On June 18, 1975, the Alameda County Zoning Administrator approved a Conditional Use Permit request (Operating Engineers Local Union No. 3 Credit Union - 6300-6370 Village Parkway) to allow administrative offices in an M-1, Light Industrial District. On April 7, 1982, the Alameda County Zoning Administrator approved a Conditional Use Permit request (Operating Engineers Local Union No. 3 Credit Union - 6300-6370 Village Parkway) to allow the expansion of an existing conditional use (office use) by constructing a second floor addition to the Credit Union building located in an M-1, Light Industrial District. On April 7, 1982, the Alameda County Planning Director approved a Site Development Review request (Operating Engineers Local Union No. 3 Credit Union 6300-6370 Village Parkway) to construct a second addition to the Credit Union building. On March 14, 1988, the Dublin Planning Director approved a Site Development Review Sign request (6400 Village Parkway) to construct a freestanding office building master identification sign. On July 24, 1992, the Dublin Planning Director approved a Site Development Review Sign request (6300-6370 Village Parkway) for an existing alternate type freestanding office building master identification sign and one individual lettered wall sign on the east building elevation. APPLICABLE REGULATIONS: Section 8-95.0 Site Development Review of the Zoning Ordinance states that Site Development Review is a discretionary review process -2- PAGE or -1 intended to promote orderly, attractive and harmonious site and structural development compatible with individual site environmental constraints and compatible with surrounding properties and neighborhoods; to resolve major project related issues including, but not limited to, building location, architectural and landscape design and theme, vehicular and pedestrian access and on -site circulation, parking and traffic impacts; to ensure compliance with development standards and general requirements established for Zoning and Planned Development Districts, including, but not limited to, setbacks, heights, parking, fences, accessory structures and signage; to stabilize property values; and to promote the general welfare. ENVIRONMENTAL REVIEW: A Negative Declaration has been prepared pursuant to the California Environmental Quality Act (CEQA), State CEQA Guidelines and the City of Dublin Environmental Guidelines. The proposed project will not have a significant effect on the environment. NOTIFICATION: Public Notice of the October 19, 1992 hearing was published in the local newspaper, mailed to adjacent property owners, and posted in public buildings. ANALYSIS: The Applicant is requesting a Zone Change to rezone one of the parcels (6300-6370 Village Parkway) from the M-1, Light Industrial District to the C-O, Administrative Office District. The Applicant is also requesting Site Development Review approval to construct an approximate 1,500 square foot covered walkway/breezeway structure connecting two buildings located on two adjacent parcels. Zone Change In response to the Operating Engineers' Zone Change request, the Planning Department requested a Zone Change initiation to rezone eight contiguous parcels (including the Operating Engineers parcel, 6300-6370 Village Parkway) located on Clark Avenue and Village Parkway from the M- 1, Light Industrial District to the C-0, Administrative Office District, and for one parcel located at the southwest corner of Village Parkway and Dublin Boulevard from the M-1, Light Industrial District to the C-2, General Commercial District. On August 17, 1992, the Planning Commission adopted Resolution No. 92-046 approving this zone change initiation (see Attachments 2 and 3). The parcel being considered for the Zone Change is primarily an office use. The M-1 District does not allow office as a primary use. The County of Alameda approved the construction of this office building and establishment of the office use prior to the City of Dublin incorporating. Because the enclosed walkway will connect two buildings located on separate, yet adjacent parcels, approval of a lot merger application is required prior to issuance of building permits. However, the northern parcel (6400 Village Parkway) is zoned C-O, Administrative Office District. The application cannot be considered at this time because the resulting parcel would be split zoned. Zone Change approval would -3- PAGE provide a consistent zoning designation for the combined parcels and would allow the Planning Department to consider the lot merger application. Approval of the lot merger is contingent upon the City Council's effective zone change approval. The Applicant's Zone Change request is being considered as part of the City initiated Zone Change project (PA 92-067). The Applicant is being charged for processing only their Zone Change request, and not the entire City initiated Zone Change project. As concluded in the Staff Report for the City initiated Zone Change, Staff recommends Zone Change approval for the parcel located at 6300-6370 Village Parkway. The C-O District zoning designation would allow the continued operation of the existing primary office use and is more consistent with the adjacent downtown general commercial, retail, and office uses and zoning designations. The C-0 District is also consistent with the General Plan land use designation for the site, which is Business Park/Industrial. This land use classification includes non - retail businesses, such as research, limited manufacturing and distribution activities, and administrative offices. Site Development Review In order to expand operations, Operating Engineers recently purchased the property (6400 Village Parkway) immediately to the north of their existing building. An approximate 1,500 square foot, single story enclosed walkway/breezeway is proposed for construction between the two buildings to serve as a pedestrian walkway and to accommodate a common lunchroom area. The architectural design of the proposed walkway, including the scale, color, texture, height and architectural features of the structure are compatible with the existing two story office buildings and the other surrounding commercial buildings in the area. New rooftop mechanical equipment is proposed for the building located at 6400 Village Parkway. As shown on Exhibit A, this equipment will be appropriately screened. The existing parking lot configuration for the southern parcel (6300-6370 Village Parkway) will be revised to accommodate the new walkway and adequate on -site circulation. Some existing vegetation will be removed and 2 existing parking spaces will be relocated to establish adequate vehicular and pedestrian circulation. As a Public Works Department requirement, a minimum 10 foot turn around for vehicles is necessary at the southern driveway parking lot as shown on the Staff Study, Exhibit A. Three new parking spaces are proposed for the southern parcel. The number of parking spaces provided (114 parking spaces) is in compliance with the Zoning Ordinance. The required number of parking spaces for both buildings is 97. Because the project will generate some additional traffic on local roadways, the Applicant is voluntarily contributing traffic improvement funds in the amount of $1,715.00 (see Attachment 4). This payment will be made prior to issuance of building permits. -4- The project has been reviewed by other City departments, the City Attorney and other government agencies and their comments have been incorporated into the Draft Resolution Exhibit C as conditions of approval. A Negative Declaration has been prepared for the project pursuant to the California Environmental Quality Act (CEQA), State CEQA Guidelines and the City of Dublin Environmental Guidelines. The 21-day public review period began August 31, 1992. No comments on the Negative Declaration have been received to date. A Negative Declaration has been prepared because the project will not have a significant effect on the environment. Staff recommends Zone Change to rezone one parcel (6300-6370 Village Parkway) from the M-1, Light Industrial District to the C-O, Administrative Office District, and Site Development Review approval to construct an approximate 1,500 square foot enclosed walkway/ breezeway structure connecting two buildings located on two adjacent lots, subject to the conditions specified in the Draft Resolutions (Exhibits B and C). RECOMMENDATIONS: FORMAT: 1) Open public hearing and hear Staff presentation. 2) Take testimony from Applicant and the public. 3) Question Staff, Applicant and the public. 4) Close public hearing and deliberate. 5) Adopt Draft Resolutions approving PA 92-050 Operating Engineers Negative Declaration (Exhibit B) and Site Development Review (Exhibit C), or give Staff and Applicant direction and continue the matter.
