in the Dublin Civic Center City Council Chambers. Chairperson Johnson called the meeting to
order at 7:00 p.m.

8.1PA 02-012 Village Parkway Specific Plan Area Rezoning - A City-initiated
application to rezone parcels in the Village Parkway Specific Plan Area from
existing zoning districts C-N, C-l, and C-2 to a new Planned Development (Village

Parkway Specific Plan) Zoning District. The current zoning districts for the site
are partially inconsistent with the Specific Plan adopted for the area in December
2000. A new Planned Development (Village Parkway Specific Plan) Zoning
District rezone will bring the zoning for the properties into conformance with the
Specific Plan. This rezoning will not change the allowed uses in the area, but
will serve to apply one Planned Development zoning district to all properties in
the Specific Plan Area and will provide the clearest direction on what
development is desired for the Village Parkway Area.
Cm. Johnson asked for staff report.
Kristi Bascom, Associate Planner presented the staff report. Ms. Bascom stated that this is a City
initiated application to rezone parcels in the Village Parkway Specific Plan Area from the existing
zoning districts CN, C-1 & C-2 to one uniform zoning district which will be called Planned
Development Village Parkway Specific Plan. The Village Parkway Specific Plan was approved in
December 2000 and has two land use categories that were approved as part of the Specific Plan
which were Retail/Office combination and a Retail/Office & Auto combination. The purpose of the
application is to update the Zoning Ordinance so it conforms to the Specific Plan. Through the
Village Parkway Specific Plan Area Map, Ms. Bascom showed the location of the areas with the
different uses. She explained that the current land use designations in the Specific Plan are not
consistent. Ms. Bascom pointed out two areas in the Specific Plan, which are currently zoned as
Planned Development, and that they have been excluded from the proposed rezoning. Staff
believes that rezoning the other properties to a uniform zoning district would provide the
conformance to the Specific Plan. The property owners were notified through a letter in April
explaining the process. An informational meeting was also held for the property owners. The
property owners did not have any specific concerns on the issue. Staff recommends that the
Planning Commission adopt the attached Resolution recommending City Council approve the
rezoning. Ms. Bascom clarified that the crosshatched area in Attachment 2 of the staff report is the
area that has been excluded from the rezoning.
Cm. Johnson asked the Commissioners if they had any questions for Staff.
Cm. Musser asked if there are any uses currently in the area that are not consistent with the Specific
Plan. Ms. Bascom stated that all the uses are consistent with the Specific Plan. If there are any uses
that are not, they will be allowed to continue as a legal non-conforming use.
Cm. Musser wanted to know if as a result of this rezone, in the future when a Property Owner
decides to change the use of his property, would the Planning Commission be involved in the

decision making. Ms. Bascom stated if a Property Owner proposes new development on the
property, they would have to go through a Site Development Review, may be presented to the
Planning Commission for their approval. Ms. Ram stated that if the change has a minor impact
then it would be decided at Staff level.
Cm. Nassar asked how does the rezoning measure the upgrade and revitalization of the area. Ms
Bascom stated that the rezoning changes the zoning district to Planned Development and that
zoning refers specifically to the Specific Plan, which includes the development standards, allowed
uses and goals. Therefore, the redevelopment and revitalization is contained in the goals and
policies of the Specific Plan and becomes part of the zoning. Cm. Nassar asked how will the City
ensure the upgraded appearance of the property. Ms. Bascom informed Cm. Nassar that the
rezoning provides a framework for consistency in case a property owner would like to change the
use or proposes new development. Ms. Ram stated that the City hopes that as a result of the City's
investments in the infrastructure improvements for the area would encourage the property owners
to do something with their property.
Cm. Johnson opened the public hearing and asked if anyone in the audience who wished to speak
on the item.
Rick Camacho, business owner on 7136 Village Parkway expressed his concerns about the allowed
uses being changed as a result of this rezoning. Ms. Bascom stated that the proposed rezoning
would not change the allowed uses in the area. Mr. Camacho also suggested that the City should
be aggressive in enforcing a cohesive color scheme for the area.
Cm. Johnson closed the public hearing and asked for a motion.
On a motion by Cm. Fasulkey, seconded by Cm. Musser, in the absence of Cm. Jennings, and by a
vote of 4-0, the Planning Commission adopted:

8.2 PA 02-014 West Dublin BART Specific Plan Area Rezoning - A City-initiated
application to rezone parcels in the West Dublin BART Specific Plan Area from
existing zoning districts M-l, C-l, and C-2 to a new Planned Development (West
Dublin BART Specific Plan) Zoning District. The current zoning districts for the
site are partially inconsistent with the Specific Plan adopted for the area in
December 2000. A new Planned Development (West Dublin BART Specific Plan)
Zoning District rezone will bring the zoning for the properties into conformance
with the Specific Plan. This rezoning will not change the allowed uses in the
area, but will serve to apply one Planned Development zoning district to all
properties in the Specific Plan Area and will provide the clearest direction on what
development is desired for the West Dublin BART area.

BART Specific Plan Rezone is the third and the last area for the proposed downtown rezonings.
The current zoning for the West Dublin BART area is Light Industrial and Commercial Zoning
Districts. There are eight land use categories for this area: Retail, Hotel/Lodging, Office, Residential
and mixed use. The West Dublin BART area has a couple of properties that are already zoned as
Planned Development and hence are excluded from this proposed rezoning. The areas excluded
are shown as crosshatched in the map attached to the staff report. Notifications were mailed to the
property owners informing them about the proposed rezoning. The property owners did not have
any specific concerns and hence Staff recommends that the Planning Commission adopt the
attached Resolution recommending that the City Council approve the rezoning for the West Dublin
BART Specific Plan Area.
Cm. Musser asked if there were uses in this area that were inconsistent with the Specific Plan. Ms
Bascom stated that there are some uses which would be inconsistent with the proposed rezoning;
however, they would be considered legal non-conforming uses and would be allowed to cont'mue.
Cm. Nassar asked if the parking garages for BART would be underground. Ms Bascom replied that
the Specific Plan encourages underground parking but it does not preclude the use of surface
parking.

Cm. Johnson asked if the buildings would be 8 stories high. Ms Bascom replied that the Specific
Plan allows 8 stories to be the maximum limit for the buildings in the West Dublin BART area.
Additionally, the FARs specified limit the intensity of the development in the area.
Cm. Johnson opened the public hearing and asked if there was anyone in audience who wished to
speak on the item.
Hearing none he closed the public hearing and asked for a motion.
On a mofion by Cm. Nassar, seconded by Cm. Musser, in the absence of Cm. Jennings, and by a
vote of 4-0, the Planning Commission adopted:
