RECOMMENDATION: Adopt Resolution to accept the work completed.

FINANCIAL STATEMENT: A maintenance bond in the amount of $167,825 to
guarantee against defects has been provided to the
City. The City will incur street maintenance and
sweeping costs. Landscape and soundwall maintenance
costs are paid by Landscape Maintenance Assessment
District 86-1.
DESCRIPTION:
On June 27, 1988, the City Council approved Parcel Map 5353, which is a two-
lot subdivision consisting of Village IV and V. The housing developments
themselves have since been resubdivided as Tracts 5872 and 6052. Improvements
constructed as part of Parcel Map 5353 include Fall Creek Road and its
associated utilities,.drainage, and landscaping, as well as the Dougherty Road
soundwall, pathway, and landscaping north of Willow Creek Drive. These
improvements have been completed to the satisfaction of the City Engineer and
according to approved plans and requirements.
At the time the City and Rafanelli and Nahas executed the contract for the
Tract improvements, the subdivider was required to provide a performance bond
in the amount of $671,300 to provide the necessary security for the
performance of work involved. As the work is now completed, the performance
security requirement can be reduced, in accordance with the authority
contained in Section 66499.7 of the Government Code, to an amount necessary to
guarantee maintenance of the work for a one-year period following acceptance
of the work. The sanitary sewer and domestic water services have been covered
by a separate maintenance bond issued to DSRSD.
Staff recommends that the City Council adopt the resolution accepting
improvements and authorize Staff to accept the maintenance bond.

A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF DUBLIN

FOR THE ACCEPTANCE OF IMPROVEMENTS, PARCEL MAP 5353
(FALL CREEK ROAD)
WHEREAS, the owner-subdivider of the aforesaid Parcel Map
previously entered into a contract with the City of Dublin to improve said
Parcel Map in accordance with plans and specifications on file with the City
Engineer, said Tract identified as follows:
a) Subdivider: Rafanelli and Nahas
b) Location: Northerly of the Willow Creek Drive; easterly of
Alamo Creek
c) Tract Size: 2 lots
d) Resolution Approving Final Map: 93-88
e) City Streets Affected: Fall Creek Road; Dougherty Road as to
soundwall and landscaping
WHEREAS, said improvements have been completed in accordance with
said plans and specifications, and any approved modifications thereof, to the
satisfaction of the City Engineer of the City of Dublin; and
WHEREAS, as a condition of said contract, the subdivider is
required to guarantee the improvements and to maintain the completed work for
a period of one year following acceptance of the work by the said City of
Dublin; and
WHEREAS, as the improvements are now completed, the original
performance bond security requirement can be reduced, in accordance with the
authority contained in Section 66499.7 of the Government Code of the State of
California, to an amount found necessary to guarantee maintenance of the
completed work for the aforesaid one-year period;
NOW, THEREFORE, BE IT RESOLVED that:
1. The improvements completed within said Parcel Map be, and they are
hereby approved and accepted subject to the aforesaid one-year guarantee; and
2. The aforesaid original performance bond security requirement be
reduced from the amount of $671,300 to a revised security requirement in the
amount of $167,825, upon acceptance by Staff of the replacement maintenance
bond in the said amount of $167,825 as security for the aforesaid one-year

guarantee period, and the Mayor of this City Council be, and he is hereby
authorized and directed to execute the said bond on behalf of the said City of
Dublin; and
3. The said original performance bond in the amount of $671,300 posted
in connection with the work involved in the construction of said Tract be
hereby released upon acceptance of said maintenance bond.
PASSED, APPROVED, AND ADOPTED this 11th day of June, 1990.
