HomeMy WebLinkAboutPC Reso 91-027 PA 91-030 Crossroads Toyota/ Pontiac CUP for Temp Promo Signs- 60 day timeframe RESOLUTION NO. 91 - 027 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF DUBLIN APPROVING PA 91-030 CROSSROADS TOYOTA/PONTIAC CONDITIONAL USE PERMIT FOR TEMPORARY PROMOTIONAL SIGNS - 60 DAY TIME FRAME, 6450 DUBLIN COURT WHEREAS, Larry Alexander, on behalf of Crossroads Toyota/Pontiac, filed a Conditional Use Permit to allow use of temporary promotional advertising displays for a cumulative period of up to 60 days within a 12-month period at 6450 Dublin Court; and WHEREAS, the Planning Commission did hold a public hearing on said application on June 3, 1991; and WHEREAS, proper notice of said public hearing was given in all respects as required by law; and WHEREAS, the application has been reviewed in accordance with the provisions of the California Environmental Quality Act (CEQA) and was found to be Categorically Exempt under Section 15311 c), Class 11 ; and WHEREAS, the Staff Report was submitted recommending that the application be conditionally approved; and WHEREAS, the proposed temporary promotional advertising displays, if conditionally approved, are appropriate for the subject property in terms of being compatible with existing land uses in the area and will not overburden public services; and WHEREAS, the Planning Commission did hear and consider all said reports, recommendations and testimony hereinabove set forth. NOW, THEREFORE, BE IT RESOLVED THAT THE Dublin Planning Commission does hereby find that: A. The proposed project will serve a public need by providing temporary promotional advertising displays in conjunction with special promotional events at an existing commercial establishment in the City of Dublin. B. The use will be properly related to other land uses and transportation and service facilities in the vicinity, as the proposed use will be compatible to the type and nature of operations typically found in the neighborhood. C. The use, under all circumstances and conditions of this particular case, will not materially adversely affect the health or safety of persons residing or working in the vicinity, or be materially detrimental to the public welfare or injurious to property or improvements in the neighborhood, as all applicable regulations will be met. D. The use will not be contrary to the specific intent clauses or performance standards established for the district in which it is to be located. BE IT FURTHER RESOLVED THAT THE Dublin Planning Commission does hereby conditionally approve PA 91-030 Crossroads Toyota/Pontiac Conditional Use Permit to allow the use of temporary promotional advertising displays for a maximum cumulative period of 60 days within a 12-month period as generally depicted in Exhibit A, stamped approved and on file with the City Planning Department, consisting of one sheet, dated received by the Planning Department May 13, 1991, subject to the following conditions: CONDITIONS OF APPROVAL: Unless stated otherwise, all Conditions of Approval shall be complied with prior to the issuance of building permits or establishment of use, and shall be subject to Planning Department review and approval. The following codes represent those departments/agencies responsible for monitoring compliance of the conditions of approval. [PL] Planning, [B] Building, [PO] Police, [PW] Public Works, (ADM] Administration, [FIN] Finance, [F] Dougherty Regional Fire Authority, [DSR] Dublin San Ramon Services District, [CO] Alameda County Department of Environmental Health. 1. PA 91-030 Conditional Use Permit approval is for the erection and use of temporary promotional advertising displays such as roof- mounted cold-air balloons, pennants, banners, helium balloons and search lights, for a maximum cumulative period of sixty (60) days within a 12-month period running from June 14, 1991, through June 13, 1992, at 6450 Dublin Court. [PL] 2. The temporary promotional advertising displays specified in Condition No. 1, or similar displays, shall be subject to the following restrictions on their respective periods of use: [PL] a. No temporary promotional advertising displays (banners and pennants) may be displayed for a period exceeding fourteen (14) consecutive days. b. Searchlights may be utilized for a maximum of twelve (12) days during a 12-month period, with no more than three (3) consecutive days of use. c. Cable-anchored helium, or other gaseous balloons, may be utilized for a maximum of twelve (12) days, with no more than three (3) consecutive days of use. When used over weekend periods (i.e., used on a Friday, Saturday and/or Sunday), balloons may be used no more frequently than two (2) consecutive weekends. d. Roof-mounted, cold-air balloons may be utilized for a maximum of sixty (60) days, with no more than three (3) consecutive days of use. When used over weekend periods (i.e., used on a Friday, Saturday and/or Sunday), balloons - 2 - may be used no more frequently than two (2) consecutive weekends. 3. All temporary promotional advertising displays established in accordance with this permit shall be located, erected and maintained in a manner so as not to create a visual or physical hazard for either pedestrians or vehicles. [PL] 4. The regulations outlined in Condition No. 2 above which control the frequency of use of specific types of promotional displays shall apply to this 60 day Conditional Use Permit approval. [PL] 5. The Applicant shall provide written notice to the City of Dublin Planning Department a minimum of four (4) calendar days prior to each promotional event where temporary promotional advertising displays are used. Said written notice shall indicate the dates of use for each respective type of temporary promotional advertising display to be utilized. Written notice shall be in the form supplied by the City (attached). A master summary of the dates of use for each respective type of temporary promotional advertising display shall be maintained at all times on the premises and shall be available at all times during business hours for review by City of Dublin Staff. Any displays utilized on non-preauthorized days shall be subject to citations and/or may result in revocation of the permits. [PL] 6. A minimum of four (4) days prior to the first use of any temporary promotional advertising display, other than the display approved under this permit (Exhibit A), the Applicant shall prepare and submit a site plan detailing the general location of temporary promotional advertising displays proposed for use under this permit. This site plan depiction of the location for the respective types of displays shall be subject to review and approval by the Planning Director. This plan may be modified or supplemented, if desired, by the Applicant by submittal of a revised plan for review and approval by the Planning Director. [PL] 7. Approval for temporary use of tents in conjunction with special promotional events is granted by this permit only if the tent use is in compliance with the Dougherty Regional Fire Authority and City Building Department requirements. The Applicant shall provide the Planning Director written documentation from the Dougherty Regional Fire Authority and the City Building Department that all requirements have been met. The tent use shall be subject to Condition No. 5 above. [PL, F, B] 8. At any time during the effectiveness of this approval, the approval shall be revocable for cause in accordance with Section 8-90.3 of the Dublin Zoning Ordinance. Any violation of the terms or conditions of this permit shall be subject to citation. [PL] - 3 - 9. This use shall be subject to Zoning Investigator review and determination as to compliance with the conditions of approval. [PL] 10. This approval shall expire June 13, 1992. [PL] PASSED, APPROVED AND ADOPTED this 3rd day of June, 1991.
