RECOMMENDATION: 1.72,AX Adopt Resolutions FINANCIAL STATEMENT: The estimated assessment per single-family lot for L990-91 landscaping and lighting maintenance costs is $120.00. Multi-family lots are being assessed at the rate of approximately $60.00 per dwelling unit. No cost to the City. DESCRIPTION: As part of the review and approval of the 145-unit single family development (Village VI) and the other, multi-family Villages, certain landscaping and open space maintenance was made a condition of approval. This maintenance assessment district provides funds for this work. The City Council approved formation of the District on November 10, 1986, with the initial assessment in the 1987-88 tax year. The County Assessor collects these monies for the City for the maintenance of landscaping and irrigation systems, right-of-way fencing, walls and entrance signs and trash removal. The open space parcel maintenance was charged to the District for three years only, with this last year (1989-90) being the final year, similar to the agreement made for Tract 4719. The District' s boundaries include all of Tract 5511. Staff plans to hold an informational meeting with interested property owners in order to explain the scope of work and answer any questions. Adoption of the resolutions approves the Preliminary Engineer's Report and sets June 25, 1990 as the date for a protest hearing for the Assessment. Staff recommends that the City Council adopt the resolutions. The assessment per single family lot last year was $120.00, with the multi- family lots being assessed on the basis of approximately $60.00 per dwelling unit. This year's assessment for each unit is proposed to be the same as the assessment for the previous Fiscal Year. ITEM NO. ,444 COPIES TO: Rafanelli & Nahas J. L. Assessment: Including Scope of Work, Estimate of Costs, Assessment Roll, and Method of Apportioning 2. Assessment Diagram -1- ASSESSMENT WHEREAS, on April 9, 1990, the City Council of the City of Dublin, California, pursuant to the provisions of the Landscaping and Lighting Act of 1972, adopted its Resolution Directing Preparation of Annual Report for Maintenance Assessment District for the maintenance of improvements more particularly therein described; and WHEREAS, said Resolution directed the undersigned to prepare and file a report pursuant to Section 22565, et. seq. of said Act; NOW, THEREFORE, the undersigned, by virtue of the power vested in me under said Act and the order of the Council of said City, hereby make the following assessment to cover the portion of the estimated cost of the maintenance of said improvements and the cost and expenses incidental thereto, to be paid by said District. Surplus from 1989-90 Fiscal Year $ 111,465 $ $ NET TO BE ASSESSED FOR FISCAL YEAR 1990-91 $ 78,180 $ $ As required by said Act, a diagram is hereto attached showing the exterior boundaries of said landscaping maintenance assessment district and also the lines and dimensions of each lot or parcel of land within said landscaping maintenance assessment district as the same existed at the time of the passage of said resolution, each of which lots or parcels having been given a separate number upon said diagram. I do hereby assess the net amount to be assessed upon all assessable lots or parcels of land within said landscaping maintenance assessment district by apportioning that amount among the several lots or parcels in proportion to -2- the estimated benefits to be received by each such lot or parcel from the maintenance of said improvements, and more particularly set forth in the list hereto attached and by reference made a part hereof. Said assessment is made upon the several lots or parcels of land within said landscaping maintenance assessment district in proportion to the estimated benefits to be received by said lots or parcels respectively from the maintenance of said improvements. The diagram and assessment numbers appearing herein are the diagram numbers appearing on said diagram, to which reference is hereby made for a more particular description of said property. Each lot or parcel of land assessed is described in the assessment list by reference to its parcel number as shown on the Assessor' s Maps of the County of Alameda for the fiscal year 1990-1991 and includes all of such parcel excepting those portions thereof within existing public roads or right-of-way to be acquired in these proceedings for public road purposes. For a more particular description of said property, reference is hereby made to the deeds and maps on file and of record in the office of the County Recorder of said County. Because the names of the several owners are unknown to me, I hereby place the word "Unknown" opposite the number of each lot or parcel of land assessed, the amount assessed thereon, and the number of the assessment. Dated: June 7, 1990 City Engineer -3- SCOPE OF WORK The following areas are to be maintained by this Maintenance Assessment District: 1) The median and roadside landscaping along the north side of the street for the entire length of Willow Creek Drive. 2) Roadside landscaping along Shady Creek Drive within Lots 1, 2, 3, 4, 5, 6, 15, 16, 37, 38, and south of Lot 145, all within Tract 5511. 3) Roadside landscaping, wall,, fence, and pathway improvements along the west side of Dougherty Road between Amador Valley Boulevard and the northerly City Limit line, and along the north side of Amador Valley Boulevard between Dougherty Road and Wildwood Road. 4) Roadside_ landscaping, fence, and pathway improvements along the west side of Wildwood Road. 5) Roadside landscaping, fence, wall, and pathway improvements along the west side of Dougherty Road and the south side of Amador Valley Boulevard adjacent to Lot 150. 6) Roadside landscaping, fence, and pathway improvements along the west and north sides of Fall Creek Road. -4- ENGINEER' S COST ESTIMATE FISCAL YEAR 1990-91 The estimated cost for the maintenance of improvements described in this Report for the fiscal year 1990-91 is as follows: Maintenance 1. I, the City Clerk of the City of Dublin, California, hereby certify that a certified copy of the assessment and diagram was filed in the office of the County Auditor of the County of Alameda, California, on 1990. -8- RESOLUTION NO. -90 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DUBLIN A RESOLUTION APPROVING PRELIMINARY ENGINEER'S REPORT, CONFIRMING DIAGRAM AND ASSESSMENT CITY OF DUBLIN LANDSCAPING AND LIGHTING MAINTENANCE ASSESSMENT DISTRICT 86-1 WHEREAS, by its Resolution No. 37-90, a Resolution Directing Preparation of Annual Report for Maintenance Assessment District, City of Dublin Landscaping and Lighting Maintenance Assessment District, 86-1 (the "district") , this Council designated the City Engineer, as Engineer and ordered said engineer to make and file a report in writing in accordance with and pursuant to the Landscaping and Lighting Act of 1972; and WHEREAS, said Engineer of Work has made and filed with the City Clerk a preliminary report in writing as called for in said Resolution No. 37-90 and under and pursuant to said Act, which report has been presented to this Council for consideration; and WHEREAS, said Council has duly considered said report and each and every part thereof, and finds that each and every part of said report is sufficient; and that said report, nor any part thereof requires or should be modified in any respect; NOW, THEREFORE, BE IT RESOLVED a) that the Engineer's estimate of the itemized and total costs and expenses of maintaining said improvements and of the incidental expenses of maintaining said improvements and of the incidental expenses in connection therewith, as contained in said report be, and each of them are hereby preliminarily approved. b) that the diagram showing the assessment district, description of the improvements to be maintained, and the boundaries and dimensions of the respective lots and parcels of land within said district, as contained in said report be, and it is hereby preliminarily approved. c) the assessment of the total amount of the cost and expenses of the proposed maintenance of said improvements upon the several lots and parcels of land in said District in proportion to the estimated benefits to be received by such lots and parcels, respectively, from said maintenance, and of the expenses incidental thereto, as contained in said report be and they are hereby preliminarily approved. AYES: NOES: ABSENT: Mayor ATTEST: City Clerk RESOLUTION NO. -90 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DUBLIN A RESOLUTION APPOINTING TIME AND PLACE OF HEARING PROTESTS IN RELATION TO PROPOSED ASSESSMENTS CITY OF DUBLIN LANDSCAPING AND LIGHTING MAINTENANCE ASSESSMENT DISTRICT 86-1 WHEREAS, by its Resolution No. 37-90, a Resolution Directing Preparation of Annual Report for Maintenance Assessment District, City of Dublin Landscaping and Lighting Maintenance Assessment District 86-1 (the "District") this Council designated the City Engineer as Engineer and ordered that engineer to make and file a report in writing in accordance with and pursuant to the Landscaping and Lighting Act of 1972; and WHEREAS, said Engineer of Work has made and filed with the City Clerk a preliminary report in writing as called for in said Resolution No. 37-90, and under and pursuant to said Act, which report has been presented to this Council for consideration; and • WHEREAS, said Council has duly considered said report and each and every part thereof, and finds that each and every part of said report is sufficient; NOW, THEREFORE, BE IT RESOLVED that on June 25, 1990, at the hour of 7:30 p.m. in the regular meeting place of said Council, Dublin Civic Center, 100 Civic Plaza, Dublin, California, be, and the same are hereby appointed and fixed as the time and place when and where it will consider and finally act upon the Engineer's Report. BE IT FURTHER RESOLVED that the City Clerk is hereby directed to give notice of said hearing once a week for two weeks in the local newspaper published and circulated in said City, and by conspicuously posting a notice thereof at public locations, and not less than three in all; said posting and first publication to be had and completed at least ten (10) days before the date herein set for hearing of protests. BE IT FURTHER RESOLVED that said notices shall be headed "Notice of Assessment" and shall, in legible characters, state the fact and date of the passage of this Resolution and approving the preliminary Engineer's Report and of the date, hour, and place set for the hearing of said protests, and briefly describe the assessments proposed to be made, and refer to said Resolution and report for further particulars.
