No. 02-25, Item 5.6, Adopted 01/14/2025 Page 1 of 2 RESOLUTION NO. 02 – 25 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DUBLIN WAIVING SITE DEVELOPMENT REVIEW AND APPROVING AN AGREEMENT BETWEEN THE CITY OF DUBLIN AND COUNTY OF ALAMEDA REGARDING THE ENFORCEMENT OF CONDITIONS OF APPROVAL FOR THE ALAMEDA COUNTY FIRE TRAINING CENTER PLPA-2024-00040 (APN: 986-0005-038-16) WHEREAS, the Alameda County Fire Department, through the Alameda County General Services Agency, proposes to construct a new fire training center (“the Project”) on County-owned land; and WHEREAS, the Project would be constructed on a vacant 5.2-acre site located at 5053 Gleason Drive (APN: 986-0005-038-16), which is owned by the County. The property has a General Plan and Eastern Dublin Specific Plan land use designation of Public/Semi-Public and is subject to a Planned Development (PD) zoning district (Resolution No. 105-85); and WHEREAS, the Project would consist of a 7,791-square-foot classroom/administration building, 5,741-square-foot five story training towner, 915-square-foot Self-Contained Breathing Apparatus/restroom building, 42 parking spaces and related site improvements; and WHEREAS, the City of Dublin and County of Alameda are parties to a 1993 Annexation Agreement (Resolution No. 52-93) that governs development of the County-owned land. Specifically, Section 9 of the agreement governs land use approvals for County governmental property; and WHEREAS, in January 2024, the County of Alameda, through its General Services Agency, submitted an application to the City of Dublin for Site Development Review (SDR) of the proposed fire training center, and during the processing of the SDR there were differences expressed in interpreting the 1993 Annexation Agreement regarding enforcement of conditions of approval and obligations to pay the City’s development impact fees; and WHEREAS, in order to expedite the project and avoid further delays, the City and County desire to enter into an agreement, which would waive SDR and approve an agreement between the City and County regarding the enforcement of conditions of approval, including but not limited to providing payment of all applicable development impact fees; and WHEREAS, the California Environmental Quality Act (CEQA), together with State Guidelines and City of Dublin CEQA Guidelines and Procedures, require that certain projects be reviewed for environmental impacts and environmental documents be prepared; and WHEREAS, the County of Alameda, as the lead agency for CEQA, has prepared a Mitigated Negative Declaration (MND) for the project. The Alameda County Board of Supervisors has approved the MND and a Notice of Determination was filed with the County Clerk on March 16, 2023. Therefore, no further environmental review is required.
