PA87-124: On August 29, 1988, the Planning Director approved a C-2-B-40 directory sign for the subject site. PA90-082: On November 5, 1990, the Planning Commission approved a Conditional Use Permit for Del Piso Masonry, Tile & Stone, to allow the establishment of an outdoor storage yard and Site Development Review approval for exterior site modifications at the west end of the existing improved site. PA90-081: On January 22, 1991, the Planning Commission approved a Conditional Use Permit for United Hands Recycling Center to operate a recycling facility and food distribution center and denied a Site Development Review request for exterior site modifications regarding outdoor storage. The use has ceased operation and the United Hands Recycling Center has vacated the building. APPLICABLE REGULATIONS: Section 8-51.3(A)(10) states that other uses (such as a Church) which are found by the Planning Commission as may meet the intent of the district and the requirements of Section 8-51.8 Performance Standards: M-1 Districts, may be permitted as a Conditional Use in the M-1 District. Section 8-61.0(d) states that churches are allowed as Conditional Uses in any District if approved by the Planning Commission. Section 8-94.0 states that conditional uses must be analyzed to determine 1) whether or not the use is required by the public need; 2) whether or not the use will be properly related to other land uses, transportation and service facilities in the vicinity; 3) whether or not the use will materially affect the health or safety of persons residing or working in the vicinity; and 4) whether or not the use will be contrary to the specific intent clauses or performance standards established for the district in which it is located. ENVIRONMENTAL REVIEW: A Negative Declaration has been prepared for the project pursuant to the California Environmental Quality Act (CEQA), the State CEQA Guidelines, and the City of Dublin Environmental Guidelines. The proposed project will not have a significant effect on the environment. -2- PAGE OF 13 NOTIFICATION: Public Notice of the August 17, 1992 hearing was published in the local newspaper, mailed to adjacent property owners, and posted in public buildings. ANALYSIS: The Applicant, Mr. Jack Wallace, representing Crosswinds Church, is requesting approval of a Conditional Use Permit to allow the establishment of a church use within an existing ±40,000 square foot tenant space, in an M-1, Light Industrial District, located at 6444 Sierra Court. The Applicant intends to occupy this space for up to five (5) years, or until a permanent location can be found. The church facility is comprised of small meeting rooms, classrooms, day care, administrative offices, a lobby and a principal congregational meeting room/recreation room. The proposed church hours are 8:00 a.m. to 12:00 p.m. on Sundays and 6:00 p.m. to 9:00 p.m. on approximately three weekday evenings. The principal congregational meeting room measures approximately 61' x 120' (7,320 square feet) and will accommodate 700 seats during services. A stage and audio/visual booth are proposed, and are used as integral components of each service. The principal congregational meeting room will also serve as the recreation room, including basketball and volleyball courts. In order to accommodate this dual purpose, portable chairs, instead of traditional fixed seating, or pews will be utilized in the principal congregational meeting room. Parking on site is based on the occupant load of the principal congregational meeting room. The occupant load for this room is 1,046 people (7320 square feet x 1 person/7 square feet). Required parking is calculated at one parking space for each six occupants, or 174 parking spaces. The parking lot will be restriped to accommodate a minimum of 175 parking spaces on -site. The proposed church will operate only on weekends and during weekday evenings. This will not present a problem for the existing adjacent uses on -site, as they will not be in operation during these times. A "Joint Use Parking Agreement" has been submitted by the Applicant which will permit the use of all the available parking on -site during church related activities. The proposed church use could be considered an appropriate use within the M-1, Light Industrial District, as it could be considered a minor alteration to the planned land use of the light industrial district. There are currently 14 churches operating within the City of Dublin. Two of these churches are located within commercially zoned properties: First Christian Church located within the Dublin Green Store at 11873 Dublin Boulevard; and Tri-City Baptist Church located within the Parkway Plaza at 6912 Village Parkway. -3- PAGE 3 OF 13 Although approval of the proposed Crosswinds Church use will displace light industrial space available within the City, the tenant space proposed for use is currently vacant. In addition, several other industrial buildings in the vicinity currently have vacancies. In the long term a proliferation of non -retail, non-commercial or non- industrial uses within the City's commercial or light industrial districts could adversely affect the City's economic base. The proposed project is in conformance with all applicable regulations of the Zoning Ordinance. This project has been reviewed by other City departments and affected agencies, and their comments have been incorporated into the draft resolution. The City Attorney had no comments on this project. Staff recommends approval of the Applicant's request for Conditional Use Permit subject to the conditions listed in the draft resolution, Exhibit C. RECOMMENDATIONS: FORMAT: 1) Open public hearing and hear Staff presentation. 2) Take testimony from Applicant and the public. 3) Question Staff, Applicant and the public. 4) Close public hearing and deliberate. 5) Adopt resolutions relating to PA 92-038, Crosswinds Church Conditional Use Permit, or give Staff and Applicant direction and continue the matter. ACTION: Staff recommends that the Planning Commission adopt the draft resolutions approving the Negative Declaration (Exhibit B) and Conditional Use Permit (Exhibit C) relating to PA 92-038. NOW, THEREFORE, BE IT RESOLVED THAT THE Dublin Planning Commission does hereby find that: 1. The Crosswinds Church Conditional Use Permit project will not have a significant effect on the environment. 2. The Negative Declaration has been prepared and processed in accordance with State and local environmental laws and guideline regulations. 3. The Negative Declaration is complete and adequate. AYES: NOES: ABSENT: ATTEST: Planning Director Planning Commission Chairperson EXHIBIT13 PAGE Zaij RESOLUTION NO. 92 - A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF DUBLIN APPROVING PA 92-038 CROSSWINDS CHURCH CONDITIONAL USE PERMIT APPLICATION FOR THE ESTABLISHMENT OF A COMMUNITY FACILITY (CHURCH) USE WITHIN AN M-1, LIGHT INDUSTRIAL DISTRICT AT 6444 SIERRA COURT WHEREAS, Jack Wallace, on behalf of Crosswinds Church, has filed an application requesting Conditional Use Permit approval for the establishment of a community facility (church) within an existing ±40,000 square foot tenant space, in an M-1, Light Industrial District, located at 6444 Sierra Court; and WHEREAS, the Planning Commission did hold a public hearing on said application on August 17, 1992; and WHEREAS, proper notice of said public hearing was given in all respects as required by law; and WHEREAS, the application has been reviewed in accordance with the provisions of the California Environmental Quality Act (CEQA) and a Negative Declaration has been adopted (Planning Commission Resolution No. 92- ). The project will not have a significant effect on the environment; and WHEREAS, the Staff Report was submitted recommending that the application be conditionally approved; and WHEREAS, the Planning Commission did hear and consider all said reports, recommendations and testimony hereinabove set forth. NOW, THEREFORE, BE IT RESOLVED THAT THE Dublin Planning Commission does hereby find: A. The proposed church use will serve the public need by providing increased opportunity for spiritual worship, counseling and community activities. B. The proposed church use will be properly related to other land uses, transportation and service facilities in the immediate vicinity, as the proposed use will be compatible to said land uses, transportation and service facilities in the immediate vicinity. C. The proposed church use will not materially adversely affect the health or safety of persons residing or working in the vicinity, or be materially detrimental to the public welfare or injurious to property or improvements in the neighborhood, as all applicable regulations will be met. D. The proposed church use will not be contrary to the specific intent clauses or performance standards established for the district in which it is to be located, as the proposed use is compatible with the adjacent light industrial district uses. E. The project is consistent with the policies contained in the City's General Plan. °4rE V f1F' 13 BE IT FURTHER RESOLVED THAT THE Dublin Planning Commission does hereby conditionally approve Conditional Use Permit application PA 92- 038 as shown in Exhibit A, stamped approved and on file with the Dublin Planning Department, and subject to the following conditions: CONDITIONS OF APPROVAL: Unless stated otherwise, all Conditions of Approval shall be complied with prior to the issuance of building permits or establishment of use, and shall be subject to Planning Department review and approval. The following codes represent those departments/agencies responsible for monitoring compliance of the conditions of approval. (PL] Planning, (B] Building, [PO] Police, [PW] Public Works, (ADM] Administration/City Attorney, [FIN] Finance, (F] Dougherty Regional Fire Authority, (DSR] Dublin San Ramon Services District, [C0] Alameda County Department of Environmental Health. 1. This approval is for the establishment of a church facility at 6444 Sierra Court as shown on the site plan and floor plan prepared by Ambiance Associates, dated received August 10, 1992 (Exhibit A) stamped approved. Activities shall be limited to the following: Services on Sunday; Sunday School; Child -Care during Services only; Weekday evening meetings; and Administrative Offices. [PL] 2. Prior to the establishment of use the Applicant shall submit to the Planning Department 1) a letter from the parent church acknowledging the Crosswinds Church affiliation and 2) a copy of the parent church articles of religious corporation, or equivalent, subject to review and approval of the Planning Director. [PL] 3. All weekday evening meetings shall begin after 6:00 p.m. [PL, PO] 4. The Principal Congregational Meeting Room shall be limited to 7,350 square feet. Should fixed seating be installed within the Principal Congregational Meeting Room, the maximum seating capacity shall not exceed 700 seats. [B, PL] 5. Prior to the issuance of a Building Permit, the Applicant shall submit an attested copy of a "Joint Use Parking Agreement" for weekend and weekday evening use of 175 on -site parking spaces for the life of the Church use. The Applicant shall maintain a minimum of 175 on -site parking spaces at all times throughout the duration of this use. [PL, B, PO] 6. The Applicant shall comply with the City of Dublin Non - Residential Security Requirements (attached). [PO] 7. The Applicant shall be responsible for ensuring that project related noise is maintained in a manner which minimizes the impacts on surrounding businesses. [PL, B] 8. All signs for this business shall be subject to the provisions of the Sign Ordinance. [PL] - 2 PAGE 9. The Applicant shall comply with all applicable requirements of the Dublin San Ramon Services District, Dougherty Regional Fire Authority, and Dublin Building Department. [DSR, F, B] 10. The Applicant shall be responsible for clean up and disposal of project related trash to maintain a clean and litter -free site. [PL] 11. No loudspeakers or amplified music shall be permitted outside the enclosed building. [PL] 12. The Applicant shall submit a parking lot striping plan subject to review and approval of the Planning Director. All parking spaces shall be double -striped (4 inch wide stripes set 2 feet apart - see Attachment). Handicapped, employee and compact parking spaces shall be appropriately identified on the pavement and designated on the parking plan. [PL] 13. This permit shall be valid for five (5) years, expiring on August 27, 1997. The approval for the Conditional Use Permit may be extended an additional two (2) years by the Zoning Administrator, in compliance with Section 8-94.2 of the Zoning Ordinance, upon the determination that the conditions are being complied with and remain adequate to ensure that the stated findings will continue to be met. The Applicant must submit a written request for the extension prior to the expiration date of the permit. [PL] 14. On an annual basis, this use shall be subject to Zoning Investigator review and determination as to compliance with the Conditions of Approval. [PL] 15. This approval shall become null and void, in the event the approved use fails to be established or ceases to operate for a continuous one year period. [PL] 16. This permit shall be revocable for cause in accordance with Section 8-90.3 of the Dublin Zoning Ordinance. Any violation of the terms or conditions of this permit shall be subject to citation. This leased space would be used primarily as a meeting house for the church members and families. Primary hours of use would be Sam to noon on Sundays and Wednesday evenings from 6pm to 9pm. The intent is to lease and occupy approximately 40,000 sq. ft. of the existing building. The facility is intended to provide space for small meeting rooms, classrooms, day care, restrooms and administrative offices. The largest individual portion will house the principal congregational meeting area. It will seat up to 700 people in an arrangement consistent with their services. Crosswinds Church is hereby requesting an interim conditional use permit to occupy this space until an opportunity presents itself for the construction of a new, permanent facility at a later date (within five years). As a part of this proposal, the Church will provide the required exits and upgrade the existing fire separations. Existing parking has been calculated at 176 spaces, While code requires that 175 spaces be provided by such a facility. A joint parking agreement (with other tenants) is being processed at this time.
