HomeMy WebLinkAboutPC Reso 91-002 PA 90-099 Goodwill Industries Recycling/donation station RESOLUTION NO. 91 - 002 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF DUBLIN APPROVING PA 90-099 GOODWILL INDUSTRIES RECYCLING/DONATION STATION FOR A 25 FOOT LONG TRAILER IN THE PARKING LOT AREA OF THE PAK'N SAVE SHOPPING CENTER WHEREAS, Arthur Collins, representing Goodwill Industries, filed an application for a Conditional Use Permit to allow the operation of a 25 foot long truck trailer for a recycling/donation station in the parking lot near Pak'n Save, 6605-6633 Dublin Boulevard; and WHEREAS, Section 8-61.0 of the Zoning Ordinance, as amended by Ordinance 17-84, requires approval of a Conditional Use Permit to operate a recycling center in any zoning district; and WHEREAS, the Planning Commission did hold a public hearing on said application on January 22, 1991; and WHEREAS, proper notice of said public hearing was given in all respects as required by law; and WHEREAS, the application has been reviewed in accordance with the provisions of the California Environmental Quality Act (CEQA) and was found to be categorically exempt under Section 15303, Class 3(e) and Section 15311, Class 11; and WHEREAS, the Staff Report was submitted recommending that the application be conditionally approved; and WHEREAS, the Planning Commission did hear and consider all said reports, recommendations and testimony hereinabove set forth. NOW, THEREFORE, BE IT RESOLVED THAT THE Dublin Planning Commission does hereby find that: A. The use is required by the public need in that it provides a location for the general public to drop off reusable items. B. The use will be properly related to other land uses and transportation and service facilities in the vicinity, as the proposed use will be compatible to the type and nature of operations typically found in the neighborhood. C. The use, if permitted, under all circumstances and conditions of this particular case, will not materially affect adversely the health or safety of persons residing or working in the vicinity, or be materially detrimental to the public welfare or injurious to property or improvements in the neighborhood, as all applicable regulations will be met. D. The use will not be contrary to the specific intent clauses or performance standards established for the district in which it is to be located as conditions have been applied to insure conformance with the zoning regulations. BE IT FURTHER RESOLVED THAT THE Dublin Planning Commission does hereby conditionally approve said application as shown on the attached Exhibit A subject to the following conditions: CONDITIONS OF APPROVAL: Unless stated otherwise, all Conditions of Approval shall be complied with prior to the issuance of building permits or establishment of use, and shall be subject to Planning Department review and approval. 1. This approval is for the Recycling/Donation Station use, which shall consist of a truck trailer located in the northwest portion of the Pak'n Save Shopping Center parking lot at 6605-6633 Dublin Boulevard, as generally depicted on the site plan labeled Exhibit A. 2. The maximum number of parking spaces to be occupied by the Recycling/Donation Station shall be limited to four. 3. The Applicant shall obtain an annual Recycling Permit and Recycling Transporter Permit for the site as required by Resolution 26-86. 4. The recycling/donation station shall not interfere with or obstruct vehicular access or movement within the parking lot. 5. The hours of operation shall be from 9:30 a.m. to 5:00 p.m., 7 days a week. After hours, the trailer shall be locked and secured. 6. The Applicant shall be responsible for maintaining the Recycling/Donation Station in an attractive and functionally operative manner. 7. The Applicant shall take all necessary precautions to ensure that the areas surrounding the truck trailer are maintained free of litter and other debris. All recyclable and donated materials shall be stored inside the trailer, and no items shall be left outside the trailer for more than 12 hours. 8. The Applicant shall control activities connected to this use so as not to create a nuisance to the existing businesses or shoppers. 9. The Applicant shall maintain on-site signage clearly indicating hours of operation, drop-off instructions for unattended after hours and a 24-hour emergency or complaint telephone number. Said signage shall be limited to two signs, each a maximum of 8 square feet of area, and said signage shall be visible after hours subject to Planning Director review and approval. - 2 - 10. The supermarket for which the recycling/donation facility is located shall post, in a convenient, visible location within the supermarket, entrances and exits, the location of the recycling/ donation facility. 11. The Applicant shall submit evidence to the Planning Director that appropriate State and City licenses, permits or certificates to operate the recycling/donation station have been obtained. 12. Should the Applicant desire to move the trailer to an alternate location on the project site during the effective period of this permit, such a move shall secure City Planning Department review and approval a minimum of two weeks prior to its relocation. 13. This approval shall become null and void in the event the approved use ceases to operate for a continuous one-year period. 14. This permit shall be revocable for cause in accordance with Section 8-90.3 of the Dublin Zoning Ordinance. Any violation of the terms and conditions of this permit shall be subject to citation. 15. On an annual basis, these uses shall be subject to Zoning Investigator review and determination as to compliance with the conditions of approval.
