HomeMy WebLinkAbout5.6 Revisions to the Classification Plan in Accordance with Senate Bill 1100r DUBLIN CALIFORNIA STAFF REPORT CITY COUNCIL Agenda Item 5.6 DATE: TO: FROM: SUBJECT: December 17, 2024 Honorable Mayor and City Councilmembers Colleen Tribby, City Manager Revisions to the Classification Plan in Accordance with Senate Bill 1100 Prepared by: Sarah Monnastes, Human Resources Director EXECUTIVE SUMMARY: The City Council will consider proposed changes to the City's current Personnel System. The proposed adjustments are based on the need to revise the job specifications in the City's Classification Plan in accordance with Senate Bill (SB) 1100. STAFF RECOMMENDATION: Adopt the Resolution Amending the Classification Plan. FINANCIAL IMPACT: None. DESCRIPTION: Pursuant to the City's Personnel System Rules, a job specification must be adopted for each classification in the organization. Currently, all City job specifications require a candidate to have a driver's license in order to meet the minimum qualifications of the job. On September 28, 2024, Governor Newsom signed SB 1100 into law making it an unlawful employment practice, under most circumstances, to include statements about the need for a driver's license in job advertisements, postings, applications, and similar employment material. Under this law, an employer may not include a statement that an applicant must have a driver's license unless the following two conditions are met: 1. The employer reasonably expects driving to be one of the job functions of the position; and 2. The employer reasonably believes that using an alternative form of transportation would not be comparable in travel time or cost to the employer. Page 1 of 3 1 SB 1100 defines "alternative form of transportation" as ride -hailing services, a taxi, carpooling, bicycling and walking. This law takes effect on January 1, 2025. A review of all City job specifications was conducted in preparation for the new law going into effect. Attachment 1 amends the following job specifications to remove the driver's license requirement for the following classifications, as driving is not an essential function of the job: Regular Job Specifications Accountant Administrative Aide Administrative Technician Assistant City Manager Assistant Finance Director Assistant Planner Associate Planner Budget Analyst City Clerk Deputy City Clerk Environmental & Sustainability Manager Environmental Coordinator Environmental Technician Executive Aide Finance Director Finance Technician I/II Financial Analyst GIS Coordinator Graphic Design & Communications Coordinator Housing Specialist Human Resources Director Human Resources Manager Management Analyst I Management Analyst II Management Fellow Network Systems Coordinator Office Assistant I/II Permit Technician Planning Manager Plans Examiner I Plans Examiner II Principal Planner Senior Accountant Senior Finance Technician Senior Management Analyst Senior Office Assistant Senior Planner Special Projects Manager Page 2 of 3 2 Temporary Job Specifications Administrative Intern Customer Service Assistant Food Service Worker Head Lifeguard Lifeguard/Swim Instructor Pool Manager Recreation Aide Slide Attendant Additionally, two classifications, Recreation Technician and Recreation Leader, have been identified as requiring the need for a driver's license, only when assigned to certain locations. To address this, Attachment 1 amends these two job specifications to read, "Possession of a valid California Class C Driver's License and certificate of automobile insurance for personal liability may be required, depending on assignment." STRATEGIC PLAN INITIATIVE: None. NOTICING REQUIREMENTS/PUBLIC OUTREACH: The City Council Agenda was posted. XX — 24 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DUBLIN AMENDING THE CLASSIFICATION PLAN WHEREAS, in accordance with the City's Personnel System Rules, the City Council adopted Resolution No. 30-84 and subsequent resolutions which comprise the Classification Plan; and WHEREAS, it is necessary to amend job specifications in order to be in compliance with Senate Bill (SB) 1100. NOW, THEREFORE, BE IT RESOLVED that Resolution No. 30-84 and subsequent Resolutions shall be further amended to delete the driver's license requirements from the following job specifications: Accountant Administrative Aide Administrative Intern Administrative Technician Assistant City Manager Assistant Finance Director Assistant Planner Associate Planner Budget Analyst City Clerk Customer Services Assistant Deputy City Clerk Environmental & Sustainability Manager Environmental Coordinator Environmental Technician Executive Aide Finance Director Finance Technician I/II Financial Analyst Food Service Worker GIS Coordinator Graphic Design & Communications Coordinator Head Lifeguard Housing Specialist Human Resources Director Human Resources Manager Lifeguard/Swim Instructor Management Analyst I Management Analyst II Management Fellow Network Systems Coordinator Office Assistant I/II Permit Technician Reso. No. XX-24, Item X.X, Adopted 12/17/24 Page 1 of 1 4 Planning Manager Plans Examiner I Plans Examiner II Pool Manager Principal Planner Recreation Aide Senior Accountant Senior Finance Technician Senior Management Analyst Senior Office Assistant Senior Planner Slide Attendant Special Projects Manager NOW, THEREFORE, BE IT RESOLVED that Resolution No. 01-99 and 10-20 shall be further amended to replace the existing reference to driver's license requirements in the Recreation Technician and Recreation Leader job specifications with the following language: "Possession of a valid California Class C Driver's License and certificate of automobile insurance for personal liability may be required, depending on assignment." BE IT FURTHER RESOLVED that this document shall become a part of the official Classification Plan for the City of Dublin; and that the changes contained herein shall be effective on January 1, 2025.
