HomeMy WebLinkAboutPC Reso 91-033 CC Approval of Rezoning- Dougherty Regional Fire Authority RESOLUTION NO. 91 - 033 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF DUBLIN RECOMMENDING THE CITY COUNCIL APPROVE THE REZONING REQUEST CONCERNING PA 91-042 DOUGHERTY REGIONAL FIRE AUTHORITY REZONING APPLICATION WHEREAS, Harold Ritter, on behalf of the Dougherty Regional Fire Authority and Robert Glockner of Whitney Investment Company, requests approval: 1) to amend the General Plan to designate the land use of the existing DRFA Fire Station #1 site at 7494 Donohue Drive from Public/Semi-Public Facility to Retail/Office; 2) to rezone the combined parcels at 7494 Donohue Drive (from R-S-D-20 to C-1) and 7601 Amador Valley Boulevard (portion) (from PD to C-1); and 3) of a Conditional Use Permit to allow the establishment of a community facility (a fire station) within the C-1 zone on the combined parcels at 7494 Donohue Drive and 7601 Amador Valley Boulevard (portion); and WHEREAS, the Planning Commission did hold a public hearing on said application on August 5, 1991; and WHEREAS, proper notice of said public hearing was given in all respects as required by law; and WHEREAS, the application has been reviewed in accordance with the provisions of the California Environmental Quality Act (CEQA) and a Negative Declaration of Environmental Significance has been adopted by the Dougherty Regional Fire Authority on March 18, 1991, (DRFA Resolution No. 1-91) for this project, as it will have no significant effect on the environment; and WHEREAS, the Staff Report was submitted recommending that the Planning Commission recommend that the City Council rezone the combined parcels at 7494 Donohue Drive and 7601 Amador Valley Boulevard (portion) to a C-1, Retail Business District; and WHEREAS, the Planning Commission did hear and consider all said reports, recommendations and testimony hereinabove set forth. NOW, THEREFORE, BE IT RESOLVED THAT THE Dublin Planning Commission does hereby find that: 1. Rezoning the combined parcels to a C-1 Retail Business District will be appropriate for the subject property in terms of providing a range of allowable and conditionally allowable uses which will be compatible to existing and proposed land uses in the immediate vicinity; and 2. The rezoning will not have a substantial adverse affect on health or safety or be substantially detrimental to the public welfare or be injurious to property or public improvement; and 3. The rezoning will not overburden public services; and 4. The rezoning is consistent with the Dublin General Plan. BE IT FURTHER RESOLVED THAT THE Dublin Planning Commission does hereby recommend that the City Council approve PA 91-042 the Rezoning request on combined parcels at 7494 Donohue Drive (APN 941-173-1-2), from R-S-D-20, Suburban Residential Combining District to C-1, Retail Business District, and a portion of 7601 Amador Valley Boulevard (APN 941-173-1-6), from PD, Planned Development to C-1, Retail Business District. PASSED, APPROVED AND ADOPTED this 5th day of August, 1991.
