ZONING HISTORY:
On April 5, 1969, the subject parcel and adjacent area were
rezoned from M-1-B-40, Light Industrial Combining District
to C-2-B-40, General Commercial Combining District.

V-5087: On June 1, 1970, the Alameda County Planning Commission
approved Site Development Review and Variance for the
construction of a 17,000 square foot office building and a
detached Casper's restaurant on the adjacent parcel located
at 6966-6994 Village Parkway. The Variance approval allowed
a reduction in the number of parking spaces (from 65 to 62)
on the subject property located at 6900-6958 Village
Parkway, and required the recordation of a Joint Parking and
Access Agreement between the two parcels.
APPLICABLE REGULATIONS:
Chapter 4.20 of the Dublin Municipal Code regulates Massage
Establishments and Massage Services within the City.
Section 8-21.14.2 of the Zoning Ordinance defines Massage
Establishment as an establishment having a fixed place of business
where any person engages in or carries on or permits to be engaged in
or carried on any of the activities described in the definition of
"massage" described in the City of Dublin Municipal Code, Chapter
4.20, Massage Establishments and Massage Services. Any establishment
engaged in or carrying on, or permitting any combination of massage
and bathhouse shall be deemed a massage establishment.
Section 8-49.2 A)20) specifies that a Massage Establishment is a
conditional use in the C-2 District and shall be permitted only if
approved by the Planning Commission.
Section 8-94.0 states that conditional uses must be analyzed to
determine: 1) whether or not the use is required by the public need;
2) whether or not the use will be properly related to other land uses,
transportation and service facilities in the vicinity; 3) whether or
not the use will materially affect the health or safety of persons
residing or working in the vicinity; and 4) whether or not the use
will be contrary to the specific intent clauses or performance
standards established for the district in which it is located.
ENVIRONMENTAL REVIEW: The project has been found to be Categorically
Exempt from the California Environmental Quality Act (CEQA) under
Section 15301, Class 1 of the State CEQA Guidelines. The project
consists of the operation of a new massage establishment use in an
existing commercial facility, involving a negligible expansion of the
use beyond that previously existing.
NOTIFICATION: Public Notice of the November 7, 1994 hearing was
published in the local newspaper, mailed to adjacent property owners,
and posted in public buildings. ������

ANALYSIS:
The Applicant and owner of the Cuttin' Up Salon, Linda Marie
Peixoto, is requesting Conditional Use Permit approval to allow the
operation of a massage establishment and use within the existing
beauty salon located at 6982 Village Parkway. Cuttin' Up Salon is a
full service skin and hair care facility which operates from 8:00 a.m.
to 9:00 p.m., Tuesday through Saturday. The Applicant has indicated
that Ms. Debra Meuser, a certified massage therapist, will conduct
massage therapy on a part-time basis between the hours of 9:00 a.m. to
7:00 p.m., Tuesday through Saturday.
Both the Applicant and the massage therapist must comply with the
Massage Establishments and Massage Services regulations and
requirements specified by Chapter 4.20 of the Dublin Municipal Code.
The regulations require a massage therapist to obtain a massage permit
from Dublin Police Services prior to conducting the massage therapy
business.
A separate massage permit from Police Services is required for
the premises on which the operation of a massage establishment is to
be conducted. As a condition of approval of Draft Resolution, Exhibit
B, the Applicant and massage therapist are required to obtain the
necessary massage permits from Dublin Police Services prior to
establishment of the massage services use. Both the massage therapist
and the Applicant have already applied for massage permits with Police
Services.
The proposed project, as conditioned, is in compliance with the
Dublin Zoning Ordinance and General Plan and has been reviewed by
other City departments and government agencies. The project is also
consistent and compatible with the surrounding commercial and personal
service type uses especially the skin and hair care facility in which
the use will be located. A massage establishment is considered a
personal service type use in the C-2-B-40 Zoning district, since it
primarily provides a personal improvement or appearance type service.
Staff recommends approval of the Conditional Use Permit request
to allow a massage establishment and use, subject to the conditions of
approval specified in the Draft Resolution, Exhibit B.
RECOMMENDATIONS:
FORMAT: 1) Open public hearing and hear Staff presentation.
2) Take testimony from Applicant and the public.
3) Question Staff, Applicant and the public.
4) Close public hearing and deliberate.
5) Adopt Draft Resolution Exhibit B approving PA 94-046
Cuttin' Up Salon Massage Establishment Conditional Use
Permit, or give Staff and Applicant direction and
continue the matter.
ACTION: Staff recommends that the Planning Commission adopt Draft
Resolution Exhibit B approving the Conditional Use Permit
for PA 94-046 Cuttin' Up Salon Massage Establishment.

A RESOLUTION OF THE PLANNING COMMISSION
OF THE CITY OF DUBLIN
APPROVING PA 94-046 CUTTIN' UP SALON MASSAGE ESTABLISHMENT CONDITIONAL
USE PERMIT TO ALLOW THE OPERATION OF A MASSAGE ESTABLISHMENT WITHIN AN
EXISTING BEAUTY SALON FACILITY LOCATED AT 6982 VILLAGE PARKWAY
WHEREAS, Linda Marie Peixoto, Applicant and owner of Cuttin' Up
Salon, requested approval of a Conditional Use Permit to allow the
operation of a massage establishment use within the existing beauty
salon, located at 6982 Village Parkway; and
WHEREAS, the Planning Commission held a public hearing on said
application on November 7, 1994; and
WHEREAS, proper notice of said public hearing was given in all
respects as required by law; and
WHEREAS, the application has been reviewed in accordance with the
provisions of the California Environmental Quality Act (CEQA) and was
found to be Categorically Exempt under Section 15301, Class 1 of the
State CEQA Guidelines; and
WHEREAS, the Staff Report was submitted recommending that the
application be conditionally approved; and
WHEREAS, the Planning Commission did hear and consider all said
reports, recommendations and testimony hereinabove set forth.
NOW, THEREFORE, BE IT RESOLVED THAT THE Dublin Planning
Commission does hereby find that:
A. The proposed project will serve a public need by providing
massage therapy services to the general public in the City of
Dublin.
B. The proposed use will be properly related to other land uses and
transportation and service facilities in the vicinity, as the
proposed use will be compatible when compared to the type and
nature of operations typically found in the neighborhood.
C. The proposed use, under all circumstances and conditions of this
particular case, will not materially adversely affect the health
or safety of persons residing or working in the vicinity, or be
materially detrimental to the public welfare or injurious to
property or improvements in the neighborhood, as all applicable
regulations will be met.
D. The proposed use will not be contrary to the specific intent
clauses or performance standards established for the District in
which it is to be located.

E. The approval of the Conditional Use Permit will be consistent
with the Dublin General Plan and the Downtown Specific Plan.
BE IT FURTHER RESOLVED THAT THE Dublin Planning Commission does
hereby conditionally approve PA 94-046 Cuttin' Up Salon Massage
Establishment Conditional Use Permit application as generally depicted
by materials labeled Exhibit A, consisting of 3 sheets, stamped
approved and on file with the Dublin Planning Department, subject to
the following conditions:
CONDITIONS OF APPROVAL:
Unless stated otherwise, all Conditions of Approval shall be complied
with prior to the issuance of building permits or establishment of
use, and shall be subject to Planning Department review and approval.
The following codes represent those departments/agencies responsible
for monitoring compliance of the conditions of approval. [PL1
Planning, [B1 Building. [POl Police, [PWI Public Works, [ADM1
Administration/City Attorney, [FIN] Finance, [FI Dougherty Regional
Fire Authority, [DSR1 Dublin San Ramon Services District, [C01 Alameda
County Department of Environmental Health.
1. This approval is to allow a massage establishment and massage
service use within an existing beauty salon located at 6982
Village Parkway. The location of the massage service and use
shall be as shown on the approved plans labeled Exhibit A. [PL]
2. Prior to establishing the use, the Applicant and the massage
therapist shall obtain massage permits from Dublin Police
Services and shall comply with the massage requirements specified
in Chapter 4.20 of the Dublin Municipal Code. [PO, PL]
3. Prior to establishing the use, the Applicant and massage
therapist shall submit evidence to the Planning Department that
the permits specified in Condition #2 have been obtained. [PL]
4. The Applicant and massage therapist shall comply with all
applicable regulations and requirements of the Building
Inspection Department, Dougherty Regional Fire Authority and
Dublin Police Services. [B, F, PO]
5. All activities associated with the massage establishment use and
the existing salon use shall be conducted entirely within the
enclosed building. [PL]
6. The Applicant shall control all business activity so as not to
create a public or private nuisance to the existing or
surrounding businesses. [PL, PO]
7. On an annual basis, this Conditional Use Permit approval shall be
subject to Zoning Investigator review and determination as to the
compliance with the Conditions of Approval. [PL]

8. This approval shall become null and void in the event the
approved use ceases to operate for a continuous one-year period.

9. This permit shall be revocable for cause in accordance with
Section 8-90.3 of the Dublin Zoning Ordinance. Any violation of
the terms or conditions of this permit may be subiect to the
issuance of a citation. [PL]

Item 4. A therapeutic massage facility that will provide massage services for our existing patrons,for chiropractic referrals,
and local residents dedicated to exercise and health maintenance plans such as body building,walking,and jogging.
Item 4a.The public need for such services has already been established by virtue of the existence of several such massage
facilities that exist within the several city blocks contiguous with the subject property,one of which is The Hair Emporium.
Additionally, therapeutic massage services can provide collateral support for chiropractic services also located in the
immediate area, one being the Village Chiropractic Clinic.
As the negative effects of stress on the physical and emotional well-being of individuals are increasingly understood,the need
for services such as massage,which can reduce these effects,will become increasingly important,especially in our high stress
society.
Lastly,our present clientele have requested that we make these services available in much the same way that other salons are
providing:holistic and comprehensive services for all beauty and health needs at one convenient location.
Item 4b. The present C-2 B-40 zoning allows for such services to be provided, and indeed,the mix of similar existing local
business exhibits robust economic health. The present land uses were zoned with public transportation already in place.
Parking is more than ample and in accordance with present code requirement.
We feel that the subject service will directly support and compliment the neighboring service facilities. A partial list
of existing services is as follows:

Item 4c.The subject services combine the techniques of physical manipulation of soft tissue {muscles},combined with the

or other federal and state requirements. No medicines,toxic substances,or any other product that could be injurious to
health are associated with the service,nor would they be used.
Our salon is a full service beauty and hair facility,and presently employs three full time employees and one part-time
manicurist. Presently,our hours are from 8:00 a.m.to 9:00 p.m.

ANALYSIS
Harrison's Marine Centers is requesting an additional 1-year
extension of time to Conditional Use Permit PA 94-003 , which was
approved by the Planning Commission on February 8, 1994, and will
expire on February 17, 1995. The owners are requesting this
additional time period in order to continue their search for a
permanent location for a new facility within the City of Dublin.
Condition #2 of Resolution No. 94-07, specifies that the approval
of the Conditional Use Permit may be extended on a yearly basis by the
Planning Commission upon the determination that the conditions of
approval remain adequate.
Staff reviewed the existing site with Dublin Police Services for
any safety or security issues or concerns. Dublin Police Services
indicated that the overall layout of the facility has made the site
highly visible from Dougherty Road and Dublin Boulevard during patrol.
Staff conducted a site inspection and determined that the use is in
compliance with the conditions of approval of Resolution No. 94-07 .
Furthermore, Staff has determined that the conditions of approval
remain adequate.
The owner is requesting the Planning Commission approve the
Harrison' s Marine Centers request for an additional 1-year time
extension of their Conditional Use Permit.
RECOMMENDATIONS:
For a temporary use, the owners of Harrison's Marine have done an
exceptional job of improving and maintaining the site and have been
operating the business in compliance with the Zoning Ordinance. Staff
recommends that the Planning Commission determine that the conditions
of approval remain adequate and approve the owners request for the
additional extension of time.

the existing Conditional Use Permit, which expires in February of 1995, for an additional
period of one year. Due to our popularity at this location, we are in the process of
extending our original lease agreerrent with the property owner. In fact, all terms of our
lease extension have been negotiated. However, they are conditioned upon obtaining an

A RESOLUTION OF THE PLANNING COMMISSION
OF THE CITY OF DUBLIN
APPROVING PA 94-003 HARRISON'S MARINE CENTER CONDITIONAL USE
PERMIT REQUEST AT 5933 DOUGHERTY ROAD
WHEREAS, Michael St. John, representing Harrison's Marine Center,
is requesting Conditional Use Permit and Site Development Review
approval to allow the establishment of a boat sales and storage lot on
the ±.87 acre parcel located at 5933 Dougherty Road; and
WHEREAS, the Planning Commission held a public hearing on said
application on February 7, 1994; and
WHEREAS, proper notice of said public hearing was given in all
respects as required by law; and
WHEREAS, the application has been reviewed in accordance with the
provisions of the California Environmental Quality Act (CEQA) and was
found to be Categorically Exempt under Section 15301, Class 1(a) of the
State CEQA Guidelines; and
WHEREAS, the Staff Report was submitted recommending that the
application be conditionally approved; and
WHEREAS, the Planning Commission did hear and consider all said
reports, recommendations and testimony hereinabove set forth.
NOW, THEREFORE, BE IT RESOLVED THAT THE Dublin Planning Commission
does hereby find that:
A. The proposed boat sales and storage lot use provides for the public
need by offering a range of services for the community.
B. The proposed use will be properly related to other land uses and
transportation and service facilities in the vicinity, as the
proposed use will be compatible when compared to the type and
nature of operations typically found in general commercial district
areas and the uses currently in operation in the immediate
vicinity.
C. The proposed use will not materially adversely affect the health or
safety of persons residing or working in the vicinity, or be
materially detrimental to the public welfare or injurious to
property or improvements in the neighborhood, as all applicable
regulations will be met.
D. The proposed use will not be contrary to the specific intent
clauses or performance standards established for the District in
which it is to be located in that conditions have been applied to
ensure conformance with the applicable zoning regulations, and the
use is -consistent with the character of the surrounding area as
well as the retail business district.

E. The approval of the Conditional Use Permit will be consistent with
the Dublin General Plan.
BE IT FURTHER RESOLVED THAT THE Dublin Planning Commission does
hereby conditionally approve PA 94-003 Harrison's Marine Center
Conditional Use Permit application as generally depicted by materials
labeled Exhibit A, stamped approved and on file with the Dublin Planning
Department, subject to the approval of the related Site Development
Review and to the following conditions:
CONDITIONS OF APPROVAL:
Unless stated otherwise, all Conditions of Approval shall be complied
with prior to the issuance of building permits or establishment of use,
and shall be subject to Planning Department review and approval. The
following codes represent those departments/agencies responsible for
monitoring compliance of the conditions of approval. fPLI Planning, 1131

1. PA 94-003 Harrison's Marine Center Conditional Use Permit is
approved for a boat sales and storage lot. This approval shall
generally conform to the plans labeled Exhibit A, stamped approved
and on file, dated received by the Planning Department
January 21, 1994. [PL]
2. This approval shall be valid for a period of one-year, until
February 17, 1995. This approval may be extended on a yearly basis
(Applicant must submit written request for the extension prior to
the expiration date) by the Planning Commission upon the
determination that the conditions of approval remain adequate to
assure that the above stated Findings of Approval will continue to
be met. Failure to exercise the approval or to make substantial
construction progress, within 6 months from the effective date of
approval, in accord with an approved building permit for the
project will cause the permit to become null and void. [PL]
3. With the exception of storage of boats and water crafts and minor
vehicle preparat
ion work, no exterior demonstrations, displays,

services, engine repair work, or other activities shall occur in

4. The Applicant shall obtain the proper licenses and permits through
the State Board of Equalization prior to establishment of use.
Said licenses and permits shall be displayed at all times during

5. The Applicant shall work with the Dublin Police Services Department
to establish and maintain an effective security program. [PL, PO)
6. The Applicant shall be responsible for clean-up and disposal of
project related trash to maintain a clean, litter-free site. [FL]
7. No loudspeakers or amplified music shall be permitted outside the
enclosed building. [FL)

8. The Applicant shall control activity so as not to create a public
or private nuisance to the existing or surrounding businesses and

9. All signs shall be subject to the requirements of the Sign
Regulations within the Zoning Ordinance. [PL)
10. On an annual basis, this Conditional Use Permit approval shall be
subject to Zoning Investigator review and determination as to the
compliance with the Conditions of Approval. [PL]
11. This permit shall be revocable for cause in accordance with Section
8-90.3 of the Dublin Zoning Ordinance. Any violation of the terms
or conditions of this permit shall be subject to citation. [PL]
