County of Alameda Resolution No. Z-2871 established the conditions of approval for the Conditional Use Permit (C-3207). In 1987 and 1988, the Dublin Planning Department approved three Administrative Conditional Use Permits for temporary promotional signs and displays for the Dublin Honda dealership. On April 16, 1990, the Dublin Planning Commission approved Dublin Honda's Conditional Use Permit and Site Development Review requests, PA 89-040 (CUP/SDR for signs) and PA 89-122 (CUP/SDR for building addition), to permit a 27-foot tall freestanding sign; to construct a 5,392 square foot expansion of the existing Dublin Honda auto dealership building; and to permit three wall signs. On February 12, 1990, the Dublin Planning Department approved Dublin Honda's Administrative Conditional Use Permit request for temporary promotional signs and displays. -2- PACE , OF a APPLICABLE REGULATIONS: Section 8-87.10Y) Definitions states that time/temperature signs, electronic readerboard or other changeable copy signs are signs on which the copy is manually or electronically changed and which are intended primarily to promote items of general interest to the community such as time, temperature, and/or date. Section 8-87.33B)1)2) Wall Signs and Projecting Signs states that the maximum sign height, length and area for primary and secondary building frontage wall signs may be increased subject to Site Development Review approval. Section 8-87.34 Freestanding Signs of the Zoning Ordinance establishes provisions for regulating freestanding signs. Section 8-87.34B)2)b) Freestanding Signs of the Zoning Ordinance states that single use parcels one and one-half acres or greater in size may utilize signs up to a maximum height of thirty-five (35) feet, subject to approval of a Conditional Use Permit. Section 8-87.60E) Signs Requiring Conditional Use Permits states that time/temperature signs, electronic readerboards or other changeable copy signs on which the copy is manually or electronically changed and when used,to promote items of general interest to the community such as time, temperature, and/or date, require Conditional Use Permit approval. Section 8-94.0 states that conditional uses must be analyzed to determine: 1) whether or not the use is required by the public need; 2) whether or not the use will be properly related to other land uses, transportation and service facilities in the vicinity; 3) whether or not the use will materially affect the health or safety of persons residing or working in the vicinity; and 4) whether or not the use will be contrary to the specific intent clauses or performance standards established for the district in which it is located. Section 8-95.0 Site Development Review. This review is intended to 1) provide orderly, attractive and harmonious development; 2) recognize environmental limitations on development; 3) stabilize land values and investments; and 4) promote the general welfare by preventing establishment of specific intent clauses or performance standards established for the district in which it is located. ENVIRONMENTAL REVIEW: The project has been found to be Categorically Exempt from CEQA under Section 15311(a), Class 11 of the California Environmental Quality Act guidelines. The project consists of the placement of on -premise signs on a commercial site. NOTIFICATION: Public Notice of the November 4, 1991, hearing was published in the local newspaper, mailed to adjacent property owners, and posted in public buildings. -3- PAGE OF`� ANALYSIS: The Applicant is requesting Conditional Use Permit approval for one 35-foot tall freestanding sign with changeable copy (electronic readerboard) with a setback of 67.5 feet from the existing Interstate 680 Freeway right-of-way, a zero setback from the rear property line, and a 40-foot setback from the southern property line, and Site Development Review approval to relocate one existing wall sign to the southern Dublin Honda building elevation. The Applicant proposes to remove the existing 27-foot tall freestanding sign located in the front half of the property and to install a new 35-foot tall double-faced freestanding sign with an electronic readerboard at the rear portion of the property adjacent to the Interstate 680 Freeway. This sign requires Conditional Use Permit approval because it has changeable copy and is greater than 20 feet in height with a maximum height of 35 feet. The combined sign area of both the "Dublin Honda" and electronic readerboard portion of the sign is 285 square feet. As proposed, the freestanding sign location, height and sign area are in conformance with the Zoning Ordinance. The "Dublin Honda" sign cabinet portion of the freestanding sign is internally illuminated and the electronic readerboard portion is indirectly illuminated with fluorescent strip lighting. The messages on the readerboard will be displayed with glow cubes. According to the Applicant, the glow cubes will provide clear and concise readability, and unlike the incandescent lamp readerboards, the proposed sign will be readable when facing direct sunlight and when viewing at oblique angles. The Applicant also proposes to relocate an existing 180 square foot, internally illuminated, cabinet wall sign from the east building elevation (facing the Interstate 680 Freeway) to the southern building elevation. This wall sign received Site Development Review approval under the previous Site Development Review/Conditional Use Permit application (PA 89-040) because it exceeded the maximum sign height, length and sign area specified in the Zoning Ordinance. Therefore, relocation of this sign requires Site Development Review approval. All Dublin Honda signs, including the relocated wall sign and the proposed 285 square foot freestanding sign, are in conformance with the maximum allowable sign area for the Dublin Honda site. The Zoning Ordinance is unclear concerning the types of messages that can be displayed on changeable copy signs. Section 8-87.10Y) of the Zoning Ordinance states that changeable copy or electronic readerboard signs are business signs on which the copy is manually or electronically changed and which are intended primarily to promote items of general interest to the community, such as time, temperature and/or date. Zoning Ordinance Section 8-87.60E) refers to changeable or electronic readerboard signs as signs when used to promote items of general interest to the community such as time, temperature and/or date. The latter definition for changeable copy signs is more restrictive in that the proposed electronic readerboard can only be -4- PACE.`. OF used to promote items exclusively of general interest to the public, not Dublin Honda items. The Applicant proposes to display time and temperature, in addition to Dublin Honda identification, inventory, marketing, and directional information; traffic information (when requested by Caltrans); and community service messages, such as "Happy Mothers' Day," "Congratulations Dublin High School Gaels," and "Don't Drink and Drive" (see Attachment 1, Applicant's Written Statement). This project has been reviewed by the Caltrans Outdoor Advertising Branch and a State outdoor advertising sign permit is required for the proposed electronic readerboard sign. This requirement is included as a Condition of Approval in the Draft Resolutions (Exhibits B and D). In compliance with Caltrans' sign permit conditions, the Applicant will be required to use the readerboard display only to advertise the business conducted or services rendered or goods produced or sold on the property on which the display is to be placed, and/or to give public service information, including, but not limited to, the time, date, temperature, weather, or similar information. Community service messages such as those described by the Applicant are not allowed by Caltrans to be displayed. According to Caltrans, the readerboard sign must also meet the following criteria: 1. The proposed display will have no illumination which is in continuous motion or which appears to be in continuous motion. 2. The display message will not change at a rate faster than one message every four seconds. 3. The interval between messages will not be less than one second. 4. The intensity of illumination will not change. Due to the inconsistency between the two sections of the Zoning Ordinance that regulate the types of messages that are allowed to be displayed on a changeable copy sign, Staff is requesting that the Planning Commission provide their interpretation of the Zoning Ordinance regulations, and either adopt Draft Resolution D, the more restrictive resolution, approving the electronic readerboard sign for the display of general community interest items only, and prohibiting the display of Dublin Honda messages; or, adopt Draft Resolution B, Staff's recommendation, approving the electronic readerboard sign for the primary display of general community interest items, in addition to the less frequent display of Dublin Honda messages. In accordance with Caltrans' comments, both Draft Resolutions restrict the types of general community interest messages to only time, temperature, and/or date. Staff researched changeable copy sign regulations of other cities in the Bay Area in order to formulate provisions for regulating this approval. The cities of Burlingame and Pleasanton do not regulate the -5- PACE._ .® OF a �o types of messages that can be displayed on changeable copy signs. The cities of San Mateo, Pleasant Hill and San Ramon allow the display of only time, date and temperature. The City of Livermore's sign ordinance does not even permit changeable copy signs. Staff recommends that the Planning Commission adopt Draft Resolution Exhibit B approving the Applicant's Conditional Use Permit request for an electronic readerboard sign that primarily displays items of general interest to the community for 270 days during a 12- month period, and to a lesser extent, Dublin Honda messages for 90 days during a 12-month period. The Applicant does not concur with Staff's recommendation and prefers displaying general community interest items for 165 days during a 12-month period, and Dublin Honda messages for 200 days during a 12-month period. Staff's recommendation for a 90-day display of Dublin Honda messages was derived from adding the number of days allowed for temporary promotional signs with Conditional Use Permit approval (60 days) and temporary promotional signs with Administrative Conditional Use Permit approval (30 days). The Applicant will be allowed to display Dublin Honda messages for one-fourth of the 12-month period. The Planning Commission may want to regulate the types of messages displayed on the proposed electronic readerboard in a different manner. The project was reviewed by other City departments. The Police Department is concerned with the safety of motorists traveling southbound on the Interstate 680 Freeway and at the Interstate 580/ Interstate 680 interchange. Staff discussed this concern with the Public Works Department and the Public Works Director concluded that operating the electronic readerboard sign would not result in traffic hazards on the local freeways. In addition, the Applicant will need to comply with Caltrans' traffic safety regulations for electronic readerboard signs located adjacent to freeways. Staff recommends approval of the Applicant's Conditional Use Permit and Site Development Review request to relocate one existing wall sign to the southern building elevation and to install a 35-foot tall freestanding sign with changeable copy (electronic readerboard), subject to the conditions specified in the Draft Planning Commission Resolutions, Exhibits B and C. RECOMMENDATIONS: FORMAT: 1) Open public hearing and hear Staff presentation. 2) Take testimony from Applicant and the public. 3) Question Staff, Applicant and the public. 4) Close public hearing and deliberate. 5) Adopt Draft Resolutions approving PA 91-069 Dublin Honda Signs Conditional Use Permit (Exhibit B or Exhibit D) and Site Development Review (ExhibiE—C), or give Staff and Applicant direction and continue the matter. -6- PAC;OF a� ACTION: Staff recommends that the Planning Commission adopt Draft Resolution (Exhibit B) approving the Conditional Use Permit request and Draft Resolution (Exhibit C) approving the Site Development Review request for PA 91-069, Dublin Honda. IT WW1 TO BE S1WN 71:ANYOIE OIRSIOE YOUR OIOA337ATON NCR TO BE REPIOOlICEO.COPIEO OR SOWED NAVY'ASNOR • �'�IQC.,/0 RESOLUTION NO. 91 - A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF DUBLIN APPROVING PA 91-069 DUBLIN HONDA CONDITIONAL USE PERMIT TO ALLOW THE INSTALLATION OF ONE 35-FOOT TALL FREESTANDING SIGN WITH CHANGEABLE COPY (ELECTRONIC READERBOARD) AT 7099 AMADOR PLAZA ROAD WHEREAS, Ken Allen of Arrow Sign Company, on behalf of the property owner, Ken Harvey, filed a Conditional Use Permit and Site Development Review application requesting approval to remove the existing freestanding sign and install a new freestanding sign with changeable copy (electronic readerboard) and to relocate an existing wall sign to the southern Dublin Honda building elevation; and WHEREAS, the Planning Commission did hold a public hearing on said application on November 4, 1991; and WHEREAS, proper notice of said public hearing was given in all respects as required by law; and WHEREAS, the application has been reviewed in accordance with the provisions of the California Environmental Quality Act (CEQA) and was found to be Categorically Exempt under Section 15311(a), Class 11; and WHEREAS, the Staff Report was submitted recommending that the application be conditionally approved; and WHEREAS, the proposed signage, if conditionally approved, is appropriate for the subject property in terms of being compatible with existing land uses in the area and will not overburden public services; and WHEREAS, the Planning Commission did hear and consider all said reports, recommendations and testimony hereinabove set forth. NOW, THEREFORE, BE IT RESOLVED THAT THE Dublin Planning Commission does hereby find that: A. The proposed project will serve a public need by providing business identification to the general public for an auto dealership in the City of Dublin. B. The use will be properly related to other land uses and transportation and service facilities in the vicinity, as the proposed use will be compatible to the type and nature of operations typically found in the neighborhood. C. The use, under all circumstances and conditions of this particular case, will not materially adversely affect the health or safety of persons residing or working in the vicinity, or be materially detrimental to the public welfare or injurious to property or improvements in the neighborhood, as all applicable regulations will be met. PAGE %LOFa D. The use will not be contrary to the specific intent clauses or performance standards established for the district in which it is to be located. BE IT FURTHER RESOLVED THAT THE Dublin Planning Commission does hereby conditionally approve PA 91-069 Dublin Honda Conditional Use Permit as generally depicted on the plans labeled Exhibit A, stamped approved and on file with the Dublin Planning Department, subject to the approval of the related Site Development Review and to the following conditions: CONDITIONS OF APPROVAL: Unless stated otherwise, all Conditions of Approval shall be complied with prior to the issuance of building permits or establishment of use, and shall be subject to Planning Department review and approval. The following codes represent those departments/agencies responsible for monitoring compliance of the conditions of approval. Dublin Honda is competing heavily with other East Bay auto dealers for their market share in a rapidly growing Tri-Valley area. Not surprisingly, Honda just recently received approval to open a new dealership in Livermore just 10 miles from Dublin Honda. This also will dramatically impact auto sales at Dublin Honda. Dublin Honda spends thousands of dollars annually in advertising promotions and feels it is time to invest in the most effective advertising available, point of sale identity. Dublin Honda wishes to relocate an existing 35' tall, 150 sq. ft. freeway identity sign closer to Interstate 680 and include an indirectly illumi- nated electronically changeable readerboard to promote items of interest to the public. The readerboard will display messages pertaining to Dublin Honda services, safety messages and informational items to the community. The total square footage and overall sign height shall not exceed the measurements of the existing sign which is in compliance with City ordi- nances. All readerboard messages will be programmed in accordance with the regulations set forth by the California State Department of Transpor- tation (CALTRANS). The proposed electronic readerboard is a state of the art Daktronics Glowcube Model No. 1680-18GOC. This display is similar to the type Cal Trans uses for their highway road construction/safety electronic message signs. The difference is that the Glowcube is indirectly illuminated at nighttime and is non -illuminated during daylight hours. The readerboard is fully programmable via personal computer located in the administrative offices of Dublin Honda. The optic yellow cubes are pigmented to ensure against fading and to provide clear and concise readability. Unlike the more common incandescent lamp readerboards, this sign is very readable when facing direct sunlight. The Glowcube's unique construction also makes oblique (side) viewing angles very good. A complete and regular maintenance inspection and repair program will be implemented throughout the life of this product. The planned use of this readerboard is to: 1. Identify Dublin Honda to the public along the I680 corridor. 2. Identify the inventory of specific Honda models (new and used). 3.
