HomeMy WebLinkAboutPC Reso 92-053 PA 92-043 Playland Family Entertainment Center /'` RESOLUTION NO. 92 - 053 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF DUBLIN DENYING PA 92-043 PLAYLAND FAMILY ENTERTAINMENT CENTER CONDITIONAL USE PERMIT TO OPERATE A COMMERCIAL RECREATION USE AT 7214-7224 SAN RAMON ROAD WHEREAS, William Hulme, representing Regency Enterprises, has filed an application for a Conditional Use Permit to operate a commercial recreation use (arcade) in an existing 8,130i square foot tenant space within the Strouds Plaza Shopping Center at 7214 - 7224 San Ramon Road; and WHEREAS, the Planning Commission did hold a public hearing on said application on October 19, 1992; and WHEREAS, proper notice of said public hearing was given in all respects as required by law; and WHEREAS, the application has been reviewed in accordance with the provisions of the California Environmental Quality Act (CEQA) and it was found that CEQA does not apply to this project pursuant to Section 15270 of the State CEQA guidelines; and WHEREAS, the Staff Report was submitted recommending that the application be conditionally approved; and WHEREAS, the Planning Commission did hear and consider all said reports, recommendations and testimony hereinabove set forth; and WHEREAS, the Planning Commission has found that the proposed project is not appropriate for the subject site. NOW, THEREFORE, BE IT RESOLVED THAT THE Dublin Planning Commission does hereby find that: A. The proposed use would not serve a public need in that the potential impacts to surrounding residential neighborhoods exceed the benefits of providing a recreational facility use. B. The proposed use would not be properly related to other land uses and transportation and service facilities in the vicinity, as the proposed use is not compatible with the type and nature of retail shopper operations typically found in the Strouds Plaza Shopping Center. C. The proposed use would have an adverse effect on the health and safety of persons residing and working in the vicinity, would be materially detrimental to the public welfare and would be injurious to property or improvements in the neighborhood, due to the proximity of the proposed use to an - 1 - existing residential neighborhood and the potential impacts the use could generate. D. The proposed use is contrary to the specific intent clauses and performance standards established for the Retail Business District. E. The project is not consistent with the policies contained in the City's General Plan and San Ramon Road Specific Plan. BE IT FURTHER RESOLVED THAT THE Dublin Planning Commission does hereby deny PA 92-043 Playland Family Entertainment Center Conditional Use Permit. PASSED, APPROVED AND ADOPTED this 19th day of October, 1992.
