On June 24, 1959, the Alameda County Planning Commission approved a Zoning Adjustment to permit the operation of a livestock auction barn. This Adjustment expired June 24, 1964. On October 17, 1967, the Alameda County Planning Commission approved a Conditional Use Permit for the operation of a service station. On June 2, 1976, the Alameda County Zoning Administrator approved a Conditional Use Permit to allow the exterior storage of equipment of supplies and a Variance to allow a 0' sideyard setback where a 10' setback is required (Fleming & Prarie Industries). On February 23, 1977, the Alameda County Zoning Administrator approved a Variance to remove the continuous screen fencing at access points to the property (Prarie Industries). On April 21, 1986, the Dublin Planning Commission approved a Conditional Use Permit and Site Development Review to allow the outdoor installation of two 9' tall propane storage tanks with a combined maximum capacity of 1,150 gallons (Cal -Gas). The Conditional Use Permit expired May 2, 1988. On July 18, 1988, the Dublin Planning Commission approved the continued use of two 495 gallon propane gas storage and dispensing tanks stored outside in the equipment storage yard (Cal -Gas). The Conditional Use Permit expired July 28, 1991. -2- PAGE a- OF J i APPLICABLE REGULATIONS: Section 8-51.3(d) of the Dublin Zoning Ordinance states that the storage of liquified petroleum gas in the M-1, Light Industrial Zoning District requires a Conditional Use Permit. Section 8-94.0 states that conditional uses must be analyzed to determine: 1) whether or not the use is required by the public need; 2) whether or not the use will be properly related to other land uses, transportation and service facilities in the vicinity; 3) whether or not the use will materially affect the health or safety of persons residing or working in the vicinity; and 4) whether or not the use will be contrary to the specific intent clauses or performance standards established for the district in which it is located. ENVIRONMENTAL REVIEW: The project has been found to be Categorically Exempt from CEQA under Section 15301, Class 1 of the California Environmental Quality Act guidelines. This use consists of continuing to store and dispense propane fuel from two existing 495 gallon above -ground outdoor storage tanks. NOTIFICATION: Public Notice of the September 3, 1991, hearing was published in the local newspaper, mailed to adjacent property owners, and posted in public buildings. ANALYSIS: The Applicant is requesting Conditional Use Permit approval to allow the continued storage and dispensation of propane fuel from two existing above -ground outdoor storage tanks, each with a 495 gallon carrying capacity. The Applicant had previously applied for the same Conditional Use Permit request in 1988. This approval expired on July 28, 1991. The two propane fuel tanks will remain in the same location at the southeastern corner of the project site, approximately 25 feet from the property line. The current use at the site includes the rental of heavy machinery equipment and the retail sale of gasoline and fuel products. The propane tanks are used for dispensing and selling fuel to the public and for refilling rental equipment. Other existing development at the site includes a rental office, retail store, storage structure, outdoor storage of equipment and employee/customer parking. OF / 6-wr1 a it A Ca u63� RECEIVED' „JUL 2 6 1991 iDc h r111R1 Ikl PI Al\lt\iit\ir PAGE 1/ OF/ E,(14113 r- (!'61) RESOLUTION NO. 91 - A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF DUBLIN APPROVING PA 91-052 AMERIGAS CONDITIONAL USE PERMIT TO ALLOW THE CONTINUED STORAGE AND DISPENSATION OF PROPANE FUEL FROM THE TWO EXISTING 495 GALLON, ABOVE -GROUND, OUTDOOR STORAGE TANKS WHEREAS, Robert Freeze and Larry Wilson filed a Conditional Use Permit application requesting approval to allow the continued storage and dispensation of propane fuel from the two existing 495 gallon, above -ground, outdoor storage tanks; and WHEREAS, the Planning Commission did hold a public said application on September 3, 1991; and WHEREAS, proper notice of said public hearing was respects as required by law; and WHEREAS, the application has been reviewed in accordance with the provisions of the California Environmental Quality Act (CEQA) and was found to be Categorically Exempt under Section 15301, Class 1 ; and WHEREAS, the Staff Report was submitted recommending that the application be conditionally approved; and WHEREAS, the Planning Commission did hear and consider all said reports, recommendations and testimony hereinabove set forth. NOW, THEREFORE, BE IT RESOLVED THAT THE Dublin Planning Commission does hereby find that: A. The proposed project will serve a public need by providing a propane fuel dispensation and sales facility. B. The use will be properly related to other land uses and transportation and service facilities in the vicinity, as the proposed use will be compatible to the type and nature of operations typically found in the neighborhood. C. The use, under all circumstances and conditions of this particular case, will not materially adversely affect the health or safety of persons residing or working in the vicinity, or be materially detrimental to the public welfare or injurious to property or improvements in the neighborhood, as all applicable regulations will be met. D. The use will not be contrary to the specific intent clauses or performance standards established for the district in which it is to be located. hearing on given in all BE IT FURTHER RESOLVED THAT THE Dublin Planning Commission does hereby conditionally approve PA 91-052, AmeriGas Conditional Use Permit, as generally depicted on the plans labeled Exhibit A, stamped approved and on file with the Dublin Planning Department, subject to the following conditions: PAGE 6 OF CONDITIONS OF APPROVAL: Unless stated otherwise, all Conditions of Approval shall be complied with prior to the issuance of building permits or establishment of use, and shall be subject to Planning Department review and approval. The following codes represent those departments/agencies responsible for monitoring compliance of the conditions of approval. (PL} Planning, [B} Building, [PO] Police, (PW} Public Works, [ADM} Administration/City Attorney, (FIN} Finance, [F} Dougherty Regional Fire Authority, (DSR] Dublin San Ramon Services District, (CO} Alameda County Department of Environmental Health. 1. This Conditional Use Permit approval for PA 91-052 is to allow the continued storage and dispensation of propane fuel from the two existing 495 gallon, above -ground outdoor storage tanks. This approval shall generally conform to the plans labeled Exhibit A, consisting of a Site Plan and photographs prepared by the Applicant, Robert Freeze (3 sheets) dated received by the Planning Department July 26, 1991. [PL] 2. This use shall comply with all applicable Planning, Building, Dougherty Regional Fire Authority and Alameda County Department of Environmental Health codes, regulations and ordinances. [PL, B, F, CO] 3. On an annual basis, this use shall be subject to Zoning Investigator review and determination as to the compliance with the Conditions of Approval. [PL] 4. This approval shall become null and void, in the event the approved use ceases to operate for a continuous one year period. [PL] 5. This permit shall be revocable for cause in accordance with Section 8-90.3 of the Dublin Zoning Ordinance. Any violation of the terms or conditions of this permit shall be subject to citation.
