or safety of persons residing or working in the vicinity, or be materially detrimental to the public welfare or injurious to property or improvements in the neighborhood, as all applicable regulations will be met. D. The use will not be contrary to the specific intent clauses or performance standards established for the District in which it is to be located. '•� E. The approval of the Conditional Use Permit is consistent with the Dublin General Plan. BE IT FURTHER RESOLVED THAT THE Dublin Planning Commission does hereby conditionally approve PA 92-025 Conditional Use Permit as generally depicted on the site plan labeled Exhibit A, stamped approved and on file with the Dublin Planning Department, subject to the following conditions: CONDITIONS OF APPROVAL: Unless stated otherwise, all Conditions of Approval shall be complied with prior to the issuance of building permits or establishment of use, and shall be subject to Planning Department review and approval. The following codes represent those departments/agencies responsible for monitoring compliance of the conditions of approval. [PL] Planning, (B] Building, [PO] Police, [PW] Public Works, [ADM] Administration/City Attorney, [FIN] Finance, [F] Dougherty Regional Fire Authority, [DSR] Dublin San Ramon Services District, [CO] Alameda County Department of Environmental Health. 1. This approval for PA 92-025 is to allow the continued operation of the existing Dublin Security Storage and Ryder Truck Rental facility and ancillary P.G.&E. facility with outdoor storage of recreational vehicles, Ryder truck rentals and P.G.&E. trucks and equipment located at 6005 Scarlett Court. This approval shall generally conform to the Site Plan labeled Exhibit A (1 sheet), dated May 5, 1992, stamped approved and on file with the Dublin Planning Department. [PL, B] 2. The Applicant shall comply with all applicable Planning, Building, Dougherty Regional Fire Authority and Police Department regulations and ordinances. [PL, B, F, PO] 3. The outdoor parking of recreational vehicles, Ryder truck rentals and other vehicles shall occur in the designated parking spaces on-site (148 parking spaces for recreational and other vehicles, and 8 parking spaces for Ryder truck rentals) and not at the three customer and employee parking spaces located outside the front entrance security gate. [PL] 4. The outside storage of P.G.&E. vehicles and equipment shall be limited to the enclosed P.G.&E. facility area. [PL] 5. The Applicant shall provide on-site informational signage indicating storage facility and Ryder truck rental hours of operation, instructions for after hour rental returns and a telephone number for use in case of an emergency. [PL] 6. All signs shall be subject to the requirements of the Sign Regulations within the Zoning Ordinance. [PL] 7. Any changes in the operation of the ancillary P.G.&E. use shall be subject to the Planning Director's review and determination as to whether the use is still compatible and ancillary to the - 2 - Dublin Security Storage facility or whether other planning approvals are required. [PL] 8. The Applicant shall be responsible for clean-up and disposal of project related trash to maintain a clean, litter-free site. [PL] 9. No loudspeakers or amplified music shall be permitted outside the enclosed buildings. All activities, except for the outdoor storage of recreational vehicles, Ryder rental trucks and P.G.&E. trucks and equipment, shall be conducted entirely within the enclosed buildings. [PL] 10. All existing landscape areas shall be enhanced and properly maintained. [PL] 11. On an annual basis, this Conditional Use Permit approval shall be subject to Zoning Investigator review and determination as to compliance with the Conditions of Approval. [PL] 12. This approval shall become null and void in the event the approved use ceases to operate for a continuous one year period. [PL] 13. This permit shall be revocable for cause in accordance with Section 8-90.3 of the Dublin Zoning Ordinance. Any violation of the terms or conditions of this permit shall be subject to citation. [PL] PASSED, APPROVED AND ADOPTED this 1st day of June, 1992.
