February 1987, PA 87-017: Planning Director approved Site Development Review for monument sign and metal price sign. July 1987, PA 87-038: Zoning Administrator Variance for sign height of 11 feet where 8 feet is required. August 1989, PA 89-063: Planning Commission approved Conditional Use Permit and Site Development Review for a new service station. APPLICABLE REGULATIONS: Section 8-48.2 Conditional Uses C-1 District, permits service station Type A subject to approval of Conditional Use Permit. Section 8-65.1 establishes restrictions and limitations placed on Type A service stations. Section 8-94.0 states that conditional uses must be analyzed to determine: 1) whether or not the use is required by the public need; 2) whether or not the use will be propertly related to other land uses, transportation and service facilities in the vicinity; 3) whether or not the use will materially affect the health or safety of persons residing or working in the vicinity; and 4) whether or not the use will be contrary to the specific intent clauses or performance standards established for the district in which it is located. ENVIRONMENTAL REVIEW: A Negative Declaration of Environmental Impact was approved on August 7, 1989. The requested change to Condition #43 is Categorically Exempt from CEQA, Class 5, minor alterations to land use limitations. NOTIFICATION: Public Notice of the May 7, 1990, hearing was published in the local newspaper, mailed to adjacent property owners, and posted in public buildings. -2- PAGE OF ' n ANALYSIS: Chevron is requesting a revision to Condition #43 of Resolution No. 89- 046 for PA 89-063 which requires Chevron to construct street frontage improvements along Dublin Boulevard. Instead of installing the improvements, Chevron proposes to contribute $36,600 to the City as Chevron's share of the cost of the Dublin Boulevard widening. The City in turn would use the funds to complete the widening which is included in the City's five (5) year Capital Improvement Plan. The Engineering Department has reviewed the requested revision to the condition and recommends approval. To allow the in lieu contribution, Condition #43 should be revised to read as follows: Dedication of land shall be made to the City of Dublin such that it conveys land sufficient for the approved street right-of-way. The applicant shall contribute $36,600 to the planned project to improve Dublin Boulevard between Donlon Way and Village Parkway. The project frontage improvements shall be limited to the relocation of driveways as necessary to meet the new site plan and curb underdrains to convey on- site storm water to the street gutter. RECOMMENDATION: FORMAT: 1) Open public hearing and hear Staff presentation. 2) Take testimony from Applicant and the public. 3) Question Staff, Applicant and the public. 4) Close public hearing and deliberate. 5) Adopt resolution revising Condition #43, or give Staff and Applicant direction and continue the matter. ACTION: Staff recommends that the Planning Commission adopt the attached resolution approving the requested revision to Condition #43 of Resolution No. 89-046 for PA 89-063. ATTACHMENTS: Exhibit A: Resolution Revising Condition #43 of Resolution No. 89-046 Attachment 1: Location Map Attachment 2: Applicant's Written Statement -3- PAGE '1 OF 7 RESOLUTION NO. 90 - A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF DUBLIN APPROVING REVISION TO CONDITION #43 OF RESOLUTION NO. 89-046 FOR PA 89-063 CHEVRON SERVICE STATION/CONVENIENCE MART CONDITIONAL USE PERMIT/ SITE DEVELOPMENT REVIEW LOCATED AT 7007 SAN RAMON ROAD WHEREAS, Chevron USA (Applicant) requests approval of a revision to Condition #43 of Resolution 89-046 for PA 89-063 to allow contribution of in- lieu fees rather than completed street frontage improvements along Dublin Boulevard; and WHEREAS, the Planning Commission did hold a public hearing on said application on May 7, 1990; and WHEREAS, proper notice of said public hearing was given in all respects as required by law; and WHEREAS, a Negative Declaration was approved for the project on August 7, 1989, and this application is Categorically Exempt (Class 5) from the requirements of the California Environmental Quality Act (CEQA) ; and WHEREAS, the Staff Report was submitted recommending that the application be approved; and WHEREAS, the Planning Commission did hear and consider all said reports , recommendations and testimony hereinabove set forth; and WHEREAS, the requested revision to Condition #43 of Resolution No. 89-046, if approved, is appropriate for the subject property. NOW, THEREFORE, BE IT RESOLVED THAT THE Dublin Planning Commission does hereby find: a) The approval of the requested revision to Condition #43 is consistent with the Dublin General Plan and Downtown Specific Plan. b) All provisions of Section 8-95.0 through 8-96.8, Site Development Review of the Zoning Ordinance, are complied with. c) The approval of the requested revision to Condition #43 is in the best interest of the public health, safety and general welfare. -Dmv.k Reis. Box 2340 _ _Dublin, _CA 94568 - Subject: PA89-063 Conditional Use Permit Request for Change of Conditions Dear Mr. Tong: One of our Conditions of Approval for our station reconstruction at the northeast corner of San Ramon Road and Dublin Boulevard requires that we reconstruct our frontage improvements along Duhlin Boulevard on your new alignment. As this is only a partial widening, there will be an offset in these improvements from the property owner to the east. It is also my under- standing that the City plans to complete the total widening within the next one to two years. We would, therefore, offer to contribute $36,600 to your overall project in lieu of our contractor's performing our frontage work. To allow this in-lieu contribution, it is my understanding that a Change of Condition #43 of our Use Permit is necessary. We hereby request that this condition be revised to read: 43.
