PA 83-055: On December 6, 1983, the Planning Commission approved a one -day pet vaccination clinic. PA 83-077: On November 16, 1983, the Planning Director approved a Site Development Review request for a wall mounted sign for Liquor Barn. PA 85-006: On January 24, 1985, the Planning Director approved an Administrative Conditional Use Permit for promotional advertising display for Pak'n Save. On May 5, 1986, the Planning Commission approved a Conditional Use Permit for a three day pet vaccination clinic. On May 16, 1986, a member of the Dublin City Council appealed the decision of the Planning Commission. On May 29, 1986, the Applicant withdrew the application. On April 28, 1988, the Planning Director approved a Site Development Review request to remodel portions of the exterior facade of the existing Liquor Barn. On May 2, 1988, the Applicant appealed the Planning Director's action to the Planning Commission. On June 28, 1988, the Planning Commission accepted withdrawal of the appeal. -2- PA 88-078: PA 89-134: PA 90-052: PA 90-098: On September 19, 1988, the Planning Commission approved a Conditional Use Permit request by 20/20 Recycle Centers to establish a recycling center in the parking lot. This permit expired on September 28, 1989. On November 17, 1989, the Planning Director approved an Administrative Conditional Use Permit to allow the operation of a Christmas tree lot in the parking lot. On June 28, 1990, 20/20 Recycle Centers applied for renewal of PA 88-078. However, the Applicant withdrew the application on August 10, 1990, citing low volume of business and contract termination with grocer as reasons for withdrawal. On November 18, 1990, the Planning Director approved an Administrative Conditional Use Permit to allow the operation of a Christmas tree lot in the parking lot. APPLICABLE REGULATIONS: _ Section 8-61.0 of the Zoning Ordinance, as amended by Ordinance 17-84, requires that (in any zoning district) a Conditional Use Permit be obtained from the Planning Commission for the operation of recycling centers which would collect, sort and temporarily store glass, metals and other reusable materials (it does not allow for processing activities to occur). Section 8-94.0 states that conditional uses must be analyzed to determine: 1) whether or not the use is required by the public need; 2) whether or not the use will be properly related to other land uses, transportation and service facilities in the vicinity; 3) whether or not the use will materially affect the health or safety of persons residing or working in the vicinity; and 4) whether or not the use will be contrary to the specific intent clauses or performance standards established for the district in which it is located. ENVIRONMENTAL REVIEW: Categorically exempt pursuant to the California Environmental Quality Act (CEQA) guidelines, Section 15303, Class 3(e) and Section 15311, Class 11 - Installation of new accessory structures and placement of minor structures accessory to existing commercial facilities. NOTIFICATION: Public Notice of the January 22, 1991 hearing was published in the local newspaper, mailed to adjacent property owners, and posted in public buildings. ANALYSIS: The Applicant is requesting approval of a Conditional Use Permit to allow the operation of a recycle/donation center in the parking lot area of the Pak'n Save Shopping Center. The Zoning Ordinance requires an approved Conditional Use Permit in order to operate a recycling center at the proposed site. The use is not anticipated to create any special problems for the existing commercial tenants at the shopping center. The use will consist of placing a self-contained truck trailer standing 13 feet in height, with a length of 25 feet and a width of 8 feet in the northwest portion of the parking lot of Pak'n Save Shopping Center (see Exhibit A). The hours of operation for the station are 9:30 a.m. to 5:00 p.m. seven days a week. A Goodwill employee will be present at the trailer during business hours to issue vouchers and receipts to donors and to keep the surrounding area clean. During non -business hours, the recycling/donation station trailer doors will be secured and locked. The usual concerns regarding these types of use are the trailer's impact on parking, circulation and access, visual impact, and after -hour donations left outside the trailer. However, the location at the Pak'n Save Shopping Center (next to Liquor Barn) does not hinder traffic circulation and is placed in under-utilized parking area. Staff recommends that the maximum number of parking spaces to be used for the recycling/donation center be limited to four. Ample, convenient parking is available in the center and within the vicinity of the main entries of the site's uses. The location is away from public streets and screened by parking lot landscaping, convenient and visible for customers and is not a hindrance to traffic circulation. In response to the issue of after-hours donation items left outside the trailer, the Applicant indicated that Goodwill trucks regularly check donation sites after hours to pick up any items that might be left outside the trailer. A condition of approval has been included in the draft resolution (Exhibit B) to ensure the site is maintained in a litter free condition and requiring items to be stored inside the truck trailer and prohibiting items from being left outside the trailer for more than 12 hours. Another condition of approval has been included in the draft resolution which requires the Applicant to maintain on -site informational signs, visible after hours, which clearly show the hours of operation, drop-off instructions for unattended after hours, and a 24-hour emergency or complaint telephone number. -4- Since March 28, 1989, the Applicant has operated a donation station on Amador Valley Boulevard without any zoning violation complaints. The Applicant has been informed by a letter from the Assistant City Manager that a recycling facility permit and a recycling transporter permit must be obtained prior to beginning operation of the use. A condition of approval has been included in the draft resolution to ensure that these permits are obtained. The Applicant's proposal has been reviewed by the applicable public agencies. Conditions of approval have been included in the draft resolution. RECOMMENDATIONS: FORMAT: 1) Open public hearing and hear Staff presentation. 2) Take testimony from Applicant and the public. 3) Question Staff, Applicant and the public. 4) Close public hearing and deliberate. 5) Adopt resolution approving Conditional Use Permit, or give Staff and Applicant direction and continue the matter. ACTION: Staff recommends the Planning Commission adopt the attached resolution (Exhibit B) approving Conditional Use Permit application PA 90-099 for Goodwill Industries. NOW, THEREFORE, BE IT RESOLVED THAT THE Dublin Planning Commission does hereby find that: A. The use is required by the public need in that it provides a location for the general public to drop off reusable items. B. The use will be properly related to other land uses and transportation and service facilities in the vicinity, as the proposed use will be compatible to the type and nature of operations typically found in the neighborhood. C. The use, if permitted, under all circumstances and conditions of this particular case, will not materially affect adversely the health or safety of persons residing or working in the vicinity, or be materially detrimental to the public welfare or injurious to property or improvements in the neighborhood, as all applicable regulations will be met. D. The use will not be contrary to the specific intent clauses or performance standards established for the district in which it is to be located as conditions have been applied to insure conformance with the zoning regulations. 8 BE IT FURTHER RESOLVED THAT THE Dublin Planning Commission does hereby conditionally approve said application as shown on the attached Exhibit A subject to the following conditions: CONDITIONS OF APPROVAL:. Unless stated otherwise, all Conditions of Approval shall be complied with prior to the issuance of building permits or establishment of use, and shall be subject to Planning Department review and approval. 1. This approval is for the Recycling/Donation Station use, which shall consist of a truck trailer located in the northwest portion of the Pak'n Save Shopping Center parking lot at 6605-6633 Dublin Boulevard, as generally depicted on the site plan labeled Exhibit A 2. The maximum number of parking spaces to be occupied by the Recycling/Donation Station shall be limited to four. 3. The Applicant shall obtain an annual Recycling Permit and Recycling Transporter Permit for the site as required by Resolution 26-86. 4. The recycling/donation station shall not interfere with or obstruct vehicular access or movement within the parking lot. 5. The hours of operation shall be from 9:30 a.m. to 5:00 p.m., 7 days a week. After hours, the trailer shall be locked and secured. 6. The Applicant shall be responsible for maintaining the Recycling/Donation Station in an attractive and functionally operative manner. 7. The Applicant shall take all necessary precautions to ensure that the areas surrounding the truck trailer are maintained free of litter and other debris. All recyclable and donated materials shall be stored inside the trailer, and no items shall be left outside the trailer for more than 12 hours. 8. The Applicant shall control activities connected to this use so as not to create a nuisance to the existing businesses or shoppers. 9. The Applicant shall maintain on -site signage clearly indicating hours of operation, drop-off instructions for unattended after hours and a 24-hour emergency or complaint telephone number. Said signage shall be limited to two signs, each a maximum of 8 square feet of area, and said signage shall be visible after hours subject to Planning Director review and approval. 10. The supermarket for which the recycling/donation facility is located shall post, in a convenient, visible location within the supermarket, entrances and exists, the location of the recycling/donation facility. 11. The Applicant shall submit evidence to the Planning Director that appropriate State and City licenses, permits or certificates to operate the recycling/donation station have been obtained. 12. Should the Applicant desire to move the trailer to an alternate location on the project site during the effective period of this permit, such a move shall secure City Planning Department review and approval a minimum of two weeks prior to its relocation. 13. This approval shall become null and void in the event the approved use ceases to operate for a continuous one-year period. 14. This permit shall be revocable for cause in accordance with Section 8-90.3 of the Dublin Zoning Ordinance. Any violation of the terms and conditions of this permit shall be subject to citation. 15. On an annual basis, these uses shall be subject to Zoning Investigator review and determination as to compliance with the conditions of approval. During non -business hours the donation recy-cling station will be secured and locked. All recyclables and donations will be self contained. After hours a Goodwill truck will make pick-ups of any items which might have been left by donors. During the day a pick-up delivery vehicle is available on an on -call basis. Whenever the trailer gets full it will then be replaced. (normally once a week, depending oh volume). Vouchers will be issued to donors on all CA redeemables such as aluminum cans, glass & plastics, and accepted at the Pac & Save and any of Goodwills retail outlets. As a community service, the station provides Dublin residents a convenient method for donating their used goods to Goodwill Industries. From a business perspective however, the Donation Station is in fact the lifeblood of our nonprofit organization. It is our primary method of collecting our merchandise, i.e, used goods. Sales proceeds from our business (e.g., Goodwill Store) operations provide sole financial support for our on-the-job training and job placement services that serve vocationally handicapped adults in th greater East Bay. The direct benefit to Dublin is related to the extent to which local residents may participate in our human service programs. Otherwise, the Dublin operation helps the support the entire business and therefore vocationally handicapped people from throughout Alameda, Contra Costa and Solano counties. As an additional community benefit, the donation of used goods to Goodwill Industries helps to keep those goods out of the waste stream and ultimately out of landfills, or dumps. The person who donates a piece of used clothing or a household item to Goodwill, rather than throwing it away, is helping to protect the environment by "recycling" that item and preventing it from becoming garbage. The community wins, the environment wins, and ultimately, handicapped and disadvantaged people win by benefiting from Goodwill's human services programs. RECEIVED. The Planning Department is processing a Conditional Use Permit, which addresses land use issues. The purpose of this letter is to inform you of requirements for a "Recycling Facility Permit" and a "Recycling Transporter Permit." As a practical matter, these permits cannot be issued until you have obtained land use approval. However, I wanted to transmit information which will provide you with an understanding of these permits. I will recommend to the Planning Department that obtaining these permits should be a condition of your use permit. Enclosed are the following documents: 1. Recycling Facility Permit 2. Recycling Transporter Permit 3.
