On March 28, 1973, the Alameda County Zoning
Administrator approved a Conditional Use Permit to
allow the outdoor storage of vans to be converted
to campers, and finished campers before shipment
to dealers within an enclosed portion of the site.
On August 29, 1988, the Planning Director approved
a C-2-B-40 directory sign for the subject site.
On November 5, 1990, the Planning Commission
approved a Conditional Use Permit and Site
Development Review request for Del,Piso Tile and
Brick Company located at 6500 Sierra Court.
APPLICABLE REGULATIONS:
Section 8-51.3 Conditional Uses: M-1 District of the Zoning
Ordinance, states that a recycling facility is a conditional use
in the M-1 District.
Section 8-51.3 Conditional Uses: M-1 District of the Zoning
Ordinance, states that an outdoor storage yard for equipment and
supplies, if conducted within an area enclosed by a solid wall or
fence, may be permitted as a conditional use in the M-1 District.
Section 8-95.0 Site Development Review of the Zoning
Ordinance, establishes findings and procedures for Site
Development Review.
Section 8-94.0 Conditional Uses of the Zoning Ordinance,
states that conditional uses must be analyzed to determine:
1) whether or not the use is required by the public need;
2) whether or not the use will be properly related to other land

uses, transportation and service facilities in the vicinity;
3) whether or not the use will materially affect the health or
safety of persons residing or working in the vicinity; and
4) whether or not the use will be contrary to the specific intent
clauses or performance standards established for the district in
which it is located.
ENVIRONMENTAL REVIEW: A Negative Declaration has been prepared
pursuant to the California Environmental Quality Act (CEQA),
State CEQA Guidelines and the City of Dublin Environmental
Guidelines, Section 1.7(c), 5.5. The proposed project will not
have a significant effect on the environment.
NOTIFICATION: Public Notice of the December 17, 1990 hearing was
published in the local newspaper, mailed to adjacent property
owners, and posted in public buildings.
BACKGROUND:
This item was continued from the December 17, 1990 Planning
Commission meeting in order for Staff to receive written
authorization from the Property Owner regarding the Applicant's
request. The recycling facility is currently operating without
Conditional Use Permit approval.
The Applicant first contacted the Planning Department in the
beginning of August 1990, to inquire about appropriate planning
approvals for the recycling facility. The Applicant submitted a
planning application on September 13, 1990. The Applicant began
to operate the recycling facility prior to submittal of the
application. Zoning enforcement has been held in abeyance
pending the processing of the Applicant's Conditional Use Permit
and Site Development Review application.
At the December 17, 1990 Planning Commission meeting, the
Planning Commission directed Staff to initiate zoning enforcement
procedures. A warning notice was issued to the Applicant and
Property Owners which postponed zoning enforcement if either of
the following occurs before January 23, 1991:
1) written authorization is submitted by the Property
Owners and Conditional Use Permit approval is received
by the Applicant; or
2) the recycling facility ceases to operate.
ANALYSIS:
The Applicant is requesting Conditional Use Permit and Site
Development Review approval to operate a recycling facility and
food distribution center, to limit office uses permitted on the
site, and to allow outdoor storage and exterior site
modifications. The proposed project will be located in an
existing building and the use will occupy approximately 16,000

square feet of warehouse space and no more than 20 parking spaces
for outdoor storage of bins and truck trailers containing
recyclable materials.
An approved Conditional Use Permit is required for the
project because a recycling facility and outdoor storage are
conditional uses within an M-1, Light Industrial District. A
Site Development Review permit is required because the project
will result in exterior changes to the property in that the
proposed outdoor storage would displace parking spaces, possibly
impact travel lanes, and include screen fencing for outdoor
storage.
On January 10, 1991, Staff received a letter from the
Property Owners (see Attachment 1) which authorizes the Applicant
to apply for a Conditional Use Permit to operate a recycling
facility and food distribution center within the leased space
portion of the building. The Property Owners are not authorizing
the Applicant to apply for the outdoor storage of truck trailers
and bins containing recyclable material.
Staff is concerned with the compatibility of the outdoor
storage use (i.e., fork lifting operation) with other businesses
on the site and the unattractiveness of outdoor storage. Due to
these concerns and the lack of property owner authorization of
the outdoor storage use, Staff recommends Planning Commission
denial of the request to allow outdoor storage.
As described in the Applicant's written statement (see
Attachment 3), the operation of the recycling facility will
involve collecting, sorting, storing and preparing recyclable
material for transport to appropriate recycling processors. Much
of the recyclable material is retrieved at sources, or collection
sites (i.e., bars, restaurants, office complexes, etc.). The
bins containing this material are then emptied in the warehouse.
All sorting and preparing of the material for shipment is done
within the building.
Operation of the facility also involves a buy-back or drop-
off program for the public. The Applicant will not allow patrons
inside the warehouse. They will be parking outside and given
carts and bins to transport the material to the entrance of the
warehouse where they will be assisted by employees of the
recycling facility. Public drop-off hours will be from
10:00 a.m. to 5:30 p.m.
The food distribution center will involve storage of
packaged and refrigerated fresh foods in the warehouse and
distribution of food to community -based organizations and other
charitable organizations.
The project has been reviewed by the City's Public Works,
Building, Fire, Police and Administration departments, as well as

the Alameda County Department of Environmental Health, Dublin San
Ramon Services District, and the Livermore Dublin Disposal
Service. All comments from public agencies and City departments
have been incorporated into the attached Draft Planning
Commission Resolution, Exhibit C, as conditions of approval.
One issue of concern is that the Applicant will be handling
and storing hazardous materials and will also be collecting and
storing food at the recycling facility. In order to conduct
these activities, the Applicant must obtain appropriate approvals
from the Alameda County Department of Environmental Health and
the Dougherty Regional Fire Authority. Both agencies have
specified that all hazardous materials must be stored in a
secondary container which will be able to contain the hazardous
materials in the event of a failure in the primary container. It
should be noted that draft conditions of approval (Exhibit C)
require a final inspection of the recycling facility and food
distribution center by the City, the Dougherty Regional Fire
Authority and the Alameda County Department of Environmental
Health within 21 days of project approval by the Planning
Commission and every year thereafter.
In addition to applying for planning permits, the Applicant
has applied for a Recycling Transporter Permit and a Recycling
Facility Permit with the City Administration Department. The
Recycling Facility Permit can be issued only after appropriate
planning approval (Conditional Use Permit) has been obtained.
Conditions are included in the Draft Resolution (Exhibit C) which
require the Applicant to apply for these approvals.
The Applicant is not proposing to transport solid waste or
non -recyclable material. However, there is the potential for
non -recyclable material to enter the bins located at receptor
sources. According to the Recycling Permit and Transporter
Permit requirements, the Applicant will be allowed to transport
only source separated recyclable material and will be required to
inspect all bins and containers at the receptor sites for non -
recyclable material prior to the transport of the bins to the
recycling facility.
In accordance with the California Environmental Quality Act
(CEQA), because the recycling facility will be storing and
handling hazardous material which has the potential to emit
hazardous air emissions in the event of an explosion, the Dublin
Unified School District and the Fountainhead Montessori School
(located within one-fourth of a mile of the recycling facility),
have been notified of this project more than 30 days prior to the
hearing date. Staff has not received any comments from either
school on the project or the Negative Declaration.
The proposed project is in compliance with the City's Zoning
Ordinance and the General Plan.

Staff recommends approval of the Applicant's Conditional Use
Permit request to operate an indoor recycling facility and food
distribution center without outdoor storage, subject to the
conditions specified in the Draft Resolution, Exhibit C; and
denial of the Applicant's Site Development Review request to
allow exterior modifications regaring outdoor storage.

PA 90-081.

ADOPTING A NEGATIVE DECLARATION FOR
PA 90-081 UNITED HANDS ENVIRONMENTAL CENTER CONDITIONAL USE PERMIT
TO ALLOW OPERATION OF A RECYCLING FACILITY AND FOOD DISTRIBUTION CENTER
AT 6488 SIERRA COURT
WHEREAS, William Moss, owner and operator of United Hands
Environmental Center, filed an application requesting Conditional Use
Permit and Site Development Review approval to allow the operation of a
recycling facility and food distribution center, to allow outdoor storage,
and to construct exterior modifications to the existing building and
improved site located at 6488 Sierra Court, more specifically APN 941-205-
11; and
WHEREAS, the Planning Commission did review and consider the Negative
Declaration at a public hearing held on December 17, 1990 and January 22,
1991; and
WHEREAS, proper notice of said public hearing was given in all
respects as required by law; and
WHEREAS, the California Environmental Quality Act (CEQA), State CEQA
Guidelines and the City Environmental Guidelines require that certain
projects be reviewed for environmental impacts and that environmental
documentation must be prepared; and
WHEREAS, an Initial Study was prepared finding that the project, as
proposed, would not have a significant effect on the environment; and
WHEREAS, a Negative Declaration has been prepared for this
application.
NOW, THEREFORE, BE IT RESOLVED THAT THE Dublin Planning Commission
does hereby find that:
1. The Conditional Use Permit for the project, PA 90-081, will not
have a significant effect on the environment.
2. The Negative Declaration has been prepared and processed in
accordance with State and local environmental laws and guideline
regulations.
3. The Negative Declaration is complete and adequate.

WITHOUT OUTDOOR STORAGE AT 6488 SIERRA COURT
WHEREAS, William Moss, owner and operator of United Hands
Environmental Center, filed an application requesting Conditional Use
Permit and Site Development Review approval to allow the operation of
a recycling facility and food distribution center, to allow outdoor
storage, and to construct exterior modifications to the existing
improved site located at 6488 Sierra Court; and
WHEREAS, the Planning Commission did hold a public hearing on
said application on December 17, 1990 and January 22, 1991; and
WHEREAS, proper notice of said public hearing was given in all
respects as required by law; and
WHEREAS, the application has been reviewed in accordance with the
provisions of the California Environmental Quality Act (CEQA) and a
Negative Declaration has been adopted (Planning Commission Resolution
No. ) for this project as it will have no significant effect on
the environment; and
WHEREAS, the Applicant's Conditional Use Permit and Site
Development Review request for outdoor storage does not have Property
Owner authorization; and
WHEREAS, the Staff Report was submitted recommending that the
application be conditionally approved; and
WHEREAS, the proposed land use, if conditionally approved, is
appropriate for the subject property in terms of being compatible with
the existing land uses in the area and will not overburden public
services; and
WHEREAS, the Planning Commission did hear and consider all said
reports, recommendations and testimony hereinabove set forth.
NOW, THEREFORE, BE IT RESOLVED THAT THE Dublin Planning
Commission does hereby find:
A. The United Hands Environmental Center will serve the public
need by providing a recycling service and food distribution
center for the community.
B. The use will be properly related to other land uses,
transportation and service facilities in the vicinity, as
the proposed use will be compatible to said land uses,
transportation and service facilities in the immediate
vicinity.
C. The use will not materially adversely affect the health or
safety of persons residing or working in the vicinity, or be

materially detrimental to the public welfare or injurious to
property or improvements in the neighborhood, as all
applicable regulations will be met.
D. The use will not be contrary to the specific intent clauses
or performance standards established for the district in
which it is to be located, as the proposed use is compatible
with the adjacent general commercial and retail business
district uses.
E. The project is consistent with the policies contained in the
City's General Plan.
BE IT FURTHER RESOLVED THAT THE Dublin Planning Commission does
hereby conditionally approve Conditional Use Permit application PA 90-
081 as shown in Exhibit A, subject to the following conditions:
CONDITIONS OF APPROVAL:
Unless stated otherwise, all Conditions of Approval shall be complied
with within 21 days of the effective date of this Conditional Use
Permit approval, and shall be subject to Planning Department review
and approval. The following codes represent those departments/
agencies responsible for monitoring compliance of the conditions of
approval. FPL1 Planning, [B1 Building, fPO1 Police, fPWI Public
Works, FADMIN1 Administration, FDRFA1 Dougherty Regional Fire
Authority, FDSRSD1 Dublin San Ramon Services District, FCOUNTY1
Alameda County Department of Environmental Health.
1. PA 90-081 Conditional Use Permit approval is to allow the
operation of: an indoor recycling facility to include
collecting, sorting, storing and preparing source separated
recyclable material for transport to appropriate recycling
processors and a buy-back or drop-off (of recyclable
material) program for the public; and a food distribution
center to include the storing and distribution of packaged
and refrigerated food; as shown on the floor plan dated
received by the Planning Department September 13, 1990
(Exhibit A). This Conditional Use Permit approval does not
allow outdoor storage.(PL)
2. All outdoor activities related to the loading and unloading
of recyclable material (unloading for transport into
recycling facility; loading for transport to recycling
processors) shall take place between the hours of 7:30 a.m.
and 5:30 p.m., except as may be approved in advance in
writing by the Planning Director.(PL)
3. The Applicant shall be responsible for maintaining the site
and adjacent neighborhoods clean and free of project related
debris.(PL)
4. No loudspeakers or amplified music shall be permitted
outside the enclosed building.(PL)

5. All signs shall be subject to the requirements of the Dublin
Zoning Ordinance.(PL)
6. Approval must be obtained from the Alameda County Department
of Environmental Health to collect, transport and store
hazardous material and to collect and store food. This
approval must be obtained within 21 days of the effective
date of this approval.(PL) (COUNTY)
7. The Applicant must comply with all the requirements of the
Dougherty Regional Fire Authority. In particular, all
hazardous materials must be stored in a secondary
containment system.(DRFA)
8. A final inspection of the uses shall be conducted by the
City Planning Department, Administration Department, Alameda
County Department of Environmental Health and the Dougherty
Regional Fire Authority within 21 days of the effective date
of this approval, and every year thereafter. (PL) (ADMIN)

9. The Applicant shall provide written documentation to the
City Planning Department that the requirements of the
Alameda County Department of Environmental Health and the
Dougherty Regional Fire Authority have been met.(PL)
10. A Recycling Facility Permit and Transporter Permit must be
obtained from the City within 21 days of the effective date
of this approval.(ADMIN) (PL)
11. In accordance with the Solid Waste Ordinance, all containers
or bins left at collection sites must be properly identified
with the property owner's name, address and telephone number
and each must state what should and what should not be put
in the containers. The Applicant must obtain permission
from the property owner prior to placement of the
containers. The containers shall be kept clean and well
maintained at all times, such that no nuisances are created
(i.e., noise, dust, odor, litter or vectors). The
containers shall be located in areas which do not cause
public safety problems or obstruct required parking or drive
aisles.(ADMIN) (PL)
12. The collection, transport, storage and handling of
recyclable materials must be conducted in ways which prevent
the creation of nuisances (i.e., noise, dust, odor, litter
and vectors).(PL)
13. The Applicant shall operate the recycling use at all times
in accordance with all the provisions of Chapter 5.32 of the
Dublin Municipal Code.(ADMIN) (PL)
14. The Applicant shall comply with the Building Code
requirements related to the amount of hazardous material
which can be stored within a building. The Applicant shall

consult with the City Building Department within 21 days of
the effective date of this approval.(B)
15. The Applicant shall work with the Dublin Police Services
Department on an ongoing basis to establish an effective
theft prevention and security program.(PO)
16. The Applicant must submit project plans to the Dublin San
Ramon Services District for review of water and sewer
facilities, in particular, the "cleaning area" located in
the recycling facility and determination of related fees.
Within 21 days of the effective date of this approval, the
Applicant shall supply written confirmation to the Planning
Director that the requirements of the Dublin San Ramon
Services District have been met.(DSRSD) (PL)
17. All damaged on -site pavement sections shall be repaired or
replaced as directed by the City Public Works Director.(PW)
18. All damaged concrete aprons around catch basins shall be
replaced by a three foot concrete apron in accordance with
City of Dublin Standard Plans, CD-306.(PW)
19. The Applicant shall submit for review and approval by the
City Public Works Director an "Off -site Public Service
Directional Sign Plan" for United Hands Charities (a non-
profit organization), showing location, type, size,
material, and post type of proposed sign(s). An
Encroachment Permit application is required to be submitted
to the Public Works Department for these signs. All costs
to construct and install the signage shall be paid by the
Applicant.(PW)
20. An Encroachment Permit shall be secured from the Public
Works Director for any work done in the public right-of-
way.(PW)
21. The Applicant shall conform to the "Typical Public Works
Conditions of Approval for Commercial/Industrial Site
Development Review or Conditional Use Permit Development"
(attached). In particular, the Applicant must comply with
conditions #26, #33, #37, #38, #40 and #47.(PW)
22. On an annual basis, the recycling facility/outdoor storage
and food distribution center uses shall be subject to Zoning
Investigator, Alameda County Department of Environmental
Health and Dougherty Regional Fire Authority review and
determination as to the compliance with the Conditions of
Approval.(PL) (COUNTY) (DRFA)
23. This approval shall become null and void, in the event the
approved use ceases to operate for a continuous one year
period.(PL)

24. This permit shall be revocable for cause in accordance with
Section 8-90.3 of the Dublin Zoning Ordinance. Any
violation of the terms or conditions of this permit shall be
subject to citation.(PL)

Permit and Site Development Review approval to allow the operation of
a recycling facility and food distribution center, to allow outdoor
storage, and to construct exterior modifications to the existing
improved site located at 6488 Sierra Court; and
WHEREAS, the Planning Commission did hold a public hearing on

Section 8-95.0 through 8-95.8 Site Development Review of the
Zoning Ordinance.
B. The project is not consistent with Section 8-95.0, in that
the project will not promote orderly, attractive and
harmonious development, recognize environmental limitations
on development; stabilize land values and investments; and
promote the general welfare by preventing establishment of
uses or erection of structures having qualities which would
not meet the specific intent clauses or performance
standards set forth in the Zoning Ordinance and which are
not consistent with their environmental setting.
C. The approval of the application is not in the best interest
of the public health, safety and general welfare.
D. General site considerations regarding the proposed exterior
modifications, including site layout, vehicular access,
circulation and parking, setbacks, height, walls, public

safety and similar elements have not been designed to
provide a desirable environment for the development.
E. General architectural considerations, including the
character, scale and quality of the design, the
architectural relationship with the site and other
buildings, building materials and colors, screening of
exterior appurtenances, exterior lighting, and similar
elements have not been incorporated into the project in
order to insure compatibility of this development with its

Background, History, and -Goals
United Hands was created shortly after the earthquake, in response
the overwhelming need of the victims of the earthquake and the
desire of the residents of the Tri-Valley Area to respond with
their gifts of love, food, clothes, volunteer hours, etc. Within
45 days following the earthquake, United Hands, a newly created and
loosely formed community base organization (CBO), shipped
approximately 1/2 million pounds of food, clothing, bedding and
supplies to the needy and other CBO's.
As the founder and executive director of United Hands, William
Moss, found it important to individually continue to help other
local families and agencies. A local food pantries were created,
currently giving ever $4,000 per week to agencies and local needy.
His desire was to do this full time and to support United Hands
staff's and it's activities.
As a result of picking up surplus food at the restaurant Fresh
Choice, at the mall, United Hands was introduce to the economical
opportunity to support it's staff and goals through recycling.
Recycling can be a profitable business, but requires a substantial
up front capital. It was necessary to create a partnership with
private investors, local businesses, the general public, along with
the CBO, United Hands Foundation.
Because of recent change in state laws that mandate the cities to
reduce their landfills uses and the public awareness and their
desire to recycle, there is plenty of the products, but no one was
willing to do/be a one stop drop site for recyclables, except the
local garbage companies and their cans. The local garbage
company's motives, while honorable, make money by generally
encouraging waste and or discards, where United Hands as an high
breed, working for profit and as a CBO, can encouraged
environmental conservation, and reduce the garbage stream, while
providing assistants to local needy and financially supporting
other CBO's from it's share of the profit from the
environmental/recycling center.
One thing is apparent, we must preserve our natural resources, our
landfills, our environment and reduce the garbage stream. In the
following manner United Hands Environmental Center plans to help:
1. Save/Salvage as much useable food from restaurants, stores, and
home gardens.
2. Take the salvage food and provide it to the local needy, CBO's,
resthomes, etc.
3. To recycle the obvious, redemption glass, redemption aluminum

4. To recycle other items that are traditional, but not as
profitable, misc glass, (mayonnaise, baby food jars), misc aluminum
cans (like cat food cans), newspapers, cardboard, junk mail, etc.
5. To accept for recycling non-profitable material such as
polystyrene (styrofoam), polyurethane (plastic bags), misc. other
plastic, like clothes hangers, plastic milk and water bottles,
tin/steel cans, wire clothes hangers.
6. Other items like, office paper, copper, brass.
7. To provide a central drop site for products like motor oil,
transmission fluid, anti -freeze, water -base paints, car batteries,
flashlight batteries, etc. (No other hazardous waste.)
8. Clothing/Rags, furniture, mattresses, appliances, bric and brac,
other salvageable items.
9. Limited amounts of car parts, such as generator, starters.
As a company that is operated as for profit and with a large
portion of it's profits going to local CBO's. We feel mandated to
provide to the community a service that other companies, like the
garbage company and other recyclers cannot provide because of the
lack of profitability for them.
It is important to understand we'll be taking a wide variety of
items. We have no intentions of taking tires, hazardous chemicals,
complete automobiles or any items that will be objectionable to the
community and our neighbors.

Operational Plan
It is our intention to operate a environmental/recycling center as
a service to the community, with the portion of the profits going
to Community Base Organizations.
It is also our intentions to establish from and through our center
a speaker program that could visit schools, churches and service
organization to encourage environmental conservation.
Tours will be offered to schools and agencies along with video tape
presentations on the subject of recycling and conservation.
The physical operation is broken into 4 different parts:
1. Retrieval at the sources, such as bars, office complexes,
hotels, etc. Their source separated recyclable material.
Currently we have approximately 200, 2 yard recycling bins,
with an additional 200 bins to arrive in the near future. Our
delivery trucks will take empty bins and exchange those for
full bins, which will be returned to our recycling facility on
Sierra Court. Once the full bins are return to our
facilities, the material will be sorted and prepared for
shipment to the appropriate processing or recycling processor.
It is important to note that all sorting and preparing for
shipment will be done inside the physical building.
2. A typical buy-back or drop-off program where the public can
come to our facility and leave the allowed recyclable material
including the list that is attached here to. It is important
to note that the public's cars/trucks will not be allowed in
the physical warehouse. We'll provide to them carts, baskets
or bins for the transfer of their material from their cars to
our receiving station/scales. The public portion of our
facility will be less than 1,000 sq ft. This is for the
public protection and our security.
3. Once the materials are received in our facility they will then
be prepared for shipment inside and at the appropriate work
station. Recycleables will be prepared as follows: Aluminum
cans will be crushed, Bottles will be sorted by color,
Plastics will be accumulated and bailed, Cardboard will be
accumulated and bailed daily, Metals will be accumulated,
crushed and bailed. Once the products are bailed, compacted,
or sorted, it will then be prepare for shipment to the
processor/recyclers
4. Shipping and Distribution, large trucks, vans, and roll -offs
will be employed to deliver the merchandize to the market.

Transportation of recyclables will include Newspaper, 30 to 40
yd bin that is covered will be employed, Aluminum a 27 to 40
ft enclosed container, Cardboard a 40 ft flat bed truck.
Plastic product (s) will be shipped on smaller truck(s) as well
as other paper products such as office paper.
In working with the Fire Marshall and Health Department, it is my
understanding the Fire Department would like less than 10 total
bails of cardboard and or plastic products inside the building at
any given time, with the balance outside prior to shipping. As it
relates to the use of motor oil, we are currently defining with the
Alameda Health Department and Dublin Fire Department the best way
to handle and store this product.
In as much as this Environmental Center will be open to the public
and will be offering tours, it is our intention to provide a clean
and safe facility to demonstrate to the public that recycling is
not and should not be a garbagely or trashy business.(This of
course is good business and a safety requirement also.)
In addition to the program and it's obvious benefits to the
community, there is a distinctive advantage to the host city.
Every ton, pound, etc, that is shipped from our facility, could and
should apply to the city's mandated in compliance with the new
state laws regarding waste reduction. We are prepared to supply,
meaningful reports to the city's manager's office, with the
understanding that confidential trade information be kept
confidential and not available to the general public, as allow
under the state conservation code.
We will require appropriate signage to make it easy (there by
encouraging recycling) for the public to find/locate the center.
