A RESOLUTION OF THE PLANNING COMMISSION
OF THE CITY OF DUBLIN
APPROVING PA 90-051 20/20 RECYCLE CENTER CONDITIONAL USE PERMIT TO
OPERATE A REDEMPTION CENTER IN THE PARKING LOT AREA OF THE SAN RAMON
VILLAGE PLAZA SHOPPING CENTER LOCATED AT 8909 SAN RAMON ROAD
WHEREAS, Boudewijn P. Hanrath representing 20/20 Recycle Center
filed an application for a Conditional Use Permit to allow the
continued operation of a recycling redemption center within the
parking lot of the Lucky/San Ramon Village Plaza Shopping Center at
8909 San Ramon Road; and
WHEREAS, the adopted City of Dublin Zoning Ordinance, as amended,
provides for the operation of recycling centers with approval of a
Conditional Use Permit; and
WHEREAS, the Planning Commission did hold a public hearing on
said application on February 19, 1991; and
WHEREAS, proper notice of said public hearing was given in all
respects as required by law; and
WHEREAS, the application has been reviewed in accordance with the
provisions of the California Environmental Quality Act (CEQA) and was
found to be categorically exempt under Section 15301, Class 1; and
WHEREAS, the Staff Report was submitted recommending that the
application be conditionally approved, subject to conditions; and
WHEREAS, the Planning Commission did hear and consider all said
reports, recommendations and testimony hereinabove set forth.
NOW, THEREFORE, BE IT RESOLVED THAT THE Dublin Planning
Commission does hereby find that:
A. The proposed project will serve a public need by providing
recycling collection/redemption center for the community.
B. The use will be properly related to other land uses and
transportation and service facilities in the vicinity, as
the proposed use will be compatible to the existing
commercial business uses in the San Ramon Village Plaza
Shopping Center.
C. The use, under all circumstances and conditions of this
particular case, will not materially adversely affect the
health or safety of persons residing or working in the
vicinity, or be materially detrimental to the public welfare
or injurious to property or improvements in the
neighborhood, as all applicable regulations will be met.
D. The use will not be contrary to the specific intent clauses
• or performance standards established for the district in
which it is to be located, in that conditions have been
applied to insure conformance with the Zoning Ordinance.
E. The use is consistent with the policies of the Dublin
General Plan.
BE IT FURTHER RESOLVED THAT THE Dublin Planning Commission does
hereby conditionally approve PA 90-051 20/20 Recycle Center
Conditional Use Permit as shown by materials labeled Exhibit A (Staff
Recommended Site) dated received January 25, 1991 and on file with the
Dublin Planning Department, subject to the following conditions:
CONDITIONS OF APPROVAL:
Unless stated otherwise, all Conditions of Approval shall be complied
with prior to the issuance of building permits or establishment of
use, and shall be subject to Planning Department review and approval.
The following codes represent those departments/agencies responsible
for monitoring compliance of the conditions of approval. fPLL

IDSR] Dublin San Ramon Services District, [CO] Alameda County
Department of Environmental Health.
1. PA 90-051 is approved for a recycling center consisting of a
maximum of six on-site igloos for the collection and temporary
storage of glass, aluminum, and plastic beverage containers which
will be relocated in the parking lot of the shopping center at
8909 San Ramon Road as generally depicted on the site plan
labeled Exhibit A (Staff Recommended Site). [PL]
2. The maximum number of parking spaces to be used for the recycling
center shall be limited to two. [PL]
3. The Applicant shall have a current annual Recycling Facility
Permit and Recycling Transporter Permit for the site as required
by Dublin Municipal Code Section 5-32. [ADM]
4. All recyclable materials shall be stored inside the approved
containers. [PL]
5. The containers shall be emptied only during the hours of
8:00 a.m. and 5:00 p.m. [PL]

maintained in an attractive and functionally operative manner.

7. The Applicant shall control activity so as not to create a
nuisance to the existing businesses or shoppers. [PL, PO]

8. A solid, enclosed receptacle shall be provided for the receipt of
recyclable materials when igloos are unattended or locked. [PL]

9. On site directional and identification signs shall not exceed
eight (8) square feet and shall not contain advertising messages
and shall be subject to Planning Director review and approval.

10. A minimum of one 40 gallon all-whether trash receptacle shall be
provided in each collection area. [PL]
11. All containers shall be clearly marked to identify the type of
material to be deposited and a notice shall be displayed stating
that no material shall be left outside the recycling containers.

12. The kiosk shall have a notice displayed identifying the name and
telephone number of the facility operator and the hours of
operation, including a 24-hour emergency telephone number. [PL,
P0]
13. The Applicant and/or Property Owner shall be responsible for
ensuring that the premises surrounding the recycling facility is
maintained free of litter, recyclable and non-recyclable
materials, and other debris. [PL]
14. The Applicant and/or Property Owner shall post, in a convenient
and visible location within the Lucky Store entrances and exits,
the location of the recycling facility. [PL]
15. The Applicant shall submit evidence to the Planning Director that
appropriate state and local licenses (including Business
License), permits or certificates have been obtained. [PL, ADM,
FIN]
16. The Applicant shall bring the site into conformance with these
project conditions of approval within thirty (30) days from the
effective date of this approval. [PL, ADM]
17. No modifications or relocation to the recycling center shall
occur without prior review and written approval of the Planning
Director and must comply with all applicable zoning, building
code and engineering regulations including issuance of building
permits if required. [PL, B, PW]
18. On at least an annual basis, this Conditional Use Permit shall be
subject to Zoning Investigator review and determination as to
compliance with the conditions of approval. [PL]
19. This approval shall be null and void in the event the approved
use ceases to operate for a continuous one year period. [PL]

.20. This permit shall be revocable for cause in accordance with
• Section 8-90.3 of the Dublin Zoning Ordinance. Any violation of
the terms of conditions of this use permit shall be subject to
citation. [PL]

Above is a photograph of a standard 20/20 Recycle Center proposed to be located in
the parking lot. The igloos are constructed of fiberglass material which is cleaned daily
by the 20/20 attendant. The color is bonded into the fiberglass which makes it
relatively easy to remove any graffiti.All equipment is secured at night with heavy duty
locks to prevent any theft.
