ADJOURNMENT (Over for Procedures Summary) DUBLIN PLANNING COMMISSION PROCEDURES SUMMARY WELCOME to the Dublin Planning Commission meeting. The Planning Commission is made up of five Dublin residents who have volunteered their services to the community. They were appointed by the Dublin City Council. The Planning Commission encourages and appreciates participation by Dublin residents. Regular meetings of the Planning Commission are held on the first and third Mondays of each month in the Dublin Civic Center Council Chambers, 100 Civic Plaza, Dublin. TIME: Planning Commission meetings begin at 7:30 p.m. No new public hearing item will begin after 10: 30 p.m. , and the meetings will be adjourned by 11:00 p.m. , except under unusual circumstances where the Commission votes to hear the item or to extend the meeting for 30-minute increments. ITEMS NOT ON THE AGENDA: No action shall be taken on any item not appearing on the posted agenda unless: 1) the Planning Commission determines by majority vote that an emergency situation exists, as defined in the Government Code 2) the Planning Commission determines by a two-thirds vote, or by a unanimous vote if only three members are present, that the need to take action arose after the agenda was posted; or 3) the item was included in a posted agenda for a prior meeting held within five (5) calendar days and was continued to the current meeting. ORDER OF PRESENTATION: After the Chairperson opens the public hearing on an item, the order of presentation will be as follows: 1) Summary Presentation by Planning Staff 2) Questions by Planning Commission 3) Comments by Applicant 4) Comments by Others in Favor 5) Comments by Those in Opposition 6) Rebuttal by Applicant if Necessary 7) Additional Comments by Staff as Appropriate The hearing is then closed and the item turned over to the Commission for discussion and action. The audience is not permitted to make any further comments unless invited by the Planning Commission. PUBLIC COMMENTS UNDER ORAL COMMUNICATIONS: Any citizen desiring to speak on an item not scheduled on the agenda may do so under Oral Communications at the beginning of the meeting. After receiving recognition from the Chairperson, please state your name and address, then proceed with your comments. When an item not on the agenda is raised by a member of the public, the matter shall be deemed automatically referred to Staff unless the Planning Commission determines to take action as outlined in the section above entitled ITEMS NOT ON THE AGENDA. PUBLIC COMMENTS ON A HEARING ITEM: On a public hearing or other scheduled item, the Chairperson will ask the audience for its comments , first from those in favor, then from those in opposition. After receiving recognition from the Chairperson, please state your name and address , then proceed with your comments. The Planning Commission wants to hear all citizen concerns . Each new speaker is asked to be brief, add new information, and not repeat points which previous speakers have made. The Planning Commission is particularly interested in the specific reasons why the speaker is for or against an item. Applause and other demonstrations are prohibited during public hearings. Such demonstrations tend to intimidate those in the audience who may have valid but opposing viewpoints. The Chairperson maintains the discretion to request the use of Speaker Slips and to limit comments. Anyone who does not want to speak may write comments on the Speaker Slip and turn it into the Planning Commission while the public hearing is still open. The new terms of office will be until December 1990, unless a vacancy in an office occurs before that time. The Ordinance establishing the Planning Commission provides that the Planning Commission may appoint a Secretary who may be one of its members or someone else. Staff recommends that the Planning Commission 1) elect a Chairperson, 2) elect a Vice-Chairperson, and 3) appoint the Planning Director as Secretary. May 3, 1979: A Parcel Map was approved by Alameda County to subdivide the property line into five parcels. October 22, 1980: A Site Development Review was approved by Alameda County for the construction of six office buildings at the end of Amador Plaza Road (four were constructed). April 2, 1981: Approval was granted by the Alameda County Board of Supervisors rezoning the site from C-2, General Commercial District to a PD, Planned Development District allowing C-0, Administrative Office District uses and allowing a racquetball club, gymnasium, restaurant and other C-1 Retail Business District uses that are determined to be compatible with C-0 uses (1464th Zoning Unit) . August 23, 1984: The Applicant submitted a Site Development Review application to construct a one-story retail building, a two-story retail and office building, and an addition to the existing theater. This application was found to be incomplete and no further action was taken on the application (PA 84-023). February 25, 1985: The Dublin City Council denied a PD, Planned Development District Rezoning request to rezone the northerly 16.3 acres of the Enea Plaza holding to a PD, Planned Development District allowing C-1, Retail Business District type uses (PA 84-040). July 27, 1987: Approval was granted by the Dublin City Council rezoning approximately 5.0+ acres to allow for a range of retail shopper, office, personal service and financial uses within a new three building retail complex (PA 87-018). December 14, 1987: The Dublin City Council approved Resolution 105-87, which amended Resolution No. 41-87 (PA 87-018), which modified the conditions of approval relating to the proposed road parallel to Dublin Boulevard. March 28, 1988: The Dublin City Council approved a Planned Development Rezoning request to rezone the southern 3.0+ acres of APN 941-1500-40 to a new PD, allowing a range of retail, office, personal service and financial uses identical to those permitted by City Council Resolution No. 41-87 and Planned Development Application PA 87-018 (PA 87-178) . June 14, 1989: A Site Development Review was approved by the City of Dublin Planning Director to build a 26,946+ square foot commercial/retail project on vacant property and a 5,060+ square foot commercial/retail building on partially developed property (PA 89-028). APPLICABLE REGULATIONS Section 1.2 of the City subdivision regulations states that it is the intent of the Subdivision Ordinance to: 1) promote the public health, safety and general welfare; - 2 - PAGE,OF 2) assure in the division of land consistent with the policies of the General Plan and with the intent and provision of the Zoning Ordinance; 3) coordinate lot design, street patterns, rights-of-way, utilities and public facilities with community and neighborhood plans; 4) assure that areas dedicated for public purposes will be properly improved initially so as not to be a future burden upon the community; 5) preserve natural resources and prevent environmental damage; 6) maintain suitable standards to insure adequate, safe building sites; and 7) prevent hazard to life and property. Section 8-2.5 of the Subdivision regulations states that conditions of approval to tentative maps may include dedication and improvement of streets, alleys including access rights and abutter's rights, drainage, public utility easements and other public easements. Section 8-2.6 requires that a tentative map must be in conformance with the Subdivision Ordinance, Zoning Ordinance and any other ordinance of the City. ENVIRONMENTAL REVIEW: The City of Dublin proposes to adopt a Negative Declaration of Environmental Significance for the project. NOTIFICATION: Public Notice of the December 4, 1989 hearing was published in the local newspaper, mailed to adjacent property owners, and posted in public buildings. ANALYSIS The Applicant is requesting approval of a Tentative Parcel Map to create two parcels from a 5.83 acre lot. The property is located along the southwest intersection of Amador Plaza Road and Dublin Boulevard. The site is partially occupied by a 19,000+ square foot commercial/retail building with associated parking facilities. The remaining vacant portion of the property has an approved Site Development Review application (PA 89-028) to build two commercial/retail buildings totalling 32,006+ square feet. The requested subdivision of the property was not a condition of approval of the Site Development Review and would not be necessary to construct the project. The Applicants have requested the proposed subdivision in order to facilitate construction financing of the new buildings proposed on the site. Unless otherwise noted in the conditions of approval, it is not the intent of Staff to modify any previous conditions of approval relating to previous rezoning actions, Site Development Review actions, or other previous agreements between the City of Dublin and the Applicants. The Planning Staff's primary interest in reviewing this application relates to the proposed road which will eventually bisect the project site. The approved Site Development Review application for the commercial/retail buildings has been reviewed - 3 - PAGE_,OF and conditioned to allow for the construction of the road at such time that the City deems the road necessary. As depicted in Attachment 4, the ultimate improvement of the proposed road will create three parcels along Amador Plaza Road, pending approval of this parcel map. Although technically not part of this application, Staff conceptually reviewed Parcels "B1" and "B2" to ensure that these parcels could "stand alone" as independent parcels upon construction of the proposed road. The Staff review found that these parcels would be consistent with the City's General Plan, Downtown Specific Plan, Zoning Ordinance, and would be consistent with the development standards applicable to commercial/retail development. With the construction of the proposed road, all parcels would have adequate lot frontages. The Site Development Review approved for Enea Plaza II (PA 89-028) determined that a shared parking program for the existing development and the proposed project would be necessary for the proposed development to meet its parking requirements. The Staff has added a condition to the proposed subdivision ensuring that a joint parking, maintenance and access agreement acceptable to the City Attorney and City Engineer be recorded as part of the Final Map. The second concern of Staff related to the size and shape of the future Parcel "Bl". This parcel, as proposed, would be the smallest of the three parcels and is configured to contain a 5,060+ square foot building and associated parking consistent with the project approved as "Enea Plaza II" (PA 89-028). In the unlikely scenario that the approved project is either not built or substantially modified and the proposed road is constructed, the Staff will recommend that future projects could require a lot line consolidation between Parcel "A" and "Bl". Staff believes that the proposed subdivision is appropriate in light of the approved Site Development Review. RECOMMENDATIONS FORMAT: 1) Open public hearing and hear Staff presentation. 2) Take testimony from Applicant and the public. 3) Question Staff, Applicant and the public. 4) Close public hearing and deliberate. 5) Adopt Resolution approving Exhibit A, Negative Declaration, and Exhibit B, Tentative Parcel Map No. 5783, or give Staff direction and continue the item. ACTION: Staff recommends that the Planning Commission adopt the draft resolutions approving the Negative Declaration and Tentative Parcel Map for PA 89-127. A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF DUBLIN ADOPTING A NEGATIVE DECLARATION OF ENVIRONMENTAL SIGNIFICANCE FOR PA 89-127 TENTATIVE PARCEL MAP NO. 5783 WHEREAS, Ron Archer on behalf of Enea Plaza, a California Partnership, filed a Tentative Map application requesting approval of a two-lot subdivision of Parcel "C" of Parcel Map 2922, filed June 6, 1988, Book 128 of Maps, Page 58, Alameda County Records, more specifically APN 941-1500-40; and WHEREAS, the California Environmental Quality Act (CEQA), together with the State Guidelines and City environmental regulations, require that certain projects be reviewed for environmental impact and that environmental documents be prepared; and WHEREAS, an initial study was conducted finding that the project, as proposed, would not have a significant effect on the environment; and WHEREAS, a Negative Declaration has been prepared for this application; and WHEREAS, public notice of the Negative Declaration was given in all respects as required by State Law; and WHEREAS, the Planning Commission did review and consider the Negative Declaration at a Public Hearing on December 4, 1989; and NOW, THEREFORE, BE IT RESOLVED THAT THE Dublin Planning Commission finds as follows: 1. That the project PA 89-127 Tentative Parcel Map No. 5783 will not have a significant effect on the environment; 2. That the Negative Declaration has been prepared and processed in accordance with State and local environmental laws and guideline regulations; and 3. That the Negative Declaration is complete and adequate. AYES: NOES: ABSENT: Planning Commission Chairman ATTEST: Planning Director [89127RE1/jd:ga) PAGE_OF EXHIBIT A RESOLUTION NO. 89 - A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF DUBLIN APPROVING PA 89-1217 ENEA TENTATIVE MAP NO. 5783 WHEREAS, Ron Archer Civil Engineer, Inc., on behalf of Enea Plaza, a California Partnership, has requested approval of a Tentative Map to create two parcels within the Dublin City limits; and WHEREAS, the State of California Subdivision Map Act and the adopted City of Dublin Subdivision Regulations require that no real property may be divided into two or more parcels for the purposes of sale, lease or financing unless a Tentative Map is acted upon and a Final Map is approved consistent with the Subdivision Map Act and City of Dublin Subdivision Regulations; and WHEREAS, the Planning Commission held a public hearing on said application on December 4, 1989; and WHEREAS, proper notice of said public hearings was given in all respects as required by law; and WHEREAS, this application has been reviewed in accordance with the provisions of the California Environmental Quality Act, and has been found to have no significant environmental impact; and NOW, THEREFORE, BE IT RESOLVED THAT THE Dublin Planning Commission finds that: 1. Tentative Map No. 5783 will not have substantial adverse effects on health or safety, or be substantially detrimental to the public welfare, or be injurious to property or public improvements. 2. The proposed Tentative Map is consistent with the City's General Plan and City Zoning, related ordinances, and the Downtown Specific Plan. 3. The Tentative Map is consistent with street patterns, rights-of- way, utilities and public facilities planned for the area. 4. Areas proposed to be dedicated for public purposes will conform to minimum improvement standards so as not to be a future burden upon the community. 5. The Tentative Map will not have a significant environmental impact. 6. The site is physically suitable for the proposed development, in that a soils investigation report has been prepared and includes recommendations to insure site will be suitable for commercial development. 7. This project will not cause serious public health problems in that all necessary utilities are, or will be, required to be available and Zoning, Building, and Plumbing Ordinances control the type of development, and the operation, of the uses to prevent health problems after development. BE IT FURTHER RESOLVED THAT THE City of Dublin Planning Commission approves PA 89-127, Enea Tentative Map No. 5783, subject to the following conditions: CONDITIONS OF APPROVAL Unless otherwise specified, the following conditions shall be complied with prior to the recordation of the Final Map. Each item is subject to review and approval by the Planning Department unless otherwise specified. k. PAGE-OF ff GENERAL PROVISIONS 1. The design and improvements of Enea Tentative Map No. 5783 shall be in conformance with the design and improvements indicated on the map labeled Attachment 1 on file with the Dublin Planning Department (PA 89-127) unless otherwise conditioned below. 2. An encroachment permit shall be obtained for any driveways for the lot. 3. Address numbers for all development shall be visible from the street per Dougherty Regional Fire Department requirement. 4. The Applicant shall provide DSRSD with plans showing the water and sewer services to the lots. 5. If, during construction, archaeological remains are encountered, construction in the vicinity shall be halted, an archaeologist consulted, and the City Planning Department notified. If, in the opinion of the archaeologist, the remains are significant, measures, as may be required by the Plananing Director, shall be taken to protect them. DEDICATIONS AND PUBLIC IMPROVEMENTS 6. Prior to recordation of the final map, the final location of proposed sanitary sewer water lines shall be reviewed and approved by the Dublin San Ramon Services District. The applicant shall provide documentation that all Ordinance requirements of the District have been, or will be satisfied, prior to the issuance of building permits. 7. Prior to recordation of the final map, the proposed on-site drainage layout shall be redesigned so that it will not cross the future street right-of- way. 8. Each lot shall be graded as not to drain on any other lot or adjoining property prior to being picked up by an approved drainage system. 9. Any relocation of improvements or public facilities (with the exception of the future street) shall be accomplished at no expense to the City. DUST 10. Areas undergoing grading, and all other construction activities, shall be watered, or other dust-pallative measures used to prevent dust, as conditions warrant. 11. Dust control measures, as approved by the City Engineer, shall be followed at all times during grading and construction operations. EASEMENTS 12. Existing and proposed access and utility easements shall be submitted for review and approval by the City Engineer prior to Final Map approval. These easements shall allow for practical vehicular and utility service access for all areas. 13. A 10-foot public utility easement shall be shown along all street frontages. 14. All existing easements shall be shown on the Final Map unless evidence is furnished to the City showing that all parties having a right, title, or interest in a specific easement agree to its abandonment. 15. Required parking for this project is determined through a shared parking program for the existing and future developments on APN 941-1500-40 & 38-1. Prior to recordation of the final map, a joint parking, maintenance and access agreement acceptable to the City Attorney and Public Works Director shall be recorded as a separate document prior to, or be recorded with the final map. -2_ PAGE-OF_._. MISCELLANEOUS 16. Except as specifically altered by the above Conditions of Approval, development of the project site shall comply with the conditions established for Planned Development District zoning PA 87-178, PA 87-018 and PA 89-028 (Site Development Review for Enea Plaza II). 17. Copies of the Final Map and improvement plans, indicating all lots, streets, and drainage facilities within the subdivision shall be submitted at 1" — 400 feet scale and 1" — 200 feet scale for City mapping purposes, one mylar copy and one blackline copy of the Final Map shall be delivered to the City after the map has been recorded. Three copies of the signed improvement plans shall be delivered to the City for inspection purposes. One reproducible and one blackline print of the improvement plans shall be delivered after "as-built" conditions have been incorporated. 18. The developer shall keep adjoining public streets free and clean of project dirt, mud, materials, and debris during the construction period, as is found necessary by the City Engineer. 19. All improvements within the public right-of-way, including curb gutter, sidewalks, driveways, paving, and utilities, must be constructed in accordance with approved standards and/or plans. 20. The developer will comply with all zoning provisions, including Zoning Ordinance and rezoning Conditions of Approval. 21. The applicants shall be advised that substantial modification to the approved Site Development Review application, PA 89-023, or filing a new application for Site Development Review on the project site may result in a condition requiring a new subdivision of the subject property or a lot line consolidation of said property.
