ZONING HISTORY:
September 19, 1978: Alameda County Board of Supervisors approved
PD, Planned Development 1362nd Zoning Unit permitting banks,
savings and loan or restaurant uses on Sites A and B (APN 941-
1550-4 and 941-1550-3), and permitting business, administrative
and professional office uses on Site C (APN 941-1550-5).
Condition #14 of 1362nd Zoning Unit requires Planning Commission
approval of site design, landscaping, parking layout,
architectural style, exterior building materials, exterior
colors, floor plans, lighting and signing. Condition #15
requires that the architectural style of the structure be similar
to the style of the office center.
July 16, 1979: Alameda County Planning Commission approved plans
for Shakey's Pizza Restaurant.
January 20, 1986: Dublin Planning Commission approved Resolution
No. 85-102 to allow a recreational facility (dance floor) in an
existing restaurant.
APPLICABLE REGULATIONS:
Section 8-94.0 states that conditional uses must be analyzed to
determine: 1) whether or not the use is required by the public need;
2) whether or not the use will be properly related to other land uses,
transportation and service facilities in the vicinity; 3) whether or
not the use will materially affect the health or safety of persons
residing or working in the vicinity; and 4) whether or not the use
will be contrary to the specific intent clauses or performance
standards established for the district in which it is located.
ENVIRONMENTAL REVIEW: Categorically Exempt, Class 1, Section 15301
NOTIFICATION: Public Notice of the July 2, 1990 hearing was published
in the local newspaper, mailed to adjacent property owners, and posted
in public buildings.
ANALYSIS:
The Applicant is requesting approval of a Conditional Use
Permit/Site Development Review to expand an existing patio on the west
side of the restaurant at 11891 Dublin Boulevard. The restaurant is
currently vacant and is located within a Planned Development District
which requires Conditional Use Permit approval for outdoor uses.
Although a portion of the proposed patio area was previously used for
outdoor seating, the patio was never approved for such use. A wooden
fence around the existing patio area was recently removed.
The total area of the patio would be 2,035 square feet (the
existing patio area covers 720 square feet and the additional patio
area would cover 1,315 square feet). The patio area would provide
seating for 56 people. The seating capacity within the existing

restaurant is 124 (the total seating capacity of the restaurant
including the patio, would be 183).
A new 6 foot high fence would be constructed around the perimeter
of the patio enclosure. The bottom of the fence would be constructed
of T1-11 panels painted to match the building. The top of the fence
would consist of clear Plexiglass panels.
The existing parking areas on the east and south side of the
building would be restriped to provide a total of 22 parking spaces,
including 19 standard stalls and 3 handicapped spaces. The Applicant
has obtained approval from Staff to install a new handicap ramp
between the parking area on the east side of the building and the
building's main entrance. The Applicant has also obtained approval
from Staff and is currently constructing a small addition on the south
side of the building for the trash enclosure and manager's office. In
addition, a new Sign Program for this site was recently approved by
Staff, consisting of wall signs and neon tubing.
Adequate on-site parking is provided because the subject parcel
is located adjacent to the Heritage office complex and shares a
reciprocal ingress, egress and parking easement over the adjacent
property. There are a total of 483 existing parking spaces within the
center (excluding the subject parcel and the adjacent First Christian
Church site) compared to 320 required spaces. Thus, there are a total
of 163 excess parking spaces in the center.
The existing restaurant, including the outdoor seating area,
requires a total of 58 parking spaces (one space for each 60 square
feet of floor area accessible to the public) compared to a total of 22
proposed parking spaces on the subject parcel. The 36 additional
required spaces are available within the Heritage office complex.
In conjunction with the construction of the patio area, the
Applicant proposes to install new landscaping around the perimeter of
the patio fence. The new plantings would consist of a 15 gallon white
alder (Alnus Rhonbifolia) tree and 23 five gallon evergreen
(Pittosporun Penuifolium) shrubs. The two existing trees within the
proposed patio area would remain.
It should be noted that the City will be widening Dublin
Boulevard in front of the restaurant in order to add a new right turn
lane. This will require the removal of most of the existing
landscaping near the northeast corner of the site between the existing
restaurant and Dublin Boulevard.
Finally, the Applicant requests approval to repaint the building.
Condition #14 of 1362nd Zoning Unit requires Planning Commission
approval of the exterior colors. The building siding would be painted
grey and the trim would be red and yellow. Color elevations and color
samples will be presented at the meeting.
In addition, the Applicant is proposing to paint the existing
pitched roof on the north, east and west sides of the restaurant. The
existing blue asphalt shingle would be painted green. However, the

paint on the asphalt shingles will peel faster than the paint on the
building walls, exposing the blue shingles under the green paint.
Thus, the conditions of approval would require the Applicant to
replace the existing shingles with new green asphalt shingles rather
than painting them green as proposed.
The proposed project has been reviewed by other City departments
and applicable conditions of approval are included in the draft
resolution. Staff is recommending approval of the Conditional Use
Permit and Site Development Review subject to conditions of approval .
RECOMMENDATION:
FORMAT: 1) Open public hearing and hear Staff presentation.
2 ) Take testimony from Applicant and the public .
3) Question Staff, Applicant and the public .
4 ) Close public hearing and deliberate.
5) Adopt resolution relating to PA 90-026 , or give
Staff and Applicant direction and continue the matter.
ACTION: Staff recommends that the Planning Commission adopt
resolutions (Exhibit B and C) approving PA 90-026

A RESOLUTION OF THE PLANNING COMMISSION
OF THE CITY OF DUBLIN
APPROVING PA 90-026 FRANKIE, JOHNNIE & LUIGI TOO CONDITIONAL USE
PERMIT TO CONSTRUCT AN ENCLOSED PATIO FOR OUTDOOR RESTAURANT SEATING
AT AN EXISTING RESTAURANT LOCATED AT 11891 DUBLIN BOULEVARD
WHEREAS, Chuck Dittmar Construction, representing D'Ambrosio
Bros. Investment Co., filed an application for a Conditional Use
Permit and Site Development Review to construct an enclosed patio for
outdoor seating in an existing restaurant at 11891 Dublin Boulevard;
and
WHEREAS, Section 8-31.8 of the Dublin Zoning Ordinance requires
Conditional Use Permit approval for minor modifications of the Land
Use and Development Plan in a PD District; and
WHEREAS, the Planning Commission did hold a public hearing on
said application on July 2, 1990; and
WHEREAS, proper notice of said public hearing was given in all
respects as required by law; and
WHEREAS, this application has been reviewed in accordance with
the provisions of the California Environmental Quality Act and has
been found to be Categorically Exempt, Class 1, Section 15301; and
WHEREAS, the Planning Commission finds that the Conditional Use
Permit will not have a significant environmental impact; and
WHEREAS, the Staff Report was submitted recommending the
Conditional Use Permit application be approved; and
WHEREAS, the Planning Commission did hear and consider all said
reports, recommendations and testimony herein above set forth; and
WHEREAS, the proposed outdoor patio, if conditionally approved,
is appropriate for the subject property in terms of being compatible
to existing land uses in the area and will not overburden public
services.
NOW, THEREFORE, BE IT RESOLVED THAT THE Dublin Planning
Commission hereby finds:
a) The modification of the use of the subject restaurant to
allow outdoor eating serves the public need by expanding the range and
diversity of available restaurant facilities.

b) The uses will be properly related to other land uses, and
transportation and service facilities in the vicinity, as the proposed
peak hour uses of the restaurant can be anticipated to be during lunch
and evening hours rather than at normal peak-hour business periods,
and therefore will not be in conflict with existing office uses in the
adjoining office complex.
c) The uses will not materially adversely affect the health or
safety of persons residing or working in the vicinity, or be
materially detrimental to the public welfare or injurious to property
or improvements in the neighborhood, as all applicable regulations
will be met.
d) The uses will not be contrary to the specific intent clauses
or performance standards established for the District in which it is
to be located, as the proposed uses will be compatible with the
adjoining uses.
e) The approval of the Conditional Use Permit will be
consistent with the Dublin General Plan.
BE IT FURTHER RESOLVED that the Planning Commission does hereby
conditionally approve PA 90-026 Conditional Use Permit application as
shown by materials labeled Background Attachment A on file with the
Dublin Planning Department, subject to the Site Development Review
approval Resolution No. and to the following conditions:
CONDITIONS OF APPROVAL
Unless stated otherwise, all Conditions of Approval shall be complied
with prior to issuance of building permits or establishment of use,
and shall be subject to Planning Department review and approval.
1. The approval is for an enclosed patio for outdoor dining
containing 2,035 square feet.
2. No loudspeakers or amplified music shall be permitted
outside of the enclosed building.
3. All activities shall be controlled so as not to create a
nuisance to the existing and/or future adjoining businesses.
4. The Applicant/Property Owner shall, on a continuous basis,
maintain the outdoor patio dining area and the site in a litter free
condition. The Applicant shall be responsible for cleaning up and
disposing of the restaurant generated trash and litter on-site and
off-site within the neighborhood.
5. This approval supersedes all other conditional use permit
approvals for the site.

6 . This approval shall become null and void, in the event the
approved use ceases to operate for a continuous one-year period.
7 . This permit shall be revocable for cause in accordance with
Section 8-90 . 3 of the Dublin Zoning Ordinance. Any violation of the
terms of conditions of this permit shall be subject to citation.
8 . On an annual basis, these uses shall be subject to Zoning
Investigator review and determination as to compliance with the
Conditions of Approval .

which would not meet the specific intent clauses or performance
standards set forth in the Zoning Ordinance and which are not
consistent with their environmental setting.
c) The approval of the project as conditioned is in the best
interest of the public health, safety and general welfare.
d) General site considerations, including site layout,
orientation, and the location of buildings, vehicular access,
circulation and parking, setbacks, height, public safety and similar
elements have been designed to provide a desirable environment for the
development.
e) General architectural considerations, as modified by the
conditions of approval, including the architectural relationship with
the site and other buildings, building materials and colors, and
similar elements have been incorporated into the project in order to
insure compatibility of this development with its design concept and
the character of adjacent buildings and uses.
BE IT FURTHER RESOLVED THAT THE Dublin Planning Commission does
hereby conditionally approve PA 90-026 Site Development Review
application as shown by materials labeled Exhibit A (Site Plan,
Elevations and Landscape Plan dated received June 11, 1990) on file
with the Dublin Planning Department, subject to the approval of the
related Conditional Use Permit and to the following conditions:
CONDITIONS OF APPROVAL
Unless stated otherwise, all Conditions of Approval shall be complied
with prior to the issuance of building and grading permits and
establishment of use, and shall be subject to Planning Department
review and approval.
i. Development shall be generally as shown on the plans
submitted with the application dated received by the Dublin Planning
Department on June 11, 1990. Development shall be subject to final
review and approval by the Planning Director prior to the issuance of
a building permit or establishment of the requested use and shall be
subject to the conditions listed below.
2. A minimum of twenty-two (22) on-site parking spaces shall be
provided. Continuous concrete curbing is required for all parking
stalls. All parking spaces shall be double striped.
3. The Applicant shall comply with the City of Dublin Site
Development Review Standard Conditions and City of Dublin Non-
Residential Security Requirements (attached).

ARCHITECTURAL
4. Exterior colors and materials shall be subject to final
review and approval by the Planning Director. The existing blue
asphalt shingles on the pitched roof on the north, east and west sides
of the building shall be replaced with new green shingles.
PUBLIC WORKS
5. The Applicant shall comply with all applicable Public Works
Department requirements, including but not limited to, the following:
a. All missing street trees on Dublin Boulevard shall be
replaced in accordance with the street tree details.
b. The Applicant shall be responsible for correcting
deficiencies in the existing frontage improvements to the
satisfaction of the City Engineer. Any relocation of
improvements or public facilities shall be accomplished at no
expense to the City.
c. An encroachment permit shall be secured from the City
Engineer for any work done within the public right-of-way.
d. The Applicant shall repair damaged pavement areas as
directed by the City Engineer.
e. The flow line of all asphalt paved areas carrying water
shall be slurry sealed at least three (3) feet on either side of
the center of the swale.
f. All existing catch basins not against curb and gutter shall
have a three (3) foot concrete apron installed around all sides
of the inlet.
OTHER DEPARTMENTS
6. The Applicant shall comply with all requirements of the
Dublin Building Department, Dublin Police Department and Dougherty
Regional Fire Authority.
LANDSCAPING AND IRRIGATION PLANS
7. A detailed landscape and irrigation plan (at 1 inch = 20
feet or larger), along with a cost estimate of the work and materials
proposed, shall be submitted for review and approval by the Planning
Director. Landscape and irrigation plans shall be prepared and signed
by a licensed landscape architect.
8. The Developer/Owner shall sign and submit a copy of the City
of Dublin Landscape Maintenance Agreement (attached).
9. Planting and maintenance specifications shall be prepared
and submitted to the Planning Director for review and approval.

LIGHTING
10. Exterior lighting shall be of a design and placement so as
not to cause glare onto Dublin Boulevard or onto adjoining properties.
Lighting used after daylight hours shall be adequate to provide for
security needs. Photometric and lighting plan for the site shall be
submitted to the Planning Department and the Dublin Police Services
for review and approval prior to the issuance of building permits.
MISCELLANEOUS
11. The Applicant shall comply with all applicable building code
requirements, including Title 24 relating to handicapped parking
requirements.
12. This permit shall be revocable for cause in accordance with
Section 8-90.3 of the Dublin Zoning Ordinance. Any violation of the
terms of conditions of this permit shall be subject to citation.
13. To Apply for a building permit, the Applicant shall submit
six (6) sets of construction plans to the Building Department for plan
check. Each set of plans shall have attached an annotated copy of
this Resolution of Approval. The notations shall clearly indicate how
all conditions of approval will be complied with. Construction plans
will not be accepted without the annotated resolutions attached to
each set of plans. The Applicant will be responsible for obtaining
the approvals of all participating non-City agencies prior to the
issuance of building permits.

NON-RESIDENTIAL SECURITY REQUIREMENTS
City Ordinance No. 21-89
1988 Building Code
Section 4101
1. Doors. Exterior doors which are located at the rear, or side, or away from the
primary entrance shall be solid doors with no glazing and shall be installed in
metal frames. Exterior wood doors shall be solid wood construction 1 3/4"
thick or hollow metal doors.
2. Locking devices. Exterior swinging doors which are exit doors as setforth in
Chapter 33 shall have cylinder dead-bolt locks which shall be openable without
the use of key, special effort, or knowledge. In Group B occupancies, a double
cylinder dead-bolt lock may be used on the main exit door if there is a readily
visible, durable sign on, or adjacent, to the door stating, "this door to
remain unlocked during business hours." The sign shall be in letters not less
than 1 inch high on contrasting background. When unlocked the single door and
both leaves of a pair of doors shall be free to swing without operation of any
latching device. Doors which are not exit doors shall have the inactive leaf
secured with flush-bolts at the top and bottoms. The bolts shall be hardened
steel 1/4" minimum diameter and shall engage a metal strike plate to, a minimum
depth of 3/8 inch.
The dead bolts shall be hardened steel and shall have a minimum of a one inch
throw. If the cylinder of the lock protrudes from the face of the door it
shall be fitted with a cylinder ring geared so that it cannot be griped with
pliers or other wrenching devices.
Vehicle door, overhead doors, and sliding doors shall be secured with metal to
metal locking devices which prevent the door from opening.
3. Strike plates. Strike plates for wood jambs shall be the high security type
and shall be secured with a minimum of two wood screws 3" long which shall
engage the door studs.
4. Jambs. Inswinging doors with wood jambs shall have rabitted jambs. The jambs
on the strike side shall have solid shims above and below the strike plates and
the opposite jamb shall have solid shims at the level of the strike plate.
Both door studs shall be reinforced with horizontal solid blocking at the
approximate height of strike.
5. Hinges. Exterior doors shall have non-removable hinge pins.
6. Sliding glass doors. Sliding glass doors shall comply with Chapter 54.
Sliding glass doors shall be fitted with a locking device that shall engage the
strike sufficiently to prevent its being disengaged by any possible movement of
the door within the space or clearances provided for installation and
operation. The bolt and strike shall be reinforced by hardened material so as
to prevent their separation by pulling, prying or similar attack. An auxiliary
locking device shall be installed on the door which may be a pin, lock, or
similar device of not less than 1/4" diameter. The pin shall be of hardened

material and engage the metal portion of the sliding door. The primary locking
device shall be operable by a keyed or code lock inside. Doors with 2 sliding
panels shall be locked at the meeting rails and shall have an auxiliary locking
device as described above.
8. Windows. All accessible windows which are not located at the front or main
entrance side of a non-residential building shall be made secure as follows:
a) Sliding glass windows shall be secured on the inside with a locking device
capable of withstanding prying or wrenching. An auxiliary lock shall be
installed on each sliding window that prevents movement in the sliding
track.
b) Louvered windows shall not be used within eight feet of ground level,
adjacent structures, or fire escapes.
c) Casement type windows shall be secured with a metal to metal locking device
contacting both frames of the window at the meeting edge. Auxiliary locks
such as a pin that penetrates both frame structures shall be installed on
casement and double hung windows.
d) Windows shall not be located within 40 inches of the locking device of any
door not located on the main entrance side of the non-residential building
unless the windows are glazed with 1/4" tempered glass.
9. Openable transoms. All exterior openable transoms exceeding 8 x 12 which are
not located on the front or main entrance side of a non-residential building
shall be protected with a steel grill and 1/4" minimum bars not more than 2" on
center or by a screen with 1/8" diameter wire mesh not more than 2" on center
mounted on the inside.
9. Roof openings. All skylights on the roof of a non-residential building shall
be protected by:
a) Iron bars 1/2 inch minimum diameter not more than 8" on center or;
b) A screen with 1/8" diameter wire mesh not more than 2" on center.
All roof access hatches of non-residential building shall be protected as
follows:
a) If the hatchway is of wooden material, it shall be covered on the inside
with at least 16 gauge sheet steel or its equivalent attached with screws at
6" o.c.;
b) The hatchway shall be secured from the inside with a slide bar or slide
bolts;
c) Outside hinges on all hatchway openings shall be provided with non-removable
pins when using pin-type hinges.
All air duct or air vent openings exceeding 8" x 12" on the roof or exterior
walls of any building or premise used for business purposes shall be secured by
covering the same with eitherof the following:
a) Iron bars of at least 1/2" round or 1" x 1/4" flat steel material, spaced no
more than 8" o.c. apart and securely fastened.

ZONING HISTORY:
On March 14, 1983, the Alameda County Zoning Administrator approved a
Variance application (V-6046) to allow the construction of 13,920+ square foot
office building with a reduced front yard setback (25 feet where 30 feet is
required) and a reduced sideyard setback (12 feet where 20 feet is required).
On April 4, 1973, the Alameda County Planning Director approved a Site
Development Review application (S-471) to allow the construction of a 13,920+
square foot office building with reduced front and side yards.
On April 3, 1989, the Planning Commission approved PA 88-076 Conditional
Use Permit for the expansion of a rental car business and temporary rental car
storage lot.
APPLICABLE REGULATIONS:
Section 8-49.2(g) of the Dublin Zoning Ordinance states that an
automobile storage or rental lot in C-2 zoning district is permitted subject
to approval of a Conditional Use Permit.
Section 8-94.0 states that conditional uses must be analyzed to
determine: 1) whether or not the use is required by the public need;
2) whether or not the use will be properly related to other land uses,
transportation and service facilities in the vicinity; 3) whether or not the
use will materially affect the health or safety of persons residing or working
in the vicinity; and 4) whether or not the use will be contrary to the
specific intent clauses or performance standards established for the district
in which it is located.
ENVIRONMENTAL REVIEW: This project has been found to be Categorically Exempt
from CEQA under Section 15301, Class 1 of the
California Environmental Quality Act Guidelines in
that the use consists of the operation of a rental car
business and temporary storage lot involving no
expansion of use beyond that previously existing.
NOTIFICATION: Public Notice of the July 2, 1990, hearing was published in
the local newspaper, mailed to adjacent property owners, and posted in
public buildings.
ANALYSIS:
The Applicant is requesting approval of a Conditional Use Permit to
operate a rental car business office and temporary rental car storage lot
located at 7000 Village Parkway.
The operation of the rental car business has not changed from the
previously approved Conditional Use Permit. Agency Rent-A-Car presently
occupies 533 square feet of office space within the 13,920+ square foot
building with 10 parking spaces used for vehicle storage. Business hours are
Monday through Thursday from 8:00 a.m. to 5:30 p.m., Friday from 8:00 a.m. to
6:00 p.m., and Saturday from 9:00 a.m. to 12:00 noon.

Activities associated with the business include administrative and
management duties typical of a rental car operation; telemarketing and
customer service; rental car pick up and delivery; and temporary storage of
rental cars. Overnight storage of vehicles on site will range from 3 to 10
vehicles per night. No washing or servicing of vehicles will occur at the
site.
The parking requirements for the site have not changed since approval of
the original Conditional Use Permit, PA 88-076. Adequate on-site parking for
the storage of rental cars and the rental car office is provided. Fifty-four
(54) parking spaces are required for the site, and a total of 70 parking
spaces is available for use by all tenants occupying the entire office
building. Ten (10) spaces at the western portion of the property, adjacent to
Interstate 680 will be used for rental car storage.
In the past year, Agency Rent-A-Car has operated their business in
compliance with the previous Conditional Use Permit requirements, and no
zoning violations have occurred. The application has been reviewed by the
applicable public agencies and City departments, and is in compliance with the
City's Zoning Ordinance.
RECOMMENDATION:
FORMAT: 1) Open public hearing and hear Staff presentation.
2) Take testimony from Applicant and the public.
3) Question Staff, Applicant and the public.
4) Close public hearing and deliberate.
5) Adopt Resolution approving PA 90-042, or give Staff and
Applicant direction and continue the matter.
ACTION: Staff recommends that the Planning Commission adopt the attached
resolution (Exhibit B) approving the Conditional Use Permit,
PA 90-042 for Agency Rent-A-Car.

A RESOLUTION OF THE PLANNING COMMISSION
OF THE CITY OF DUBLIN
APPROVING PA 90-042 AGENCY RENT-A-CAR CONDITIONAL USE PERMIT REQUEST
TO OPERATE A RENTAL CAR BUSINESS AND TEMPORARY RENTAL CAR STORAGE LOT
AT 7000 VILLAGE PARKWAY
WHEREAS, Agency Rent-A-Car filed an application for a Conditional Use
Permit (PA 90-042) for the operation of a rental car business and temporary
rental car storage lot at 7000 Village Parkway; and
WHEREAS, the Planning Commission did hold a public hearing on said
application on July 2, 1990; and
WHEREAS, proper notice of said public hearing was given in all respects
as required by law; and
WHEREAS, the application has been reviewed in accordance with the
provisions of the California Environmental Quality Act (CEQA) and has been
found to be Categorically Exempt under Section 15301, Class 1; and
WHEREAS, the Staff Report was submitted recommending the application be
approved subject to conditions; and
WHEREAS, the Planning Commission did hear and consider all said reports,
recommendations and testimony hereinabove set forth.
NOW, THEREFORE, BE IT RESOLVED THAT THE Dublin Planning Commission does
hereby find:
a) The use is required to serve a public need in that it provides a
car rental service to the community.
b) The use will be properly related to other land uses and
transportation and service facilities in the vicinity in that daytime
activities will be commensurate with present use of properties in the
neighborhood.
c) The use, under all circumstances and conditions of this particular
case, will not materially affect adversely the health or safety of persons
residing or working in the vicinity, or be materially detrimental to the public
welfare or injurious to property or improvements in the neighborhood, in that
all applicable regulations will be met.
d) The use will not be contrary to the specific intent clauses or
performance standards established for the district in which it is to be located
in that the car rental business is an office use which is consistent with the
character of the commercial district.

BE IT FURTHER RESOLVED THAT THE Dublin Planning Commission does hereby
conditionally approve PA 90-042 Agency Rent-A-Car Conditional Use Permit as
shown on Exhibit A, plans prepared by Charles Huff Architect dated received May
31, 1990, on file with the Dublin Planning Department, subject to the following
conditions:
CONDITIONS OF APPROVAL:
Unless stated otherwise, all Conditions of Approval shall be complied with
prior to the issuance of building permits or establishment of use, and shall be
subject to Planning Department review and approval.
1) PA 90-042 Agency Rent-A-Car Conditional Use Permit is approved for
the operation of a rental car business and temporary rental car storage lot at
7000 Village Parkway. The activities associated with the business will be
limited to the following:
Rental car office operations including administrative and management
duties; telemarketing, and customer interface; rental car pick up and
delivery; and temporary storage of rental cars in the parking lot.
2) Agency Rent-A-Car occupancy shall be limited to the 533 square foot
tenant space at 7000 Village Parkway. Any expansion must be approved by the
Planning Department prior to the expansion taking place.
3) Temporary storage and parking of Agency Rent-A-Car vehicles shall
be within the designated parking area located in the rear western portion of
the site, per Exhibit A, and be limited to a maximum of 10 cars at any one
time.
4) The servicing or washing of Agency Rent-A-Car vehicles or equipment
on the site is not permitted.
5) No loudspeakers or outside amplification of music or sound shall be
allowed.
6) This approval shall be null and void, in the event the approved use
ceases to operate for a continuous one-year period.
7) On an annual basis, this Conditional Use Permit shall be subject to
Zoning Investigator review and determination as to compliance with the
Conditions of Approval.

8) This permit shall be revocable for cause in accordance with Section
8-90.3 of the Dublin Zoning Ordinance. Any violation of the terms of the
conditions of the Use Permit will be subject to citation.

year Conditional Use Permit to allow Pacific Telephone to store
outdoor equipment and vehicles.
C-3550 - On March 28, 1979, the Alameda County Zoning Administrator
approved a Conditional Use Permit allowing administrative offices
in an M-1, Light Industrial District at 6400 Sierra Court.
APPLICABLE REGULATIONS:
Section 8-51.3 states that other uses found by the Planning Commission
to meet the intent of the district and the requirements of Section 8-51.8,
Performance Standards in the M-1 zone, such as auto auctions, may be approved
as conditional uses.
City Council Ordinance No. 5-87 establishing regulations for auctioneers
within the City of Dublin.
Section 8-87.60(c) requires a Conditional Use Permit for banners, when
used for special promotional events, for periods that cumulatively do not
exceed a maximum of sixty (60) days annually, within a 12 month period, and on
an individual promotional event basis, not to exceed fourteen (14) consecutive
days of display.
Section 8-94.0 states that conditional uses must be analyzed to
determine: 1) whether or not the use is required by the public need;
2) whether or not the use will be properly related to other land uses,
transportation and service facilities in the vicinity; 3) whether or not the
use will materially affect the health or safety of persons residing or working
in the vicinity; and 4) whether or not the use will be contrary to the
specific intent clauses or performance standards established for the district
in which it is located.
ENVIRONMENTAL REVIEW: This project has been found to be Categorically Exempt

ANALYSIS:
The Applicant is proposing the establishment of an automobile auctioning
business to be conducted on a leased portion of the existing Chevron
Industries, Inc., Record Retention Warehouse site, located at 6400 Sierra
Court. A 1.21 acre portion, at the northern end of the parking lot, of the
13.46 acre Chevron site, as well as the use of 96 parking spaces for potential
customers, would be leased to the Applicant for the operation of the proposed
project. The leased space will be completely enclosed within a fenced area,
with appropriate screening utilized.
The existing 180,000 square foot building on the site was originally
constructed for Western Electric as a manufacturing and office facility.
Accordingly, the site improvements reflect parking requirements for
manufacturing and office uses, with approximately 985 spaces provided on site.
The current use of the site by Chevron involves primarily warehousing,
with minor office activity. Chevron employs approximately 30 employees at
this site, working Monday through Friday, 8:00 a.m. to 5:00 p.m. Deliveries
are made to the Chevron building each evening during the work week at two hour
intervals from 11:00 p.m. through 5:00 a.m.
The auctioning business would operate approximately every other Saturday
throughout the year. This would not conflict with the normal operation of the
Chevron warehouse facility.
Modifications to the leased portion of the parking lot to accommodate
the proposed use include 1) the installation of a 24 foot x 10 foot
prefabricated trailer for office use; 2) the restriping of the rear, west
portion of the leased space to provide 60 standard size parking spaces for
storing the vehicles to be auctioned; 3) the installation of a vinyl coated
chain link fence along the entire south perimeter of the leased space, with
redwood slats used on the western half of the fence to screen the office and
parking area (a chain link fence with redwood slats exists on the north, east
and west boundaries of the project site); 4) the installation of additional
lighting around the newly striped parking area; and 5) the addition of trash
cans and portable toilets.
A maximum of 60 vehicles at any one time, primarily cars but also
including trucks, boats and trailers, motorcycles and golf carts, would be
auctioned. Vehicles intended for the auction will be brought onto the site
two to three days prior to the event, with the majority of the auction fleet
arriving at the site by Friday evening. The vehicles will be stored in the
striped parking area at the rear of the project site. Absolutely no
automotive repair will be allowed on the site, including washing or detailing
of the vehicles. Vehicles must be prepared for sale prior to being brought
onto the site.

Measures taken to help ensure the security of the stored vehicles
include: installing additional lighting around the storage area; requiring
the Applicant to work with the Police Services Department on an ongoing basis
to establish an effective theft prevention and security program for this site;
and providing visual access to the stored vehicles by; 1) requiring the
removal of the redwood slats from the front gate of the leased space; and
2) limiting the screening to the western half of the fence along the southern
perimeter, leaving the eastern half open, since there will be no storage of
vehicles on this portion of the site, thereby allowing the Police Services
Department to view the stored cars during their evening patrol.
The proposed automobile auctions will be open to the general public, as
well as automobile wholesalers. Since this business does involve the general
public, basic provisions for garbage and toilets will be provided. The
Applicant is proposing the use of portable toilets on-site. This should be
sufficient because of the limited nature of this project, a maximum of 26
events per year. The Applicant will be required to have the portable toilets
serviced within 2 days after the auction.
Identification for the proposed business will be accomplished through
the use of a temporary (3 foot x 15 foot) vinyl banner, displayed the day
before and the day of the event only. The banner will consist of a white
background with navy blue letters, and will be mounted above the front gates
of the project site. The use of a temporary banner for identification of
special events, not to exceed 60 days per calendar year, is allowed if a
Conditional Use Permit is obtained. A small (2.5 foot x 3 foot) directional
sign for customer parking, which is permitted under the Sign Ordinance, will
also be installed near the entrance to the project site. This directional
sign will utilize the same color scheme as the temporary banner.
The automobile auctioning business proposed by the Applicant takes
advantage of an existing under utilized parcel. The temporary nature of the
use, the relatively low impacts to the site and the weekend hours of operation
allow for the complimentary shared use of the Chevron site.
This project has been reviewed by other city departments and affected
agencies (Public Works, Police, Fire, Building, Dublin San Ramon Services
District and Livermore Dublin Disposal Service) and all applicable conditions
of approval have been included within the draft resolutions. Staff recommends
approving the Conditional Use Permit for the proposed project with a limit of
26 auctions per year (approximately every other weekend) and with a limit of
60 vehicles per auction.

A RESOLUTION OF THE PLANNING COMMISSION
OF THE CITY OF DUBLIN
APPROVING PA 90-041 MASON AUTO AUCTIONEERS
CONDITIONAL USE PERMIT AT 6400 SIERRA COURT
WHEREAS, Bryce C. Mason, on behalf of Mason Auto Auctioneers, requests
approval of a Conditional Use Permit and Site Development Review for an auto
auctioning business and signs on a 1.21 acre portion of the existing Chevron
Industries, Inc., Record Retention Warehouse site at 6400 Sierra Court; and
WHEREAS, Section 8.51.3 of the adopted City of Dublin Zoning Ordinance
requires approval by the Planning Commission of a Conditional Use Permit for
the operation of an auto auctioning business finding that it is an appropriate
use within the M-1, Light Industrial District; and
WHEREAS, proper notice of said public hearing was given in all respects
as required by law; and
WHEREAS, the Planning Commission did hold a public hearing on said
application on July 2, 1990; and
WHEREAS, the request is Categorically Exempt under Section 15304 Class
4(e) in accordance with the provisions of the California Environmental Quality
Act (CEQA); and
WHEREAS, the Staff Report was submitted recommending that the application
be conditionally approved; and
WHEREAS, the Planning Commission did hear and consider all said reports,
recommendations and testimony hereinabove set forth; and
WHEREAS, the proposed land use, if conditionally approved, is appropriate
for the subject property in terms of being compatible to existing land uses in
the area and will not overburden public services.
NOW, THEREFORE, BE IT RESOLVED THAT THE Dublin Planning Commission does
hereby find:
A. The establishment of an auto auctioning business provides for the
public need by offering a range of services for the community.
B. The use will be properly related to other land uses, and
transportation and service facilities in the vicinity, as the proposed use is
compatible when compared to the type and nature of operations typically found
in light industrial district areas and the uses currently in operation in the
immediate vicinity.
C. The use will not materially adversely affect the health or safety of
persons residing or working in the vicinity, or be materially detrimental to
the public welfare or injurious to property or improvements in the
neighborhood, as all applicable regulations will be met.
EXHIBIT
D. The uses will not be contrary to the specific intent clauses or
performance standards established for the District in which it is to be located
in that conditions have been applied to ensure conformance with the applicable
zoning regulations, and the use is consistent with the character of the
surrounding area as well as the light industrial district.
E. The approval of the Conditional Use Permit will be consistent with
the Dublin General Plan.
BE IT FURTHER RESOLVED THAT THE Dublin Planning Commission does hereby
conditionally approve PA 90-041 Conditional Use Permit application as shown by
materials labeled Exhibit A (Site Plan prepared by Brian Manning and
Associates, dated received June 5, 1990 and sign elevations dated received May
24, 1990) on file with the Dublin Planning Department, subject to the approval
of the related Site Development Review and to the following conditions:
CONDITIONS OF APPROVAL
Unless stated otherwise, all Conditions of Approval shall be complied with
prior to the issuance of building permits and establishment of use, and shall
be subject to Planning Department review and approval.
1. This approval is for an automotive auctioning business consisting of
incidental office activity, the storage of vehicles, and the auctioning
of various types of vehicles including, but not limited to, cars, trucks,
boats and trailers, motorcycles and golf carts, and a temporary banner
(3 feet x 15 feet) to be displayed a maximum of sixty (60) days annually,
not to exceed fourteen (14) consecutive days of display.
2. The Applicant shall maintain an up-to-date List of Dates for Temporary
Promotional Advertising Displays (Attached), both on site and on file
with the City of Dublin Planning Department. Said list must be submitted
to the Planning Department a minimum of four (4) days prior to the
intended date of display.
3. This use shall be limited to a maximum of 26 auctions per year.
4. Each auction shall be limited to 60 vehicles which may be bidded upon.
5. All outdoor auction related activities shall take place between the hours
of 7:30 a.m. and 5:30 p.m., except as may be approved in advance in
writing by the Planning Director.
6. The Applicant shall be responsible for clean up and disposal of auction
related trash to maintain a clean and litter free site.
7. No amplified music shall be permitted outside the enclosed building.
During the auctions, if a loudspeaker is to be used, it shall be directed
away from, and kept at a low level so as not to create a nuisance to
adjacent neighboring residential area to the west.
8. No automotive repair is permitted on site, including washing and
detailing of the vehicles.

9. The Applicant shall maintain a minimum of two toilet facilities, at all
times, on site. If portable toilets are utilized, they shall be serviced
a maximum of two days following the auction event. The exact type,
number and location of the toilet facilities shall be reviewed and
approved by the Planning Director.
10. The Applicant shall obtain the proper licenses and permits through the
Department of Motor Vehicles and the State Board of Equalization prior to
occupancy. Said licenses and permits shall be displayed at all times
during the operation of this business.
11. The Applicant shall work with the Dublin Police Services Department on an
ongoing basis to establish an effective theft prevention and security
program.
12. On an annual basis, these uses shall be subject to Zoning Investigator
review and determination as to the compliance with the Conditions of
Approval.
13. This approval shall become null and void, in the event the approved use
ceases to operate for a continuous period of one year.
14. This permit shall be revocable for cause in accordance with Section
8-90.3 of the Dublin Zoning Ordinance. Any violation of the terms of
conditions of this permit shall be subject to citation.

buildings, building materials and colors, screening of exterior
appurtenances, exterior lighting, and similar elements have been
incorporated into the project in order to insure compatibility of
this development with its design concept and the character of
adjacent buildings and uses.

parking spaces for storing the vehicles to be auctioned; 3) the
installation of a vinyl coated chain link fence along the entire south
perimeter of the leased space, with redwood slats used on the western
half of the fence to screen the office and parking area; 4) the
installation of additional lighting around the newly striped parking
area; and 5) the addition of trash cans and portable toilets.
2. A vinyl coated chain link fence shall be installed along the entire
length of the southern perimeter of the project site. Redwood slats
shall be installed along approximately 250 feet of said fence on the
western half, for screening purposes, and shall utilize barbed wire the
entire length across the top to prevent intrusion.
3. The existing redwood slats in the gate at the entrance to the project
site shall be removed.
4. Any damaged or missing wooden slats in the existing chain link fence on
the northern, eastern and western sides of the project area shall be
replaced.
5. A minimum of sixty (60) standard size (9 feet x 18 feet) parking stalls
shall be provided and striped at the rear, west, portion of the project
site. Said spaces for the proposed vehicle storage area shall be single
4-inch striped between each space.

6. Vehicles shall be stored within the screened, striped area provided at
the rear of the site. There shall be no vehicle parking or storing of
materials located on the unscreened eastern portion of the project site.
7. Roof drains shall empty into approved dissipating devices.
8. The Applicant shall comply with the City of Dublin Site Development
Review Standard Conditions and the City of Dublin Non-Residential
Security Requirements (Attached).
ARCHITECTURAL
9. Exterior colors and materials for the new structure shall be subject to
final review and approval by the Planning Director. All ducts, meters,
air conditioning equipment, trailer supports and other mechanical
equipment on the structure shall be effectively screened from view with
materials architecturally compatible with the main structure subject to
review and approval of the Planning Director.
10. The toilet facilities shall be designed with materials architecturally
compatible with the main structure, subject to review and approval of the
Planning Director.
DEBRIS/DUST
11. Measures shall be taken to contain all trash, construction debris, and
materials on site until disposal off site can be arranged. The Applicant
shall keep adjoining public street free and clean of project dirt, mud,
and materials during the construction period. The Applicant shall be
responsible for corrective measures at no expense to the City of Dublin.
12. The existing paving within the leased space shall be maintained in a
clean, dust free manner.
PUBLIC WORKS
13. All construction activity shall be limited to take place between the
hours of 7:30 a.m. and 5:30 p.m., Monday through Friday, except as may be
approved in advance in writing by the City Engineer.
14. Any damaged or missing catch basin grates shall be repaired or replaced
as directed by the City Engineer. In particular, the catch basin grate
at the middle of the front parking lot shall be replaced to prevent
pedestrian injury.
POLICE
15. The Applicant shall comply with all applicable requirements of the Dublin
Police Services Department.
16. Prior to issuance of building permits, the Applicant shall supply written
confirmation that the requirements of the Police Services have been, or
will be, met.

FIRE PROTECTION
17. The Applicant shall comply with all applicable requirements of the
Dougherty Regional Fire Authority (DRFA).
18. One portable fire extinguisher of a 2A:10C rating is required within 75
feet of all portions of the office trailer. Mounting a fire extinguisher
on the exterior of the trailer, in a fire extinguisher cabinet, is
preferable.
19. Prior to issuance of building permits, the Applicant shall supply written
confirmation that the requirements of the DRFA have been, or will be,
met.
DUBLIN SAN RAMON SERVICES DISTRICT (DSRSD)
20. Prior to issuance of building permits, the Applicant shall supply written
confirmation that the requirements of the DSRSD have been, or will be,
met.
LIGHTING
21. Exterior lighting shall be of a design and placement so as not to cause
glare onto adjoining proprties. Lighting used after daylight hours shall
be adequate to provide for security needs. Photometrics and lighting
plan for the site shall be submitted to the Planning Department and the
Dublin Police Services for review and approval prior to the issuance of
building permits.
MISCELLANEOUS
22. This permit shall be revocable for cause in accordance with Section
8-90.3 of the Dublin Zoning Ordinance. Any violation of the terms of
conditions of this permit shall be subject to citation.
23. To apply for building permits, the Applicant shall submit two (2) sets of
construction plans to the Building Department for plan check. Each set
of plans shall have attached an annotated copy of this Resolution of
Approval. The notations shall clearly indicate how all conditions of
approval will be complied with. Construction plans will not be accepted
without the annotated resolutions attached to each set of plans. The
Applicant will be responsible for obtaining the approvals of all
participating non-City agencies prior to the issuance of building
permits.

City of Dublin:
We are a relatively new Northern California company designed
to provide low cost auction service for private and public
vehicles. Our customers range from local lending institutions,
insurance companies, the DEA, government bodies, and the private
individual. Our auctions provide a timely and effective way to
sell personal vehicles, while at the same time providing an
efficient way for the public to purchase a desirable vehicle of a
competitive price.
Our auctions would be held on Saturday or Sunday on every
other weekend. We would auction between 20 and 50 vehicles.
Auctions would be held between the hours of 10:00 A.M. and 4:00
P.M. During the weekends the Chevron building is closed and the
enclosed letter grants us permission to share parking their parking
facilities. Besides auction day there will be no additional
parking required in these spaces. There would be ample room within
our proposed site for any business transactions at those times.
Vehicles will begin to arrive one week prior to the auction so that
they may be viewed by perspective buyers. Some vehicles will remain
there for about one week after the auction until they are picked
up by their rightful owner.
Why is MAA different from other auctions?
MAA gives the public the opportunity to participate in
automobile auctions which are normally reserved for dealer only
attendence. This means that people can purchase a desirable
vehicle and never once have to deal with a car salesman and the
pushy sales talk. They are free to inspect the vehicles and make
their offers or not make them. Nobody is there to tell them that,
"your offer is a little low, what can you really afford."

SITE DEVELOPMENT REVIEW STANDARD CONDITIONS
All projects approved by the City of Dublin shall meet the following standard
conditions unless specifically exempted by the Planning Department.
1. Final building and site development plans shall be reviewed and approved
by the Planning Department staff prior to the issuance of a building
permit. All such plans shall insure:
a. That standard commercial or residential security requirements as
established by the Dublin Police Department are provided.
b. That ramps, special parking spaces, signing, and other appropriate
physical features for the handicapped, are provided throughout the
site for all publicly used facilities.
c. That continuous concrete curbing is provided for all parking
stalls.
d. That exterior lighting of the building and site is not directed
onto adjacent properties and the light source is shielded from
direct offsite viewing.
e. That all mechanical equipment, including electrical and gas
meters, is architecturally screened from view, and that electrical
transformers are either undergrounded or architecturally screened.
f. That all trash enclosures are of a sturdy material (preferably
masonry) and in harmony with the architecture of the building(s).
g. That all vents, gutters, downspouts, flashings, etc., are painted
to match the color of adjacent surface.
h. That all materials and colors are to be as approved by the Dublin
Planning Department. Once constructed or installed, all
improvements are to be maintained in accordance with the approved
plans. Any changes which affect the exterior character shall be
• resubmitted to the Dublin Planning Department for approval.
i. That each parking space designated for compact cars be identified
with a pavement marking reading "Small Car Only" or its
equivalent, and additional signing be provided if necessary.
j. That all exterior architectural elements visible from view and not
detailed on the plans be finished in a style and in materials in
harmony with the exterior of the building.
k. That all other public agencies that require review of the project
be supplied with copies of the final building and site plans and
that compliance be obtained with at least their minimum Code
requirements.
ATTACHMENT
2. Final landscape plans , irrigation system plans , tree preservation
techniques , and guarantees, shall be reviewed and approved by the Dublin
Planning Department prior to the issuance of the building permit. All
such submittals shall insure:
a. That plant material is utilized which will be capable of healthy
growth within the given range of soil and climate.
b. That proposed landscape screening is of a height and density so
that it provides a positive visual impact within three years from
the time of planting.
c. That unless unusual circumstances prevail, at least 75% of the
proposed trees on the site are a minimum of 15 gallons in size,
and at least 50% of the proposed shrubs on the site are minimum of
5 gallons in size.
d. That a plan for an automatic irrigation system be provided which
assures that all plants get adequate water. In unusual
circumstances, and if approved by Staff, a manual or quick coupler
system may be used.
e. That concrete curbing is to be used at the edges of all planters
and paving surfaces .
f. That all cut and fill slopes in excess of 5 feet in height are
rounded both horizontally and vertically.
g. That all cut and fill slopes graded and not constructed on by
September 1, of any given year, are hydroseeded with perennial or
native grasses and flowers , and that stock piles of loose soil
existing on that date are hydroseeded in a similar manner.
h. That the area under the drip line of all existing oaks , walnuts,
etc. , which are to be saved are fenced during construction and
grading operations and no activity is permitted under them that
will cause soil compaction or damage to the tree.
i. That a guarantee from the owners or contractors shall be required
guaranteeing all schrubs and ground cover, all trees , and the
irrigation system for one year.
j . That a permanent maintenance agreement on all landscaping will be
required from the owner insuring regular irrigation, fertilization
and weed abatement.
3 . Final inspection or occupancy permits will not be granted until all
construction and landscaping is complete in accordance with approved
plans and the conditions required by the City.

NON-RESIDENTIAL SECURITY REQUIREMENTS
City Ordinance No. 21-89
1988 Building Code
Section 4101
1. Doors. Exterior doors which are located at the rear, or side, or away from the
primary entrance shall be solid doors with no glazing and shall be installed in
metal frames. Exterior wood doors shall be solid wood construction 1 3/4"
thick or hollow metal doors.
2. Locking devices. Exterior swinging doors which are exit doors as setforth in
Chapter 33 shall have cylinder dead-bolt locks which shall be openable without
the use of key, special effort, or knowledge. In Group B occupancies, a double
cylinder dead-bolt lock may be used on the main exit door if there is a readily
visible, durable sign on, or adjacent, to the door stating, "this door to
remain unlocked during business hours . " The sign shall be in letters not less
than 1 inch high on contrasting background. When unlocked the single door and
both leaves of a pair of doors shall be free to swing without operation of any
latching device. Doors which are not exit doors shall have the inactive leaf
secured with flush-bolts at the top and bottoms. The bolts shall be hardened
steel 1/4" minimum diameter and shall engage a metal strike plate to, a minimum
depth of 3/8 inch.
The dead bolts shall be hardened steel and shall have a minimum of a one inch
throw. If the cylinder of the lock protrudes from the face of the door it
shall be fitted with a cylinder ring geared so that it cannot be griped with
pliers or other wrenching devices.
Vehicle door, overhead doors, and sliding doors shall be secured with metal to
metal locking devices which prevent the door from opening.
3. Strike plates. Strike plates for wood jambs shall be the high security type
and shall be secured with a minimum of two wood screws 3" long which shall
engage the door studs.
4. Jambs . Inswinging doors with wood jambs shall have rabitted jambs. The jambs
on the strike side shall have solid shims above and below the strike plates and
the opposite jamb shall have solid shims at the level of the strike plate.
Both door studs shall be reinforced with horizontal solid blocking at the
approximate height of strike.
5. Hinges. Exterior doors shall have non-removable hinge pins.
6. Sliding glass doors . Sliding glass doors shall comply with Chapter 54.
Sliding glass doors shall be fitted with a locking device that shall engage the
strike sufficiently to prevent its being disengaged by any possible movement of
the door within the space or clearances provided for installation and
operation. The bolt and strike shall be reinforced by hardened material so as
to prevent their separation by pulling, prying or similar attack. An auxiliary
locking device shall be installed on the door which may be a pin, lock, or
similar device of not less than 1/4" diameter. The pin shall be of hardened

material and engage the metal portion of the sliding door. The primary locking
device shall be operable by a keyed or code lock inside. Doors with 2 sliding
panels shall be locked at the meeting rails and shall have an auxiliary locking
device as described above.
8. Windows. All accessible windows which are not located at the front or main
entrance side of a non-residential building shall be made secure as follows:
a) Sliding glass windows shall be secured on the inside with a locking device
capable of withstanding prying or wrenching. An auxiliary lock shall be
installed on each sliding window that prevents movement in the sliding
track.
b) Louvered windows shall not be used within eight feet of ground level,
adjacent structures, or fire escapes.
c) Casement type windows shall be secured with a metal to metal locking device
contacting both frames of the window at the meeting edge. Auxiliary locks
such as a pin that penetrates both frame structures shall be installed on
casement and double hung windows.
d) Windows shall not be located within 40 inches of the locking device of any
door not located on the main entrance side of the non-residential building
unless the windows are glazed with 1/4" tempered glass .
9 . Openable transoms. All exterior openable transoms exceeding 8 x 12 which are
not located on the front or main entrance side of a non-residential building
shall be protected with a steel grill and 1/4" minimum bars not more than 2" on
center or by a screen with 1/8" diameter wire mesh not more than 2" on center
mounted on the inside.
9. Roof openings. All skylights on the roof of a non-residential building shall
be protected by:
a) Iron bars 1/2 inch minimum diameter not more than 8" on center or;
b) A screen with 1/8" diameter wire mesh not more than 2" on center.
All roof access hatches of non-residential building shall be protected as
follows:
a) If the hatchway is of wooden material, it shall be covered on the inside
with at least 16 gauge sheet steel or its equivalent attached with screws at
6" o.c. ;
b) The hatchway shall be secured from the inside with a slide bar or slide
bolts;
c) Outside hinges on all hatchway openings shall be provided with non-removable
pins when using pin-type hinges.
All air duct or air vent openings exceeding 8" x 12" on the roof or exterior
walls of any building or premise used for business purposes shall be secured by
covering the same with eitherof the following:

a) Iron bars of at least 1/2" round or 1" x 1/4" flat steel material, spaced no
more than 8" o.c. apart and securely fastened.
10. Exterior ladders . Exterior ladders to the roof are not permitted.
