approved a Site Development Review
application allowing the construction of
three new buildings containing 9,191 square
feet of office/retail space and a Sign
Program for wall -mounted signs and one free-
standing sign.
On February 19, 1991, the Planning Commission
adopted Resolution No. 91-016 finding the
proposed DRFA Fire Station #1 to be in
conformity as to location, purpose and extent
with the Retail/Office land use designation
of the Dublin General Plan.
PA 91-044
Pending Site Development Review application
for the construction of two new buildings,
totalling 4,801 square feet, on a 42,791
square foot portion of the 56,478 square foot
site at 7601-7603 Amador Valley Boulevard.
On June 10, 1991, the City Council initiated
a General Plan Amendment Study and Rezone for
the existing DRFA Fire Station #1 site at
7494 Donohue Drive.
APPLICABLE REGULATIONS:
Section 8-48.2: A community facility is a conditional use
within the C-1 Zoning District.
Section 8-94.0 states that conditional uses must be analyzed
to determine: 1) whether or not the use is required by the
public need; 2) whether or not the use will be properly related
to other land uses, transportation and service facilities in the
vicinity; 3) whether or not the use will materially affect the
health or safety of persons residing or working in the vicinity;
and 4) whether or not the use will be contrary to the specific
intent clauses or performance standards established for the
district in which it is located.
GENERAL PLAN LAND USE DESIGNATIONS:
Retail/Office. Shopping centers, stores, restaurants, business
and professional offices, motels, service stations, and sale of
auto parts are included in this classification. Residential use
is excluded except in the Downtown Intensification Area.
Public/Semi-Public Facilities. Uses other than parks owned by a
public agency that are of sufficient size to warrant

differentiation from adjoining uses are labeled. Development of
housing on a site designated on the General Plan as semi-public
shall be considered consistent with the General Plan.
Determination as to whether housing should be permitted on a
specific semi-public site and the acceptable density and design
will be through review of a Planned Unit Development proposal
under the Zoning Ordinance. Examples: Public and private
schools, churches.
ENVIRONMENTAL REVIEW: A Negative Declaration was prepared
pursuant to the California Environmental Quality Act, State CEQA
Guidelines, and the City of Dublin Environmental Guidelines, and
was adopted by Resolution No. 1-91 of the Dougherty Regional Fire
Authority on March 18, 1991.
NOTIFICATION: Public Notice of the August 5, 1991, hearing was
published in the local newspaper, mailed to adjacent property
owners, and posted in public buildings.
BACKGROUND
The Dougherty Regional Fire Authority (DRFA) is considering
potential locations for rebuilding Fire Station #1, currently
located at 7494 Donohue Drive. A Fire Station Location Study was
prepared by Hughes, Heiss & Associates in November of 1989. The
report identified a minimum .6 acre lot size to accommodate a
two -company fire station. The current site is 15,000 square
feet, .34 acres, and is too small for the proposed expansion.
DRFA is considering acquiring an approximate 13,687 square
foot portion of the parcel contiguous to the south of the
existing fire station site (see Attachment 5), located at 7601
Amador Valley Boulevard. This, in combination with the existing
fire station site, would provide a building site totalling 28,687
square feet, or .658 acres.
The owner of the parcel at 7601 Amador Valley Boulevard,
Robert Glockner of Whitney Investment Company, has a valid Site
Development Review approval (expires October 26, 1991) for the
addition of three buildings totalling 9,191 square feet. The
owner submitted a new Site Development Review application on June
26, 1991, modifying the approved site plan by eliminating the
northernmost building. This will allow a 13,687 square foot
portion of the property to be acquired by DRFA in order to
facilitate the relocation of DRFA Fire Station #1.
A lot line adjustment is currently being processed to add
the 13,687 square foot portion of the parcel at 7601 Amador
Valley Boulevard to the existing DRFA Fire Station #1 parcel
located at 7494 Donohue Drive.

On February 19, 1991, the Planning Commission to facilitate
the acquisition of the property, adopted Resolution No. 91-016,
finding the proposed DRFA Fire Station #1 to be in conformity as
to location, purpose and extent with the Retail/Office land use
designation of the Dublin General Plan.
On June 10, 1991, the City Council initiated a General Plan
Amendment Study and a Rezone study for the existing DRFA Fire
Station #1 site at 7494 Donohue Drive.
ANALYSIS
The Applicant, DRFA Fire Chief Harold Ritter, also
representing Robert Glockner, is requesting approval: 1) to amend
the General Plan to designate the land use of the existing DRFA
Fire Station #1 site at 7494 Donohue Drive from Public/Semi-
Public Facility to Retail/Office; 2) to rezone the combined
parcels at 7494 Donohue Drive (from R-S-D-20, Suburban
Residential Combining District to C-1, Retail Business District)
and 7601 Amador Valley Boulevard (portion) (from PD, Planned
Development to C-1, Retail Business District); and 3) of a
Conditional Use Permit to allow the establishment of a community
facility, a fire station, on the combined parcels within the C-1
zone .
Both the General Plan land use designation and the zoning
designation for the existing DRFA Fire Station #1 site at 7494
Donohue Drive and the proposed acquisition site at 7601 Amador
Valley Boulevard (portion) are different. To eliminate a split
General Plan land use designation and zoning designation on the
combined lot, approval of the General Plan Amendment and Rezoning
are requested.
General Plan Amendment
The existing DRFA Fire Station #1 site has a General Plan
land use designation of Public/Semi-Public Facility. The General
Plan land use designation for the proposed acquisition site is
Retail/Office. The Applicant is requesting to amend the General
Plan to designate the existing DRFA Fire Station #1 site as a
Retail/Office land use.
Uses permitted within the Retail/Office General Plan land
use designation include retail shops, business and professional
offices, and service stations. The operation of the fire station
is similar in nature as the aforementioned uses. The intensity
of the fire station use is not expected to exceed that normally
found within a Retail/Office land use designation. The fire
station use will include primarily office activities, with minor
maintenance of the emergency vehicles occurring on -site.

The proposed General Plan Amendment is consistent with other
small public facilities in Dublin which are located on parcels
with General Plan land use designations other than Public/Semi-
Public Facilities. Some of these include: Dublin San Ramon
Services District, Retail/Office land use designation; Senior
Center, Single Family Residential land use designation; and the
City Corporation Yard, Business Park/Industrial: Outdoor Storage
land use designation.
The proposed application is consistent with the Planning
Commission finding of February 19, 1991, that the proposed
relocation of the DRFA Fire Station #1 is in conformity as to
location, purpose and extent with the Retail/Office land use
designation of the General Plan. In addition, the proposed
General Plan Amendment will provide a consistent General Plan
land use designation for the combined parcel.
The Planning Commission's role regarding this request is to
provide a recommendation to the City Council.
Rezone
The existing DRFA Fire Station #1 site is zoned R-S-D-20,
Suburban Residential Combining District. The proposed
acquisition site is zoned PD, Planned Development. The Applicant
has requested approval of a Rezone request to prevent a split
zoned parcel.
State Law requires consistency between the General Plan and
the Zoning Ordinance. In order to provide such consistency, the
Applicant is requesting to rezone both of the parcels to the C-1,
Retail Business District.
The C-1, Retail Business District has been established
within the Zoning Ordinance to implement the policies of the
Retail/ Office General Plan land use designation. The
establishment of community facilities (a fire station) are
allowed within the C-1, Retail Business District subject to the
approval of a Conditional Use Permit.
The Planning Commission's role regarding this request is to
provide a recommendation to the City Council.
Conditional Use Permit
The Applicant is also requesting approval of a Conditional
Use Permit to allow the establishment of a community facility, a
fire station, on the combined parcels within the C-1 Zoning
District.

The new DRFA Fire Station #1 will contain approximately
8,000 square feet of building area which will include: a three
bay wide, two bay deep apparatus room; offices; dormitory for a
minimum of eight firefighters; an above ground, 1,000 gallon fuel
tank; restroom facilities; kitchen; dayroom; exercise area;
locker room; workshop; and communications area. Approximately 18
calls per week are dispatched from the existing DRFA Fire Station
#1. It is expected that the new fire station will accommodate
this same level of activity.
The new DRFA Fire Station #1 will be built primarily on the
southern portion of the combined parcel. The existing DRFA Fire
Station #1 must remain operational until the new station is
completed. After completion of the new station, the existing
station will be demolished to provide parking and landscaping for
the new station.
Site Development Review approval is required prior to the
rebuilding of DRFA Fire Station #1 on the combined parcels.
This application has been reviewed by the applicable public
agencies and City Departments and all applicable Conditions of
Approval have been incorporated into the draft resolutions.
Staff recommends that the Planning Commission adopt the draft
resolutions recommending to the City Council approval of the
General Plan Amendment, Rezoning, and Conditional Use Permit,
Exhibits A, B, and C respectively.
RECOMMENDATIONS:
FORMAT: 1) Open public hearing and hear Staff presentation.
2) Take testimony from Applicant and the public.
3) Question Staff, Applicant and the public.
4) Close public hearing and deliberate.
5) Adopt draft resolutions (Exhibits A, B and C)
relating to PA 91-042, or give Staff and Applicant
direction and continue the matter.
ACTION: Staff recommends the Planning Commission adopt the
draft resolutions 1) recommending the City Council
adopt the DRFA General Plan Amendment (Exhibit A),
2) recommending the City Council adopt the DRFA Rezone
(Exhibit B), and 3) recommending the City Council
conditionally approve the Conditional Use Permit
(Exhibit C) relating to PA 91-042.

A RESOLUTION OF THE PLANNING COMMISSION
OF THE CITY OF DUBLIN
RECOMMENDING THAT THE CITY COUNCIL ADOPT PA 91-042 DOUGHERTY REGIONAL
FIRE AUTHORITY GENERAL PLAN AMENDMENT
WHEREAS, Harold Ritter, on behalf of the Dougherty Regional Fire
Authority and Robert Glockner of Whitney Investment Company, requests
approval 1) to amend General Plan to designate the land use of the
existing DRFA Fire Station #1 site at 7494 Donohue Drive from
Public/Semi-Public Facility to Retail/Office; 2) to rezone the
combined parcels at 7494 Donohue Drive (from R-S-D-20 to C-1) and 7601
Amador Valley Boulevard (portion) (from PD to C-1); and 3) of a
Conditional Use Permit to allow the establishment of a community
facility (a fire station) within the C-1 zone on the combined parcels

WHEREAS, the Planning Commission did hold a public hearing on
said application on August 5, 1991; and

WHEREAS, the application has been reviewed in accordance with the
provisions of the California Environmental Quality Act (CEQA) and a
Negative Declaration of Environmental Significance has been adopted by
the Dougherty Regional Fire Authority on March 18, 1991 (DRFA
Resolution No. 1-91) for this project, as it will have no significant
effect on the environment; and
WHEREAS, the Staff Report was submitted recommending that the
Planning Commission recommend that the City Council approve the
General Plan Amendment; and
WHEREAS, the Planning Commission did hear and consider all said
reports, recommendations and testimony hereinabove set forth.
NOW, THEREFORE, BE IT RESOLVED THAT THE Dublin Planning
Commission does hereby recommend that the City Council approve the
Dougherty Regional Fire Authority General Plan Amendment PA 91-042 to
amend Figure 1 of the Dublin General Plan - Primary Planning Area map
to amend the land use designation for APN 941-173-1-2 designating the
existing DRFA Fire Station #1 site at 7494 Donohue Drive to Retail/
Office (See Attachment A-1); and

BE IT FURTHER RESOLVED THAT THE Dublin Planning Commission does
hereby recommend that the City Council direct Staff to edit, format,
and print the up-to-date Dublin General Plan with all City Council
approved revisions and without any other substantive changes.

1. Rezoning the combined parcels to a C-1 Retail Business
District will be appropriate for the subject property in
terms of providing a range of allowable and conditionally
allowable uses which will be compatible to existing and
proposed land uses in the immediate vicinity; and
2. The rezoning will not have a substantial adverse affect on
health or safety or be substantially detrimental to the
public welfare or be injurious to property or public
improvement; and

3. The rezoning will not overburden public services; and
4. The rezoning is consistent with the Dublin General Plan.
BE IT FURTHER RESOLVED THAT THE Dublin Planning Commission does

request on combined parcels at 7494 Donohue Drive (APN 941-173-1-2),
from R-S-D-20, Suburban Residential Combining District to C-1, Retail
Business District, and a portion of 7601 Amador Valley Boulevard

WHEREAS, the Staff Report was submitted recommending the Planning
Commission recommend City Council conditionally approve the

WHEREAS, Section 8-48.2 of the adopted City of Dublin Zoning
Ordinance requires approval by the Planning Commission of a
Conditional Use Permit for the establishment of a Community Facility
(fire station) finding that it is an appropriate use within the C-1,
Retail Business District; and
WHEREAS, the Planning Commission did hear and consider all said
reports, recommendations and testimony hereinabove set forth.
NOW, THEREFORE, BE IT RESOLVED THAT THE Dublin Planning
Commission does hereby find:
A. The establishment of a Community Facility (fire station)
will serve the public need by providing essential emergency
services to the community in a central location.

B. The use will be properly related to other land uses and
transportation and service facilities in the vicinity, as
the proposed use will be compatible to the type and nature
of operations typically found in the neighborhood.
C. The use will not materially adversely affect the health or
safety of persons residing or working in the vicinity, or be
materially detrimental to the public welfare or injurious to
property or improvements in the neighborhood, as all
applicable regulations will be met.
D. The use will not be contrary to the specific intent clauses
or performance standards established for the district in
which it is to be located in that conditions have been
applied to ensure conformance with the applicable zoning.
E. The approval of the Conditional Use Permit will be
consistent with the Dublin General Plan.
BE IT FURTHER RESOLVED THAT THE Dublin Planning Commission does
hereby recommend the City Council conditionally approve PA 91-042
Conditional Use Permit, subject to approval of the related General
Plan Amendment, Rezoning, a subsequent Site Development Review
application, to be submitted for review and approval per Section 8-
95.0 of the Zoning Ordinance and to the following conditions:
CONDITIONS OF APPROVAL:
Unless stated otherwise, all Conditions of Approval shall be complied
with prior to the issuance of building permits or establishment of
use, and shall be subject to Planning Department review and approval.
The following codes represent those departments/agencies responsible
for monitoring compliance of the conditions of approval. [PL]
Planning, [B] Building, [PO] Police, [PW] Public Works, [ADM]
Administration, [FIN] Finance, [FJ Dougherty Regional Fire Authority,
[DSR1 Dublin San Ramon Services District, [CO' Alameda County
Department of Environmental Health.
1. This approval is for the establishment of a fire station facility
consisting of: an apparatus room; administrative offices;
dormitory for a minimum of eight firefighters; an above ground
1,000 gallon fuel tank; restroom facilities; kitchen; dayroom;
exercise area; locker room; workshop; and communications area, on
the combined parcels located at 7494 Donohue Drive and 7601
Amador Valley Boulevard (portion). Said approval shall be
contingent upon the Applicant receiving approval of the related
General Plan Amendment and Rezoning requests and subsequent Site
Development Review. [PL]
2. The Applicant shall be responsible for clean-up and disposal of
project related trash to maintain a clean and litter -free site.

3. Site Development Review approval pursuant to Sections 8-48.3 and
8-95.0 of the Zoning Ordinance is required prior to issuance of a
building permit.
4. All signs shall be subject to the requirements of the Sign

5. This use shall be subject to Zoning Investigator review and
determination as to the compliance with the Conditions of
Approval. [PL]
8. This approval shall become null and void, in the event the
approved use ceases to operate for a continuous one year period.

Section 8-90.3 of the Dublin Zoning Ordinance. Any violation of
the terms or conditions of this permit shall be subject to

Project Description
Proposal to acquire an approximate 13,500 square foot portion of an
existing 1.3 acre site at 7601 Amador Valley Boulevard, located
contiguous to the existing 15,000 square foot Dougherty Regional Fire
Authority (DRFA) Fire Station #1 site at 7494 Donohue Drive. A lot
line adjustment between the two contiguous parcels will be processed
to create an approximate 28,500 square foot, .65 acre, site to rebuild
the DRFA Fire Station #1.
The proposed acquisition site is zoned PD, Planned Development and has
a General Plan land use designation of Retail/Office. The existing
fire station site is zoned R-S-D-20, Suburban Residential Combining
District and has a General Plan land use designation of Public/Semi-
Public facility. As part of this application, in order to avoid a
split zoning/General Plan land use designation, a Rezoning (from PD &
R-S-D-20 to C-1, Retail Business) and a General Plan Amendment (from
Public/Semi-Public Building to Retail Office) will be processed. A
Conditional Use Permit will be processed to allow the establishment of
a Community Facility (Fire Station) within the C-1, Retail Business
District.
Site Development Review approval is required for the rebuilding of
DRFA Fire Station #1. The new fire station will consist of an
approximate 7,800 square foot building including: a 3,000 square
foot, single story apparatus room with three double vehicle depth
parking bays; a 4,800 square foot, two story administration building
with sleeping quarters; and approximately 24 on -site parking spaces.
The existing fire station will remain intact, until the new fire
station is completed and fully operation. The existing fire station
will then be demolished and the land converted to parking and
landscaping to service the new fire station.
Environmental Setting
The project site is relatively flat, containing no unique, rare or
endangered species of plants or animals. The site does not possess
any cultural, historical or scenic aspects unique to the heritage of
the City of Dublin. The site is currently occupied by two buildings,
totalling 3,687 square feet, and associated parking. The buildings
are occupied by a sit-down delicatessen and office uses.
Surrounding Properties
Properties surrounding the project site are fully developed and
contain no unique, rare or endangered species of plants or animals.
The surrounding properties do not possess any cultural, historical or
scenic aspects unique to the heritage of the City of Dublin. Uses on
the surrounding properties include: multi -family residential
apartments to the east and west; the existing DRFA Fire Station #1 to
the north; and the Alameda County public library to the south.

A RESOLUTION OF THE DOUGHERTY REGIONAL FIRE AUTHORITY
ADOPTING A NEGATIVE DECLARATION OF ENVIRONMENTAL SIGNIFICANCE
FOR THE RELOCATION AND REBUILDING OF DOUGHERTY REGIONAL FIRE AUTHORITY
FIRE STATION NO. 1 ON A PORTION OF THE PARCEL
AT 7601 AMADOR VALLEY BOULEVARD
WHEREAS, the Dougherty Regional Fire Authority is proposing the
relocation and rebuilding of DRFA Fire Station No. 1 on a portion of
the parcel at 7601 Amador Valley Boulevard; and
WHEREAS, the California Environmental Quality Act (CEQA),
together with the State guidelines and City environmental regulation,
require that certain projects be reviewed for environmental impact and
that environmental documents be prepared; and
WHEREAS, an Initial Study was conducted finding that the project,
as proposed, would not have a significant effect on the environment;
and
WHEREAS, a Negative Declaration has been prepared for this
application; and
WHEREAS, the Dougherty Regional Fire Authority did review and
consider the Negative Declaration at a public hearing on March 18,
1991; and
WHEREAS, proper notice of said public hearing was given in all
respects as required by law; and
NOW, THEREFORE, BE IT RESOLVED THAT THE Dougherty Regional Fire
Authority does hereby find that:
1. The project will not have a significant effect on the
environment.
2. The Negative Declaration has been prepared and processed in
accordance with State and local environmental laws and guideline
regulation.
3. The Negative Declaration is complete and adequate.
PASSED, APPROVED AND ADOPTED this 18th day of March, 1991.
