On June 24, 1968, the Alameda County Planning
Commission approved a Conditional Use Permit
(Fairway Investment Corporation) to allow two
advertising signs, each 300 square feet in
size. This approval expired on June 24,
1970.
On September 10, 1970, the Alameda County
Planning Commission approved a Conditional
Use Permit (American Mobilehome Corporation)
to allow the establishment and construction
of a sales center for mobile home units for a
two year period and utilization of a mobile
home unit as a sales office in a C-2, General
Commercial District.
On March 26, 1980, The Alameda County Zoning
Administrator approved a Conditional Use
Permit (Ozzie Davis-Pontiac/Toyota) to allow
the operation of a new and used car
dealership, including a service and parts
facility.
On April 17, 1980, the Alameda County
Planning Commission approved a Site
Development Review request for the
construction of the Ozzie Davis-
Pontiac/Toyota car dealership facility. The
parcel at the west end of the project site
remained vacant.
On June 2, 1986, the Dublin Planning
Commission approved a Conditional Use Permit
(Ozzie Davis-Pontiac/Toyota) to allow the use
of temporary promotional advertising
displays.
On June 15, 1987, the Dublin Planning
Commission approved a Conditional Use Permit
(Ozzie Davis-Pontiac/Toyota) to allow
temporary promotional signage for a 60-day
time frame.
On June 20, 1988, the Dublin Planning
Commission approved a Conditional Use Permit
(Ozzie Davis-Pontiac/Toyota) to allow
temporary promotional signage for a 60-day
time frame.

Between June 15, 1988, and August 10, 1990,
the Dublin Planning Department approved three
Administrative Conditional Use Permits (Ozzie
Davis-Pontiac/Toyota) to allow 30-day
temporary promotional displays within a 12-
month period.
On February 19, 1991, the Dublin Planning
Commission approved the Office Club Tentative
Parcel Map No. 6097 request to subdivide the
existing vacant lot (3.07 acres) into two
parcels, located at the vacant lot on the
south side of Dublin Court.
On March 22, 1991, the Planning Director
approved the Office Club Site Development
Review request to construct a 20,200 square
foot membership warehouse retail store
located at 6440 Dublin Court.
APPLICABLE REGULATIONS:
Section 8-87.34 Freestanding Signs of the Zoning Ordinance
establishes provisions for regulating freestanding signs.
Section 8-87.34B)1)d) Freestanding Signs of the Zoning
Ordinance specifies that all freestanding signs shall be set back
a minimum of fifty (50) feet from the right-of-way of an
Interstate Freeway.
Section 8-87.34B)2)b) Freestanding Signs of the Zoning
Ordinance specifies that single -use parcels one and one half
acres or greater in size, may utilize signs up to a maximum
height of thirty-five (35) feet, subject to approval of a
Conditional Use Permit.
Section 8-87.34B)4)a) Freestanding Signs of the
Ordinance specifies that freestanding signs shall be
proportionately dimensioned with the sign face width
exceed one-half the sign's total height and the sign
not to exceed three -tenths the sign's total height.
Section 8-87.60D) Signs requiring Conditional Use Permits of
the Zoning Ordinance specifies that freestanding signs in excess
of 20 feet to 35 feet maximum in height require approval of a
Conditional Use Permit.

Section 8-94.0 Conditional Uses of the Zoning Ordinance
states that conditional uses must be analyzed to determine:

1) whether or not the use is required by the public need;
2) whether or not the use will be properly related to other land
uses, transportation and service facilities in the vicinity;
3) whether or not the use will materially affect the health or
safety of persons residing or working in the vicinity; and
4) whether or not the use will be contrary to the specific intent
clauses or performance standards established for the district in
which it is located.
ENVIRONMENTAL REVIEW: The project has been found to be
categorically exempt from the provisions of the California
Environmental Quality Act (CEQA), pursuant to Section 15311(a),
Class 11 of the State CEQA Guidelines. The project will consist
of the placement of an on -premise sign to a commercial facility.
NOTIFICATION: Public Notice of the April 15, 1991, hearing was
published in the local newspaper, mailed to adjacent property
owners, and posted in public buildings.
ANALYSIS:
The Applicant is requesting Conditional Use Permit approval
to allow one freestanding sign for the Office Club at 6440 Dublin
Court. The freestanding sign would be 35 feet in height and
double faced, with a total sign area of 284 square feet. The
sign can would be internally illuminated with a blue background
and yellow copy. The freestanding sign would be set back a
minimum of 50 feet from the rear property line, and a minimum of
3 feet from the western property line.
Conditional Use Permit approval is required for freestanding
signs which exceed a height of 20 feet to a maximum height of 35
feet and are located on a single -use parcel, 1.5 acres or greater
in size.
The Office Club, a 20,200 square foot membership warehouse
retail store, received Site Development Review (PA 90-087)
approval from the Planning Department on March 22, 1991. This
Site Development Review approval also included three wall signs
and two directional signs.
As proposed, the sign proportions of the freestanding sign
are not in precise compliance with the Zoning Ordinance [Section
8-87.34B)4)a)]. However, since the proportions of the proposed
freestanding sign are appropriate for the height and setback of
the sign and meet the intent of the Sign Ordinance, Staff
recommends approval of the proposed sign proportions.
According to the Zoning Ordinance [Section 8-87.34B)1)d)],
the freestanding sign shall be set back a minimum of 50 feet from
the right-of-way of the Interstate 580 Freeway. Exhibit A
depicts the location of the freestanding sign in conformance with
the Zoning Ordinance.

The project has been reviewed by other departments and their
comments have been incorporated into the attached draft
resolution (Exhibit B) as conditions of approval. The proposed
freestanding sign is in compliance with the lot size, sign
height, setback and sign area requirements for freestanding signs
of the Zoning Ordinance.
Staff recommends approval of the Applicant's Conditional Use
Permit request to allow one Office Club freestanding sign,
subject to the conditions specified in the Draft Planning
Commission Resolution (Exhibit B).
RECOMMENDATIONS:
FORMAT: 1) Open public hearing and hear Staff presentation.
2) Take testimony from Applicant and the public.
3) Question Staff, Applicant and the public.
4) Close public hearing and deliberate.
5) Adopt Draft Resolution approving PA 90-092 Office
Club Conditional Use Permit, or give Staff and
Applicant direction and continue the matter.
ACTION: Staff recommends that the Planning Commission adopt the
Draft Resolution (Exhibit B) approving PA 90-092 Office
Club Conditional Use Permit.

A RESOLUTION OF THE PLANNING COMMISSION
OF THE CITY OF DUBLIN
APPROVING PA 90-092 OFFICE CLUB CONDITIONAL USE PERMIT TO ALLOW ONE
FREESTANDING SIGN AT 6440 DUBLIN COURT
WHEREAS, George Britt, on behalf of the Office Club, filed a
Conditional Use Permit application to allow one 35 foot tall
freestanding sign with a sign area of 284 square feet, at 6440 Dublin
Court; and
WHEREAS, on March 22, 1991, the Planning Director approved PA 90-
087 Site Development Review request for the construction of a 20,200
square foot membership warehouse retail building, including three wall
signs and two directional signs and the voluntary contribution of
traffic improvement funds at 6440 Dublin Court.
WHEREAS, the Planning Commission did hold a public hearing on
said freestanding sign Conditional Use Permit application on April 15,
1991; and
WHEREAS, proper notice of said public hearing was given in all
respects as required by law; and
WHEREAS, the application has been reviewed in accordance with the
provisions of the California Environmental Quality Act (CEQA) and was
found to be categorically exempt under Section 15311(a), Class 11 of
the State CEQA Guidelines ; and
WHEREAS, the Staff Report was submitted recommending that the
application be conditionally approved; and
WHEREAS, the proposed signage, if conditionally approved, is
appropriate for the subject property in terms of being compatible with
existing land uses in the area and will not overburden public
services; and
WHEREAS, the Planning Commission did hear and consider all said
reports, recommendations and testimony hereinabove set forth.
NOW, THEREFORE, BE IT RESOLVED THAT THE Dublin Planning
Commission does hereby find:
A. The proposed project will serve a public need by providing
business identification to the general public for a new
commercial establishment in the City of Dublin.
B. The use will not materially adversely affect the health or
safety of persons residing or working in the vicinity, or be
materially detrimental to the public welfare or injurious to
property or improvements in the neighborhood, as all
applicable regulations will be met.
C. The use will be properly related to other land uses and
transportation and service facilities in the vicinity, as
the proposed use will be compatible with ex- '� ' ecial

land uses, transportation and service facilities in the
immediate vicinity.
D. The use will not be contrary to the specific intent clauses
or performance standards established for the district in
which it is to be located in that conditions have been
applied to ensure conformance with the applicable zoning
regulations, and the use is compatible with the adjacent
general commercial district uses.
E. The approval of the Conditional Use Permit will be
consistent with the Dublin General Plan.
BE IT FURTHER RESOLVED THAT THE Dublin Planning Commission does
hereby conditionally approve PA 90-092 Office Club freestanding sign
as generally depicted on the sign plan labeled Exhibit A, stamped
approved and on file with the Dublin Planning Department, consisting
of one sheet prepared by Ad/Art Inc., dated received by the Planning
Department, March 29, 1991, subject to the following conditions:
CONDITIONS OF APPROVAL:
Unless stated otherwise, all Conditions of Approval shall be complied
with prior to the issuance of building permits or establishment of
use, and shall be subject to Planning Department review and approval.
The following codes represent those departments/agencies responsible
for monitoring compliance of the conditions of approval. [PL]
Planning, [B] Building, [PO] Police, [PW] Public Works, [ADM]
Administration, [FIN] Finance, [F] Dougherty Regional Fire Authority,
[DSR] Dublin San Ramon Services District, [CO] Alameda County
Department of Environmental Health.
1. PA 90-092 Conditional Use Permit is for the approval of one
double-faced freestanding sign which shall generally conform to
the following dimensions: [PL]
a. Maximum Sign Area: 284 square feet (142 square feet per
face)
b. Maximum Sign Height: 35 feet
c. Minimum setback from
Interstate 580 Freeway: 50 feet (from edge of sign can)
2. The freestanding sign shall be located within a landscaped area
or planter. [PL, B]
3. All building permits for the proposed freestanding sign shall be
secured and construction commenced within six (6) months of the
date of approval of this use permit. The Applicant and/or
property owner shall comply with all applicable building code
requirements. [B, PL]
4. Any modifications to said freestanding sign shall be subject to
review and approval of the Dublin Planning Department. [PL]

5. This approval shall become null and void, in the event the
approved use ceases to operate for a continuous one-year period.

6. This use shall be subject to Zoning Investigator review and
determination as to compliance with the conditions of approval.

7. This permit shall be revocable for cause in accordance with
Section 8-90.3 of the Dublin Zoning Ordinance. Any violation of
the terms or conditions of this permit shall be subject to
citation. [PL]
8. To apply for building permits, the Applicant shall submit six (6)
sets of construction plans to the Building Department for plan
check. Each set of plans shall have attached an annotated copy
of this Resolution of Approval. The notations shall clearly
indicate how all conditions of approval will be complied with.
Construction plans will not be accepted without the annotated
resolutions attached to each set of plans. The Applicant will be
responsible for obtaining the approvals of all participating non -
City agencies prior to the issuance of building permits. [PL, B]
