On August 31, 1977, the Alameda County Zoning
Administrator approved a Conditional Use
Permit request to allow the occupancy of a
mobile home for security purposes in
conjunction with Dublin High School, a
facility in an R-1-B-E Single Family
Residential Combining District.
On September 10, 1980, the Alameda County
Zoning Administrator approved a Conditional
Use Permit request to allow the continued
occupancy of a mobile home for security
purposes in conjunction with Dublin High
School, a community facility in an R-1-B-E
Single Family Combining District.
On January 8, 1985, the City of Dublin
Planning Director approved an Administrative
Conditional Use Permit to allow a newspaper
collection bin on the Dublin High School
site.
On March 12, 1986, the City of Dublin
Planning Director approved an Administrative
Conditional Use Permit for the continued use
of a newspaper recycling bin (extension of
PA 84-060).
On November 21, 1988, the Dublin Planning
Commission approved a Conditional Use Permit
to allow the continued occupancy by security
personnel of a mobile home on the site of
Dublin High School, a community facility in
an R-1-B-E Single Family Residential
Combining District.

PA 89-112:
On May 25, 1988, the City of Dublin Planning
Director approved an Administrative
Conditional Use Permit for the continued use
of a newspaper recycling bin on the Dublin
High School site (extension of PA 86-001).
An incomplete application was submitted
requesting an Administrative Conditional Use
Permit for the continued use of a newspaper
recycling bin on the Dublin High School site.
On March 19, 1990 the file for PA 89-095 was
closed.
On March 5, 1990, the City of Dublin Planning
Director approved an Administrative
Conditional Use Permit for a "U-Sell" auto
display fund-raising event on a portion of
the Dublin High School Parking Lot.
APPLICABLE REGULATIONS:
Section 39610.5 of the State of California Education Code
states that a school district governing board may construct and
maintain a mobile home on the grounds of any district facility
for occupancy by persons providing surveillance over said
grounds.
Section 8-26.3(a) of the Dublin Zoning Ordinance states that
community facility uses (which includes schools, Section 8-20.10)
in the R-1 zoning are subject to approval of a Conditional Use
Permit.
Section 8-94.0 states that conditional uses must be analyzed
to determine: 1) whether or not the use is required by the
public need; 2) whether or not the use will be properly related
to other land uses, transportation and service facilities in the
vicinity; 3) whether or not the use will materially affect the
health or safety of persons residing or working in the vicinity;
and 4) whether or not the use will be contrary to the specific
intent clauses or performance standards established for the
district in which it is located.
ENVIRONMENTAL REVIEW: The project has been found to be
Categorically Exempt from CEQA under Section 15301, Class 1 of
the California Environmental Quality Act guidelines. This use
consists of the continued operation of an existing public
structure involving no expansion of use beyond that previously
existing.
NOTIFICATION: Public Notice of the February 18, 1992 hearing was
published in the local newspaper, mailed to adjacent property
owners, and posted in public buildings.

ANALYSIS:
The Applicant is requesting Conditional Use Permit approval
for the continued use of a mobile home for occupancy by security
personnel on the site of Dublin High School (community facility)
located at 8151 Village Parkway in an R-1-B-E Single Family
Residential Combining District. The mobile home is considered an
ancillary use to the high school and has been on the school site
since it was first approved by Alameda County in 1977. Subsequent
approvals/extensions were processed in 1980 and 1988. The
Applicant was required to submit a new application when
Conditional Use Permit PA 87-172 expired on December 1, 1991.
There are no use conflicts between the mobile home, the high
school, or the surrounding residences. The security personnel
residence location is fenced in and has its own parking space.
The single wide mobile home is located on the southeastern
portion of the high school site. It is not readily visible from
the street and generally not visible from adjacent residences
(the closest of which are located approximately 300 feet south of
the mobile home).
The security personnel occupying the mobile home (a family
of two adults and two children) provide 7 days a week security to
the school grounds and facilities, from 6:00 p.m. to 7:00 a.m. on
weekdays, 12:00 noon to 7:00 a.m. on weekend days, and 24 hours
during Winter Recess, Summer Recess, and Summer Vacation. The
deterrent posed by citizen presence is augmented by the making of
regular surveillance rounds. The Dublin Unified School District
requires that security personnel report all suspicious or illegal
activities to the Dublin Police Department and the School
District Offices.
The Police Department and Zoning Investigator have not
received any complaints pertaining to this use. The proposal has
been reviewed by the Building, Public Works, Police, and Fire
Departments. Police services has noted that vandalism does
continue to occur on the high school campus in spite of the added
surveillance but that the presence of extra eyes is probably
beneficial. School District officials believe that some vandalism
occurs during school operating hours and that this security
measure deters some vandalism occurring outside of regular school
operating hours.
The project is in compliance with the Zoning Ordinance and
the General Plan. Staff recommends approval of the Applicant's
request to allow the continued use of a mobile home for occupancy

by security personnel (as a part of the Community Facility High
School use) on the site of Dublin High School located at 8151
Village Parkway subject to the conditions specified in the Draft
Resolution (Exhibit B).
RECOMMENDATIONS:
FORMAT: 1) Open public hearing and hear Staff presentation.
2) Take testimony from Applicant and the public.
3) Question Staff, Applicant and the public.
4) Close public hearing and deliberate.
5) Adopt Draft Resolution approving PA 92-001 Dublin
High School Mobile Home Conditional Use Permit, or
give Staff and Applicant direction and continue
the matter.
ACTION: Staff recommends that the Planning Commission adopt the
Draft Resolution (Exhibit B) approving the Conditional
Use Permit for PA 92-001, Dublin High School Mobile
Home.

A RESOLUTION OF THE PLANNING COMMISSION
OF THE CITY OF DUBLIN
APPROVING PA 92-001 DUBLIN HIGH SCHOOL CONDITIONAL USE PERMIT REQUEST
TO ALLOW THE CONTINUED USE OF A MOBILE HOME FOR OCCUPANCY BY SECURITY
PERSONNEL (AS PART OF THE COMMUNITY FACILITY HIGH SCHOOL USE) ON THE
SITE OF DUBLIN HIGH SCHOOL LOCATED AT 8151 VILLAGE PARKWAY IN A
R-1-B-E SINGLE FAMILY RESIDENTIAL COMBINING DISTRICT
WHEREAS, Stanley Maleski on behalf of the Dublin Unified School
District submitted an application requesting approval of a Conditional
Use Permit to allow the continued use of a mobile home for occupancy
by security personnel (as part of the Community Facility High School
use) on the site of Dublin High School located at 8151 Village Parkway
in a R-1-B-E District; and
WHEREAS, the Planning Commission did hold a public hearing on
said application on February 18, 1992; and
WHEREAS, proper notice of said public hearing was given in all
respects as required by law; and
WHEREAS, the application has been reviewed in accordance with the
provisions of the California Environmental Quality Act (CEQA) and was
found to be Categorically Exempt under Section 15301, Class 1; and
WHEREAS, the Staff Report was submitted recommending that the
application be conditionally approved; and
WHEREAS, the Planning Commission did hear and consider all said
reports, recommendations and testimony hereinabove set forth.
NOW, THEREFORE, BE IT RESOLVED THAT THE Dublin Planning
Commission does hereby find that:
A. The proposed project will serve a public need by providing
off hours security surveillance for Dublin High School.
B. The use will be properly related to other land uses and
transportation and service facilities in the vicinity, as
the proposed use will be compatible to the type and nature
of operations typically found in the neighborhood.
C. The use, under all circumstances and conditions of this
particular case, will not materially adversely affect the
health or safety of persons residing or working in the
vicinity, or be materially detrimental to the public welfare
or injurious to property or improvements in the
neighborhood, as all applicable regulations will be met.
D. The use will not be contrary to the specific intent clauses
or performance standards established for the district in
which it is to be located.

BE IT FURTHER RESOLVED THAT THE Dublin Planning Commission does
hereby conditionally approve PA 92-001, Dublin High School Mobile Home
Conditional Use Permit Application, as generally depicted by materials
labeled Exhibit A, stamped approved, and on file with the Dublin
Planning Department, subject to the following conditions:
CONDITIONS OF APPROVAL:
Unless stated otherwise, all Conditions of Approval shall be complied
with prior to the issuance of building permits or establishment of
use, and shall be subject to Planning Department review and approval.
The following codes represent those departments/agencies responsible
for monitoring compliance of the conditions of approval. [PL]
Planning, [B] Building, [P0] Police, [PW] Public Works, [ADM]
Administration/City Attorney, [FIN] Finance, [F] Dougherty Regional
Fire Authority, [DSR] Dublin San Ramon Services District, [C01 Alameda
County Department of Environmental Health.
1. This Conditional Use Permit approval for PA 92-001 is to allow
the continued use of a mobile home for occupancy by security
personnel on the site of Dublin High School located at 8151
Village Parkway in a R-1-B-E District Zone. This approval shall
generally conform to the plans stamped approved, labeled Exhibit
A, consisting of a Site Plan dated received January 8, 1992. [PL]
2. This use shall comply with all applicable Planning, Building,
Dougherty Regional Fire Authority, and Police Department
regulations and ordinances. [PL, B, F, PO]
3. This approval shall become null and void in the event the
approved use ceases to operate for a continuous one year period.

4. This use shall be subject to zoning investigator review and
determination as to compliance with the conditions of approval.
[PL]
5. At any time during the effectiveness of this approval, the
approval shall be revocable for cause in accordance with Section
8-90.3 of the Dublin Zoning Ordinance. Any violation of the
terms or conditions of this permit shall be subject to citation.
