HomeMy WebLinkAbout4.01 Approve 03-26 & 27-90 Minutes REGULAR MEETING - March 26, 1990 A regular meeting of the City Council of the City of Dublin was held on Monday, March 26, 1990, in the Council Chambers of the Dublin Civic Center. The meeting was called to order at 7: 34 p.m. , by Mayor Paul Moffatt. ROLL CALL PRESENT: Councilmembers Hegarty, Jeffery, Snyder, Vonheeder and Mayor Moffatt. PLEDGE OF ALLEGIANCE The Mayor led the Council, Staff and those present in the pledge of allegiance to the flag. PROCLAMATION HONORING ALICE PITCHFORD Mayor Moffatt read and presented a proclamation to Alice Pitchford for her many years of community service. Alice and her husband, Norm, are retiring and will be moving to Olympia, Washington. PRESENTATION OF ORGANIZATION OF THE YEAR AWARD TO SOROPTIMISTS Vice Mayor Vonheeder advised that Soroptimists International of Dublin has been selected as recipient of the Organization of the Year award for 1989 . An engraved placque was presented to Kim Woods. PRESENTATION OF CITIZEN OF THE YEAR AWARD TO KAREN SEALS Vice Mayor Vonheeder presented the Citizen of the Year award to Karen Seals, who has been very active on the Dublin Substance Abuse_ Council and almost single handedly organized past Dublin Red Ribbon Week activities. PROCLAMATION REGARDING EARTHQUAKE PREPAREDNESS MONTH Mayor Moffatt advised that April, 1990, has been declared as California Earthquake Preparedness Month and encouraged all citizens to enhance their knowledge and awareness of proper safety measures to follow before, during, and after an earthquake. CM - VOL 9 - 61 Regular Meeting March 26, 1990 ---------------------------------------------------------------------- COPIES TO: ITEM NO: CLOSED SESSION At 7 :47 p.m. , Mayor Moffatt announced that the Council would recess to a closed executive session in accordance with Government Code Section 54956.9 (a) . The title of the litigation was not stated because to do so would jeopardize the City's ability to conclude existing settlement negotiations to its advantage. PUBLIC MEETING RECONVENED At 9 : 10 p.m. , the public meeting was reconvened, with all Council- members present. CONSENT CALENDAR On motion of Cm. Jeffery, seconded by Cm. Vonheeder, and by unanimous vote, the Council took the following actions: Approved Minutes of Regular Meeting of March 12, 1990 Adopted RESOLUTION NO. 26 - 90 DECLARING MARCH 25-31, 1990 AS "CENSUS AWARENESS WEER" Granted a request to waive fees for use of the Dublin Sports Grounds fields for Challenger Division (handicapped youth) of Dublin Little League Adopted RESOLUTION NO. 27 - 90 APPROVING THE APPLICATION FOR GRANT FUNDS FOR THE LUCKY/A'S YOUTH BASEBALL FIELDS PROGRAM Authorized Staff to enter into a contract agreement with Singer & Hodges, Inc. , for Landscape Architectural Services for the Frederiksen School kindergarten tot lot at a cost not to exceed $5, 300; authorized an additional appropriation from the unallocated reserves in the amount of $4,400 to cover the cost of design and construction documents; and directed Staff to negotiate a development agreement with the Dublin Unified School District for the project Adopted RESOLUTION NO. 28 - 90 AWARDING CONTRACT 90-03 ANNUAL SIDEWALK REPAIR/HANDICAP RAMP CONSTRUCTION PROGRAM TO B & B CONCRETE CONSTRUCTION ($107,731.85) CM - VOL 9 62 Regular Meeting March 26, 1990 and authorized the Mayor to execute the agreement; authorized a budget transfer in the amount of $2 ,200 from the Sidewalk Repair Capital Improvement Project (CIP) to the Dublin Boulevard Sidewalk @ Clark Avenue CIP; and created a new CIP for the previously unbudgeted Civic Center Service Entrance and authorized a budget transfer in the amount of $18, 000 from the Annual Overlay Project Adopted RESOLUTION NO. 29 - 90 AWARDING CONTRACT 90-02 ALAMO CREEK PARR PHASE II TO R.M.T. LANDSCAPE ($271,356.91) and authorized the Mayor to execute the agreement; authorized budget transfers of a) $38, 000 from the Underground Utilities - Dougherty Road project; b) $10, 000 from the Traffic Signal Pre-Emption project; c) $10, 000 from the Traffic Signals - Village Parkway/Brighton Drive and Village Parkway/Tamarack Drive project; d) $17, 000 from the I-580/ I-680 Ramp Widening project; and e) an additional appropriation of $26, 285 from Unallocated Reserves Adopted RESOLUTION NO. 30 - 90 ACCEPTANCE OF FINAL MAP FOR TRACT 6258 (PARR WOOD CIRCLE VILLAGE III) RAFANELLI & NAHAS Denied a protest from Bay Cities Paving and rejected bid submitted by Bay Cities Paving and adopted RESOLUTION NO. 31 - 90 AWARDING CONTRACT 90-04 ANNUAL STREET OVERLAY/REPAIR PROGRAM TO GRANITE CONSTRUCTION, INC. ($419,674) and authorized the Mayor to execute the agreement Accepted improvements under Contract 88-7 (San Ramon Road Phase III Street Reconstruction, Widening, Traffic Signals, Bike Path, and Landscaping) ; authorized release of securities and retention payment to Gallagher and Burk ($48, 168 .22) ; and authorized a transfer of $94, 497 . 84 from Unallocated Reserves . Approved Warrant Register in the amount of $699, 332 . 11 Adopted RESOLUTION NO. 32 - 90 DECLARING INTENTION TO ISSUE BONDS FOR THE PURPOSE OF PROVIDING FINANCING FOR CERTAIN PUBLIC STREET IMPROVEMENTS CM - VOL 9 - 63 Regular Meeting March 26, 1990 FIRST WESTERN DEVELOPMENT PD, PLANNED DEVELOPMENT REZONING PA 89-050 Planning Director Tong advised that in accordance with City Council direction at the public hearing on March 12 , 1990, Staff revised the draft general provisions for the Planned Development Rezoning general provision 9-C-4, to allow wall signage on the east building elevation subject to a Conditional Use Permit. The revised provision would read: 114 . The east building elevation may be considered a Secondary Building Frontage for City Sign Ordinance purposes if a Conditional. Use Permit is granted. In order to grant a CUP for signage on the east building elevation, the decision making body must find, based upon facts in the record, that: a) The color, size, shape, lighting intensity, and other physical design character- istics of the signage will not have any adverse effect on traffic safety conditions and safe traffic operations on I-680; b) The signage will be proportionate with human scale as visible to traveler on I-680; and c) The signage meets all other applicable provisions of the City Sign Ordinance with the exception that the projection of the east building elevation need not be in a roadway or public open space area such as a private street, an open plaza or square, or an auto parking area, per Section 8-87 . 10 (s) . " Cm. Snyder asked Mr. Hess how many businesses they anticipate will wind up in this building. Mr. Hess responded that there will be Kuppenheimer's, plus the possibility of 2 or 3 other tenants. On motion of Cm. Jeffery, seconded by Cm. Vonheeder, and by unanimous vote, the Council adopted RESOLUTION NO. 33 - 90 ADOPTING A NEGATIVE DECLARATION OF ENVIRONMENTAL SIGNIFICANCE CONCERNING PA 89-050 FIRST WESTERN DEVELOPMENT REZONING APPLICATION and RESOLUTION NO. 34 - 90 ESTABLISHING FINDINGS AND GENERAL PROVISIONS FOR A PD, PLANNED DEVELOPMENT DISTRICT REZONING FOR PA 89-050 FIRST WESTERN DEVELOPMENT and RESOLUTION NO. 35 - 90 IMPOSING A TRAFFIC IMPACT FEE ON PA 89-050 FIRST WESTERN DEVELOPMENT CM - VOL 9 - 64 Regular Meeting March 26, 1990 and waived the reading and INTRODUCED an Ordinance amending the Zoning Ordinance to permit the rezoning of real property located at the southeast corner of Amador Valley Boulevard and Amador Plaza Road, 7450 Amador Valley Boulevard, and continued the item to the April 9, 1990 Council meeting for a second reading and adoption of the Ordinance. OTHER BUSINESS Goals & Obiectives Meeting, Location Chancre Mayor Moffatt announced that the City Council would hold its annual Goals & Objectives meeting the following night, March 27, 1990. The meeting location has been changed from the Civic Center to the West Room of Shannon Community Center, and will begin at 6: 30 p.m. West Dublin Study Area Meeting Cancelled Mayor Moffatt announced that the special joint City Council/Planning Commission meeting scheduled for Monday, April 2 , 1990 to discuss land use alternatives for the West Dublin Study Area has been cancelled. A new date will be scheduled. ADJOURNMENT There being no further business to come before the Council, the meeting was adjourned at 9: 17 p.m. Mayor ATTEST: City Clerk CM - VOL 9 - 65 Regular Meeting March 26, 1990 ADJOURNED REGULAR MEETING - March 27, 1990 An adjourned regular meeting of the City Council of the City of Dublin was held on Tuesday, March 27, 1990, in the West Room of the Shannon Community Center. The meeting was called to order at 6:45 p.m. , by Mayor Paul Moffatt. ROLL CALL PRESENT: Councilmembers Hegarty, Jeffery, Snyder, Vonheeder and Mayor Moffatt. CLOSED SESSION On motion of Cm. Jeffery, seconded by Cm. Vonheeder, and by unanimous vote, the Council identified the need to add a closed session in accordance with Government Code Section 54956.9 (a) . The title of the litigation was not stated, because to do so would jeopardize the City's ability to conclude existing settlement negotiations to its advantage. The Council then adjourned to a closed session. PUBLIC MEETING RECONVENED At 7 : 07 p.m. , the public meeting was reconvened with all Council- members present. City Manager Ambrose advised that the purpose of this special meeting was to review the status of the City's 1989 Goals & Objectives and to then establish, prioritize and adopt Goals & Objectives for 1990. 1989 GOALS & OBJECTIVES With regard to the 1989 adopted objectives, Mr. Ambrose explained that 56 (57%) are either complete or nearly complete. Of the 65 objectives which were designated high priority objectives, 42 (65%) are completed or nearly complete. There were only 4 high priority objectives in which no action was taken. Since February, 1989, Staff identified 19 major tasks or responsibilities which were added during the year. These tasks or responsibilities impacted Staff's ability to accomplish those objectives originally adopted by the City Council last year. Mr. Ambrose advised that with the adoption of the 1989-90 Capital Budget, the Council allocated funding for a total of 26 Capital Equipment items and/or Capital Projects. In addition to these projects, 2 Capital Projects were added to the Capital Budget during the first half of FY 89-90. Of these 26 projects, the City has completed or is on schedule with 19 projects at this time. On Page 2 of the 1989 Report, under Finance goals, Cm. Hegarty discussed item 3 .b. , implementation of the Police Computer Aided Dispatch Police Records System Software. He thought this should be a CM - VOL 9 - 66 Adjourned Regular Meeting March 27, 1990 high rather than medium priority for Staff. Mr. Ambrose explained that the County is not yet on line with the CAD system, but should be by June, 1990. On Page 3 , Intergovernmental Relations, 2 goals dealt with meeting and aggressively monitoring activities of other agencies. Cm. Hegarty questioned if Dublin was doing all it could in this regard. It often seems that we get our comments in late in the game. He felt Dublin should be more aggressive, particularly regarding issues which will have a significant impact on Dublin. Specific instances were discussed. Mr. Ambrose felt that the City could spend more time regarding sewer and water issues. The new General Manager of DSRSD is very receptive to this. Cm. Jeffery stated that many times. in the past, she would hesitate stating a position of the City Council when they may not have taken a position. Cm. Vonheeder felt that overall, Dublin does a pretty good job of staying ahead of the game. 1990 GOALS & OBJECTIVES Mr. Ambrose advised that the 1990 Preliminary Goals & Objectives include a total of 105 objectives. This includes 35 new objectives proposed for 1990. The remaining objectives have been carried over from the previous year and/or have been expanded in scope. Cm. Vonheeder stated that in some cases she had not ranked projects and explained that if Staff was already working on something, she did not feel a need to rank them, as they are already being done. Cm. Vonheeder felt that essentially, we are making great strides and with the last audit, may have the necessary information available to do this. Finance Director Molina stated he would like to see this raised from a low priority to a high priority. Mr. Ambrose explained the costs involved and felt that Dublin would benefit only if it were going into debt, and he did not anticipate that we will in the next year. Also, under the Finance goals, George Zika questioned how many other cities had done sales tax auditing programs, and how successful they were. Mr. Molina advised that Livermore had done this and discussed some of the information obtained. Snyder expressed concern in that there are a lot of businesses that should be involved that don't necessarily belong to the Chamber of Commerce. High (89) Develop Press Release Program Discussion was held regarding the goal of developing a Press Release Program. Cm. Jeffery felt that press releases should be structured in a manner that they not go through one person. We should make sure that we inundate the press with as much information as we get. Cm. Hegarty expressed concern that there are often misconceptions about what the City is doing. The development of a Press Release Program, when ranked by the Council, received a medium priority ranking, and Cm. Jeffery encouraged someone to raise their ranking. Mayor Moffatt agreed to change his ranking to a high priority, thus giving the combined ranking by the Council a high priority status. Snyder stated he hoped that Valley High and Valley Christian Schools were included. Cm. Hegarty stated his reasons for giving this a low priority, when the rest of the Council rated it high. The City held extensive public hearings on this project at both the Planning Commission and City Council levels. He felt that the request for 10 more lots is simply greed. He did not feel it was appropriate to have Staff put in a lot of time on this. Cm. Jeffery stated she gave it a high ranking just to get it over with. Mr. Ambrose and Mr. Tong advised that 60-70% of the Staff work on this is completed. Cm. Jeffery stated she felt it was important to involve kids in their local government, and this would be a nice chance to have someone on the Commission representing the youth. Cm. Hegarty agreed to change his rating to a high, thereby placing this in a high priority. Staff pointed out that this was listed as medium priority by error. It was actually already a high priority. Snyder advised that the School District is also required to have a disaster simulation exercise program and questioned if we could coordinate somehow. Mr. Rankin advised that the City has been doing this from the standpoint that the City's Recreation Director is the principal staff person for shelter locations and sharing information, plus some of their equipment might be used. Mr. Ambrose explained that Mr. Taugher is working on the development of an earthquake damage assessment program. Cm. Snyder felt it would be a good idea to have all the Valley cities work together on this. Cm. Jeffery indicated she attended a seminar in Hollister shortly after an earthquake and relayed some of the information. Quite often, governments unfortunately tend to become the enemy in disaster situations. Cm. Vonheeder felt that if we lose communication, we need to have some way to get information to the people. Mr. Rankin stated that all the preparedness information indicates that neighborhoods need to be prepared to fend for themselves for 3 days following a disaster. D. Vonheeder advised that all . the Valley Staffs feel pretty much the same about the recent MTC report. It is highly unlikely that much of the information in their report will be used to draft the RFP. All the cities have grave concerns related to the conclusions of the report. Medium (87) Work with other agencies to implement Measure B projects Medium (87) Report on County Transportation Plan Cm. Jeffery requested that a goal be added under Capital Improvements to move the "walk" signal buttons so they can be reached from a wheelchair. Mr. Thompson advised that the intern will inventory these. Mr. Rankin advised that the City is constantly being informed that the extended poles have been knocked down.
