HomeMy WebLinkAbout01-22-2002 PC MinutesA regular meeting of the City of Dublin Planning Commission was held on Tuesday, January 22, 2002, in the Dublin Civic Center City Council Chambers. Chairperson Johnson called the meeting to order at 7:00 p.m. ROLL CALL Present: Commissioners, Johnson, Musser, and Nassar; Jeri Ram, Planning Manager; Mike Porto, Project Planner; and Renuka Dhadwal, Recording Secretary. Absent: Cm. Jennings & Cm. Fasulkey PLEDGE OF ALLEGIANCE TO THE FLAG Cm. Johnson led the Commission, Staff, and those present in the pledge of allegiance to the flag. The minutes from November 13, 2001 were approved as submitted. The minutes from January 8, 2002 were not approved due to lack of quorum. Cm. Johnson wanted to make a correction to the January 8, 2002 minutes. He suggested changing the phrase "and emerging competitive providers" on Page 93 to "and emerging technologies'. Ms. Jeri Ram stated that the correction would be made and brought before the Commission for approval at the next Planning Commission meeting. ADDITIONS OR REVISIONS TO THE AGENDA - None ORAL COMMUNICATIONS - None WRITTEN COMMUNICATIONS - None ~annir~ Commission ~ff. tIufar P,,leetina 96 January 22, 2002 PUBLIC HEARING 8.1 PA 01-009 Toll Brothers - A Site Development Review and Tentative Map for Dublin Ranch Area G Neighborhood H2 Tract 7327 for 626 dwelling units - 482 stacked flats and 144 town homes; 1 to 3 bedroom - units ranging from 841 sq. ft. to 1,301 sq. ft. Cm. Johnson asked for staff report. Mike Porto, Project Planner, prior to presenting the staff report clarified some items with the Commission. He explained that a memo with some revisions to the Conditions of Approval was handed out. These revisions would be added to the Resolution as part of the Planning Commission's motion. He also pointed out that the number of dwelling units mentioned in the staff report was incorrect. It should read 626 dwelling units. He stated that Neighborhood H-2 is one of the largest sites in the southeast area. All 626 units are condominiums. They range from 841 sq. ft. to 1301 sq. ft. These are the smallest units in the Town Center area. Toll has 10 floor plans for this project. The architecture is Spanish Colonial and has 3 different color schemes. This project will have 4 stories over parking. Staff has worked with the Developer on the Affordable Housing agreement. Toll will be providing 7 1/2 percent (105 units approximately) of the units for affordable housing. Additionally, they will also be paying an in-lieu fee. Mr. Porto then concluded his presentation. Cm. Johnson asked if anyone had any questions. Cm. Johnson asked how many units have direct garage access. Rick Nelson, Senior Project Manager for Toll, said about 35-40 units will have this ability. Cm. Johnson opened the public hearing and asked the Applicant to make his presentation. Rick Nelson, Senior Project Manager for Toll commended Staff for their hard work. He said that this is a unique design for a project of this density. The units are primarily stacked flats. However, town homes have been integrated with the stacked fiats resulting in a pleasing streetscape. He spoke in detail about the unit design. Toll has a variety of floor plans for the project. There are 8 buildings that will be located on a 2-story subterranean parking structure. He talked about access to the parking structure as well as landscaping for these structures and the courtyards. With that he concluded his presentation and said that he would answer any questions for the Commission. ~[anning Commission 97 ~anuarff 22, 2002 qLeguFar Sleeting Cm. Johnson asked if anyone had any questions. Cm. Musser asked for the dimensions of the open space in the courtyards and the separation between the buildings. Rick Nelson said that the dimensions for the courtyards are 80ft. by 60 ft. and for the pedestrian pathway is approximately 40 ft. Cm. Musser asked for the square foot dimensions for landscaping between the street and the structure. Mr. Porto replied that it is generally 50 ft including the pathway and sidewalk dimensions. Mr. Porto and Mr. Nelson explained in detail the landscaping provided by Toll for this project. Cm. Nassar asked for the size of the Neighborhood Park and if it would be accessible to non- homeowners. Mr. Nelson said that the Park would be developed on 6.7 acres of land. Mr. Porto informed the Planning Commission that the Park would be dedicated to the City and therefore would be accessible to all Dublin residents. Cm. Nassar asked for the population projection for the project. Mr. Porto replied that approximately 1300 people are expected to move in. Cm. Nassar asked for the demographics for the project. Mr. Nelson explained that based on Toll's Dublin Greene project, where the average homeowner is a young professional with no kids, it expects a similar ownership. Cm. Johnson asked the price range for the units. Mr. Nelson replied that the units would range from the low $200,000-$300,000 for the smaller units and low to mid $400,000 for the larger units. Cm. Nassar asked clarifications on the affordable housing condition. Particularly, he wanted to know why Toll was paying a fee of $1.4 million. Mr. Porto explained that this was a City negotiated in-lieu housing fee based on the City's current housing ordinance. The City and Toll are still negotiating the details. Cm. Johnson asked if anyone had any questions. Hearing none, he closed the public hearing and asked if the Commission would like to discuss any issues. Cm. Johnson said that he wanted to comment about the Telecommunications condition that was discussed at the previous Planning Commission meeting. Based on the discussions that were held previously and since this project is related to the other three neighborhoods, he wanted a new condition to be added to the conditions of approval which would require Toll to install the conduits from the street to each of the individual units. Cm. Johnson asked Cm. Musser if he would like to comment on this issue. Cm. Musser said that he would like to ask the Applicant's opinion on the matter. ~P[anning Commission 98 January 22, 2002 ~tuFar Sleeting Cm. Johnson reopened the public hearing and asked the Applicant for his comments. Jon Paynter, Vice President for Toll, said that Toll would need to design the conduit system up front and not prior to framing due to the timing factor. Toll would prefer if the City required them to pre-wire the units prior to issuance of Building Permits. Cm. Johnson suggested that if Toll was bringing the conduits to the utility boxes for each unit, then it should be able to pre-wire the units for emerging technologies. Mr. Paynter and Mr. Nelson explained and discussed at length the cost involved as well as feasibility of such a task. Mr. Nelson explained that the reason Toll was bringing the wiring to the utility box for each unit is to provide the capability for the homeowner if they choose to opt for it. After the discussion, it was decided that the following new condition should be added to the conditions of approval: "Condition # 118. Telecommunications - If the City of Dublin approves a revised Telecommunications Ordinance that contains requirements to provide conduit to contain category 5 wiring from the street to each dwelling unit prior to issuance of Building Permits for the residential units, the Applicant/Developer shall be required to provide said conduit." Hearing no other questions, Cm. Johnson closed the public hearing again and asked the Commissioners for their comments. Cm. Musser commended Staff and the Developer for their hard work. Cm. Johnson also agreed with Cm. Musser and said that it is an exciting time for Dublin to have these units and the City of Dublin is looking forward to the development of these projects. On motion by Cm. Musser, seconded by Cm. Nassar, with the addition of Condition # 118 as well as the revisions presented by Staff and by a vote of 3-0-2, with Cm. Jennings and Cm. Fasulkey absent, the Planning Commission adopted RESOLUTION NO. 02 - 06 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF DUBLIN APPOVING THE SITE SITE DEVELOPMENT REVIEW AND TENTATIVE TRACT MAP 7327 FOR PA 01-009 TOLL BROTHERS DUBLIN RANCH AREA G - NEIGHBORHOOD H-2 ~[annintt Commission 99 January 22, 2002 q~ttuFar S~4eeting NEW OR UNFINISHED BUSINESS None OTHER BUSINESS Ms. Jeri Ram discussed with the Commission the Appeal by Dublin Security Storage, which was presented to the City Council on January 15, 2002. She asked Cm. Musser if he would like to inform the Commissioners about the City Council decision since he was present at the City Council meeting. Cm. Musser explained that he made a brief presentation to the City Council regarding the Planning Commission's reason for denial. The City Council wanted to take a tour of the site prior to making a decision. The field trip has been scheduled on February 5, 2002 at 4:00 p.m. Ms. Ram requested Cm. Musser to be present at the field trip in case the Council had any questions. Ms. Ram informed the Planning Commission regarding the Mayor's decision to appeal the Conditional Use Permit for Journey Community Church. She explained that the Mayor's decision to appeal was not due to a conflict with the Planning Commission's decision, but she would like the Applicant to state on record that they understand that the CUP is for two years and, additionally, a Specific Plan Amendment study is proposed for the site.
