HomeMy WebLinkAboutPC Reso 91-004 PA 90-112 Dublin Meadows for directional tract sign RESOLUTION NO. 91 - 004 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF DUBLIN DENYING PA 90-112 DUBLIN MEADOWS CONDITIONAL USE PERMIT FOR USE OF A DIRECTIONAL TRACT SIGN LOCATED AT 11960 SILVERGATE DRIVE (APN 941-103-69-1) WHEREAS, Bernie Hawkins, representing Sign Technology, filed an application for a Conditional Use Permit request to allow a Directional Tract Sign at 11960 Silvergate Drive; and WHEREAS, the Planning Commission did hold a public hearing on said application on January 22, 1991; and WHEREAS, proper notice of said public hearing was given in all respects as required by law; and WHEREAS, the application has been reviewed in accordance with the provisions of the California Environmental Quality Act (CEQA) and was found to be categorically exempt under Section 15311, Class 11(a) ; and WHEREAS, the Staff Report was submitted recommending that the application be conditionally approved; and WHEREAS, the Planning Commission did hear and consider all said reports, recommendations and testimony hereinabove set forth. NOW, THEREFORE, BE IT RESOLVED THAT THE Dublin Planning Commission does hereby find that: A. The use is not required by the public need in that two approved Directional Tract Signs for Dublin Meadows (PA 90-111 and PA 90-113) already provide the general public with directional information for reaching the Dublin Meadows housing development. B. The use will not be properly related to other land uses and transportation and service facilities in the vicinity, in that all currently approved existing Directional Tract Signs located within the City of Dublin have been limited by Planning Commission action to two approved signs per residential development; and the Planning Commission has already approved two Directional Tract Signs for Dublin Meadows (PA 90-111 and PA 90-113). C. The use, if permitted under all circumstances and conditions of this particular case, will not materially adversely affect the health or safety of persons residing or working in the vicinity, or be materially detrimental to the public welfare or injurious to property or improvements in the neighborhood, as all applicable regulations will be met. D. The use will not be contrary to the specific intent clauses or performance standards established for the district in which it is to be located, in that it conforms with the Zoning Ordinance. BE IT FURTHER RESOLVED THAT THE Dublin Planning Commission does hereby deny Conditional Use Permit PA 90-112 Dublin Meadows Directional Tract Sign at 11960 Silvergate Drive, as shown by materials labeled Exhibit A on file with the Dublin Planning Department.
