CALL TO ORDER 2. PLEDGE OF ALLEGIANCE TO THE FLAG 3. ORAL COMMUNICATIONS At this time, members of the audience are permitted to address the City Council on any item which is NOT on the City Council Agenda. Comments should not exceed 5 minutes. If any person feels that this is not sufficient time to address their concern, that person should arrange with the City Clerk to have their particular concern placed on the agenda for a future meeting. The City Council CANNOT deliberate or take action on a non-agenda item UNLESS there is factual evidence presented to the Council indicating that the subject brought up falls into one of the exceptions under Government Code Section 54954.2. 4. CONSENT CALENDAR Consent Calendar items are typically of a non-controversial nature and are considered for approval by the City Council with one single action. Members of the audience who would like an item removed from the Consent Calendar for purpose of public input may request the City Council to remove the item. The request may be made at the time that the Mayor asks the audience members if there is anyone interested in removing an item from the Consent Calendar. 4.1 Minutes of Regular Meeting of February 26, 1990 STAFF RECOMMENDATION: Approve 4.2 City Treasurer's Investment Report for Period Ending February 28, 1990 STAFF RECOMMENDATION: Accept Report 4.3 Establishment of Position of City Clerk Since 1982, the responsibilities of City Clerk have been vested with the City Manager. In accordance with conceptual approval by the City Council, this position is now being set up as a separate management position. STAFF RECOMMENDATION: Adopt Resolution regarding Exempt Management Positions & Prescribing Leave Benefits; adopt revised 1989 position Allocation Plan; adopt Resolution amending the Classification Plan; adopt Resolution amending the Salary Plan; authorize a budget transfer from the City'S Contingent Reserve to the City Manager/City Clerk's budget. 4.4 Acceptance of Work - Contract 89-13 - Drainage Inlet Grate Replacement (Phase I) This project was completed within budget and was totally funded by Transportation Development Act monies. STAFF RECOMMENDATION: Accept improvements and authorize payment ($67,482) to P & F Construction. 4.5 Acceptance of Work - Contract 88-1A (Masonry Wall) and 88-8 (Wood Wall) Major Arterials Soundwalls Total project cost exceeded total funds budgeted by $643; however, money expended in FY89-90 exceeded the budget for that fiscal year by $28,218. STAFF RECOMMENDATION: 1) Accept improvements; 2) authorize budget transfer in the amount of $28,218 from unallocated reserves to the Major Arterial Soundwalls Capital Improvement Project; and 3) authorize final payment and retention ($16,638.16) to B & B Concrete. 4.6 Dublin High School Football Field Renovation - Contract 90-05 The City Council will review the final design and construction documents for the Dublin High School football field renovation. STAFF RECOMMENDATION: Authorize Staff to advertise for bids. 4.7 Financial Statements for Period Ending February 28, 1990 STAFF RECOMMENDATION: Receive Report 4.8 Dublin Police Services 1989 Calendar Year Report This Report documents the activities of the Dublin Police Services for calendar year 1989. The Report tabulates police matters and compares them to the previous year. STAFF RECOMMENDATION: Receive Report 4.9 Warrant Register Dated March 12, 1990 STAFF RECOMMENDATION: Approve 5. WRITTEN COMMUNICATION 5.1 Association of Bay Area Governments (ABAG) Proposed Dues Increase The City recently received ABAG's Budget Summary for Fiscal Year 1990-91, which includes an approximate 4% overall dues increase. Dublin's increase is approximately 9.9%, and is mainly attributable to Dublin's substantial population increase. STAFF RECOMMENDATION: Consider 6. PUBLIC HEARING 6.1 First Western Development Planned Development Rezoning, PA 89-050 First Western Development is requesting to rezone the circuit City site from C-1 Retail Business District to PD, Planned Development District. STAFF RECOMMENDATION: Conduct public hearing; deliberate; adopt Resolutions; introduce Ordinance; -OR- provide Staff and Applicant with direction and continue the item to March 26, 1990 Council meeting. 7. UNFINISHED BUSINESS 7.1 Agreement to Conduct Household Hazardous Waste Collection (HHW) Pursuant to City Council direction, Staff has worked with the cities of Livermore and Pleasanton to develop a HHW collection day. The cost of the program will be recovered through an adjustment to the garbage rate. The proposed date of the collection is May 5, 1990. STAFF RECOMMENDATION: 1) Approve the agreement and authorize the Mayor to execute; 2) establish Public Hearing for April 23, 1990, to consider a garbage rate adjustment which would become effective July 1, 1990. 8. NEW BUSINESS 8.1 Amendment to Waste Management Authority Joint Powers Agreement The enactment of AB 939 revises the responsibilities of the County Waste Management Authority. The Authority has requested that each of the Member Agencies adopt an amended agreement. Due to deadlines contained within the Law, it is important that an agreement be in place as soon as possible. However, there are still issues which will need to be reviewed by a Technical Advisory Committee consisting of Staff members. It is anticipated that these issues may be resolved through a future amendment to the JPA. STAFF RECOMMENDATION: Adopt Resolution approving amended JPA. 8.2 Report on February 28, 1990 Doolan Road/Croak Road Sphere of Influence Study and Environmental Impact Report The Alameda County Local Agency Formation Commission (LAFCO) has had the Doolan Road/Croak Road Sphere of Influence Study and EIR prepared. The Study recommends that LAFCO allocate the Study Area to the City of Dublin's Sphere of Influence. STAFF RECOMMENDATION: 1) Strongly support the findings and recommendations of the Study that: a) Dublin is the appropriate City to plan urban uses in the Doolan Road/Croak Road area; b) LAFCO should allocate the area to the City of Dublin's Sphere of Influence; 2) Direct Staff to submit written comments to LAFCO; and 3) Direct Staff and/or a City Council representative to attend the LAFCO hearing and present the City Council's position. 8.3 City Participation in Dublin Pride Week The Mayor has worked with a committee of community representatives to plan the 1990 Dublin Pride Week. In past years, the City has contributed towards this program. The committee has requested reimbursement for expenses not to exceed $2,775. It is hoped that some of the costs will be offset by contributions from service clubs. STAFF RECOMMENDATION: Approve participation. 9. OTHER BUSINESS 10.
