HomeMy WebLinkAboutPC Reso 91-021 20/20 Recycle Center- operate redemption center in parking lot area of Payless/ Dub Plaza RESOLUTION NO. 91 - 021 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF DUBLIN APPROVING PA 90-050 20/20 RECYCLE CENTER CONDITIONAL USE PERMIT TO OPERATE A REDEMPTION CENTER IN THE PARKING LOT AREA OF THE PAYLESS/DUBLIN PLAZA SHOPPING CENTER LOCATED AT 7201 REGIONAL STREET WHEREAS, Boudewijn P. Hanrath representing 20/20 Recycle Center filed an application for a Conditional Use Permit to allow the continued operation of a recycling redemption center within the parking lot of the Payless/Dublin Plaza Shopping Center at 7201 Regional Street; and WHEREAS, the adopted City of Dublin Zoning Ordinance, as amended, provides for the operation of recycling centers through the Conditional Use Permit process; and WHEREAS, the Planning Commission did hold a public hearing on said application on February 19, 1991 and March 18, 1991; and WHEREAS, proper notice of said public hearing was given in all respects as required by law; and WHEREAS, the application has been reviewed in accordance with the provisions of the California Environmental Quality Act (CEQA) and was found to be categorically exempt under Section 15301, Class 1; and WHEREAS, the Staff Report was submitted recommending that the application be conditionally approved, subject to conditions; and WHEREAS, the Planning Commission did hear and consider all said reports, recommendations and testimony hereinabove set forth. NOW, THEREFORE, BE IT RESOLVED THAT THE Dublin Planning Commission does hereby find that: A. The proposed project will serve a public need by providing a recycling collection/redemption center for the community. B. The use will be properly related to other land uses and transportation and service facilities in the vicinity, as the proposed use will be compatible to the existing commercial business uses in the Dublin Plaza Shopping Center. C. The use, under all circumstances and conditions of this particular case, will not materially adversely affect the health or safety of persons residing or working in the vicinity, or be materially detrimental to the public welfare or injurious to property or improvements in the neighborhood, as all applicable regulations will be met. D. The use will not be contrary to the specific intent clauses or performance standards established for the district in which it is to be located, in that conditions have been applied to insure conformance with the Zoning Ordinance. E. The use is consistent with the policies of the Dublin General Plan. BE IT FURTHER RESOLVED THAT THE Dublin Planning Commission does hereby conditionally approve PA 90-050 20/20 Recycle Center Conditional Use Permit as shown by materials labeled Exhibit A dated received January 25, 1991 and on file with the Dublin Planning Department, subject to the following conditions: CONDITIONS OF APPROVAL: Unless stated otherwise, all Conditions of Approval shall be complied with prior to the issuance of building permits or establishment of use, and shall be subject to Planning Department review and approval. The following codes represent those departments/agencies responsible for monitoring compliance of the conditions of approval. [PL1 Planning. fB] Building. [CO] Alameda County Department of Environmental Health. 1. PA 90-050 is approved for a recycling center consisting of a 28 foot long trailer and a maximum of four on-site igloos for the collection and temporary storage of glass, aluminum and plastic beverage containers which will be located in the parking lot of the shopping center at 7201 Regional Street as generally depicted on the site plan prepared by George Meu Associates dated received January 25, 1991 and photograph of trailer and igloos labeled Exhibit A. [PL] 2. The maximum number of parking spaces utilized by the recycling center shall be subject to review and approval of the Planning Director. [PL] 3. The Applicant and/or Property Owner shall post signage along the drive aisle indicating "no double parking" and "no blocking drive aisle". Specific location and wording of the signage shall be subject to Planning Director review and approval prior to installation. The sign area shall not exceed 8 square feet in compliance with Section 8-87.50E). [PL] 4. The Applicant shall have a current annual Recycling Facility Permit and Recycling Transporter Permit for the site as required by Dublin Municipal Code Section 5-32. [ADM] 5. All recyclable materials shall be stored inside the approved trailer and igloo containers. [PL] - 2 - 6. The containers shall be emptied only during the hours of 8:00 a.m. and 5:00 p.m. [PL] . 7. The Applicant shall take all necessary precautions to ensure litter and materials are controlled and that the units are maintained in an attractive and functionally operative manner. [PL] 8. The Applicant shall control activity so as not to create a nuisance to the existing businesses or shoppers. [PL, PO] 9. A solid, enclosed receptacle shall be provided for the receipt of recyclable materials when igloos are unattended or locked. [PL] 10. On-site directional and identification signs shall not exceed eight (8) square feet and shall not contain advertising messages subject to Planning Director review and approval. [PL] 11. A minimum of one 40 gallon all-whether trash receptacle shall be provided in each collection area. [PL] 12. All containers shall be clearly marked to identify the type of material to be deposited and a notice will be displayed stating that no material shall be left outside the recycling containers. [PL] 13. The trailer shall have a notice identifying the name and telephone number of the facility operator and the hours of operation including a 24-hour emergency number. [PL, PO] 14. The Applicant and/or Property Owner shall be responsible for ensuring that the premises surrounding the recycling facility is maintained free of litter, recyclable and non-recyclable materials, and other debris. [PL] 15. The Applicant and/or Property Owner shall post, in a convenient and visible location within the Payless Store entrances and exits, the location of the recycling facility. [PL] 16. The Applicant shall submit evidence to the Planning Director that appropriate state and local licenses, (including Business License) permits or certificates have been obtained. [PL, ADM, FIN] 17. The Applicant shall bring the site into conformance with the project conditions of approval within thirty (30) days from the effective date of this approval. [PL, ADM] 18. No modifications or relocation to the recycling center shall occur without prior review and written approval of the Planning Director and must comply with all applicable zoning, building code and Public Works regulations including issuance of building permits if required. [PL, B, PW] - 3 - . 19. On at least an annual basis, this Conditional Use Permit shall be subject to Zoning Investigator review and determination as to compliance with the conditions of approval. [PL] 20. This permit shall be null and void in the event the approved use ceases to operate for a continuous one year period. [PL] 21. This permit shall be revocable for cause in accordance with Section 8-90.3 of the Dublin Zoning Ordinance. Any violation of the terms or conditions of this use permit shall be subject to citation. When the trailer is full, it is replaced with an empty trailer that is steam cleaned prior to placement in the field. The igloos are constructed of fiberglass material which is cleaned daily by the 20/20 attendant. The color is bonded into the fiberglass which makes it relatively easy to remove any graffiti. The igloos and the trailer are secured at night with heavy duty locks to prevent any theft. The trailer is also fitted with a king-pin locking device to minimize complete trailer theft.
