ENVIRONMENTAL REVIEW: This project has been found to be Categorically Exempt
from CEQA under Section 15311, Class 11 (a) of the
California Environmental Quality Act Guidelines. This
use consists of placement of an on-premise sign
accessory to an existing commercial facility.
NOTIFICATION: Public Notice of the February 20, 1990, hearing was
published in a local newspaper, mailed to adjacent property
owners, and posted in public buildings.
ANALYSIS:
This item was continued from the Planning Commission meeting of February 20,
1990, in order for the Applicant to resubmit a new site plan to locate a 35
foot tall freestanding sign on the site in compliance with the Sign Ordinance.
At that meeting the Commission denied the Applicant's request for a Variance
to locate a freestanding sign within the required 10 foot sideyard setback
area.
The proposed freestanding sign will be double-faced with a total of 275 square
feet of sign area, (137.5 square feet per face), as indicated on plans marked
Exhibit A. The Applicant is requesting the freestanding sign be located
within a proposed planter area (Exhibit A) using a single vehicle display
parking space. The sign will be setback 50 feet from the front property line
and 11 feet from the east side property line. The sign will not be located
within the required setback areas.
The parking requirements for the site will continue to be met, in that the
site has a total of 379 parking spaces (the Zoning Ordinance requires 79
spaces). The Applicant will not be using any additional required parking
spaces to construct the landscaped planter area in which to erect the sign.
Staff recommends approval of the Conditional Use Permit request to erect and
maintain a 35 foot tall freestanding sign on the site. The proposed sign is
in compliance with the Sign Ordinance concerning the height, sign area and
setback requirements.
Staff has also identified four other businesses on Scarlett Court that have 35
foot tall freestanding signs with Conditional Use Permit approvals. These are
the U-Haul Truck Rental at 6365 Scarlett Court; the Nissan Dealership at 6031
Scarlett Court; the Ryder Mini Storage at 6005 Scarlett Court and the 84
Lumber Company at 5777 Scarlett Court. None of these signs are within the
required setback areas.
RECOMMENDATION:
FORMAT: 1) Open public hearing and hear Staff presentation.
2) Take testimony from Applicant and the public.
3) Question Staff, Applicant and the public.
4) Close public hearing and deliberate.
5) Adopt Resolution relating to PA 90-001, or give Staff and
Applicant direction and continue the matter.

ACTION: Staff recommends that the Planning Commission adopt the draft
resolution (Exhibit B) approving the Conditional Use Permit for
PA 90-001.

RESOLUTION NO. 90 -
A RESOLUTION OF THE PLANNING COMMISSION
OF THE CITY OF DUBLIN
APPROVING PA 90-001 CONDITIONAL USE PERMIT REQUEST FOR A FREESTANDING SIGN AT
LEW DOTY CADILLAC/OLDSMOBILE DEALERSHIP AT 6301 SCARLETT COURT
WHEREAS, Wade McClure, representing Lew Doty Cadillac/Oldsmobile filed an
application for a Conditional Use Permit to locate a new freestanding sign on
the site at 6301 Scarlett Court; and
WHEREAS, the Planning Commission did hold a public hearing on said
application on February 20, 1990, and March 5, 1990; and
WHEREAS, proper notice of said public hearing was given in all respects
as required by law; and
WHEREAS, the application has been reviewed in accordance with the
provisions of the California Environmental Quality Act (CEQA) and has been
found to be categorically exempt under Section 15311, Class 11(a); and
WHEREAS, the Staff Report was submitted recommending the application be
conditionally approved; and
WHEREAS, the Planning Commission did hear and consider all said reports,
recommendations and testimony hereinabove set forth.
NOW, THEREFORE, BE IT RESOLVED THAT THE Dublin Planning Commission does
hereby find:
1. The use is required by the public need in that it provides business
identification to the general public for an auto dealership facility in
the City of Dublin.
2. The use will be properly related to other land uses and transportation
and service facilities in the vicinity, as it will be commensurate with
the present use of properties in the industrial zoning district.
3. The use, if permitted under all of the circumstances and conditions of
this particular case, will not materially affect adversely the health or
safety of persons residing or working in the vicinity or be materially
detrimental to the public welfare or injurious to property or
improvements in the area as all applicable regulations will be met.
4. The use will not be contrary to the specific intent clauses or
performance standards established for the district in which it is to be
located. The use is consistent with the intent of the zoning district
and with the General Plan.
BE IT FURTHER RESOLVED THAT THE Dublin Planning Commission does hereby
conditionally approve PA 90-001 Lew Doty Cadillac/Oldsmobile Freestanding sign
as shown on the plans labeled Exhibit A, submitted to the Planning Department
on February 23, 1990, and subject to the following conditions of approval:

CONDITIONS OF APPROVAL:
Unless stated otherwise, all Conditions of Approval shall be complied with
prior to the issuance of building permits or establishment of use, and shall be
subject to Planning Department review and approval.
1. The double faced freestanding sign shall generally conform to the
following dimensions:
a. Maximum Sign Area: 275 square feet (137.5 square feet per face)
b. Maximum Sign Height: 35 feet
c. Front Setback: 50 feet
d. Side Yard Setback: 10 feet
The sign shall be located within the landscaped planter area as indicated
by Exhibit A.
2. Prior to the issuance of building permits, the Applicant shall submit
landscape and irrigation plans subject to Planning Director review and
approval.
3. Final landscape plan shall indicate general plant pallet with common and
botanical names and container size and growth rate. Final landscape plan
shall include planting and staking detail.
4. The Applicant and/or property owner shall sign and submit to the Planning
Department a copy of the City of Dublin landscape maintenance agreement
(see Attachment to Exhibit B).
5. All landscaping within the planter area shall be maintained in a viable
and well kept manner at all times.
6. Within 30 days of the approval of this use permit or prior to the
installation of said freestanding sign, which ever occurs first, the
Applicant or Property Owner shall remove the existing "CADILLAC-
OLDSMOBILE" window signs from the front side of the building. Any new or
existing signs on the site shall conform to the City of Dublin Sign
Ordinance.
7. All building permits for the proposed freestanding sign shall be secured
and construction commenced within six (6) months of the date of approval
of this use permit.
8. This approval shall become null and void, in the event the approved use
ceases to operate for a continuous one-year period.
9. This use shall be subject to Zoning Investigator review and determination
as to compliance with the conditions of approval.
10. This permit shall be revocable for cause in accordance with Section 8-
90.3 of the Dublin Zoning Ordinance. Any violation of the terms or
conditions of this permit shall be subject to citation.

STANDARD PLANT MATERIAL, IRRIGATION SYSTEM AND MAINTENANCE
AGREEMENT
I (property owner) do hereby
agree that all plants (trees, shrubs and ground cover) will be
installed in accordance with the City of Dublin's approved
landscape plan for (name of
project) located at
• (address). All plants will be replaced in kind as per the
approved plan at such time as they are found to be missing,
diseased, damaged, or dead, for at least one (1) year from the
date of their installation.
I further agree that all plants will henceforth be irrigated,
fertilized, weeded and tended on a regular basis such that they
will maintain a healthy and weedfree appearance.
I further agree that the irrigation system will be installed
according to the irrigation plans as approved by the City of
Dublin, and that said system will be kept in good working order
for at least one (1) year from the date of the landscaping
installation.
This agreement is binding against this and all property owners
of record.
