ZONING HISTORY:
PA 86-116.1: On December 2, 1986, the Dublin Zoning Administrator
denied a Variance request (Custom Music/Dublin
Investments) to allow the construction of a low profile
sign that would exceed the maximum allowable aggregate
sign area for the site.

On May 4, 1987, Enterprise Rent -a Car (Applicant)
withdrew a Conditional Use Permit application request
to establish an auto rental service with outdoor
storage of rental vehicles.
On September 1, 1987, the Dublin Planning Director
approved an Administrative Conditional Use Permit
request (Custom Music) to allow temporary promotional
displays (30 day time frame).
On June 27, 1989, the Dublin Planning Director approved
an Administrative Conditional Use Permit request (Airco
Supply Company) to allow a 30 day grand opening
temporary promotional sign.
On March 14, 1990, the Dublin Planning Director
approved a Site Development Review request (Dublin
Business Center Sign Program) for new wall signs and a
C-2-B-40 directory sign.
On May 4, 1990, the Dublin Planning Director approved
an Administrative Conditional Use Permit request
(Classic Oak) to allow a 30 day grand opening temporary
promotional sign; and on July 20, 1990, the Planning
Director approved an Administrative Conditional Use
Permit request (Classic Oak) to allow temporary
promotional displays (20 day time frame).
APPLICABLE REGULATIONS:
Section 8-49.2.A.9) Conditional Uses: C-2 Districts states that
an automobile storage or rental lot is a conditional use subject to
Planning Commission approval in the C-2 District.
Section 8-94.0 states that conditional uses must be analyzed to
determine: 1) whether or not the use is required by the public need;
2) whether or not the use will be properly related to other land uses,
transportation and service facilities in the vicinity; 3) whether or
not the use will materially affect the health or safety of persons
residing or working in the vicinity; and 4) whether or not the use
will be contrary to the specific intent clauses or performance
standards established for the district in which it is located.

ENVIRONMENTAL REVIEW: The project has been found to be categorically
exempt from the California Environmental Quality Act (CEQA), under
Section 15303, Class 3 of the State CEQA Guidelines. The use consists
of the minor conversion of an existing commercial tenant space from
one use (formerly retail car stereo store) to another use (car rental
agency).
NOTIFICATION: Public Notice of the May 4, 1992 hearing was published
in the local newspaper, mailed to adjacent property owners, and posted
in public buildings.
ANALYSIS:
The Applicant is requesting Conditional Use Permit approval to
establish a car rental agency with outdoor storage of vehicles in a C-
2-B-40, General Commercial Combining District. An auto storage or
rental lot is a conditional use subject to Planning Commission
approval in the C-2-B-40 District.
Enterprise Rent -a -Car is currently located in the Stroud's Plaza
Shopping Center at 7224 San Ramon Road. The business has been in
operation at this location for approximately five years. The
Applicant's reason for moving to a new location on Dublin Boulevard is
to better serve the community.
Enterprise Rent -a -Car provides car rental services to the public
on a "walk-in" basis, including the pick-up and delivery of rental
vehicles to customers at their home, car repair shop, or place of
business. The Applicant is requesting Conditional Use Permit approval
to allow the temporary on -site storage of rental vehicles until these
vehicles are reserved by customers. A maximum of 15 parking spaces
located at the northwest corner of the project site are proposed for
rental vehicle storage (see Exhibit A). Enterprise -Rent -a -Car will
not service or wash the vehicles on site. All vehicles will be
maintained by car repair facilities or local service stations in the
Dublin area.
Enterprise Rent -a -Car will be operating Monday through Friday
from 7:30 a.m. to 5:30 p.m, and Saturday from 9:00 a.m. to 12:00 p.m.,
which is similar to the existing hours of operation. There is no
record of any zoning violations with the existing operation located on
San Ramon Road.
There is adequate employee and customer parking for Enterprise
Rent -a -Car and other commercial businesses located at the project site
in compliance with the Zoning Ordinance. The site has a total of 69
parking spaces. The businesses currently located at the site,
including Enterprise Rent -a -Car, are only required to have 50 employee
and customer parking spaces. Excluding the 15 parking spaces
designated for rental vehicle storage, 54 parking spaces will remain
at the site for customer and employee parking, which exceeds the
site's parking requirement by 4 spaces.

The project has been reviewed by other City departments and their
comments have been incorporated into the Draft Resolution (Exhibit B)
as conditions of approval. As a condition of the Building Department,
the Applicant will be required to remove the illegal mezzanine floor
located in the Enterprise Rent -a -Car tenant space prior to
establishment of the use. The Applicant is aware of this requirement.
No major concerns were noted by other departments.
The City Attorney reviewed the Staff Report and had no comments.
The project is in compliance with the Zoning Ordinance and the
General Plan.
Staff recommends approval of the Conditional Use Permit request
to allow the establishment of a car rental agency with outdoor storage
in a C-2-B-40 District subject to the conditions specified in the
Draft Resolution (Exhibit B).
RECOMMENDATIONS:
FORMAT: 1) Open public hearing and hear Staff presentation.
2) Take testimony from Applicant and the public.
3) Question Staff, Applicant and the public.
4) Close public hearing and deliberate.
5) Adopt Draft Resolution approving PA 92-016 Enterprise
Rent -a -Car Conditional Use Permit (Exhibit B), or give
Staff and Applicant direction and continue the matter.
ACTION: Staff recommends that the Planning Commission adopt Draft
Resolution (Exhibit B) approving the Conditional Use Permit,
for PA 92-016 Enterprise Rent -a -Car.

RESOLUTION NO. 92 -
A RESOLUTION OF THE PLANNING COMMISSION
OF THE CITY OF DUBLIN
APPROVING PA 92-016 ENTERPRISE RENT -A -CAR CONDITIONAL USE PERMIT TO
ALLOW THE ESTABLISHMENT OF A CAR RENTAL FACILITY WITH OUTDOOR STORAGE
OF RENTAL VEHICLES IN A C-2-B-40 DISTRICT LOCATED
AT 6867 DUBLIN BOULEVARD
WHEREAS, Len Almalech, Applicant, filed a Conditional Use Permit
application to allow the establishment of a car rental facility with
fifteen (15) parking spaces for the outdoor storage of rental
vehicles; and
WHEREAS, the Planning Commission did hold a public hearing on
said application on May 4, 1992; and
WHEREAS, proper notice of said public hearing was given in all
respects as required by law; and
WHEREAS, the application has been reviewed in accordance with the
provisions of the California Environmental Quality Act (CEQA) and was
found to be Categorically Exempt under Section 15303, Class 3; and
WHEREAS, the Staff Report was submitted recommending that the
application be conditionally approved; and
WHEREAS, the Planning Commission did hear and consider all said
reports, recommendations and testimony hereinabove set forth.
NOW, THEREFORE, BE IT RESOLVED THAT THE Dublin Planning
Commission does hereby find that:
A. The proposed project will serve a public need by providing a
car rental agency in the City of Dublin.
B. The use will be properly related to other land uses and
transportation and service facilities in the vicinity, as
the proposed use will be compatible to the type and nature
of operations typically found in the neighborhood.
C. The use, under all circumstances and conditions of this
particular case, will not materially adversely affect the
health or safety of persons residing or working in the
vicinity, or be materially detrimental to the public welfare
or injurious to property or improvements in the
neighborhood, as all applicable regulations will be met.
D. The use will not be contrary to the specific intent clauses
or performance standards established for the district in
which it is to be located.
E. The approval of this Conditional Use Permit is consistent
with the Dublin General Plan.

BE IT FURTHER RESOLVED THAT THE Dublin Planning Commission does
hereby conditionally approve PA 92-016 Conditional Use Permit as
generally depicted on the plans labeled Exhibit A, stamped approved
and on file with the Dublin Planning Department, subject to the
following conditions:
CONDITIONS OF APPROVAL:
Unless stated otherwise, all Conditions of Approval shall be complied
with prior to the issuance of building permits or establishment of
use, and shall be subject to Planning Department review and approval.
The following codes represent those departments/agencies responsible
for monitoring compliance of the conditions of approval. [PL]
Planning, [B] Building, [PO] Police, [PW] Public Works, [ADM]
Administration/City Attorney, [FIN] Finance, [F] Dougherty Regional
Fire Authority, [DSR] Dublin San Ramon Services District, (C0] Alameda
County Department of Environmental Health.
1. This Conditional Use Permit approval for PA 92-016 is to allow
the establishment of a car rental facility with fifteen (15)
parking spaces designated as outdoor storage of rental vehicles,
located at 6867 Dublin Boulevard. This approval shall generally
conform to the plans labeled Exhibit A, stamped approved and on
file with the Dublin Planning Department, and as modified by the
following conditions of approval, consisting of a Site Plan and
Floor Plan (2 sheets) dated received by the Planning Department
March 12, 1992, and a Staff Study dated March 27, 1992. [PL, B]
2. The activities associated with the car rental facility shall
consist of: [PL]
a. administrative and management operations
b. customer service
c. rental vehicle pick-up and delivery
d. temporary outdoor storage of rental vehicles at the fifteen
(15) designated parking spaces
3. The storage and parking of rental vehicles shall occupy a maximum
of fifteen (15) parking spaces located at the rear, northwest
corner of the project site in conformance with the Site Plan
labeled Exhibit A. [PL]
4. The Applicant shall provide appropriate pavement marking
designating the fifteen (15) parking spaces reserved for
Enterprise Rent -a -Car rental vehicles. [PL, PW]
5. The servicing or washing of the rental vehicles or equipment on
the site shall not be permitted. [PL]
6. No loudspeakers or amplified music shall be permitted outside the
enclosed buildings. [PL]

7. The Applicant shall remove the illegal mezzanine floor located
within the Enterprise Rent-A-Car tenant space in compliance with
the Building Department requirements. [B, PL]
8. The Applicant shall comply with all applicable Planning,
Building, Dougherty Regional Fire Authority and Police Department
regulations and ordinances. [PL, B, F, PO]
9. On an annual basis, this Conditional Use Permit shall be subject
to Zoning Investigator review and determination as to compliance
with the conditions of approval. [PL]
10. This approval shall be null and void in the event the approved
use ceases to operate for a continuous one year period. [PL]
11. This permit shall be revocable for cause in accordance with
Section 8-90.3 of the Dublin Zoning Ordinance. Any violation of
the terms or conditions of this use permit shall be subject to
citation. [PL]

Dear Mr. Kachadourian:
As per your request for our use permit, this is a brief summary of
the type of business Enterprise Rent-A-Car provides.
Enterprise Rent-A-Car provides replacement transportation for
individuals whose vehicles are in need of repair. Presently,
Enterprise Rent-A-Car has in excess of 1000 locations nationwide,
with over 38 offices in the San Francisco Bay Area.
Our primary business is to provide replacement transportation for
customers whose vehicles are disabled as a result of an automobile
accident or mechanical problem. Our service includes pick-up and
delivery of rental vehicles to customers at their home, repair
shop, or place of business.
Enterprise Rent-A-Car has long established itself as a community
business. We believe strongly in working with the community in
which we operate branch locations. Since Enterprise Rent-A-Car
does not perform any on -site vehicle maintenance, all vehicles will
be maintained by local service stations and repair facilities in
the Dublin area. Our rental branch in Dublin provides employment
opportunities for Dublin residents, and equally important, we
believe Enterprise Rent-A-Car provides a much needed service to the
residents of the Dublin community.
We are looking to relocate our present location from the Stroud's
Plaza Shopping Center, 7224 San Ramon Road, to a new site, located
at 6867 Dublin Blvd. in Dublin. We feel confident that our new
location will enable us to better service the local Dublin

Enterprise Rent-A-Car does not store vehicles at its rental
location. Enterprise's business philosophy is to run a high
utilization factor with all of our rental vehicles. On occasion,
rental vehicles that are not presently utilized may be temporarily
parked awaiting a customer's reservation. As previously discussed,
it is anticipated, on average, we will need parking for
approximately 15 rental vehicles. All parking will be behind our
new facility in Dublin, which has ample room for our use.
Mr. Kachadourian, I would like to again thank you for meeting with
me to go over the needed essentials for our conditional use permit.
