July 16, 1987: The Planning Commission approved PA 87-102 Conditional Use Permit to continue the outdoor seating in front of the Bagel King Store. APPLICABLE REGULATIONS: Section 8-48.9 states that all principal uses in a C-1 District shall be conducted within a building. Outside uses can be considered with approval of a Conditional Use Permit. Section 8-94.0 states that conditional uses must be analyzed to determine: 1) whether or not the use is required by the public need; 2) whether or not the use will be properly related to other land uses, transportation and service facilities in the vicinity; 3) whether or not the use will materially affect the health or safety of persons residing or working in the vicinity; and 4) whether or not the use will be contrary to the specific intent clauses or performance standards established for the district in which it is located. ENVIRONMENTAL REVIEW: This project has been found to be categorically except from CEQA under Section 15301, Class 1, of the California Environmental Quality Act Guidelines in that the use consists of the operation of an existing bakery and outdoor seating area involving no expansion of use beyond that previously existing. NOTIFICATION: Public Notice of the September 17, 1990 hearing was published in the local newspaper, mailed to adjacent property owners, and posted in public buildings. ANALYSIS: On July 16, 1987, the Planning Commission approved a request from the Bagel King Inc. to allow four tables and eight chairs for outside eating directly in front of their tenant space at 7168 Regional Street. This approval expired on August 17, 1990. On August 14, 1990, the Applicant and new owner of the Bagel Bakery submitted a Conditional Use Permit application to the Planning Department requesting to continue having the outdoor seating area. The location and operation of the outdoor seating area has not changed from the previously approved Conditional Use Permit. The tables and chairs will be located against the building so as not to interfere with pedestrian traffic access on the sidewalk. -2- There have not been any complaints or other zoning violations associated with the existing use. The use is consistent with the intent of the policies set forth in the Dublin Downtown Specific Plan. The application has been reviewed by the applicable public agencies and city departments, and is in compliance with the City's Zoning Ordinance. RECOMMENDATIONS: FORMAT: 1) Open public hearing and hear Staff presentation. 2) Take testimony from Applicant and the public. 3) Question Staff, Applicant and the public. 4) Close public hearing and deliberate. 5) Adopt resolution approving PA 90-069, or give Staff and Applicant direction and continue the matter. ACTION: Staff recommends the Planning Commission adopt the attached resolution (Exhibit B) approving Conditional Use Permit PA 90-069 for the Bagel Bakery outdoor seating area. NOW, THEREFORE, BE IT RESOLVED THAT THE Dublin Planning Commission does hereby find that: a. The use is required to serve a public need in that it provides an outside seating/eating area for use by the customers of the bakery. b. The use will be properly related to other land uses and transportation and service facilities in the vicinity in that daytime activities will be commensurate with present use of properties in the neighborhood. c. The use, under all circumstances and conditions of this particular case, will not materially affect adversely the health or safety of persons residing or working in the vicinity, or be materially detrimental to the public welfare or injurious to property or improvements in the neighborhood, in that all applicable regulations will be met. d. The use will not be contrary to the specific intent clauses or performance standards established for the district in which it is to be located in that the use of the outdoor seating area for the bakery is consistent with the character of the commercial district. BE IT FURTHER RESOLVED THAT THE Dublin Planning Commission does hereby conditionally approve PA 90-069 Bagel Bakery Conditional Use Permit as shown on Exhibit A, plans dated and received August 14, EXHIBIT 13' 1990, and stamped approved on file with the Dublin Planning Department, subject to the following conditions: CONDITIONS OF APPROVAL: Unless stated otherwise, all Conditions of Approval shall be complied with prior to the issuance of building permits or establishment of use, and shall be subject to Planning Department review and approval. 1. This approval is for the continued use of outside patron seating/eating for the Bagel Bakery. There shall be no more than four tables and eight chairs located on the site at any one time. Placement of the tables and chairs shall be limited to within two feet of the store front. The tables and chairs shall be placed directly next to the building in front of this tenant space. 2. The tables and chairs shall be arranged so as not to block access to the store or impede normal pedestrian traffic on the sidewalk. 3. A trash receptacle shall be located in front of the store; the location of the trash receptacle shall be located as shown on the approved plans (Exhibit A). 4. The sidewalk and parking area shall be kept clean of all debris resulting from the outside eating area. 5. No loudspeakers or outside amplification of music or sound shall be allowed. 6. This approval shall be null and void, in the event the approved use ceases to operate for a continuous one-year period. 7. On an annual basis, the Conditional Use Permit shall be subject to Zoning Investigator review and determination as to compliance with the Conditions of Approval. 8. This permit shall be revocable for cause in accordance with Section 8-90.3 of the Dublin Zoning Ordinance. Any violation of the terms of conditions of this permit shall be subject to citation. May 5, 1990: Planning Director approved PA 90-010 Valley Dodge Site Development Review for a 736 square foot office addition to an existing 11,040 square foot buiding. APPLICABLE REGULATIONS: Section 8-87.33 Wall Signs and Projecting Signs establishes maximum height, width and area permitted for wall signs and makes provisions for increases in the limitations through the Site Development Review process. Section 8-87.34(B)3a) . The maximum sign area may be increased five (5) square feet for double faced signs for each one (1) foot the sign is set back from the street frontage, not to exceed three hundred (300) square feet. - 2 - U VUti Section 8-87.60 (D) of the City's Zoning Ordinance provides an exception to the 20-foot maximum sign height requirement whereby single use parcels one and one-half (1-1/2) acres or greater may utilize a sign up to 35 feet subject to approval of a Conditional Use Permit. Section 8-94.0 states that conditional uses must be analyzed to determine: 1) whether or not the use is required by the public need; 2) whether or not the use will be properly related to other land uses, transportation and service facilities in the vicinity; 3) whether or not the use will materially affect the health or safety of persons residing or working in the vicinity; and 4) whether or not the use will be contrary to the specific intent clauses or performance standards established for the district in which it is located. This use consists of placement of on-premise signs accessory to an existing commercial facility. NOTIFICATION: Public Notice of the September 17, 1990, hearing was published in the local newspaper mailed to adjacent property owners, and posted in public buildings. ANALYSIS: The Applicant is requesting approval of a Conditional Use Permit to increase the height of an existing freestanding sign from 26 feet to 35 feet and Site Development Review for a new wall mounted sign at 6015 Scarlett Court. Per Section 8-87.60 (D) of the Zoning Ordinance freestanding signs on single use parcels one and one-half (1-1/2) acres in size are allowed a maximum height of 35 feet subject to Planning Commission approval of a Conditional Use Permit. The Applicant is requesting approval to raise the existing "Dodge" freestanding sign up to 35 feet. A landscape area will be provided around the base of this sign. The existing double-faced Dodge freestanding sign is setback approximately 60 feet from the front property line. The location of the proposed freestanding sign will remain unchanged. The proposed height, area, and setback for this freestanding sign is in conformance with the Zoning Ordinance. The Applicant proposes a wall mounted sign on the primary, south, building frontage. The internally illuminated, channel letter, "Truck Center" sign (21.5 feet x 2 feet) will be similar in size and height to the existing "Valley Nissan" and "Valley Dodge" wall signs, Site Development Review approval is required - 3 - UVU. to allow a letter height greater than 19 inches. The area of the wall sign, 43 square feet, is in conformance with the regulations of the Sign Ordinance. Staff recommends approval of the Conditional Use Permit and the Site Development Review for the proposed freestanding sign and wall mounted sign. RECOMMENDATION: FORMAT: 1) Open public hearing and hear Staff presentation. 2) Take testimony from Applicant and the Public. 3) Questions Staff, Applicant and the Public. 4) Close public hearing and deliberate. 5) Adopt Resolutions relating to PA 90-065 or give Staff and Applicant direction and continue the item. BE IT FURTHER RESOLVED THAT THE Dublin Planning Commission does hereby conditionally approve PA 90-065 Valley Nissan/Dodge freestanding sign as shown on the plans labeled Exhibit A, stamped approved and on file in the Dublin Planning Department, consisting of one sheet prepared by Barber Sign Co., Inc., submitted to the Planning Department on August 2, 1990, and subject to the following conditions of approval. CONDITIONS OF APPROVAL: Unless stated otherwise, all Conditions of Approval shall be complied with prior to the issuance of building permits or establishment of use, and shall be subject to Planning Department review and approval. 1. PA 90-065 Conditional Use Permit is approved for one double faced freestanding sign which shall generally conform to the following dimensions: a. Maximum Sign Area: 240 square feet (120 square feet per face) b. Maximum Sign Height: 35 feet c. Front Setback: 60 feet Note: Approval of this Conditional Use Permit shall supersede previous approval for Dodge freestanding sign PA 89-143, Planning Commission Resolution No. 90-010. 2. A Landscape and Irrigation Plan for the landscape planter area around the base of said freestanding sign shall be submitted for review and approval by the Planning Director. Said planter area shall be maintained in a viable and well kept manner at all times. 3. All building permits for the proposed freestanding sign shall be secured and construction commenced within six (6) months of the date of approval of this use permit. The Applicant and/or property owner shall comply with all applicable building code requirements. 4. Any modifications to said freestanding sign shall be subject to review and approval of the Dublin Planning Department. - 2 - GUVG 5. This approval shall become null and void, in the event the approved use ceases to operate for a continuous one-year period. 6. This use shall be subject to Zoning Investigator review and determination as to compliance with the conditions of approval. 7. All provisions of Section 8-95.0 through 8-95.8, Site Development Review of the Zoning Ordinance, are complied with. B. Consistent with Section 8-95.0, this project will promote orderly, attractive, and harmonious development; recognize environmental limitations on development; stabilize land values and investments; and promote the general welfare by preventing erection of signs having qualities which would not meet the specific intent clauses or performance standards set forth in the Zoning Ordinance and which are not consistent with their environmental setting. The site is physically suitable for the proposed development in that the site is indicated to be geologically satisfactory for the type of development proposed in locations as shown, and the site is in a good location regarding public services and facilities. BE IT FURTHER RESOLVED THAT THE Dublin Planning Commission does hereby approve PA 90-065 Valley Dodge Site Development Review for an additional internally illuminated wall sign as shown on the plans labeled Exhibit A, stamped approved and on file in the Dublin Planning Department, consisting of one sheet prepared by Barber Sign Co., Inc., submitted to the Planning Department on August 2, 1990, and subject to the following conditions of approval. CONDITIONS OF APPROVAL: Unless stated otherwise, all Conditions of Approval shall be complied with prior to the issuance of building permits or establishment of use, and shall be subject to Planning Department review and approval. 1. PA 90-065 Site Development Review is approved for one internally illuminated, channel letter, "Truck Center" wall mounted sign, which shall generally conform to the following: a. Primary Frontage: South Elevation b. Maximum Letter Height: 24 inches c. Maximum Sign Length: 21.5 feet d. Maximum Sign Area: 43 square feet Note: All existing wall signs on-site shall remain consistent with their previous approvals. - 2 - UvUJ 2. All signs are to be well maintained in an attractive manner and in accordance with the approved plans. All indirect light fixtures are to be glare shielded. 3. Any additional signage utilized on this site shall be subject to review and approval by the Planning Department prior to installation. 4. Any mounting holes from previous signs shall be repaired and walls repainted prior to mounting the proposed signs. 5. Transformers, irrigation control boxes, utility meters, valves and the like shall be enclosed in vaults, screened by fencing or be painted out and landscaped as acceptable to the Planning Department. 6. Building permits for the proposed signs shall be secured and construction commenced within six (6) months after approval of this application or said approval shall be void. 7. The "Dodge" freestanding sign is subject to all conditions of the approved Conditional Use Permit for PA 90-065, Planning Commission Resolution No. 8. This use shall be subject to Zoning Investigator review and determination as to compliance with the conditions of approval. 9. This permit shall be revocable for cause in accordance with Section 8-90.3 of the Dublin Zoning Ordinance. Any violation of the terms or conditions of this permit shall be subject to citation.
