This approval expired on June 24, 1970. On September 10, 1970, the Alameda County Planning Commission approved a Conditional Use Permit (American Mobilehome Corp.) to allow the establishment and construction of a sales center for mobile home units for a two year period and utilization of a mobile home unit as a sales office in a C-2, General Commercial District. On March 26, 1980, the Alameda County Zoning Administrator approved a Conditional Use Permit (Ozzie Davis -Pontiac Toyota) to allow the operation of a new and used car dealership, including a service and parts facility. On April 17, 1980, the Alameda County Planning Commission approved a Site Development Review request for the construction of the Ozzie -Davis Pontiac Toyota car dealership facility. The parcel at the west end of the project site remained vacant. PA86-029: PA86-039: On April 4, 1986 and April 25, 1986, the Dublin Planning Department approved an Administrative Conditional Use Permit (Ozzie Davis - Pontiac/Toyota) to allow temporary promotional advertising displays for specific dates (a total of 12 days). PA86-040: On June 2, 1986, the Dublin Planning Commission approved a Conditional Use Permit (Ozzie Davis -Pontiac Toyota) to allow the use of temporary promotional advertising displays. PA87-082: On June 15, 1987, the Dublin Planning Commission approved a Conditional Use Permit (Ozzie Davis- -2- PAGE ,. OF Pontiac/Toyota) to allow temporary promotional signage for a 60-day time frame. PA87-083: On June 15, 1987, the Dublin Planning Department approved an Administrative Conditional Use Permit (Ozzie Davis - Pontiac/Toyota) to allow temporary promotional signage for a 30-day time frame. PA88-061: On June 20, 1988, the Dublin Planning Commission approved a Conditional Use Permit (Ozzie Davis- Pontiac/Toyota) to allow temporary promotional signage for a 60-day time frame. PA88-062, PA89-083, PA90-067: Between June 15, 1988 and August 10, 1990, the Dublin Planning Department approved three Administrative Conditional Use Permits (Ozzie Davis - Pontiac/Toyota) to allow 30-day temporary promotional displays within a 12-month period. APPLICABLE REGULATIONS: Section 8-87.60 c) Signs Requiring Conditional Use Permits of the Zoning Ordinance establishes provisions for temporary promotional signs or similar advertising devices (balloons, banners, search lights, etc.) when used for special promotional events, for a maximum cumulative period of sixty (60) days within a 12-month period, not to exceed fourteen (14) consecutive days of display for each individual promotional event. Section 8-87.61 c) Signs Requiring Administrative Conditional Use Permits of the Zoning Ordinance establishes provisions for temporary promotional signs or similar advertising devices (balloons, banners, searchlights, etc.) when used for special promotional events, for a maximum cumulative period of thirty (30) days within a 12-month period, not to exceed fourteen (14) consecutive days of display for each individual promotional event. Section 8-94.0 states that conditional uses must be analyzed to determine: 1) whether or not the use is required by the public need; 2) whether or not the use will be properly related to other land uses, transportation and service facilities in the vicinity; 3) whether or not the use will materially affect the health or safety of persons residing or working in the vicinity; and 4) whether or not the use will be contrary to the specific intent clauses or performance standards established for the district in which it is located. -3- PAGE 3. OF ENVIRONMENTAL REVIEW: The project has been found to be Categorically Exempt from CEQA under Section 15311(a), Class 11 of the California Environmental Quality Act guidelines. This use consists of the use and placement of temporary promotional advertising displays on an existing auto dealership. NOTIFICATION: Public Notice of the June 3, 1991, hearing was published in the local newspaper, mailed to adjacent property owners, and posted in public buildings. ANALYSIS: The Applicant is requesting Conditional Use Permit approval to allow the use of temporary promotional advertising displays for the Crossroads Toyota/Pontiac dealership, for a maximum cumulative period of 60 days within a 12-month period. The Applicant previously received an Administrative Conditional Use Permit approval for the use of temporary promotional balloon displays for 30 days (cumulative total) from August 15, 1990, to August 12, 1991. However, 30 days of display have already been utilized and the Applicant will not be able to apply for another Administrative Conditional Use Permit until after August 12, 1991. For this reason, the Applicant is applying for Conditional Use Permit approval to allow the use of temporary promotional displays for a cumulative period of 60 days. Approval of this Conditional Use Permit request would allow the Applicant to utilize a variety of promotional signs and displays (i.e., banners, pennants, cold -air balloons, helium balloons and searchlights). In order to monitor the number and type of displays, a condition is included in the Draft Resolution requiring the Applicant to complete and submit a notification form to the Planning Staff a minimum of four (4) days prior to any promotional event, indicating the types of displays to be utilized and the length of their respective use (see Attachment 2 )• Under this approval and according to Section 8-87.60 c) of the Zoning Ordinance, the Applicant cannot exceed 14 consecutive days of display of banners and pennants for each individual promotional event. Shorter time frames apply to other types of displays. The attached Draft Planning Commission Resolution (Exhibit B) includes conditions of approval regulating the frequency of use of specific types of promotional displays. The Applicant has continuously applied for Administrative Conditional Use Permits and Conditional Use Permits to use temporary promotional advertising displays for the last four -4- PAGE 'k OF years and the City has no record of any zoning violations or complaints associated with these approvals. Staff recommends approval of the Applicant's Conditional Use Permit request to allow the use of temporary promotional advertising displays for a maximum cumulative period of 60 days within a 12-month period, subject to conditions specified in the Draft Planning Commission Resolution (Exhibit B). RECOMMENDATIONS: FORMAT: 1) Open public hearing and hear Staff presentation. 2) Take testimony from Applicant and the public. 3) Question Staff, Applicant and the public. 4) Close public hearing and deliberate. 5) Adopt Draft Resolution approving PA 91-030, Crossroads Toyota/Pontiac Temporary Promotional Signs Conditional Use Permit, or give Staff and Applicant direction and continue the matter. ACTION: Staff recommends that the Planning Commission adopt the Draft Resolution (Exhibit B) approving PA 91-030 Crossroads Toyota/Pontiac Temporary Promotional Signs Conditional Use Permit. NOW, THEREFORE, BE IT RESOLVED THAT THE Dublin Planning Commission does hereby find that: A. The proposed project will serve a public need by providing temporary promotional advertising displays in conjunction with special promotional events at an existing commercial establishment in the City of Dublin. B. The use will be properly related to other land uses and transportation and service facilities in the vicinity, as the proposed use will be compatible to the type and nature of operations typically found in the neighborhood. C. The use, under all circumstances and conditions of this particular case, will not materially adversely affect the health or safety of persons residing or working in the vicinity, or be materially detrimental to the public welfare or injurious to property or improvements in the neighborhood, as all applicable regulations will be met. BE IT FURTHER RESOLVED THAT THE Dublin Planning Commission does hereby conditionally approve PA 91-030 Crossroads Toyota/Pontiac Conditional Use Permit to allow the use of temporary promotional advertising displays for a maximum cumulative period of 60 days within a 12-month period as generally depicted in Exhibit A, stamped approved and on file with the City Planning Department, consisting of one sheet, dated received by the Planning Department May 13, 1991, subject to the following conditions: CONDITIONS OF APPROVAL: Unless stated otherwise, all Conditions of Approval shall be complied with prior to the issuance of building permits or establishment of use, and shall be subject to Planning Department review and approval. The following codes represent those departments/agencies responsible for monitoring compliance of the conditions of approval. [PL] Planning, [B] Building, [PO] Police, [PW1 Public Works, [ADM] Administration, [FIN] Finance, fFJ Dougherty Regional Fire Authority, [DSR1 Dublin San Ramon Services District, [CO1 Alameda County Department of Environmental Health. 1. PA 91-030 Conditional Use Permit approval is for the erection and use of temporary promotional advertising displays such as roof - mounted cold -air balloons, pennants, banners, helium balloons and search lights, for a maximum cumulative period of sixty (60) days within a 12-month period running from June 14, 1991, through June 13, 1992, at 6450 Dublin Court. [PL] 2. The temporary promotional advertising displays specified in Condition No. 1, or similar displays, shall be subject to the following restrictions on their respective periods of use: [PL] a. No temporary promotional advertising displays (banners and pennants) may be displayed for a period exceeding fourteen (14) consecutive days. b. Searchlights may be utilized for a maximum of twelve (12) days during a 12-month period, with no more than three (3) consecutive days of use. c. Cable -anchored helium, or other gaseous balloons, may be utilized for a maximum of twelve (12) days, with no more than three (3) consecutive days of use. When used over weekend periods (i.e., used on a Friday, Saturday and/or Sunday), balloons may be used no more frequently than two (2) consecutive weekends. d. Roof -mounted, cold -air balloons may be utilized for a maximum of sixty (60) days, with no more than three (3) consecutive days of use. When used over weekend periods (i.e., used on a Friday, Saturday and/or Sunday), balloons - 2 - PAGE nF may be used no more frequently than two (2) consecutive weekends. 3. All temporary promotional advertising displays established in accordance with this permit shall be located, erected and maintained in a manner so as not to create a visual or physical hazard for either pedestrians or vehicles. [PL] 4. The regulations outlined in Condition No. 2 above which control the frequency of use of specific types of promotional displays shall apply to this 60 day Conditional Use Permit approval. [PL] 5. The Applicant shall provide written notice to the City of Dublin Planning Department a minimum of four (4) calendar days prior to each promotional event where temporary promotional advertising displays are used. Said written notice shall indicate the dates of use for each respective type of temporary promotional advertising display to be utilized. Written notice shall be in the form supplied by the City (attached). A master summary of the dates of use for each respective type of temporary promotional advertising display shall be maintained at all times on the premises and shall be available at all times during business hours for review by City of Dublin Staff. Any displays utilized on non-preauthorized days shall be subject to citations and/or may result in revocation of the permits. [PL] 6. A minimum of four (4) days prior to the first use of any temporary promotional advertising display, other than the display approved under this permit (Exhibit A), the Applicant shall prepare and submit a site plan detailing the general location of temporary promotional advertising displays proposed for use under this permit. This site plan depiction of the location for the respective types of displays shall be subject to review and approval by the Planning Director. This plan may be modified or supplemented, if desired, by the Applicant by submittal of a revised plan for review and approval by the Planning Director. [PL] 7. Approval for temporary use of tents in conjunction with special promotional events is granted by this permit only if the tent use is in compliance with the Dougherty Regional Fire Authority and City Building Department requirements. The Applicant shall provide the Planning Director written documentation from the Dougherty Regional Fire Authority and the City Building Department that all requirements have been met. The tent use shall be subject to Condition No. 5 above. [PL, F, B] 8. At any time during the effectiveness of this approval, the approval shall be revocable for cause in accordance with Section 8-90.3 of the Dublin Zoning Ordinance. Any violation of the terms or conditions of this permit shall be subject to citation. [PL] - 3 PAGE 9 OF 9.
