On May 4, 1987, Enterprise Rent -a Car (Applicant) withdrew a Conditional Use Permit application request to establish an auto rental service with outdoor storage of rental vehicles. On September 1, 1987, the Dublin Planning Director approved an Administrative Conditional Use Permit request (Custom Music) to allow temporary promotional displays (30 day time frame). On June 27, 1989, the Dublin Planning Director approved an Administrative Conditional Use Permit request (Airco Supply Company) to allow a 30 day grand opening temporary promotional sign. On March 14, 1990, the Dublin Planning Director approved a Site Development Review request (Dublin Business Center Sign Program) for new wall signs and a C-2-B-40 directory sign. On May 4, 1990, the Dublin Planning Director approved an Administrative Conditional Use Permit request (Classic Oak) to allow a 30 day grand opening temporary promotional sign; and on July 20, 1990, the Planning Director approved an Administrative Conditional Use Permit request (Classic Oak) to allow temporary promotional displays (20 day time frame). On May 4, 1992, the Dublin Planning Commission approved a Conditional Use Permit request (Planning Commission Resolution No. 92-026) to establish a car facility with outdoor storage of rental vehicles in a C-2-B-40 District. APPLICABLE REGULATIONS: Section 8-94.0 states that conditional uses must be analyzed to determine: 1) whether or not the use is required by the public need; -2- PAGE 2 OF 2) whether or not the use will be properly related to other land uses, transportation and service facilities in the vicinity; 3) whether or not the use will materially affect the health or safety of persons residing or working in the vicinity; and 4) whether or not the use will be contrary to the specific intent clauses or performance standards established for the district in which it is located. Section 8-94.2 Conditional Uses: Changes and Renewals of the Zoning Ordinance states that the Planning Commission/Zoning Administrator shall hear and decide applications to waive any condition previously imposed upon a Conditional Use. ENVIRONMENTAL REVIEW: The project has been found to be categorically exempt from the California Environmental Quality Act (CEQA), under Section 15301, Class 1 of the State CEQA Guidelines. The project consists of a minor change to the operation of an existing car rental facility to include outdoor car washing on the project site. NOTIFICATION: Public Notice of the July 6, 1992 hearing was published in the local newspaper, mailed to adjacent property owners, and posted in public buildings. ANALYSIS: On May 4, 1992 the Planning Commission approved a Conditional Use Permit request (Planning Commission Resolution No. 92-026) to allow the establishment of a car rental facility with the outdoor storage of rental vehicles in a C-2-B-40 District. The Applicant is requesting a modification to Condition #5 of the Conditional Use Permit resolution to allow the washing of rental vehicles on -site. Condition #5 currently reads as follows, "The servicing or washing of the rental vehicles or equipment on the site shall not be permitted." The Applicant is proposing to wash the vehicles at one of the two locations shown on Attachment 2 by using a garden hose attached to a hose bib along the west or east sides of the building. Both locations are adjacent to the parking lot drainage system. The project was reviewed by other City departments and government agencies. The Dublin San Ramon Services District did not apply any water recycling or water services fee conditions to the project since a drive -through type car wash facility was not being proposed. Dougherty Regional Fire Authority (DRFA) had concerns with location #1 in that a minimum 20 foot wide driveway access for emergency vehicles would not be maintained. DRFA had no objection to location #2. Planning Staff recommends approval of location #2 for car washing because DRFA requirements would be met and car washing would not be visible to the public from Dublin Boulevard. As a condition of approval, the vehicles being washed shall not block any on -site drive aisles, parking spaces or rear building entrances or exits. -3- PAGE OF I The project is in compliance with the Zoning Ordinance and the General Plan. Staff recommends approval of the Conditional Use Permit request to modify Condition #5 of the previous Conditional Use Permit approval (Planning Commission Resolution No. 92-026) to allow the washing of vehicles on site, subject to the conditions specified in the Draft Resolution (Exhibit B). RECOMMENDATIONS: FORMAT: 1) Open public hearing and hear Staff presentation. 2) Take testimony from Applicant and the public. 3) Question Staff, Applicant and the public. 4) Close public hearing and deliberate. 5) Adopt Draft Resolution approving PA 92-031 Enterprise Rent -a -Car Conditional Use Permit (Exhibit B), or give Staff and Applicant direction and continue the matter. ACTION: Staff recommends that the Planning Commission adopt Draft Resolution (Exhibit B) approving the Conditional Use Permit, for PA 92-031 Enterprise Rent -a -Car. NOW, THEREFORE, BE IT RESOLVED THAT THE Dublin Planning Commission does hereby find that: A. The proposed project will serve a public need by providing a car rental agency in the City of Dublin. B. The use will be properly related to other land uses and transportation and service facilities in the vicinity, as the proposed use will be compatible to the type and nature of operations typically found in the neighborhood. C. The use, under all circumstances and conditions of this particular case, will not materially adversely affect the health or safety of persons residing or working in the vicinity, or be materially detrimental to the public welfare or injurious to property or improvements in the neighborhood, as all applicable regulations will be met. The approval of this Conditional Use Permit is consistent with the Dublin General Plan. BE IT FURTHER RESOLVED THAT THE Dublin Planning Commission does hereby conditionally approve PA 92-031 Conditional Use Permit as generally depicted on the plans labeled Exhibit A, stamped approved and on file with the Dublin Planning Department, subject to the following conditions: CONDITIONS OF APPROVAL: Unless stated otherwise, all Conditions of Approval shall be complied with prior to the issuance of building permits or establishment of use, and shall be subject to Planning Department review and approval. The following codes represent those departments/agencies responsible for monitoring compliance of the conditions of approval. This Conditional Use Permit approval for PA 92-031 supplements the previous Conditional Use Permit approval PA 92-016 for the establishment of Enterprise Rent-A-Car car rental agency with outdoor storage by revising Condition #5 of Planning Commission Resolution No. 92-026 to read as follows: "The servicing of rental vehicles or equipment on the site shall not be permitted. [PL, PW]" This approval shall generally conform to the plan labeled Exhibit A, stamped approved and on file with the Dublin Planning Department, and as modified by the following conditions of approval, consisting of a Site Plan (1 sheet) dated received by the Planning Department May 14, 1992. [PL] 2. Vehicle washing shall not be visible to the public from Dublin Boulevard. [PL] 3. Vehicles being washed shall not block parking lot drive aisles, parking spaces or rear building entrances or exits. [PL, B, F] 4. The vehicle washing location approved under this Conditional Use Permit shall not change without prior review and approval of the Planning Director and Fire Marshal. [PL, F] 5. On an annual basis, this Conditional Use Permit shall be subject to Zoning Investigator review and determination as to compliance with the conditions of approval. [PL] 6. This approval shall be null and void in the event the approved use ceases to operate for a continuous one year period. [PL] - 2 PAGE 1 OF �� 7. This permit shall be revocable for cause in accordance with Section 8-90.3 of the Dublin Zoning Ordinance. Any violation of the terms or conditions of this use permit shall be subject to citation. Tong Planning Director City of Dublin 100 Civic Plaza PO Box 2340 Dublin, CA 94568 Dear Mr. Tong: RE: Use Permit Request Enterprise Rent-A-Car would like to have the option of washing cars on the premises of 6867 Dublin Blvd. We would use a garden hose from a hose bib on the west side of the building, away from the traffic and public view. There is a storm drain that is located at the west end of the building that would allow for proper drainage. The washing of a car would consist of rinsing off any dirt or dust and using biodegradable soap which is sanctioned as environmentally safe. A less preferable option for us would be to wash cars at the northeast side of the building which would have the same type of drainage, but would be on the opposite end of the building, thus farther away from our office. It is important to give our customers prompt, efficient service which would include having clean cars available on a timely basis.
