C-3262: On August 10, 1977, the Alameda County Zoning Administrator approved a Conditional Use Permit for the installation and operation of a drive-in photo kiosk within the C-N (Neighborhood Commercial) District. Ord# 80-44: On June 4, 1980, the Alameda County Board of Supervisors rezoned APN 941-175-21-6 and 21-8 from a C-N (Neighborhood Commercial) District to a PD (Planned Development) District allowing C-1 (Retail Business) District uses. C-4016: On May 13, 1981, the Alameda County Zoning Administrator approved a Conditional Use Permit to allow the operation of a tavern within the PD (Planned Development) District. PA 88-064: On July 13, 1988, the Dublin Planning Director approved Site Development Review for a 760± square foot addition of covered storage area attached to the east side of the building for Dublin Cyclery. PA 89-029: On March 17, 1989, the Dublin Planning Director approved an Administrative Conditional Use Permit for promotional advertising displays for Sandy's Flower Shop. PA 91-016: On March 18, 1991, the Dublin Planning Director approved Sign/Site Development Review for two (2) roof -mounted cabinet signs for Dublin Cyclery. APPLICABLE REGULATIONS: Section 8-31.18 of the Dublin Zoning Ordinance specifies in part that if in the opinion of the Planning Commission, the minor modification to a proposed structure, facility or land use not indicated on a land use and development plan (Planned Development) approved by the Alameda County Board of Supervisors does not materially change the provisions of the approved land use and development plan, the structure, facility or land use may be permitted subject to securing a Conditional Use Permit. Section 8-87.23 of the Dublin Sign Ordinance specifies in part the type, size, location and character of signs established in a PD (Planned Development) District shall be as stipulated by the Zoning Ordinance establishing the PD (Planned Development) District. Section 8-94.0 states that conditional uses must be analyzed to determine: 1) whether or not the use is required by the public need; 2) whether or not the use will be properly related to other land uses, transportation and service facilities in the vicinity; 3) whether or not the use will materially affect the health or safety of persons residing or working in the vicinity; and 4) whether or not the use will be contrary to the specific intent clauses or performance standards established for the district in which it is located. ENVIRONMENTAL REVIEW: The project has been found to be Categorically Exempt from CEQA under Section 15301, Class 1(g) and Section 15311, Class 11(a) of the California Environmental Quality Act guidelines. This use consists of the construction of a new on -premise sign and the maintenance of existing on -premise signs appurtenant to an existing retail/commercial center involving no expansion of use beyond that previously existing. NOTIFICATION: Public Notice of the November 16, 1992, hearing was published in the local newspaper, mailed to adjacent property owners, and posted in public buildings. ANALYSIS: The Applicant is requesting Conditional Use Permit approval for modification to the existing PD (Planned Development) District to establish a uniform sign program for the existing Valley Center shops. The Applicant's proposal is to maintain and modify the existing roof -mounted cabinet signs and to construct a new "low profile" freestanding sign to identify the name of the shopping center. This Conditional Use Permit request is to bring the existing roof -mounted cabinet signs into compliance with the Dublin Sign Ordinance. The cabinet signs were identified as nonconforming by Ordinance No. 7-86. -3- s'A;G:.. ._. OF Roof -Mounted Cabinet Signs Each of the existing roof -mounted cabinet signs are 2 feet 6 inches in height and vary in length from 9 feet to 23 feet 5 inches. The cabinet signs are internally illuminated and were designed to match the existing architecture of the shopping center. A neon cocktail glass is attached to the cabinet sign which identifies the business known as Evie's Place. This neon cocktail glass will be removed since its dimensions, including the dimensions of the cabinet sign, will exceed the height and sign area maximums allowed by the ordinance. Since the neon cocktail glass helps identify Evie's location and use, the business owner may utilize this sign by relocating it inside the front window of the tavern. The kiosk, which is currently occupied by a business known as "Mom's Flower Cart", does not have any signage identifying the use. The previous occupant, known as "The Photo Place", utilized the lexan faced panels on the east and west elevations of the kiosk for signage as shown on Exhibit A. A condition has been included in the draft resolution (Exhibit C) identifying signage for the kiosk structure. "Low Profile" Freestanding Sian The proposed low profile freestanding sign will be 4 feet in height, 6 feet 10 inches in length, with a total sign copy area of 21.6 square feet (10.8 square feet per sign face). This sign will be located within the existing parking spaces which face Amador Valley Boulevard as shown on the site plan, Exhibit A. The placement and location of the low profile freestanding sign will not obstruct or hinder access to the parking lot or block visibility to traffic or pedestrians along Amador Valley Boulevard. The proposed freestanding sign location will not remove any of the required parking spaces for the shopping center. The parking spaces on both sides of the low profile freestanding sign will be marked and designated as compact parking spaces. The Assistant City Engineer has indicated that the proposed location for the low profile freestanding sign will not cause any visibility problems to vehicles or pedestrians entering or exiting the shopping center, or to traffic along Amador Valley Boulevard, and will not be located within the public right-of- way. -4- Conclusion Conditions have been incorporated into the draft resolution to assure compliance with the provisions of the Sign Ordinance in all aspects (i.e., size, height, location, and sign content). This Conditional Use Permit application has been reviewed by the Public Works Department, Building Inspection, Dougherty Regional Fire Authority and Dublin Police Services, with no additional comments or concerns addressed. Staff recommends approval of the Applicant's Conditional Use Permit request subject to the conditions of approval specified in the Draft Resolution, Exhibit C. RECOMMENDATIONS: FORMAT: 1) Open public hearing and hear Staff presentation. 2) Take testimony from Applicant and the public. 3) Question Staff, Applicant and the public. 4) Close public hearing and deliberate. 5) Adopt the Draft Resolution approving PA 92-062 and PA 92-063, or give Staff and Applicant direction and continue the matter. ACTION: Staff recommends the Planning Commission adopt the Draft Resolution (Exhibit C) approving PA 92-062 and PA 92-063 Valley Center Sign Program Conditional Use Permit. Only signs that are specified in this document are permitted. Primary Entry Identification Sian: The intent of the center identification sign is to: 1. Clearly identify the center in a compatible design with the total project. 2. Adequately define the center's identity. 3. Direct traffic to the center's entrance. Tenant Sianaae: The design allows for individual trade style graphics within a uniform controlled and harmonious signage plan which benefits all tenants equally without visually dominating the architectural environment. The following pages describe the overall signage program as well as the specifications for individual signage and graphic elements to be used throughout the center. Temporary signs for grand openings or change of ownership will be allowed for 30 days only, with approval of landlord and the City of Dublin. GENERAL CRITERIA A. Electrical and Illumination 1. Signage illumination shall not include flashing, moving or audible effects. 2. Exposed conduit or tubing will not be permitted, except as may be approved by owner and the City of Dublin. 3. Electrical components shall bear the Underwriter's Laboratories (UL) label of approval, or equal, and shall also comply with all local building and electrical codes and industry standards and practices. 4. Neon illumination shall not be permitted. 5. All signs specified herewith will be internally illuminated unless otherwise specified. B. Construction 1 All manufacturers/installers are advised that prior to final acceptance, each unit may be inspected for conformance by an authorized representative of the landlord. Any signs found not to be in conformance will be rejected and removed immediately by the tenant or tenant's contractor. No substitutes will be accepted by the landlord whatsoever, unless so indicated in the specifications and approved by both landlord (owner) and the City of Dublin Planning Department. C. Installation 1. All signs or advertising devices advertising an individual use, building or business shall be attached to the building at a location described herein. 2. All penetrations of the building structure and raceway required for sign installation shall be neatly sealed and continuously maintained in watertight condition. 2 3. Attachments of signage to building shall be made per specifications contained herein. 4. Tenant's sign contractor shall repair any damage to the building caused by sign installation. Un repaired damage caused by tenant's sign and/or sign contractor, shall be tenant's responsibility to correct at tenant's expense. Tenant shall be fully responsible for the operations of tenant's contractor. 5. City of Dublin Planning and Building permits must be secured by tenant's sign contractor. Fabrication and installation must comply with all local planning, building and electrical codes. 6. All contractors must be fully licensed and must provide the landlord with a certification of liability insurance prior to commencing any work on the property. D. Tenant Con 1. All tenant signage shall be combined to consist solely of the tenant's trade name, logo and recognizable trademark insignia. 2. Signage copy shall not include products or services except as it may legally be part of the tenant's trade name, logo and recognizable trademark insignia. 3. All signage shall have the written approval of the owner in each case. E. Warranty The entire display shall be guaranteed by fabricator/installer for 5 years against defects in material and workmanship. Defective parts, displays or installation shall be replaced or repaired without charge to the landlord. All lamps, tubes, ballasts and transformers are excluded, but such parts will be unconditionally guaranteed and replaced without charge for a period of 90 days from date of installation. FT F. Maintenance All signs shall be maintained in a neat and orderly fashion. Periodic inspections shall be made by the landlord personnel and prompt correction of any deficiencies, sign outages or breakage shall be made by the tenant at the tenants expense. 4 SIGN SPECIFICATIONS Primary Entry Sign Provides formal identification to the center. Architectural in design, it compliments the theme of the project's building design. Location Perpendicular to Amador Valley Blvd, located in a planter of appropriate dimension. Size Double faced sign cabinet to measure 2'-2" x 5'-0". Height shall be 4'0". Sign to be mounted in 12" high x 6'-10" wide brick planter. Colors/Coov Final color specifications to be determined at a later date. Colors must be consistent with aesthetics and theme of Valley Center. Copy to read "VALLEY CENTER" as per attached specifications. Material and Fabrication Sheet metal cabinet and base. Sign faces to be white lexan faces and vinyl decoration. Illumination Internally concealed fluorescent tubing on all copy. 5 Tenant Signage Identifies individual tenants with internally illuminated, single -face sign cabinets. Locations To be installed along roof line as detailed on next page. Material Sheet metal (22 gauge) cabinet. Faces to be lexan. Finish Cabinets to be finished with satin finish Matthews polyurethane; paint color: brown. Copy Per tenant trade style and color. If tenant has no trade style established tenant should use of the three letter style shown on "Recommended Letter Styles". Size Each sign cabinet length may be up to a maximum 70% of primary store frontage area or 24'-0", whichever is less. Height to be a maximum of 2'-6". Secondary frontages shall not exceed 10' in length and 2'-6" in height. Illumination Internally concealed fluorescent tubing. 6 Window Signade Identifies miscellaneous secondary tenant window signage. 1. Tenant may display horned credit card decals on entrance door only. 2. Tenant addresses are to be installed on entrance door and standardized with respect to material, color, size and placement. 3. Credit card decals shall be those decals only which are provided by the credit card company. 4. Tenant shall not install any signs upon the Premises or the exterior of Tenant's store without Landlord's prior written consent. If landlord shall consent to any sign, upon termination of the Lease, tenant shall remove said sign and restore the Premises and/or the store in accordance with Lease provision or, at the Landlord's option, said sign shall become part of the realty and belong to Landlord without compensation to Tenant and title shall pass to Landlord under the Lease as by a bill of sale. 7 ADMINISTRATIVE PROCEDURES Conformation to the criteria and guidelines for Valley Center will be strictly enforced. Any non- conforming or unapproved signage installed by the tenant is strictly forbidden and shall be brought into conformance at the tenant's expense. Procedures for Signage Application Owner shall provide tenant the criteria for the Valley Center Signage Program. To obtain approval from the owner, each applicant shall submit or cause to submit to the landlord two (2) copies of scaled drawings, one of which will be colored, including all lettering and graphic diagrams and specifications for colors, construction, materials, illumination and installation. Cross section details shall also be shown in scale along with relevant site, plot and elevation plans. One set of approved plans will be returned by Landlord to Tenant. Citv of Dublin Permits All permits required for signage installation shall be obtained by the applicant, or his agent, at applicant's expense. The applicant shall be responsible for the fulfillment of all requirements and specifications contained in the signage program. Insurance Sign contractors shall carry WORKER'S COMPENSATION AND PUBLIC LIABILITY INSURANCE against all damage suffered or done to any and all persons and/or property while engaged in the construction or erection of signs in an appropriate amount as required by the landlord and the City of Dublin. A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF DUBLIN APPROVING PA 92-062/PA 92-063 CONDITIONAL USE PERMIT REQUEST TO MODIFY THE PD (PLANNED DEVELOPMENT) DISTRICT TO ESTABLISH A SIGN PROGRAM FOR THE VALLEY CENTER AT 7377-7459 AMADOR VALLEY BOULEVARD WHEREAS, Lori Gilliam, representing Arrow Sign Company and the property owner, Harold Zlot, filed an application for a Conditional Use Permit to establish a uniform sign program consisting of existing roof -mounted cabinet signs on the building and a new "low profile" freestanding sign identifying the Valley Center located at 7377-7459 Amador Valley Boulevard. WHEREAS, the Planning Commission did hold a public hearing on said application on November 16, 1992; and WHEREAS, proper notice of said public hearing was given in all respects as required by law; and WHEREAS, the application has been reviewed in accordance with the provisions of the California Environmental quality Act (CEQA) and was found to be categorically exempt under Section 15301, Class 1(g) and Section 15311, Class 11(a); and WHEREAS, the Staff Report was submitted recommending that the application be conditionally approved; and WHEREAS, the Planning Commission did hear and consider all said reports, recommendations and testimony hereinabove set forth. NOW, THEREFORE, BE IT RESOLVED THAT THE Dublin Planning Commission does hereby find that: A. The proposed project will serve a public need by providing business and shopping center identification to the general public for an existing retail/commercial complex within the City of Dublin. B. The use will be properly related to other land uses and transportation and service facilities in the vicinity, as the proposed sign program for the Valley Center will be compatible to the type and nature of operations typically found in the neighborhood. The use, under all circumstances and conditions of this particular case, will not materially adversely affect the health or safety or persons residing or working in the vicinity, or be materially detrimental to the public welfare or injurious to property or improvements in the neighborhood, as all applicable regulations will be met. All cabinet signs shall be well -maintained in an attractive manner and in accordance with the approved plans. [PL] 8. All support brackets for the roof -mounted cabinet signs shall not be visible and no signs shall extend above the roof ridgeline of the buildings. [PL, B] 9. Neon, bare florescent tubes, or incandescent bulbs attached or mounted to the cabinet signs, or to the exterior of the buildings shall not be permitted. If applicable, any indirect light fixtures are to be glare -shielded. [PL, B] 10. If the use or tenant space ceases to operate or is vacant for a period of ninety (90) days, the tenant sign lexan face shall be removed and replaced with an opaque plastic lexan face to cover all internal fluorescent tubing. [PL] 11. Building permits for any new cabinet signs or wall signs shall be obtained prior to installation of said signs. Submitted sign plans shall be signed by the property owner as approved. The low profile freestanding sign shall be painted to match the existing building color or another color subject to property owner and Planning Department review and approval. The low profile freestanding sign shall be located within the two (2) parking spaces as shown on Exhibit A. The Applicant and/or Property Owner shall restripe and mark these two parking spaces as "compact" spaces. [PL, B] 15. The existing pole which was used for a previous nonconforming freestanding sign shall be completely removed prior to the installation of the new "low profile" freestanding sign. [PL, B] 16. The base or planter of the approved low profile freestanding sign shall indicate the address range of the shopping center. [PL, PW, B] 17. A building permit for the low profile freestanding sign shall be secured and construction commenced within six (6) months after approval of this application or said approval shall be void. [PL, B] 18. The low profile freestanding sign shall be well -maintained in an attractive manner and in accordance with the approved plans. [PL] GENERAL SIGN REOUIREMENTS 19. All signage within the PD (Planned Development) District, shall comply with the regulations established in the sign ordinance except as specifically modified through these general provisions. The PD (Planned Development) District - 4 - general provisions related to signage may be modified subject to Site Development Review approval. [PL] 20. Any additional signage proposed to be utilized on this site shall conform to the Sign Ordinance and shall be subject to the review and written approval by the Planning Director prior to installation. [PL] 21. Signage painted directly on the buildings is not permitted. [PL] 22. The tenant's obligation to conform with the approved Sign Program criteria for the Valley Center shall be incorporated into the individual tenant lease agreements as a binding requirement. [PL] 23.
